O "Account Holder" meansa person who has enteredinto a contract with the bank for the Service who has an Account in his/her own name or a Joint Account in respect of which the bank may act on the instructions of any one or more of the joint accountholders. O "LIser ID" means the Customer'sIdentification Code (alpha-numeric) supplied to the Customer by the Bank for accessingthe Internet Banking Service. O "Password" meansthe alpha-numeric identification number for accessingthe Internet Banking Service. The initial "Password"will be generatedby the Bank and will be changedby the Customer at the time of first logon. The Customer's "Password" will be used every time the Customer logon to Internet Banking Service. O "Instruction" means any request or order to the bank which is effected through the Internet Service by use of a User ID. Memorable Answer and Password. O "Terms" meansthese terms and conditions for Internet Banking Service, as amendedfrom time to time. 2. About theseTerms and Conditions: 2.1 These terms and conditions set out the rights and obligations of the Customer and the Bank in connection with the use of Pubali Bank Internet Banking Service.All the terms and conditions of this agreementare legally binding. 2.2 This agreementis in addition to the terms and conditions that apply to the accountsthe customer may be accessingthrough the Pubali Bank Internet Banking Service and is in addition to the terms and conditions that have been agreedupon earlier at the time of opening of the account or later. 2.3 This agreementrelates only to the eligible accounts registered with the Bank for the Internet Banking Service. TI 3. Applicability and Acceptanceof the Terms: 3.I TheseTerms forms the contract betweenthe Customer and PBL for Internet Banking. 3.2 The Customer shall apply to PBL in the prescribedform for use of Internet Banking. 3.3 When the customer uses the Service, the customer acknowledges and accepts these terms. Notwithstanding anything contained herein, all Terms & Conditions pertaining to the accounts shall continue to apply. 3'4 User must compensatefor any loss that occurs as a result of his/her breach of any term and conditions. 4. Etigibility for the Service: 4.1 To subscribeto Internet Banking, Customermust maintain at least one Current or SavingsAccount with the Bank. Internet Banking will allow Customerto accessmore than one Account. 4.2 The customer will be able to accessinformation through Internet Banking only for eligible accounts maintained with PBL. 4.3 The bank has the absolute discretion to accept or reject any application for Internet Banking Service without giving any reasonthere for. 5. Joint Account: 5.1 In case of Joint Accounts, financial transactionsthrough Internet Banking will be available if the mode of operation is indicated as "either or survivor". The Customer desirous of using the Internet Banking should either be the Account holder or sole signatory or authorized to act independently in case of a joint account. 5.2 For such joint aicounts, different Login IDs and Passwordwill be issued to each of the joint account holder(s) when requested. The joint accountholder shall expresslyagree with the ilrangement and give their consentin writing on the application form for use of Internet Banking. 5.3 In caseof joint accountsoperated by more than one Customer,PBL shall act on the instruction received first. All correspondencewill be addressedto the first namedperson only. 5.4 All transactionsarising from the use of Internet Banking in the joint account shall be binding on all the joint account holders,jointly and severally. 6. Internet Banking Access,Password and Security Procedures: 6.1 Pubali Bank Limited will provide the customer with unique User ID and a Temporary Password in the first instancefor accessto Internet Banking. 6,2 As a safety measure,the User must immediately change the Passwordupon his/her first login. User is reqdestedto changehis/her Passwordfrequently thereafteras far as possible. 6.3 The customer acknowledgesthat the User ID and the Passwordwill act as lJser's authorized signature. This signatureauthorizes and validatesdirections given just as an actual written signaturedoes. 6.4 User is responsiblefor maintaining the confidentiality of User ID and Password.User agreesthat he/she will not under any circumstancesdisclose his/her Passwordto anyone, including anyone claiming to represent the Bank or to someone giving assistanceon a technical helpdesk in connection with the service. It should be clearly understood that Bank employees do not need User's password for any reason whatsoever. 6.5 If the User gives hisftrer Passwordto anyone or fails to safeguardits secrecy,he/she does so at his/trer own risk and responsibility becauseanyone with User Passwordwill have accessto his/trer accounts. 6.6 If the User forgetsthe Password,he/she has to requestthe bank for issueof a new passwordby sending a written requestto Pubali Bank Limited. I 6.7 If Customer'spassword is lost or stolen, or is known by another individual, he/she must notify pubali Bank Limited immediately. The bank may provide to the police or any prosecuting authority any information they need if the bank thinks that it will help them to find out if someoneelse is using the User ID, passwordor any of the additionalsecurity detail. 6.8 The use of the Passwordassigned to the customer will indicate Customer'sacceptance of the terms and conditions governing Customer'sAccount(s) and this Internet Banking Agreement. 6.9 The Bank reserves the right to prevent Customer's accessto Internet Banking should the bank has reason to believe that the confidentiality of Customer'sPassword has been compromised. 6.10 The User agreesand acknowledgesthat Pubali Bank Limited shall in no way be held responsible or liable if the user incurs any loss as a result of information being disclosed by the bank regarding his/trer Account(s) or carrying the instruction of the user pursuantto the accessof the Internet Banking and the user shall fully indemnify and hold harmlessPubali Bank Limited in respectof the same. 6.1 1 Customer understandsthat the bank has implemented a security procedure for the purpose of verifying the authenticity of the Instructions transmitted to the bank by the customer and not for the purpose of detecting errors in such instructions. 6.12 Customers agrees to be bound by any instruction issued by the Customer using the password and received and verified by the bank in accordancewith such security procedure and Customer shall indemnify and hold the bank harmlessfrom and againstany loss suffered or liability incurred by, arising from, the execution of instructions in good faith and in compliance with such security procedure. 7. Risks in Internet Banking: 7.1 The Customer hereby acknowledgesthat he/she will use the Internet Banking facility at his/her own risk. 7.2 The Customer acknowledgesthat in case any third person obtains accessto the account, he/she would be able to instruct fund transfersand provide payment Instructions.
