Lopez, U.S. Environmental Protection Agency Region 2, Regional Administrator Before the U.S. House of Representatives Transportation and Infrastructure Committee November 2, 2017 Good morning Mr. Chairman and fellow Transportation and Infrastructure Committee members, I am Pete Lopez, Regional Administrator for EPA’s Region 2, which covers New Jersey, New York, Puerto Rico and the U.S. Virgin Islands. Thank you for the privilege of joining you today for this important conversation. While I can only speak directly about EPA’s response to the devastating impacts of Irma and Maria in Region 2, I will first briefly highlight EPA’s overall efforts in response to Harvey, Irma and Maria. HIGHLIGHTS: In response to Hurricanes Harvey, Irma and Maria, EPA has assessed more than 5,000 drinking water systems and nearly 1,200 wastewater systems, including 100% of Texas and Florida systems. We have assessed nearly 250 National Priorities List, EPA removal and oil sites. We have assessed more than 1,400 regulated facilities, recovered more than 1,500 containers, drums and tanks, and Page 1 of 8 worked with the U.S. Coast Guard to address oil and hazardous materials released from more than 1,800 sunken vessels. We were able to pre-deploy our emergency response special teams and mobile assets to quickly conduct real-time analysis to assist with determining sources of threats to human health. To minimize or prevent disruptions with the supply of diesel fuel for mobile non-road generators and pumps used for emergency purposes, the EPA also waived the diesel requirements in the hurricane affected areas.

Since 2005, community­based projects completed through the Futures Fund have resulted in opening 157 river miles for fish passage, restoring 1,090 acres of critical fish and wildlife habitat and open space, and treating 202 million gallons of pollution. The latest awards, totaling 31, include funding for wastewater harvesting system for irrigation use in Huntington, Long Island; restoring 33 acres of coastal forest in Westport, CT; and enlisting Boy Scout troops in eastern Connecticut to install rain gardens to help control polluted runoff. Also, for the first time the Futures Fund is supporting projects in the "upper watershed" states of Long Island Sound, including a proposal by the town of Amherst, Massachusetts to install a monitoring device to help its Public Works Department reduce nitrogen discharges into the Connecticut River from its wastewater treatment plant.

Thank you for the opportunity to appear today to discuss EPA’s important role in helping Puerto Rico and the U.S. Virgin Islands following Hurricanes Irma and Maria. EXPERIENCE WITH IRENE AND LEE: In my years of experience as a New York State Legislator, I was intensely involved in a response to a devastating storm like Irma and Maria. In 2011, upstate New York was hit by Hurricane Irene and Tropical Storm Lee. Here, my parents and family members were left homeless and six out of seven counties in my district were placed in states of emergency. My region was devastated by these storms, which was particularly challenging given the geographically isolated areas and socioeconomic conditions. Throughout my experience with Irene and Lee, I developed an understanding of how complicated it can be for isolated areas to recover, and I learned that the more disadvantaged the community, the slower and more painful the recovery. 1 HURRICANES IRMA, MARIA AND THE CARIBBEAN: Let me turn to EPA’s response and the continued recovery efforts in Puerto Rico and the U.S. Virgin Islands.

In 2018, Senate Republicans lost their decades long hold on the Chamber in a number of stunning defeats across the State. Regardless of the funding being poured into campaigns, the work to regain ground is c onsidered to be uphill as nine Republican held seats have or will be vacated due to an unprecedented number of announced retirements and resignations over the last several months. Nonetheless, the battles are expected to be at full throttle until Election Day on November 3rd as Senate Democrats stand two seats away from having a veto proof majority and thereby controlling the once-in-a-decade redistricting process following the 2020 census with long-term implications for the balance of power in the upper house.

    NEW YORK / NEW JERSEY HARBOR & ESTUARY PROGRAM Lessons Learned for a Changing Future 2019 Restoration Conference Director’s Note Welcome! Thanks to the work of the people in this room, restoration of the New York – New Jersey Harbor Estuary continues to advance. The progress report released today summariz- es benefi ts from the more than 40 projects and $290 million of expenditures completed in the past three years. We have made signifi cant advancements, especially in restoring mari- time forests, conserving land, and improving aquatic connectivity for migratory fi sh. We celebrate these achievements knowing that climate change is posing critical questions about the future. Seven years after Hurricane Sandy came ashore, some innovative answers are emerging. Natural and nature-based solutions, like building living shorelines, enhanc- ing tidal wetlands, and conserving vulnerable fl oodplains, are becoming recognized by policy makers. The ability of our highly productive wetlands to sequester carbon and the importance of retaining that carbon in place, is discussed as a climate change mitigation strategy. But the policies and community of practice for implementing these techniques on the ground are still emerging. Climate change is also demanding that we reconsider traditional restoration and manage- ment practices. In a rapidly changing ecosystem, how do we manage an invasive species like Phragmites? Can we continue to make progress on restoring oysters and improving water quality? Do we need to consider new policy frameworks for wetlands and the coastal zone? Lessons Learned for a Changing Future seeks to improve our ability to deliver quality an- swers to those questions. To help us, we are fortunate to have the leaders of critical federal and state agencies with us today, to share how their agencies are tacking these issues.
