happens when people discover a new way to interact with each other, with organizations, and even with machines? What does it mean to have a new space through which to interact? These basic questions and their permutations drive digital culture observatories, which exist in the public, private, and nonprofit sector. Broadly speaking, digital culture examines the intersection of technology and society. For example, it considers how people’s ability to connect and share information affects empowerment and impacts democracy. It explores the role of technology in people’s lives, in their relationships, and in their communities. It seeks to understand the implications of rapidly changing technology and equip institutions to manage these changes. The adoption of information technology in recent years has revolutionized the way social and economic exchanges shape societies all over the world. Traditional scholarly disciplines have studied these changes, but governments and scholarship alike are approaching dynamic new ways of understanding and appropriating them into the evolving digital economy. Studying digital culture has often necessitated the creation of new institutions in various parts of the world. These include state-funded departments that survey and analyze information use among citizens, information schools – which are a worldwide movement of academic institutions that study information use and design, and research collectives that study information-related policies and trends throughout society. This range of institutions, which we refer to here as ‘digital observatories’ are at the forefront of examining various contemporary subject areas including human computer interaction, network economy, information policy, social media use, big data, digital archives, and e-governance, among others. Such digital observatories have emerged in various parts of the world and are organized around different areas of focus, funding models, and functioning structures. While a few operate broadly across many domains in the digital culture area, others focus particular areas of expertise. Some observatories primarily work under an academic model, providing training to scholars alongside their research activities. Others operate purely for research purposes, and still others provide consulting and commercial services to private-sector entities. Likewise, important distinctions emerge in the ways that such observatories and funded and structured – ranging from fully independent organizations that raise their own funding through grants and services to state-managed observatories that exist either as extensions of academic institutions or existing government departments. One important way in which many of these observatories are alike is that they are frequently highly collaborative organizations that partner extensively with other organizations either in their own domains or in related areas. Another feature we find is the prevalence of open approaches to data and research sharing in the digital observatories. We find in this research that several observatories use open models of research and dissemination even when they conduct research on technology innovation or sensitive topics such as privacy. Sharing this work in the public domain and encouraging citizen feedback and interaction with research frequently strengthens the work. Likewise, metrics for success in research evolve through various forms of outreach rather than through a traditional model of restrictive specialized publishing. 3 Fellowships, internships, and academic programs offer educational and mentorship opportunities to train a future generation of digital culture scholars and practitioners.     2 Internet Filtering: The Politics and Mechanisms of Control Jonathan Zittrain and John Palfrey It seems hard to believe that a free, online encyclopedia that anyone can edit at any time could matter much to anyone. But just as a bee can fly despite its awkward physiognomy, Wikipedia has become wildly popular and enormously influential despite its unusual format. The topics that Wikipedians write about range more broadly than any other encyclopedia known to humankind. It has more than 4.6 million articles comprising more than a billion words in two hundred languages.1 Many Google search queries will lead to a Wikipedia page among the top search results. Articles in Wikipedia cover the Tiananmen Square pro- tests of 1989, the Dalai Lama, the International Tibet Independence Movement, and the Tai- wan independence movement. Appearing both in the English and the Chinese language versions of Wikipedia—each independently written—these articles have been written to speak from what Wikipedia calls a ‘‘neutral point of view.’’2 The Wikipedians’ point of view on some topics probably does not seem so neutral to the Chinese authorities. Wikipedia has grown so influential, in fact, that it has attracted the attention of China’s cen- sors at least three times between 2004 and 2006.3 The blocking and unblocking of Wikipedia in China—as with all other filtering in China, with- out announcement or acknowledgment—might also be grounded in a fear of the communal, critical process that Wikipedia represents. The purpose of Wikipedia is ‘‘to create and distrib- ute a multilingual free encyclopedia of the highest quality to every single person on the planet in their own language,’’4 and the means of creating it is through engagement of the public at large to contribute what it knows and to debate in earnest where beliefs differ, offering sources and arguments in quasiacademic style.

But this year’s Cambridge Analytica scandal, following on the heels of many others, was the last straw. Corporations are willfully failing to respect the privacy of technology users, and we need new approaches to give them real incentives to do better—and that includes updating our privacy laws. EFF welcomes the opportunity to work with the Department of Commerce in crafting the federal government’s position on consumer privacy. The Request for Comment published in the Federal Register identifies seven main areas of discussion: Transparency, Control, Reasonable Minimization, Security, Access and Correction, Risk Management, and Accountability. When famed technology titan and philanthropist Mitch Kapor looks at Oakland, he remembers South of Market in San Francisco the way it was in the late 1990s. Former industrial properties were being transformed into inexpensive spaces for both startup tech companies and residents. There was a buzz of innovation in the air. SoMa today is not the same place Kapor remembers, but Oakland could be. “Oakland in particular is the next great South of Market,” Kapor said. “It will be to this decade what South of Market was to the previous one. There’s lots of space, both to work and to live, lots of energy and lots of opportunity. People just sense potential.” With that belief in mind, Kapor and his wife, Freada Kapor Klein, moved the operations of Kapor Capital, Kapor Enterprises Inc., the Kapor Foundation and Level Playing Field Institute, a nonprofit, to Oakland’s Uptown neighborhood from a previous location in SoMa. Kapor made his name and fortune from Lotus Development Corp., maker of the Lotus 1-2-3 spreadsheet and Lotus Notes software applications. The Kapors, along with Oakland business and community leaders, see the move as much more than just physical. It could serve as a major endorsement for Oakland’s technology sector, which so far features a handful of big names — Pandora Media, Ask.com and Sungevity — but has yet to detonate. “Oakland is a welcoming environment for innovators and for people who cross boundaries because we’re not just doing tech, we’re doing tech with social impact,” Kapor said.

Davies' comment gives us a convenient point of departure to explore the relationship between law and cyberspace. Anyone who spends a significant amount of time on the Internet knows that the Net has at least two, if not twenty-two, sides to it. Auction sites, chat rooms, instant messaging, knowledge networks, and Net radio are but a few of the Internet's constantly expanding capabilities for communication, commerce, and social interaction. It seems remarkable, then, that at a time when we are seeking to understand and enhance a medium of such Protean charac- ter, so much of our thinking about the Internet has remained bound to-and bounded by-the same few metaphors that have dominated Internet culture over the past decade. No metaphor has been more pervasive in this regard than the concept of cyberspace as the "Wild West."
