Sec. 811 Fifth Avenue Corporation c/o Gumley Haft Management 415 Madison Avenue New York, NY 10017 Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of May 13, 2003, following the Public Hearings and Public Meeting of March 25, 2003, and May 13, 2003, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on February 27, 2003.

The proposal is to establish a Master Plan governing the future installation of windows on all of the facades, including the Fifth Avenue, East 62nd Street, and the secondary north and east facades, with modern tri-partite aluminum windows to be permitted on floors five through thirteen and the penthouse on the Fifth Avenue facade, and in the bay closest to Fifth Avenue on the East 62nd Street facade, multi-light double-hung aluminum windows in the remaining window openings on the Fifth Avenue and East 62nd Street facades, and multi-light and one-over-one double-hung windows in the openings on the secondary facades, with all of the double-hung windows to match the original window configurations, and with all windows to finished in black, U. C. 51046, as shown in existing elevation drawings Ex-1 through Ex-4, proposed elevation drawings, A-1 through A-4, all dated April 29, 2003, in detail drawing A-5 showing the proposed double-hung windows and brick mold, dated December 9, 2002, in a color chip, and in photographs of the existing conditions, all prepared and presented at the Public Hearings and Public Meetings by Elliott Glass, AIA.

In reviewing this proposal, the Commission noted that the designation report describes 810 Fifth Avenue as a neo-Italian Renaissance style apartment building designed by J. E. R. Carpenter and built in 1925-26; and that the style, scale, age, materials, and details of the building contribute to the special architectural and historic character of the Upper East Side Historic District. The Commission also noted that a number of tri-partite windows had been installed prior to designation.

With regard to this proposal, the Commission found that the use of double-hung windows replicating the historic window configuration on the majority of the windows on the East 62nd Street facade, and on the secondary east and north facing facades, will be a very significant step in returning this building to its original condition; that the use of multi-pane windows on the lower four floors of the Fifth Avenue facade will maintain the historic appearance of the building as it is perceived by pedestrians on the Avenue; that the tri-partite divisions of the windows proposed for the upper portion of the Fifth Avenue facade, and the first bay on the East 62nd Street facade, avoids the appearance of large voids on the facades, and help these windows relate to the divided windows; that reducing the number of window configurations to two types will help to simplify and unify these facades; that removing the many different modern windows on the East 62nd Street facade which were installed before designation will not destroy any significant historic material; and that for these reasons the changes proposed under the Master Plan in keeping with the building, the streetscape, and the Upper East Side Historic District.

However, the Commission made its determination subject to the stipulation that staff meet with the architect on site to inspect the historic brick mold and select modern brick mold to be installed under the Master Plan, and that two sets of drawings of the approved work, including the selected brick mold, be submitted for review and perforation.

Subsequently, on June 13, 2003, staff visited the site with the architect and selected matching brick mold. On June 29, 2003, the Commission received the requested drawings, Ex-1 through Ex-4, and A-1 through A-4, all dated April 29, 2003, and A-5 dated June 17, 2003, all prepared by Elliott Glass, AIA. Staff has reviewed these drawings and finds that the approved design has been maintained in the filing drawings. On this basis, Certificate of Appropriateness 04-1612 is being issued.

The master plan sets forth a standard for future installations of replacement windows at all facades, and specifically identifies drawings which describe the approved master plan in detail. If the owner wishes to move forward with a portion of the work covered by the master plan, a completed application form is filed with the Commission indicating the specific location of the new windows, and stating that the work will conform to the approved master plan drawings and other documents on file with the Landmarks Preservation Commission. The staff of the Commission will review the application to ascertain that all proposed work is covered by the master plan, and will then send the owner an "Authorization to Proceed" letter. The Authorization to Proceed is sent prior to the commencement of the work, and is contingent on adherence to the approved master plan.

This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently displayed at the site while work is in progress. Please direct inquiries to John Graham.
