    Reconciling Ireland's Bail Laws with Traditional Irish Constitutional Values Kate Doran Thesis Offered for the Degree of Doctor of Philosophy School of Law Faculty of Arts, Humanities and Social Sciences University of Limerick Supervisor: Prof. Paul McCutcheon Submitted to the University of Limerick, November 2014 Abstract Title: Reconciling Ireland’s Bail Laws with Traditional Irish Constitutional Values Author: Kate Doran Bail is a device which provides for the pre-trial release of a criminal defendant after security has been taken for the defendant’s future appearance at trial. Ireland has traditionally adopted a liberal approach to bail. For example, in The People (Attorney General) v O’Callaghan (1966), the Supreme Court declared that the sole purpose of bail was to secure the attendance of the accused at trial and that the refusal of bail on preventative detention grounds amounted to a denial of the presumption of innocence. Accordingly, it would be unconstitutional to deny bail to an accused person as a means of preventing him from committing further offences while awaiting trial. This purist approach to the right to bail came under severe pressure in the mid-1990s from police, prosecutorial and political forces which, in turn, was a response to a media generated panic over the perceived increase over the threat posed by organised crime and an associated growth in ‘bail banditry’. A constitutional amendment effectively neutralising the effects of the O'Callaghan jurisprudence was adopted in 1996. This was swiftly followed by the Bail Act 1997 which introduced the concept of preventative detention (in the bail context) into Irish law.

    LSE Brexit: The totality of UK-Irish relations is at risk because of Brexit Page 1 of 4 The totality of UK-Irish relations is at risk because of Brexit The European Union was a crucial element of the totality of UK-Irish relationships that would allow for the 1998 Good Friday Agreement, writes Darren Litter (Queen’s University Belfast). The UK and Ireland’s historic achievement of the 1998 Good Friday Agreement (GFA) is most synonymous with the inter-prime ministerial partnership of Tony Blair and Bertie Ahern. More than any of their predecessors, Blair and Ahern got on together, shared a common understanding of the ‘Northern Ireland problem’, and were determined to approach this issue in the fully intergovernmental spirit envisaged originally by the 1985 Anglo-Irish Agreement (AIA). However – while indispensable to the efficiency and effectiveness with which the GFA was achieved – this emphasis on the Blair-Ahern partnership serves to take away from the importance of the wider totality of UK-Irish relationships – principally in the EU context – that was no longer a matter of rhetoric by the mid-1990s. This, as we shall see, contrasts with the post-Brexit state of play, where the totality of UK-Irish relations has again taken on the much less resonant meaning from when it was first introduced into the Anglo-Irish discourse at the height of the Northern Ireland conflict.     Chapter 12 Social media and political communication Martin Molony The election of Barack Obama in 2008 was widely regarded as being an internet election victory. Greengard (2009, 16) described Obama as ‘the first internet president’ and there was widespread agreement amongst political commentators and digital media experts as to ‘how politicians and the public interact [would] never be the same.’ In the days following Obama’s election, The New York Times reflected on the repetition of history in the effective use of a new medium: ‘One of the many ways that the election of Barack Obama as president has echoed that of John F. Kennedy is his use of a new medium that will forever change politics. For Mr Kennedy, it was television. For Mr Obama, it is the internet’ (Miller, 2008). Commentators, such as Huffington Post founder and editor-in-chief, Arianna Huffington (2008) went further and believed that the Obama win was entirely due to his use of the web: ‘Were it not for the Internet, Barack Obama would not be president. Were it not for the Internet, Barack Obama would not have been the nominee.’ But was Obama’s win entirely down to successful use of the internet? Why did he win when, just four years earlier, Howard Dean had failed having used the same approach? One might assume that Barack Obama perfected Dean’s trial use of internet technologies but it is also reasonable to suggest that such electronic communication had come of age and that the electorate was sufficiently comfortable with the technologies to engage with their preferred candidate.

We’ve got a good selection of musical acts – the highly tipped Dublin songwriter Anderson who became famous for selling his album door-to-door, arrives for a solo show; Cork-born songwriter Mick Flannery presents his new album in another solo gig and we’ve opened up the auditorium for some tribute shows like Live Forever and Roadhouse Doors to give a more concert-type feel, so check these out on our brochure. Legendary Manchester poet John Cooper Clarke comes to visit us on May 4th; we have theatre with ‘The Corner Boys’, God Bless The Child’ and Brendan Balfe reminisces about the golden days of Irish radio in early June. Summer is a time for the kids and again we have a series of arts workshops and classes running over the summer months to keep them all occupied.
