Abstract: This report recommends that the Committee notes the applications detailed in Appendix 1 of the report granted by the Head of Planning and Transport in accordance with the Scheme of Delegation detailed in Standing Orders.

1 RECOMMENDATION

1.1 The Committee is asked to note the applications, detailed in the Appendix, granted approval under delegated powers.

2 INTRODUCTION

2.1 In terms of the Scheme of Delegation to officers, the Head of Planning and Transport is authorised to approve planning applications in accordance with the Development Plan, the Local Plans or established policies and where there are no objections, except those which raise a general issue affecting a large area, or are of major land or economic development significance.

3 APPROVALS

3.1 Attached as an Appendix is a list of 93 applications granted under delegated authority during the period 7 March 2007 to 11 April 2007.

4 FINANCIAL IMPLICATIONS

4.1 There are no financial implications.

5 HUMAN RIGHTS IMPLICATIONS

5.1 There are no Human Rights issues arising directly as a result of this report.

Conditions

3 Noise from the condensers shall not give rise to a noise level assessed with windows closed within any dwelling or noise sensitive building in excess of that equivalent to NR curve 35 between 0700 and 2200 and NR curve 25 at all other times.

4 The applicant shall submit a detailed written specification for the acoustic barrier for the approval of the Planning Authority. The said specification shall include the height and thickness of timber. Once approved the said barrier shall be constructed prior to any use of the new condensing units and thereafter maintained in good order to the satisfaction of the Planning Authority.

Conditions

1 That the approval of the details of the siting, size, height, design, drainage and external appearance of the building(s) and the means of access thereto, shall be obtained from the Planning Authority before any development is commenced.

2 That the application for approval of the reserved matters specified herewith shall be made to the Planning Authority before:-

(a) the expiration of three years from the date of the grant of outline planning permission; (b) the expiration of six months from the date on which an earlier application for reserved matters approval was refused; or (c) the expiration of six months from the date on which an appeal against such refusal was dismissed, whichever is the latest.

Only one application for approval of reserved matters (under (b) or (c) above) may be made after the expiration of a three year period mentioned in sub-section (a).

3 That the development hereby approved must be begun not later than:-

7 That the indicative details, including site layout, access, sections, site levels and detailed design of coastal protection works is not hereby not approved. The layout to be submitted as part of any reserved matters application shall reflect the indicative layout submitted as part of the outline application.

8 That any reserved matters application shall include full details of a coastal defence system which shall be fully constructed in accordance with approved details prior to commencement of construction of any houses and maintained in accordance with approved details thereafter.

9 That the building(s) be single storey in height.

10 That any reserved matters application shall include full details of the existing and proposed ground levels, including finished floor levels of houses, in relation to a fixed ordnance datum point.

11 That the roof(s) be finished in blue slates or an alternative material giving a similar appearance and agreed in consultation with the Planning Authority prior to commencement of construction.

12 That the detailed submission complies with the Council's criteria as contained in Advice Note No. 14, "Small Housing Sites."

13 That prior to the commencement of the development, details of the means of site enclosure proposed to be used, shall be submitted for the prior approval of the Planning Authority and be erected on or before completion of the development.

14 That provision be made within the site for the parking of two private cars per dwelling.

7 That the design of the flats reflect the indicative elevation details submitted as part of the outline application.

8 That plans showing the retention of the store which adjoins the rear boundary of the site for storage/garaging or other ancillary use shall be submitted for consideration as part of any application for reserved matters.

9 That the roofs shall be finished in natural slates.

10 That the windows shall be constructed in timber and be of sash and case style or appearance.

11 That the front doors shall be in vertically-lined timber and shall have a painted finish, unless otherwise first agreed in writing with the Director of Planning & Transport

12 That finishing materials for the access and parking areas shall be agreed in consultation with and be to the satisfaction of the Director of Planning & Transport prior to the commencement of works.

13 No development shall take place within the development site until the developer has secured the implementation of a programme of archaeological works in accordance with a written scheme of investigation which has been submitted by the applicant, agreed by the Aberdeenshire Council Archaeology Service, and approved by the Planning Authority. Thereafter the developer shall ensure that the programme of archaeological works is fully implemented and that all recording and recovery of archaeological resources within the development site is undertaken to the satisfaction of the Planning Authority in agreement with the Aberdeenshire Council Archaeology Service.

Conditions

1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission.

2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the Planning Authority.

3 That permission is only granted for the operation of a hand wash facility that does not include any automated washing or drying processes.

4 That operation of the hand car wash facility is limited to 08:30 - 17:00 Monday to Saturday and 10:00 - 16:00 on Sunday.

5 That prior to the commencement of development, full details of the colour of the store building and canvas to be used for each shelter are submitted for the written approval of the planning authority. The approved scheme shall be implemented.

6 That all water treatment systems as indicated in the approved plans are installed and are kept fully functioning throughout the life of the operation.

7 That all appropriate connections to the public sewer and public water supply are in place to the satisfaction of the planning authority prior to the commencement of development.
