DECLARATIONS OF INTEREST What is a personal interest? You have a personal interest in a matter if that matter affects the well- being or financial position of you, your relatives or people with whom you have a close association more than it would affect the majority of other people in the Ward(s) to which the matter relates. A personal interest can affect you, your relatives or people with whom you have a close personal association positively or negatively. If you or they would stand to gain or lose by the decision, you should also declare it. You also have a personal interest in a matter if it relates to any interest, which you must register. What do I need to do if I have a personal interest? You must declare it when you get to this item on the agenda or as soon as it becomes apparent to you. You may still speak and vote unless it is a prejudicial interest. If a matter affects a body to which you have been appointed by the authority, or a body exercising functions of a public nature, you only need declare the interest if you are going to speak on the matter. What is a prejudicial interest? You have a prejudicial interest in a matter if:- (a) a member of the public, who knows the relevant facts, would reasonably think your personal interest is so significant that it is likely to prejudice your judgment of the public interest; and (b) the matter affects your financial interests or relates to a licensing or regulatory matter; and (c) the interest does not fall within one of the exempt categories at paragraph 10(2)(c) of the Code of Conduct. What do I need to do if I have a prejudicial interest? You must withdraw from the meeting. However, under paragraph 12(2) of the Code of Conduct, if members of the public are allowed to make representations, give evidence or answer questions about that matter, you may also make representations as if you were a member of the public. ADDRESSES BY THE PUBLIC To hear addresses from members of the public in accordance with Council Procedure Rule 11.8 for which the required notice (1.00 pm on Thursday 15th April 2010) has been given to the Head of Law and Governance. 10. QUESTIONS BY THE PUBLIC To hear questions from members of the public to the Leader, a member of the City Executive Board or the Chair of an Area Committee for which the required notice (1.00 pm on Thursday 15th April 2010) has been given to the Head of Law and Governance, and to hear responses from those members in accordance with Council Procedure Rule 11.9. Full details of any questions for which the required notice has been given will be circulated to members of Council before the meeting. 11. CITY EXECUTIVE BOARD RECOMMENDATIONS AND DECISIONS (a) Recommendations (1) 3rd March 2010 (a) Allocation of Homelessness Monies (minute extract and report) (2) 31st March 2010 (a) Annual Lettings Plan – Allocation Percentages 2010/11 (minute extract and report including report from the Value and Performance Scrutiny Committee) A confidential appendix is also submitted (b) Corporate Plan and Performance Targets 2010/11 (minute extract and refreshed report following the City Executive Board meeting) (b) Action Sheets – City Executive Board (1) 15th February 2010 (2) 3rd March 2010 (3) 31st March 2010 12. QUESTIONS ON NOTICE FROM MEMBERS OF COUNCIL Questions on notice under Council Procedure Rule 11.10(b) may be asked of the Lord Mayor, a member of the Executive Board or the Chair of a Committee. Questions on notice must, by the Constitution, be notified to the Head of Law and Governance by no later that 9.30am on Friday 16th April 2010. Full details of any questions for which the required notice has been given will be circulated to Members of Council before the meeting. 13. STATEMENTS ON NOTICE FROM MEMBERS OF COUNCIL Statements on Notice under Council Procedure Rule 11.10(b) may be asked. Statements do not need to be directed to a specific Councillor. Statements on notice must, by the Constitution, be notified to the Head of Law and Governance by no later than 9.30am on Friday 16th April 2010. Full details of any statements for which the required notice has been given will be circulated to Members of Council before the meeting. 14. MOTIONS ON NOTICE Council Procedure Rule 11.13(a) refers. The following Motions have been notified to the Proper Officer by 1.00pm on Wednesday 7th April 2010:- (a) Business Permit Scheme (Proposer – Councillor Craig Simmons) “Council notes that the discount Business Permit Scheme agreed as part of the current budget process will, if it is to generate the necessary revenue, have to attract more traffic into the city centre. Since this would lead to more congestion and pollution, discourage the use of the Park and Rides and existing public transport, as well as sending out the wrong message about the Council’s commitment to carbon reduction, the Council invites the Executive to ask the relevant Head of Service to find alternative savings.” (b) Closure of Little Scholars Nursery (Proposer – Councillor Elise Benjamin) “Council asks the Chief Executive to write to the Chief Executive of Oxford and Cherwell Valley College (OCVC) to express disappointment at the lack of consultation about the sudden closure of the Little Scholars nursery which has left many parents with significant child-care problems. Council asks that the letter includes a request for the decision to be immediately suspended and re-examined, with a view to keeping the nursery open at the college, through actively working with the parents and staff.” (c) Energy Saving Trust (EST) Audit (Proposer – Councillor Craig Simmons) “The Council notes the result of the February 2010 Energy Savings Trust Audit which rated the City Council between ‘good’ and ‘excellent’ on its approach to tackling climate change (below the top two categories of ‘excellent’ and ‘best practice’). This Council asks the Executive to set out a plan to achieve a target of an ‘excellent’ rating this calendar year and aim to deliver ‘best practice’ next year.” (d) Voting record of City’s MPs on climate change (Proposer – Councillor David Williams) “This Council notes that an independent assessment of Oxford East MP Andrew Smith’s voting record on climate change shows that he has voted in a way which would suggest that he is ‘moderately against laws to stop climate change’ (theyworkforyou.com). This compares with a rating for Oxford West and Abingdon MP Evan Harris as ‘strongly for’ policies to stop climate change. In keeping with this Council’s commitment to take a leadership role in tackling change, it asks the Leader of the Council to write to Andrew Smith MP expressing our strong views as a Council on the issue of climate change and asking him to consider these when casting future votes.” (e) Warneford Meadow (Proposer – Councillor Mary-Jane Sareva) “Council notes the decision of Justice Wakeman to uphold the decision to register Warneford Meadow as a Town Green. Council therefore invites the Executive to instruct Officers to remove Warneford Meadow as a development site from all current and future planning documents and frameworks.” (f) Temple Cowley Pools (Proposer – Councillor David Williams) “This Council believes that a family focused swimming pool to serve the needs of East Oxford is required and that the Executive should prepare plans that incorporate that vision. The plans may well involve the rebuilding of Blackbird Leys pool and could include a competition pool based there is this is more convenient for coach parking but the forward plan must include a family focused swimming provision housed in a modern eco friendly partial rebuild on the site of the present Temple Cowley Pools. Associated facilities such as the multi gym should also be incorporated into the Temple Cowley site.” (g) Poor Pollution Record (Proposer - Councillor David Williams) “Now that the city Council has had a recent report grading the City’s air pollution as poor especially in the City Centre, this Council believes given the health implications for Oxford People of such a report it is vital to focus on immediate actions to launch a range of policies to address this low standard. The council calls on the Executive to commission as a matter of urgency an action based report from relevant officers focused on resolving the air pollution problems that have been identified.” (h) HMOs (Proposer – Councillor David Williams) “Having taken note of the new rules on HMOs issues by the Minister for Housing on 28th March 2010, this Council although welcoming the reclassification of what constitutes an HMO from more that 5 unrelated persons to 3 is concerned that beyond identifying more HMOs in Oxford the new rules are still unclear as to the powers of local authorities to establish mandatory standards for tenants.
