WNDZ(AM), Portage, Indiana Facility ID: 73316 File No. BMJP-20041230ACC Petition for Reconsideration Dear Mr. Gross: We have before us a Petition for Reconsideration (“Petition”) filed jointly by Chicago Newsweb Corporation (“CNC”) and WNDZ, Inc.,1 on December 5, 2005. CNC is the licensee of WCPT(AM), Crystal Lake, Illinois, and WNDZ, Inc., is the licensee of WNDZ(AM), Portage, Indiana. The Petition asks for reconsideration of a November 3, 2005, staff decision dismissing CNC’s and WNDZ’s applications to modify WCPT(AM) and WNDZ(AM), respectively.2 For the reasons discussed below, we deny the Petition. Background. CNC and WNDZ, Inc., timely filed their FCC Form 175 applications to change the communities of license for WCPT(AM) and WNDZ(AM) during the filing window for AM Auction No. 84.3 The applications were determined to be not mutually exclusive with any other proposal filed in the filing window, and the applicants were invited to file their complete FCC Form 301 applications by 1 CNC and WNDZ, Inc., are commonly owned. Markteintritte und der Wettbewerb der Fernseh- sender haben zu einer fortschreitenden Ausdifferenzierung und Verstärkung des Programmange- bots geführt, wodurch sich die Versorgung der Zuschauer verbessern und Auswahlkriterien und -möglichkeiten an den tatsächlichen, vielfältigen Wünschen der Zuschauer orientieren konnten.m Der kontinuierliche Anstieg der Zahl der Programmangebote dient zum Beispiel als Indikator für die positive Entwicklung und die hohe Wachstumsdynamik der Fernsehbranche sowie für die daraus folgende Verbesserung der Versorgung der Zuschauer mit Fernsehprogrammen. Das Anwachsen der Zahl der Fernsehprogramme erhob u. a. das Deutsche Institut für Wirtschafts- forschung (DIW). Es ermittelte für den Zeitraum von 1986 bis 1998 einen Anstieg von 22 auf 103 Programme. Unter den 103 Fernsehprogrammen befanden sich 16 öffentlich-rechtliche Angebote. Die Zahl der bundesweit ausgestrahlten privaten Fernsehangebote stieg zwischen 1986 und 1998 von 3 auf 23. Dabei zählte das DIW ein Pay-TV-Paket als nur ein Programm.108 Die restlichen 64 Programme sind ausschließlich private Angebote, unter denen sich 13 landesweite Fenster, 14 Regional- oder Ballungsraumprogramme und 37 weitere regionale oder lokale Angebote befanden. We have observed your commitment to a reform of the code with great respect and admiration. However, on behalf of our media and advertising businesses, we urge you to reject any proposal that would limit the section 162(a) treatment of the cost of advertising as an ordinary and necessary business expense. The ability of a business to deduct all of its advertising costs as an ordinary and necessary business expense has been part of the Tax Code and approved by the Internal Revenue Service as an accepted business practice for more than 100 years. Notwithstanding that history, the bill introduced as H.R. 1 in the 113th Congress by former Chairman Dave Camp would have required advertisers to amortize half of their advertising costs over a decade. The explanation of the advertising provision, prepared by the staffs of the Joint Committee on Taxation and the Committee on Ways and Means, provided no tax policy rationale for a change of this magnitude because the economic and tax policy arguments did not support this change. The cost of advertising is as essential to a business as the salaries paid to its employees, the rent for buildings and equipment, and all of the other regular costs of doing business – all of which are currently deductible as ordinary and necessary.
