Legal description of point of diversion: Decreed point of diversion as stated in the First General Adjudication: “The headgate of the Park Ditch is situated at a point whence the Corner of Sections 26-27- 34 and 35, in Township 45 North of Range 8 West, N.M.P.M. bears North 18º 8’ East 3035.7 feet distant.” F. Source: West Branch of the Uncompahgre River. G. Amount: 0.189 c.f.s. H. Appropriation: 1881 I. Decreed Use: Irrigation, stock water, piscatorial and recreational uses. 3. Historic use: The entire .189 c.f.s. has historically been used to irrigate approximately thirteen (13) acres. The legal description of the acreage that has been historically irrigated is: Lot 2 Scenic View Subdivision, Ouray County, Colorado, according to the recorded plat thereof, located in Section 34, Township 45 North, Range 8 West, N.M.P.M. The approximate historical location of the irrigation use of the water is identified on the attached map. See attached map, Exhibit 1. The Applicant has been using the water for the decreed purposes of irrigation, stock water, piscatorial and recreational uses. 4. Statement of plan for augmentation, covering all applicable matters under CRS 37-92-103(9), 302(1)(2) and 305(8). Augmentation of evaporative losses from the SJR Pond has already been achieved by the use of historic irrigation consumptive use credits (C.U.C.). The historic irrigation C.U.C. have already been obtained by removal of the necessary .231 acres, or 10,062.36 square feet, of historically irrigated land. This removal created C.U.C. which are used to off-set the evaporative loss depletions during the irrigation season. Historic consumptive use associated with evaporative loss from the SJR Pond is estimated at .816 AF/A per year. Derivation of this Data is shown on Table 1 attached hereto as Exhibit 2. The consumptive use credits available due to the removal of .231 acres of historically irrigated land totals approximately .816 Acre Feet. The monthly distributions of available consumptive use credits are shown on Table 1, row 6, 2 attached as Exhibit 2. The Applicant has removed .231 acres from historic irrigation under the Park Ditch through by construction of the SJR Pond in June of 1986. Construction of the pond removed approximately 22,500 square feet of historically irrigated property. According to the application in 98CW60, Water Div. 4, the surface area of the high water line of the pond is 22,500 square feet. The approximate location of the Pond on the property is identified on the map, attached as Exhibit 1. The removal of .231 acres from historic irrigation will result in a reduction of the Applicant’s direct flow right in the Park Ditch to .183 c.f.s. 5. 9) Case No. 04CW78, John P. Wilson c/o L. Richard Bratton at Bratton & McClow, LLC 232 W. Tomichi Ave., Suite 202, Gunnison, CO 81230. Name of structure: Bent Creek No. 1 Well. Describe conditional water rights: Date of Original Decree: June 23, 1989, Case No.: 88CW182, Court: District Court, Water Division 4. Location: A point in the NW¼NW¼, Section 13, Township 42 North, Range 5 West, N.M.P.M., Hinsdale County, Colorado, at a point which is approximately 870 feet south of the North section line and 235 feet east of the West section line Source: Lake Fork Gunnison River Alluvium. Appropriation Date: May 26, 1898. Use: Domestic use within a thirteen residence subdivision, including lawn and garden irrigation. Depth: 69 feet. Provide a detailed outline of what has been done toward completion of the appropriation and application of water to a beneficial use as conditionally decreed: The District Court, Water Division 4 continued the conditional water right of 50 g.p.m. decreed to the Bent Creek No. 1 Well, in full force and effect on May 18, 1998, in Case No. 95CW60. Since the initial drilling of the well in October of 1989, Applicant has installed a pump, installed a ten thousand gallon storage tank, installed water lines and appurtenant taps to each of the thirteen lots, and installed two fire hydrants. The total cost of installing this water collection and distribution system was in excess of $69,000.00. During the most recent diligence period, Applicant has replaced the pump, irrigated trees and 2 acres of grass within the subdivision in order to make the lots within the subdivision more marketable, continuously advertised the lots for sale and sold two lots. If claim to make absolute, Water applied to a beneficial use: Date: October 31, 1989. Amount: 22 g.p.m. Use: Domestic, including lawn and garden irrigation. The system currently pumps 22 g.p.m. from the well to the storage tank. This water is then used for in-house domestic purposes within one residence and to irrigate 1.33 acres of maintained lawn, 2 acres of bluegrass and trees in the subdivision. 6. Description of place of use where water is applied to beneficial use: Bent Creek Subdivision, thirteen single family residential lots located on 30.21 acres in the NW¼NW¼, Section 13, Township 42 North, Range 5 West, N.M.P.M., Hinsdale County, Colorado. Names(s) and address(es) of owner(s) of the land on which structure is or will be located, upon which water is or will be stored, or upon which water is or will be placed to beneficial use: Applicant is the owner of the land on which the above referenced structures are located. WHEREFORE, Applicant respectfully requests that this Court make 22 g.p.m. of the conditional water right decreed to Bent Creek No. 1 Well absolute and continue the remaining 28 g.p.m. in full force and effect. Source: A tributary of Smith Fork Creek, a tributary of Gunnison River. Date of initiation of appropriation: June 1, 1890. Appropriation was initiated by spring development and irrigation. Date water applied to beneficial use: June 1, 1890. Amount claimed: .7 c.f.s. - absolute. Use or proposed use: Irrigation. Number of acres historically irrigated: Approximately 26 acres. Proposed to 3 be irrigated: Approximately 26 acres. Legal description of acreage: A portion of NE 1/4 of the NW 1/4 of Section 31, and the SW 1/4 of Section 30, Township 51 North, Range 6 West of the New Mexico P.M. lying easterly of Highway 92. Appropriation date: May 1, 1882, Amount: .6667 c.f.s., Use: Irrigation. Proposed change: Transfer the above water right to Hayes Teague Ditch for irrigation of applicant’s property. OURAY COUNTY.

12) Case No. 04CW81, Patrick and Linda Rutherford, P.O. Box 1300, Ridgway, CO 81432; Application for Approval of Plan for Underground Water Right, Water Storage Right: TURNER NO. 1. Located NE ¼ SW ¼ Section 9, Township 46 North, Range 8 West, N.M.P.M. Distance from section lines: 1700 feet from the south and 1700 feet from the west section lines. Source of Water: Uncompahgre River – Dakota Sandstone Aquifer. Appropriation date: 3-18-2002; Amount claimed: 15 gpm, 2.5 a.f./yr absolute; Use: Irrigation, lawns and gardens, domestic, fish pond, wildlife. Remarks: Monitoring well to be converted to production well. Water will be used for domestic uses, stored in a small (1000 ft²) lined fish raring pond, and used for irrigation of not more than 1 acre of lawn, garden, and landscaping. Return flow of domestic water will be by septic system. Application for Water Storage Rights: TURNER FISH POND. Located NE ¼ SW ¼ Section 9, Township 46 North, Range 8 West, N.M.P.M. Distance from section lines: 1720 feet from the south and 1700 feet from the west section lines. Appropriation date: June 2002. Amount claimed: a) 0.1 a.f. absolute; b) if off-channel reservoir, rate of diversion in cfs for filling the reservoir: 0.033 cfs absolute. Use: irrigation. Application for Approval of Plan for Augmentation: TURNER NO. 1. Located NE ¼ SW ¼ Section 9, Township 46 North Range 8 West, N.M.P.M., 1700 feet from the south and 1700 feet from the west section lines. Source of Water Turner Well No. 1, Dakota Sandstone Aquifer. Amount: 15 gpm; Appropriation: 2.5 a.f. per year. Decreed use: Domestic in house supply, fish pond, livestock, wildlife, irrigation of 1 acre lawn and garden. Historic Use: Well constructed in 2002. Water will be used upon adjudication and receipt f production of well permit. Totalizing flow meter will be installed and monitored for water production. Statement of plan for augmentation: Consumptive use for domestic use (15%) will total 0.33 af/yr. Evaporative losses from small 100 ft²) fish pond will total 0.10 af/yr. Consumptive use by 1.0 acre of lawn and garden will total 1.5 af/yr. Total consumptive use will be 2.0 af/yr. or less. Applicant will enter into a Purchase Agreement with Tri-County Water Conservancy District for purchase of 2.0 af/yr. of Augmentation water from Ridgway Reservoir to be released at the direction Division of Water Resources Staff. Source of Water: 4 The source of the well is groundwater tributary to Maverick Draw, tributary to the San Miguel River. Max Depth of the well is 245 feet. Appropriation date: January 30, 1998; Amount: 0.11 c.f.s. (50 pgm) conditional. Use: Commercial use at guest ranch, irrigation (an average of 2,000 sq. ft. (.05 acre) of lawn, garden and landscaping around ranch facilities), livestock watering, augmentation, and filling of still water pond. Attachment A for Wing Shadow Ranch. 4. The following has been completed toward the appropriation and application of water to a beneficial use as conditionally decreed, including expenses. A. The augmentation plan and approval from the District Court, Water Division 4, Colorado for temporary decree. B. The engineering and construction plan of still water pond. C. Bids from construction company to build still water pond. D. An assessment of Wing Shadow Ranch business plan to determine maximum return on current water use and available budgeted dollars. E. Completion of Exempt commercial well at Wind Shadow Ranch. F. Maintenance of Wing Shadow Well No. 1. Replacement of the well pump and mineral regulating system. G. Filling Still Water Pond with Wing Shadow Well No. 1 during the recent drought years was not a good idea or advisable, so the construction has been delayed. The GMWCD is the co-owner of a conditional water right for the storage of 29,000 acre feet of water in the Cactus Park Reservoir, originally decreed on January 31, 1964 in Case No. 4808, Delta County District Court, and amended by decree entered on December 13, 1972 in Case No. W-586, 11 District Court, Water Division 4. The water right was originally decreed for irrigation, fishing, recreation, municipal, domestic, stock water and storage uses. In Case Nos. 97CW131, 01CW23 and 02CW09, District Court, Water Division 4, the GMWCD obtained changes of water rights to store a portion of its Cactus Park Reservoir rights at alternate places of storage and for additional uses as follows: Upper Eggleston Lake: In Case No. 97CW131, the GMWCD obtained a change of water right to store up to 375.84 acre feet in the Upper Eggleston Lake from an alternate source of supply. In Case No. 01CW23, the decreed uses for the water rights stored in the Upper Eggleston Lake were changed to allow direct use for all of the decreed uses or to allow such uses by augmentation, replacement and exchange. Location: The center of the dam for Upper Eggleston Lake is located approximately 4200 feet east of the East Section Line of Section 36, Township 11 South, Range 95 West, 6th P.M., and 1600 feet north of the North Section Line of Section 6, Township 12 South, Range 94 West, 6th P.M. Source of supply: Natural runoff occurring above Upper Eggleston Lake, and Kiser Creek, tributary to Tongue Creek, tributary to the Gunnison River. Arch Slough: In Case No. 97CW131, the GMWCD obtained a change of water right to store up to 97.6 acre feet in the Arch Slough from an alternate source of supply. In Case No. 01CW23, the decreed uses for the water rights stored in the Arch Slough were changed to allow direct use for all of the decreed uses or to allow such uses by augmentation, replacement and exchange. Location: The center of the dam for Arch Slough is located approximately 1350 feet west of the East Section Line and 1250 feet south of the North Section Line of Section 2, Township 12 South, Range 95 West, 6th P.M. Source of supply: Natural runoff occurring above Arch Slough, and Ward Creek, tributary to Tongue Creek, tributary to the Gunnison River. Skinned Horse Reservoir: In Case No. 02CW09, the GMWCD obtained a change of water right to store up to 92.7 acre feet in the Skinned Horse Reservoir from a new source of supply. In the same case, the decreed uses for the water rights changed to the Skinned Horse Reservoir were changed to allow direct use for all of the decreed uses or to allow such uses by augmentation, replacement and exchange. Location: The center of the dam for Skinned Horse Reservoir is located approximately 750 feet west of the East Section Line and 1,300 feet north of the South Section Line of Section 2, Township 12 South, Range 95 West, 6th P.M. Source of supply: Natural runoff occurring above Skinned Horse Reservoir, which water is tributary to Ward Creek, tributary to Tongue Creek, tributary to the Gunnison River. Statement of Plan for Augmentation: Applicant owns the Alexander Lake Lodge and cabin site (hereinafter “JJAK Property”), which is comprised of approximately 10.1 acres, located in Tracts 37 and 75, Township 12 South, Range 95 West of the 6th P.M., in Delta County, Colorado. The JJAK Property operates as a short-term and vacation housing site consisting of a lodge with a restaurant and several cabins. By this Application, the Applicant proposes a plan for augmentation to provide an integrated water supply system for the existing structures located at the JJAK Property, as well as new structures to be developed on the Property. The plan will provide for a potable water supply system to serve in-house domestic and in-building commercial needs, livestock watering, and irrigation for lawns, gardens and community areas. The purpose of the augmentation plan described herein is to protect the existing and expanded water supply for the JJAK Property by augmenting of out-of-priority depletions from the Augmented Water Rights. Estimated water demands, consumptive uses and augmentation requirements. The proposed water demand for the JJAK Property will be associated with the combined use of one lodge consisting of five bedrooms, three bathrooms and a restaurant; 20 cabins; one tack/equestrian shop with one bathroom; livestock watering for up to five horses; and irrigation of a total of 8,000 square feet of lawns, gardens and community areas. Annual diversions are estimated at 21.7 acre-feet and related annual consumptive use is estimated at 3.5 acre-feet. Total EQR value for the JJAK Property is 56.1 EQRs, with 1 EQR equaling the water use of 3.5 people at 100 gallons of water per person per day. Because of the proximity of the water storage reservoirs to the Augmented Water Rights, no transit losses should be associated with the delivery of the GMWCD augmentation water; however, contracted augmentation water supplies will include five percent (5%) of depletions to cover any potential transit losses. In-building Domestic and Commercial Uses. The JJAK Property will require a water supply for: one lodge consisting of five bedrooms, three bathrooms and a restaurant; 20 cabins; and one tack/equestrian shop with one bathroom. Water demands for the lodge assume a 15-person occupancy on 12 a year-round basis, and the restaurant has a 100-seat capacity. The total EQR value for the lodge and restaurant is 34.1 EQRs. Water demands for each of the 20 cabins assume 3.5 people per cabin with 100% occupancy year-round. The EQR value for each of the cabins is 1.0 EQR, for a total cabin EQR value of 20 EQRs. The tack/equestrian shop includes one bathroom and has a total EQR value of 2.0 EQRs. All of the structures will be served by septic tank/leach field systems with a 15% consumptive use assumption, resulting in an annual in-building consumptive use of 3.19 acre-feet. Livestock Watering Use. The JJAK Property will provide livestock watering for up to five animals, at 10 gallons per animal per day. Livestock watering is presumed to be 100% consumptive, for a total annual diversion and consumptive use of 0.056 acre-feet. Irrigation Uses. Annual irrigation and lawn watering consumptive use is estimated at 0.30 acre-feet, based on an annual diversion of 0.376 acre-feet and an application efficiency of 80% for the irrigation of a total of 8,000 square feet of lawns and gardens within the JJAK Property. Augmentation Water Supplies. Augmentation water will be provided from the sources identified above as necessary to augment out-of-priority depletions caused to the unnamed tributary of Ward Creek, Ward Creek, Tongue Creek and the Gunnison River by diversions of water from the Augmented Water Rights. Prior to the entry of a ruling or decree, Applicant will provide evidence to the Court of an application for a water supply contract for the required amount of augmentation storage water needed to replace out-of-priority depletions, plus five percent (5%) to cover transit losses. A portion of the annual consumptive use may occur at times when there is no call on the Gunnison River system. Nevertheless, the plan provides for full replacement of depletions from Applicant’s uses from the Augmented Water Rights. Applicant will provide evidence to the Court regarding the timing of depletions from its uses of water from the Augmented Water Rights. Fourth Claim; Application for Appropriative Right of Exchange. Alexander Lake Exchange. Location: The exchange reach follows an unnamed tributary of Ward Creek from the points of diversion for the JJAK Well Nos. 1 and 2, Alexander Lodge Well and JJAK Spring located on the JJAK Property and feeds into Alexander Lake. Upper Termini: Points of diversion for the JJAK Well Nos. 1 and 2, Alexander Lodge Well and JJAK Spring, as described in the First Claim and the Second Claim herein. Lower Terminus: The inlet of Alexander Lake is located in Section 1 of Township 12 South, Range 95 West of the 6th P.M. at a point 2134 feet south of the north section line and 884 feet east of the west section line of said Section 1. How Appropriation Was Initiated: The exchange appropriation was initiated by the formation of intent to appropriate water and application to GMWCD for a water supply contract for the delivery of augmentation water. The exchange water will then be delivered along an unnamed tributary of Ward Creek from the Alexander Lake inlet to the points of diversion for the JJAK Well Nos. 1 and 2, Alexander Lodge Well and JJAK Spring located on the JJAK Property. Operation of Exchange: When the Applicant’s water rights divertible at the JJAK Well Nos. 1 and 2, Alexander Lodge Well and/or JJAK Spring are not in priority because of a valid call by senior adjudicated water rights, then the Applicant will continue to divert water at those structures and will deliver water from the augmentation water supply sources as needed to satisfy the call. Operation of the exchange is only required for the delivery of augmentation water supplies from either Eggleston Lake or Skinned Horse Reservoir, and operation of the exchange is not required for the delivery of augmentation water supplies from the Arch Slough.
