JOINT REQUEST FOR WITHDRAWAL OF MUST CARRY COMPLAINT

On December 18, 2014, NRJ TV SF License Co, LLC (“NRJ”), licensee of full-power commercial KTNC-TV, Concord, California (Facility ID No. 21533) (“KTNC-

TV” or the “Station”), submitted a complaint against DIRECTV, LLC (DIRECTV) regarding

DIRECTV’s carriage of KTNC-TV. No further pleadings have been filed in this matter.

The parties have resolved the carriage dispute. DIRECTV will commence carriage of the

Station in accordance with Section 338 of the Communications Act of 1934 and the Federal

Communications Commission’s Rules upon the expiration of the existing retransmission consent agreement governing the carriage of KTNC-TV (the “Agreement”). Specifically, DIRECTV will commence adding a high definition feed of KTNC-TV upon the expiration of the

Agreement, and will begin providing the high definition feed of KTNC-TV to DIRECTV subscribers entitled to receive local stations in the San Francisco-Oakland-San Jose Designated Market Area no later than May 15, 2015. DIRECTV will continue to make KTNC-TV available in standard definition to DIRECTV subscribers entitled to receive local stations in the San

Francisco-Oakland-San Jose Designated Market Area for the duration of the 2015-2017 election cycle.

NRJ and DIRECTV therefore jointly request that the Media Bureau permit NRJ to withdraw its Complaint and that the Bureau terminate this proceeding.
