All three cases ended in favor of the league and Goodell, setting strong precedent for the NFL, and to some extent other professional leagues, moving forward confirming the commissioner’s authority to discipline players under the collective bargaining agreement. “Taken together all three were pretty strong endorsements of the commissioner’s authority,” Akin Gump partner Daniel L. Nash told Law360. “The reason for that is a labor law principle that essentially, the parties to a collective bargaining agreement have a right to negotiate how things are handled. In each of the cases, both the courts and the arbitrator said this is what the parties bargained for and the labor laws require that the bargain be enforced.” While the Brady and Peterson cases grabbed a number of headlines, Akin Gump was integral in guiding the league to a win in a lesser-publicized dispute, in which the players union filed a grievance over a new player personal conduct policy issued in 2014.

INTRODUCTION The National Football League (the “NFL”) is the most popular and most valuable sports league in the United States.1 In 2018, the NFL accounted for 46 of the top 50 most- watched shows on television,2 including NBC’s “Sunday Night Football” which continued its streak as the number one primetime show for the eighth consecutive year.3 Additionally, the NFL generates the most revenue of any professional sports league, holds the most valuable franchises,4 and attracts the highest per game attendance numbers.5 As an employer, discipline is of paramount important to the NFL.6 Without an effective discipline policy in place, employers subject themselves to major risks.7 Every NFL team employs somewhere between 43 and 53 players throughout each season, which results in up to 1,696 players employed by the league in a given year.8 Accordingly, up to 1,696 NFL employees are subject to the NFL’s player discipline policy on a yearly basis.

Harker A Thesis Submitted in Partial Fulfillment of the Requirements for the Degree MASTER OF ARTS Major Subject: Communication West Texas A&M University Canyon, Texas May 2015 This research was funded in part by a generous Killgore Research Grant awarded by the West Texas A&M University Graduate School. ABSTRACT This thesis is a rhetorical analysis of current trends in image reparation strategies used by the National Football League (NFL) in an effort to restore goodwill with its stakeholders following perceived transgressions. The 2014/2015 NFL season is discussed and analyzed using the lens of Image Reparation Theory. This research also set out to discover whether or not the NFL’s image repair strategies were rhetorically successful. Findings include the application of three general strategies; corrective action, evasion of responsibility, and reduce offensiveness; and the five sub-strategies of defeasibility, minimization, differentiation, attack the accuser, and bolstering. The implications of this research concludes that in sports image repair, use of the contradictory strategies of corrective action with defeasibility, or corrective action used with differentiation or minimization, is not universally effective. OFFENSE: WR LARRY FITZGERALD, ARIZONA CARDINALS Fitzgerald had eight catches for 112 yards and three touchdowns in the Cardinals’ 48-23 win at Chicago. His three touchdowns matched his single-game high which he accomplished in the 2008 NFC Championship Game. Including the postseason, he now has 101 career touchdown receptions, the most among active players. Fitzgerald has 19 more touchdown catches than the next wide receiver on the list (STEVE SMITH SR., 82).
