ગજુ રાત ખાનગી યવુ નિવસિટી અવધવનયમ, ૨૦૦૯ િધ ુ સધુ ારિા બાબત વિધેયક.

શ્રેયાર્થ ફાઉન્ડેશન, અમદાવાદ, ચારૂતર આરો廍ય મંડળ, કરમસદ, એશશયા (ASIA) ચેરરટેબલ ટ્રસ્ટ, અમદાવાદ, ભગવાન મહાવીર એ狍યકુ ેશન ફાઉન્ડેશન, સરુ ત, શસ쫍વર ઓક એ狍યકુ ેશન એન્ડ રરસચથ સોસાયટી, અમદાવાદ, લોક જાગશૃત કેન્ર ટ્રસ્ટ, અમદાવાદ-એ રા狍યમાં ખાનગી યશુ નવશસિટીઓ સ્ર્ાપવા માટે, ગજુ રાત ખાનગી યશુ નવશસિટી અશિશનયમ, ; સન ૨૦૦૯નો ૨૦૦૯ની જોગવાઇઓ હેઠળ રા狍ય સરકારને અરજી કરી છે ગજુ રાતનો ૮મો. , અને ચકાસણી સશમશતએ સદરહુ અરજીઓની ચકાસણી કરેલી છે અને ચકાસણી સશમશતના અહેવાલ પરર્ી, રા狍ય સરકારે, ખાનગી યશુ નવશસિટીની સ્ર્ાપના કરવા માટે, સબં શંિત પરુ સ્કતાથ મડળનેં ઇરાદાપત્ર કાઢી આપ્યો છે;

અને રા狍ય સરકારને ખાતરી ર્ઇ છે કે સદરહુ અશિશનયમની કલમ ૧૦માં જોગવાઇ છે અને ઇરાદાપત્ર ુڂ કયાથ પ્રમાણે, પરુ સ્કતાથ મડં ળ-એ ઇરાદાપત્રની શરતોન ું પાલન કય પ્રમાણેન ું દેણગી ફંડ પણ સ્ર્ાપ્ય ું છે;

મંડળના નામે અને સ્ર્ળે, અનસુ ચૂચના કોલમ ૨-માં શનરદિષ્ટ કરેલી સંસ્ર્ાઓનો ખાનગી યશુ નવશસિટી તરીકે સમાવેશ કરે છે.

રાજય સરકારે, ગણુ વત્તાસભર અને ઉદ્યોગલક્ષી ઉ櫍ચ શશક્ષણ પરૂ ંુ પાડવાના હતે ર્ુ ી, રાજયમાં ખાનગી યશુ નવશસિટીઓની સ્ર્ાપના કરવા માટેની જોગવાઈ કરવા માટે અને અશિશનયમની જોગવાઇઓ અનસુ ાર તેના કાયોન ું શનયમન કરવા માટે, ગજુ રાત ખાનગી યશુ નવશસિટી અશિશનયમ, ૨૦૦૯ (સન ૨૦૦૯નો ગજુ રાતનો ૮મો) અશિશનયશમત કયો છે. , સદરહુ અશિશનયમ હઠે ળ તે તરીકે જાહરે કરેલી ખાનગી યશુ નવશસિટીએ સદરહ ુ અશિશનયમની જોગવાઇઓ મજુ બ યશુ નવશસિટીની બાબતોનો વહીવટ કરવાનો હોય છે અને -ગ બોડી, બોડથ ઓફ મેનેજમેન્ટ, એકેડેશમક કાઉન્ન્સલ અને એવા બીજા અશિકારીમંડળોﺂગવશન , એ સદરહુ અશિશનયમમા ં જોગવાઇ કયાથ પ્રમાણેની તેમની ફરજો બજાવવાની હોય છે અને , તેમના કાયો કરવાના હોય છે તર્ા એવા મંડળોની રચના સદરહુ અશિશનયમમા ં જોગવાઇ કયાથ મજુ બની હોવી જોઇશે.

રા狍ય સરકારને, શ્રેયાર્થ ફાઉન્ડેશન, અમદાવાદ, ચારૂતર આરો廍ય મંડળ, કરમસદ, એશશયા (ASIA) ચેરરટેબલ ટ્રસ્ટ, અમદાવાદ, ભગવાન મહાવીર એ狍યકુ ેશન ફાઉન્ડેશન, સરુ ત, શસ쫍વર ઓક એ狍યકુ ેશન એન્ડ રરસચથ સોસાયટી, અમદાવાદ અને લોક જાગશૃત કેન્ર ટ્રસ્ટ, અમદાવાદ તરફર્ી અનક્રુ મે શ્રેયાર્થ યશુ નવશસિટી, ભાઇકાકા યશુ નવશસિટી, 狇.જી. યશુ નવશસિટી, ભગવાન મહાવીર યશુ નવશસિટી, શસ쫍વર ઓક યશુ નવશસિટી અને લોક જાગશૃત કેન્ર યશુ નવશસિટીની ખાનગી યશુ નવશસિટી તરીકે સ્ર્ાપના કરવા માટેની દરખાસ્તો મળી છે. સદરહુ અશિશનયમની કલમ ૧૦ર્ી એવી જોગવાઇ કરી છે કે રાજય સરકારને એવી ખાતરી ર્ાય કે , , , ુ છે તો પછી રાજય સરકારે સદરહ ુڂ પરુ સ્કતાથ મડં ળે ઇરાદાપત્રની શરતોન ું પાલન કય અશિશનયમની અનસુ ચૂચમા ં યશુ નવશસિટીના નામનો સમાવેશ કરવા માટે યો廍ય કાયદો , લાવવાનો હોય છે. સદરહુ દરખાસ્તોની સદરહુ અશિશનયમની કલમ ૮ હેઠળ શનમાયેલી ચકાસણી સશમશતએ શવચારણા કરી છે અને સશમશતએ તેનો રરપોટથ રાજય સરકારને રજૂ કયો છે અને એવા રરપોટથના આિારે, રાજય સરકારે, (પોતાને) ખાતરી ર્યા પછી, અશિશનયમની કલમ ૯ હેઠળ જોગવાઇ કયાથ પ્રમાણે ઇરાદાપત્ર કાઢી આપ્યો છે અને પરુ સ્કતાથ મડં ળોએ , હોવાર્ી સદરહુ અશિશનયમની કલમ ૧૦ હેઠળ જોગવાઇ ુڂ ઇરાદાપત્રની શરતોન ું પાલન કય કયાથ પ્રમાણે અશિશનયમની અનસુ ચૂચમા ં યશુ નવશસિટીઓના નામોનો સમાવેશ કરવાન ું જરૂરી જણાય ું છે.

AND WHEREAS the said applications have been scrutinised by the scrutiny committee and on report of the Scrutiny committee, the State Government has issued the Letter of Intent to the respective sponsoring body for establishment of the private Universitv:

AND WHEREAS the State Government is satisfied that the sponsoring bodies have complied with the conditions of Letter of Intent as provided in section 10 of the said Act and have also established the Endowment Fund as per the Letter of Intent:

Now, THEREFORE, the Govemment of Gujarat, in accordance with the provisions of section 10 of the said Act, includes the institutions specified in column 2 of the Schedule as the private University, by the name and location of the aforesaid sponsoring bodies as specified in column 4 of the said Schedule.

It is hereby enacted in the Seventieth Year of the Republic of India as follows:-

STATEMENT OF OBJECTS AND REASONS

The State Government has enacted the Gujarat private Universities Act, 2009 (Guj' 8 of 2009) to provide for establishment of private Universities in the state so as to provide for quaritative and industry related higher education and to regulate their functions in accordance with the provisions of the Act' A private University declared as such under the said Act is required to administer the affairs of the University as per the provisions of the said Act and the Goveming Body, the Board of Management, the Academic council and such other authorities are required to perform their duties and discharge their functions as provided in the said Act and the constitution of such bodies shall be as provided in the said Act.

The State Govemment has received the proposars from Shreyarth Foundation, Ahmedabad, charutar Arogya Mandal, Karamsad, ASIA charitable Trust, Ahmedabad, Bhagwan Mahavir Education Foundation, surat, Silver oak Education And Research Society, Ahmedabad and Lok Jagruti Kendra Trust, Ahmedabad for establishment of Shreyarth University, Bhaikaka University, JG university, Bhagawan Mahavir University, silver Oak University and Lok Jagruti Kendra University, respectively as the private Universities. Section l0 of the said Act provides that if the State Government is satisfied that the Sponsoring Body has complied with the conditions of Letter of Intent, then, the State Government is required to bring appropriate legislation for inclusion of the name of the University in the Schedule to the said Act. The said proposals have been considered by the Scrutiny Committee appointed under section 8 of the said Act and the Committee has submitted its report to the State Government and on the basis of such report, the State Govemment has, having been satisfied, issued a Letter of Intent as provided under section 9 of the Act and since the sponsoring bodies have complied with the conditions of the Letter of Intent, it is considered necessary to include the names of the universities in the schedule to the Act as envisaged under section 10 of the said Act.

This Bill seeks to amend the said Act to achieve the aforesaid obiect.

BHUPENDRASINH CHUDASAMA. MEMORANDUM REGARDING DELEGATED LEGISLATION

This Bill involves delegation of legislative power in following respect:-

clause I-- sub-crause (2) of this clause empowers the State Government to appoint, by notification in the official Gazette, the date on which the Act shall come into force.

The delegation . of legislative power as aforesaid is necessary and is of a normal character.
