North Pole’s anatomy 1

The legal status of the two poles (North Pole and South Pole) lying diametricallyoppositeonplanetEarth’saxisofrotation differs widely, duetodifferentgeographical,geologicalandpoliticalconditions. North and South Pole’s only common features seem to be their location 2,thecommonclimateconditions 3andthecommonunfavourable weatherconditions. Suchconditionsledtoanabsenceofsovereigntyclaimsattheseregions and to a very limited presence of mankind up and down there for centuries. The North Pole –or arctic zone is the northern most point on Earth defininglatitude90°North.Upthere,allmeridiansoflongitudeconverge andstart.Itiscoveredwithdriftingpackiceand“faces”sixmonthsof constantsunlightandsixoftotaldarkness. Winter(January)temperaturesattheNorthPolecanrangefromabout −43°C (−45°F) to −26°C (−15°F). Summer temperatures (from June untilAugust)averagearoundthefreezingpoint0°C(32°F). TheNorth Pole is significantly warmer than the South Pole because it lies at sea

2 levelinthemiddleofanocean(whichactsasareservoirofheat),rather thanataltitudeinacontinentallandmass. The sea depth has been measured at 4,261 meters (13,980 ft). The nearestlandissaidtobeKaffeklubbenIsland,offthenortherncoastof about440miles(c.700km)away. TheGeographicalNorthPoledoesnotcoincideneitherwiththeNorth MagneticPole(CanadianArchipelago)norwiththeNorthGeomagnetic Pole. Byextension,thearcticzone,insidethearcticcircle,isconsistedofsea (the Arctic Ocean), continents’ territories (America, Europe, Asia), islandsrelativelyclosetothecontinentsaswellaspermanentlycold,ice encrustedareasoftheArcticOceanthatbecomemorecondensewhenwe approachthecenteroftheNorthPole. As far as it concerns the continents’ territories, there are no controversial sovereignty claims. The USA (through ), Canada, Denmark (through Greenland), Norway, Sweden, Finland and the Russian Federation possess territories or near islands inside the Arctic Circle 4. On the other hand, there are basic uncertainties arising as far as it concerns the legal status of remote areas located far away from the circumpolar states’ territories and approaching the center of the GeographicalNorthPole. UndertheDomaintheory 5,allpartsofterritory(intheArcticOceanin this case) that consist a physical projection of the continental regions’ territories,belongtothestateslocatedinthecontinents closer to these partsofterritory. ThetheorywassupportedbytheSovietUnionforobviousreasons;the SovietUnionhadveryextendednortherncoastsinAsia. Thistheoryliesagainststatesthattrytogainsovereigntybyoccupation andagainststatesthateventhoughpossessterritoriesintheregion,have

3 limited coasts, fact that prevents an extensive projection 6. Finally, it is generallyacceptedthattheterritoriesinsidethedomainsbelongde facto tothecorrespondingstates. A piece of history

Upuntil160millionyearsago,,alongwithAustralia,Africa, SouthAmerica,MadagascarandIndia,formedpartofasinglecontinent a sort of supercontinent – called Gondwana. The final parameter providingtheproofthatAntarcticawasoncepartofGondwanahastodo withbathymetricreadings 7. Asearlyasthe16 th century,peoplehavebeenstrugglingtolearnmore aboutthe6 th continentandwhynottoreachconquerit.Sincethattime, many brave explorers and navigators have oriented to the north organizingseveralexpeditionstryingtofindapassagethroughicefloes at certainfavorable times of the year in the socalled Polynia or circumpolarsea.Fortheexpeditions,whalingships,acommonmeanin thenorthernlatitudes,weremostlyused 8. Manyexplorersandothersnowandthenclaimedtohavebeenthefirst toreachorcrossthepolesomehow.However,manyofthesedeclarations raisecontroversies.

TheAmericanexplorerFrederickAlbertCook 9wasthefirsttoclaimto have reached the North Pole on April 21, 1908 with two men 10 , AhwelahandEtukishook,buthewasunabletoproduceconvincingproof andhisclaimisnotwidelyaccepted. The conquest of the North Pole was for many years credited to American Navy engineer Robert Edwin Peary 11 , who claimed to have

4 reachedthePoleonApril6,1909,accompaniedbyAmericanMatthew Henson and four Inuit men named Ootah, Seeglo, Egigingwah, and Ooqueah.However,Peary'sclaimalsoremainscontroversial. TheBritishexplorerSirWallyHerbert 12 ,initiallyasupporterofPeary, researched Peary's records in 1989 and concluded that they must have beenfalsifiedandthatPearyhadnotreachedthePole.Hethenorganized a four man dogsled expedition from Alaska across the Arctic sea to Norway 13 . ThefirstclaimedflightoverthePolewasmadeonMay9,1926byUS naval officer Richard E. Byrd 14 and copilot Floyd Bennett. Although verifiedatthe time by the US Navy and a committee of the National GeographicSociety,thisclaimhassincebeendisputed 15 . The first undisputed sighting of the Pole was on May 12, 1926 by Norwegian explorer Roald Amundsen 16 and his American sponsor LincolnEllsworthfromtheairship. According to sources and apart from Peary's disputed claim, the first mentoapproachtheNorthPolewerea Soviet Union party . These are variouslydescribedasincludingPavelGeordiyenkoand 17 someothers,or AleksandrKuznetsovandothers, wholandedaplane(s)thereonApril23, 1948. Manysourcesconfessthatthefirstconfirmedsurfaceconquestofthe NorthPolewasthatofRalphPlaisted 18 ,WaltPederson,GerryPitzland Jean Luc Bombardier, who traveled over the ice by snowmobile and arrivedonApril19,1968.

5 OnApril6,1969,SirWallyHerbert 19 andcompanionsAllanGill,Roy Koerner and Kenneth Hedges of the British TransArctic Expedition becamethefirstmentoreachtheNorthPoleonfoot 20 . OnAugust17,1977,the Soviet nuclear powered Arktika 21 completedthefirstsurfacevesseljourneytotheNorthPole. Inrecentyears,journeystotheNorthPolebyairlandingatarunway preparedontheiceorbyicebreakerhavebecomerelativelyroutine,and areevenavailabletosmallgroupsoftouriststhroughadventureholiday companies. OnAugust2,2007,aRussianexpeditionmadethefirstevermanned descenttotheoceanbottomattheNorthPole,toadepthof4.3km,as partofaresearchprograminsupportofRussia's2001territorialclaimto alargeswatheoftheArcticOcean.Thedescenttookplaceintwo submersibles and was led by Soviet and Russian polar explorer Arthur Chilingarov.Inasymbolicact,theRussianflagwasplacedontheseabed attheexactpositionofthePole 22 . Since 1728 and Czar Peter the Great, the Russians had a close relationship with the Arctic and wanted to show that they have a dominantinfluenceintheregion.Expeditionsandinvestigationshadbeen organized with the purpose to find passages to America and Japan, to explore, to ameliorate methods of navigation, to collect geographical material,tomapunknownbays,gulfs,capesandislandsofRussia’sfar northernterritoriesandoftheNorthPole. 6 ManybraveRussianexplorerstookthechancetonavigateacrossthe Arctic Ocean to find passages to the Pacific Ocean and the Atlantic Oceanandtodiscoverthetruthbehindthemythsthathadbeencovering asthickiceatthattimetheArctic. ThelargenumberofexpeditionsgavetheRussianstheopportunityto collect experience, in order to elaborate methods of navigation and mapping 25 andtoleadbettergeologicalandoceanicanalysis. Even settlements were established during the socalled Northern Expeditions(18 th 19 th centuries).Bythefirstquarterof19 th century,there were 12 large russian settlements in different corners of Alaska, which wereadministeredbytheRussianAmericanCompanyuntilAlaskawas soldtotheUSAin1867. Theadvancesinshipbuildingresultedtothecreationoftheicebreaker. Thisfactleadedtonewexpeditionsandstudiesandsewedmilitaryand commercial interests in the second half of the 19 th and during the 20 th century. TheArcticOceanwasmoreopenthaneverandthecloserelationship thathadbeencreatedforcenturieswithRussiagaveitstrongreasonsto claimsovereigntyoverthecoldregion. Russia and the North Pole

i.RussiaisthebiggestcountryonEarthstretchingfromEasternEurope totheFarEast. It is already wellknown that consists the first gas exporter and the secondoilexporteroftheglobe. 24 Ibid,M.Lomonosof,whosenamewasgiventotheLomonosofRidge(infact,itwasverycommonat thattimetogiveatthegeographicalfeaturesthenamesoftheNavalOfficersthathadledthe explorations),participatedintheGreatNorthernexpeditionsfor20years.Heteachednavigatorsto makephysicalmeasurementsandhedevelopedspecializedshiplogsandmeteorologicallogbooks.He alsowroteadescriptionofexplorationsinthenorthernseasandincludedadiscussionofActic oceanography.Apartfromalltheabove,hewasthefirsttogiveascientificallybasedtheoryofthe aurora(northernlights)andtoportrayoceanaroundtheNorthPole,contrarytogenerallyaccepted opinion. 25 EspeciallyaftertheNapoleonicWars,whentherewasrenewedinterestformappingandhundredsof milesofcoastshadbeenmappedthen(SiberianCoast,NovayaZemlyaetc.).

7 We therefore have no reason to wonder why Russia is on a rush to legitimizeasortofcontrolovertheiceencrustedArctic.Themainreason whyseemstobeRussia’sobsessionwithitsenergypolicy.Sinceastrong energypolicyisbelievedtobeanindispensablepolitical(thatistosay diplomatic)cardandsincetheNorthPoleseemstomeananotherword forsayingaquarterpercentoftheworld’soilandgassupplies 26 ,there arenodoubtsleft. Accordingtointernationallawand,morespecifically,underthecurrent UN Conventionon thelaw of thesea (1982) 27 , the North Pole andthe areaarounditbelongstonobody.Thatistosaythatnocountryhasthe right to claim sovereignty over this region. It is considered to be an international area. As a result, it is administered by the International SeabedAuthority 28 . RussiajustliketheotherfourcountriessurroundingtheArcticCircle (whicharecalledcircumpolartheUSA,Canada,NorwayandDenmark) has to accept the limited 200 nautical mile (370km) economic zone arounditscoastsforexploitation.Theareabeyondtheeconomiczoneis administeredbytheInternationalSeabedAuthority. Ontheotherhand,acountryhastheright,foratenyearperiodupon havingratifiedtheUNConvention,tomakeclaimswiththepurposeto extenditseconomiczone. Withtheaboveclarification,itseemsthatnowthingsaregettingless complicated. For a long time, scientists and international law experts have been scratchingtheirheadstobaseviageologicalandlegalfactstherussian territorial claims in the Arctic. And this should happen before the “deadline” was set to expire (while Russia had ratified the UN Conventionin1997,thelastchancetoraiseclaimsfortheextensionofits economic zone was before the end of 2007the ten year period as mentionedabove).

8 Again, under the UN Convention, a country has the right to claim sovereigntyovertheNorthPoleonlyifprovesthatitscontinentalshelfis directlylinkedwiththePole’scontinentalshelf.Toputitdifferently,a stateneedstoprovethatthestructureofthecontinentalshelfissimilarto thegeologicalstructurewithinitsterritory 29 .Untilrecentlyandunderthe UNConvention,nocountryhassuchaprerequisite. Allofasudden,lastyearduringsummer(well,tobehonest,thelast worddoesnotmakeanydifferenceto…theNorthPole),therewasaso calledandamassivescientificachievement/RCP.Agroupof RussiangeologiststraveledtotheLomonosovRidge,anunderwatershelf in Russia’s eastern Arctic Ocean. Equipped with nuclear powered icebreakersandsubmarinesabletosubduetohighpressureofthepole’s seabed, the scientists came to a conclusion of great importance: the LomonosovRidgewaslinkedtoRussianFederation’sterritory 30 . ii.NotonlyistheArcticbelievedto“bethehome”forabout25%ofthe world’soilandgassupplies,butalsothefactthatthepoleshelfis200 meters deep facilitates exploitation 31 . What makes oil drilling and gas extraction even more feasible is the climatic change due to global warming. Icemeltingiscertainlyanightmareformanycountries,manyspecies, manyNGOs,butnotinthecaseofRussia.Russiawouldhavenoreason nottobesatisfiedwiththefactthatSiberia,forexample,maygetalittle morehospitable,warmer.But,apartfromtheabovereason,icemelting mayfacilitatemorethenaturalresources’exploitationatthepole 32 . 9 Asaresult,theRussianFederationbyclaimingasectoroftheNorth PolecontinentalshelfthesizeofFrance,GermanyandItalytogether(a vast460.000milechunk 34 )willhavetheopportunitytosecureitslong termeurasianenergypoweredforeignpolicyandwhynotitshegemony overtheglobalmarkets. Russia needed desperately to expand the Federation’s maritime borders 35 beyond the agreed 200 mile economic zone. So, in 2001, it decidedtomakeasubmissiontotheUNcommissiononthelimitsofthe continental shelf (under the Law Of the Sea Treaty to which is a member 36 ),withtheabovepurpose.Thesubmissionwasneitherrejected nor accepted. Why? It is easy to guess. If the submission had been definitely accepted, the expansion of the maritime zone would have meantacceptanceofrussiansovereigntyrightsoverthepole.Afterthis legal move, Russia is planning to resubmit the claim 37 (2007), while urgestohavefound(moreandstable)scientificproofs,suchascontrol overtheLomonosovRidgeandtheMendeleevRidge. Nevertheless, these two Ridges, whichare twounderwatergeological structuresthatjutintotheoceanfromtheRussiancontinentalshelf,do notextendenoughtolegitimizeMoscow’sclaims.Apartfromthat,the sameclaimscouldbeplacedbyothersurroundingthe Arctic countries (Canadaforexample) 38 dependingonthesameRidges. Let’s return to August 2007 exploration. The Russian scientists explorers after having traveled by icebreakers and submersibles and havingreachedthepole’sseabedplacedarussianflag under the north pole 39 . This move has definitely no legal effect, but the way it was introduced–asanormalanddefinitelyjustsignofconquestandtherefore possession has raised fears for a de facto russian control over the disputedarea.

There remain though some basic problems for the North Pole’s exploitation by Russia (if we finally consider that Russia gains sovereigntyovertheregion),suchasthelackoftechnologicalknowhow andthelackofgeologicaldata.Theseproblemsarerelatedtotheendof explorationexpeditionssincethecollapseoftheSovietUnion.So,either Russiawillcarrytheentireburdenonitsshoulders (which will not be wiseineconomicterms)orwillseekcooperation. Ifweacceptthelastsolution,Norwayhasmanypossibilitiestobecome acloserstrategicpartner.TheNorwegianfirmsStatoilandNorskHydro possess important technological knowhow drilling wells in severe climates and Norway is already a strategic russian partner in Arctic hydrocarbon development(more attractive than the american firms, that face accusations for pollution and more importantly are not widely acceptedbytherussianpublicopinion) 40 .

The others

The russian expedition provoked a chain reaction of expeditions for scientificreasonsandmilitarymaneuversfromtheother“opponents”in this“race”.Allcircumpolarstatesstartedrerealizetheimportanceofthe region. ItisconsideredtobetheperfectmomentfortheUSAtoratifytheLaw of the Sea Treaty 41 ,inordernottogounchallengedtherussianviews. Apartfromthat,itwouldbetheperfectopportunityviatheTreatymeans tosettleanydisputesdisagreementswithRussia. Itisalsoagoodtimeforclosercooperationtobecreatedamongstthe “western” countries on the issue, in order to derail the fervent for dominanceoftherussianpolarbear.

11 AsaresponsetotheRussianbehavior(claimsandtheflag),Denmark andNorway 42 filedtheirownclaims,inoppositiontotheRussianones,to theUNCommissiononthelimitsofthecontinentalshelf. DenmarkwantedtoscientificallyprovethattheLomonosovRidgeisan underwaterextensionofGreenlandandnotofRussia.Inordertodoso, launcheditsownexpedition 43 . CanadaandtheUSAexpressedtheirskepticismonthesamematterand confirmedthatthisact(theflag)isofnolegaleffect. TheUSAdismisseditsownexpeditionon6August,inordertostudy globalwarming(andshowRussiathatitisnotaloneintheregion)andits countereffects. To their disappointment, the US Coast Guard realized thattherewasonlyoneicebreakercapableofcompletingthemission,the icebreakerHealy.Well,thisexpeditioninsteadofshowingtheUSpower, showeditsweakness,thecriticalconditionoftheUSicebreakingfleet 44 . The government, right after the russian expedition, launched its own expedition called “operationNanook”inthecanadianArcticon7August 45 .Canadaneeds tohurryup,inordertosubmittotheUNcommissionscientificallybased proofforsovereigntyclaims.Theperiodafterratificationexpiresin2012. Thecriticalconditionsofitsicebreakersmayleadittocooperationwith other countries, in order to gain exploitation rights in the icy northern waters. ThebestdealwouldbeacommonexploitationprojectoftheArctic’s wealthbyallfivecountries. The USA, Canada and the Nordic countries called for closer cooperation, in order to build a stable NorthWestern presence and

The future

TheRussianFederationthatistosaytheRussianpoliticiansistotally unpredictable.Thelackofmeansofsurveillanceovertheapplicationof theLawoftheSeaTreatymakestheTreatyvulnerabletoinfringements. The above statements mixed up may lead us divine that Moscow has preparedaprojectfora de facto controlovertheNorthPole,inorderto exploit the rich natural resources of the disputed, but however international, area. At the same time, diplomatic games with little significance,vialegalterms,willbeplayed.Moscowwilltrytoshowto theinternationalcommunitythatstillintendstoplaybythe(international) rulesbyprovidingproofsthatcanjustifyitsclaimsofsovereigntyover the region. Apart from that, it will try to create an international custom/rule of presence in the region using the same proofs. But no international custom can be accepted if based on illegal facts or internationallawinfringements.But,ifpushedtoomuchbya“western” internationallaw,willnothesitatetodisobey. As far as it concerns the other countries involved in the North Pole dispute,theyhaveshownthattheyfollowRussia’ssteps.They(Norway andDenmark)havefiledclaimsnotforthesakeoftheNorthPoleandthe preservationofitsinternationality,butforthesakeoftheirinterests.And I think that when Russia starts to exploit the North Pole, they will unfortunatelydothesame.Asajustificationfortheiract,theywillstate thattheydothisinresponsetoRussia’sbehavior(wedoit,becausethey dothesame).
