From today’s vantage, this policy was tentative, partial, and under-enforced. Only by the passing of the Competition Act 1998 and the Enterprise Act 2002 did the United Kingdom achieve a regulatory scheme that evinces a coherent design and an orthodox underpinning rationale. The relative tardiness of this development is a perplexing fact. For decades, the UK had been a primary exponent of the neoliberal philosophy that places faith in markets as the most efficient means of allocating societal resources. Yet the introduction of the necessary corollary - an effective policy designed to police newly competitive markets - did not emerge until recent years.

    UK Regulation after Brexit 1 Foreword How has UK regulation changed since the transition period came to an end on 31 December 2020? Has the UK diverged from EU policy or does continuity prevail? What functions and responsibilities transferred from the EU to UK regulators after 1 January 2021, and are the UK authorities ready? What are the long term prospects for UK alignment or divergence? This report takes a first step to mapping the new regulatory settlement in the wake of the UK’s withdrawal from the EU. A joint initiative by ‘Negotiating the Future’ – a project undertaken as part of ESRC’s ‘UK in a Changing Europe’ programme – together with the Centre for Competition Policy, and Brexit & Environment, it brings together leading specialists in policy and regulation to examine the impact on UK regulation of decisions taken by the UK government and the Trade and Cooperation Agreement. The assessment is inevitably provisional. The creation of a single market is one of the main objectives of the European Union's competition policy. Whilst great progress has been made further efforts are still necessary if the full economic advantages of integration are to be realised. 2. The single market represents an opportunity for EU firms to enter new markets that may have been previously closed to them because of government barriers. This penetration of new markets takes time and investment and is risky. The process is often facilitated by agreements between producers who want to break into a new market and local distributors. Efficient distribution with appropriate pre- and after-sales support is part of the competitive process that brings benefits to consumers. However, arrangements between producers and distributors can also be used to continue the partitioning of the market and exclude new entrants who would intensify competition and lead to downward pressure on prices.
