An Act repealing certain restrictions imposed on THE METROPOLITAN TRANSIT AUTHORITY WITH REFER- ENCE TO THE CONSTRUCTION OF CERTAIN RAPID TRANSIT IMPROVEMENTS IN THE CITY OF BOSTON.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 Section 1. Section 2of chapter 649 of the acts 2 of 1949 is hereby amended by striking out the last 3 three sentences, so as to read as follows: Section 2. 4 The authority shall construct and equip an addition 5 to the existing in the city of 6 Boston connecting with the said subway at or near 7 the junction of and Scollay square, 8 thence running in a general southerly direction under 9 Beacon Hill and and through and 10 under public and private lands and ways, and con- -11 necting with Park street station of said subway and 12 shall also in connection with such construction enlarge 2 HOUSE —No. 1350. 13 and alter and provide additional platform facilities 14 in the Scollay square, Park street and Boyslton street 15 stations of said subway, and shall provide continuous 16 platform facilities between said Park street station 17 and said station, and may make such 18 alterations in said subway for said purposes as it 19 may deem necessary.

1 Section 2. Section 3of chapter 649 of the acts of 2 1949, as amended by chapter 747 of the acts of 1949, 3 is hereby amended by striking out in the third sen- -4 tence the words “the point where the tunnel addition 5 to be constructed under this secion connects with the 6 present elevated structure on Washington street near 7 Cedar street” and inserting in place thereof the words: 8 Dudley street, and by striking out the last three 9 sentences, so as to read as follows: Section 3. The 10 authority shall construct and equip an addition to the 11 existing Washington street tunnel in the city of Bos- -12 ton connecting with said tunnel at or near the Boyl- -13 ston street station thereof, thence running in a general 14 southerly direction under Washington street and under 15 the right-of-way of the New York, New Haven and 16 Hartford Railroad and Boston and Albany Railroad 17 to a point at or near Cobb street, thence turning and 18 running in a general southwesterly direction under 19 public and private lands to Shawmut avenue at a 20 point near Dover street, thence running under Shaw- -21 mut avenue in a general southwesterly direction to a 22 point at or near Arnold street, thence turning and 23 running in a general southerly direction under public 24 and private lands to Washington street at a point near 25 Eustis street, thence running in a general south- -26 westerly direction under public and private lands to a 1950.] HOUSE —No. 1350. 3

27 new underground station at a point near Dudley 28 street. Said addition to the existing Washington 29 street tunnel shall include a station at or near the 30 junction of Shawmut avenue and Union Park street, 31 a station at or near the junction of Shawmut avenue 32 and West Springfield street, and a station at or near 33 Dudley street. 34 After the use by the authority of the tunnel addition 35 constructed under this section begins, the authority 36 shall proceed without delay to remove its elevated 37 structure located in or upon Washington street and 38 public or private lands or ways in the city of Boston 39 between the southerly end of the present Washington 40 street tunnel and Dudley street, above its founda- -41 tions, to put the surface of the public ways disturbed 42 by such removal into as good condition as the adjacent 43 surface of said ways, to restore to good condition 44 sidewalks affected by such removal and to repair any 45 damage done by such removal to any building to 46 which said elevated structure is affixed. The cost to 47 the authority of removing such elevated structure and 48 of restoring public ways, sidewalks and buildings as 49 aforesaid, less the amount received by the authority 50 from the sale of the structure as salvage or otherwise, 51 shall be included in the cost of the work authorized 52 by this section.

1 Section 3. Section 3A of chapter 649 of the acts 2 of 1949, inserted by chapter 747 of the acts of 1949, 3 is hereby amended by striking out the last three sen-

-4 tences, so as to read as follows: Section 3A . The 5 authority shall construct and equip an addition to the 6 Washington street tunnel, consisting of a tunnel, ele- -7 vated structures and a rapid transit line, in the city of 4 HOUSE —No. 1350. [Jan.

8 Boston, to connect with the addition authorized by 9 section three of this act at a point near the southerly 10 end of the new underground Dudley street station and 11 thence running under Washington street in a south- -12 westerly direction to a point near Valentine street, 13 thence running in a westerly direction under private 14 lands and emerging by way of an incline to the surface 15 and thence by way of an elevated structure passing 16 over and Amory street to the east- -17 erly side of the right of way of the New York, New 18 Haven and Hartford Railroad; thence following and 19 paralleling this right of way to a point near Williams 20 street, thence crossing private land in a southerly 21 direction to Washington street and joining with the 22 existing elevated structure on Washington street at or 23 near Lotus place. Said addition shall include over- -24 head stations near Columbus avenue and Amory 25 street, and near Green street. 26 After the use by the authority of the tunnel addition 27 constructed under this section begins, the authority 28 shall proceed without delay to remove its elevated 29 structure located along Washington street and on pub- -30 lie or private lands or ways in the city of Boston be- -31 tween Dudley street and the point where the tunnel 32 addition to be constructed under this section connects 33 with the present elevated structure on Washington 34 street at or near Lotus place, above its foundations, to 35 put the surface of the public ways disturbed by such 36 removal into as good condition as the adjacent surface 37 of said ways, to restore to good condition sidewalks 38 affected by such removal and to repair any damage 39 done by such removal to any building to which said 40 elevated structure is affixed. 42 public ways, sidewalks and buildings as aforesaid, less 43 the amount received by the authority from the sale 44 of the structure as salvage or otherwise, shall be in- -45 eluded in the cost of the work authorized by this 46 section.

Section 3B of chapter 649 of the acts 2 of 1949, inserted by chapter 753 of the acts of 1949, 3 is hereby amended by striking out the last three 4 sentences, so as to read as follows: Section SB. The 5 authority shall construct and equip an addition to 6 the existing Washington street tunnel in the city of 7 Boston, consisting of a tunnel and elevated structure 8 to connect with said Washington street tunnel at the 9 northerly end of the present Union station platform 10 near Haymarket square, thence running under Hay- -11 market square and under Haverhill street, thence 12 running between the Industrial Building and the 13 North Station terminal building and thence under 14 private lands continuing in a northerly direction un- -15 der the Charles river to City square in Charlestown, 16 thence under Main street in a northwesterly direction 17 to a point near Baldwin street, and thence under 18 private lands emerging by way of an incline to the 19 surface and thence by way of an elevated structure 20 passing over existing freight tracks of the Boston and 21 Maine Railroad located between Rutherford avenue 22 and Bunker Hill street and joining with the present 23 elevated structure at . Said addition 24 shall include a new underground station at the North 25 Station under Causeway street and a station between 26 City square and Thompson square at or near the 27 junction of Main street and Warren street in Charles- -28 town. 6 HOUSE —No. 1350. 29 After the use by the authority of the tunnel addi- -30 tion constructed under this section begins, the authority 31 shall proceed without delay to remove its elevated 32 structure located between Haymarket square, in 33 Boston, and near Sullivan square, Charlestown, in- -34 eluding the structure located on the Charlestown 35 bridge, so called, presently used by the main line ele- -36 vated trains, but excluding any structural members 37 incorporated in the drawbridge structure of said 38 bridge which specially support or serve said main line 39 elevated trains, and shall remove that portion of said 40 main line elevated structure now located on Causeway 41 street through Keaney square and on Commercial 42 street, Boston, above its foundations, to put the sur- -43 face of the public ways disturbed by such removal 44 into as good condition as the adjacent surface of said 45 ways, to restore to good condition sidewalks affected 46 by such removal and to repair any damage done by 47 such removal to any building to which said elevated 48 structure is affixed. The cost to the authority of re- -49 moving such elevated structure and of restoring public 50 ways, sidewalks and buildings as aforesaid, less the 51 amount received by the authority from the sale of the 52 structure as salvage or otherwise, shall be included in 53 the cost of the work authorized by this section.

1 Section 5. This act shall take effect upon its 2 passage.
