‘Welcome to the INLA UK Nuclear Law Conference 2018 run by the UK branch of INLA, the International Nuclear Law Association.

The Course will focus on key UK nuclear legislation and legal issues; we hope it will be practical, informative and interactive. The Conference is designed for INLA members – lawyers and specialist nuclear lawyers practising in the public and private sector, policy makers, regulators and students. It provides an ideal introduction for newcomers to the UK nuclear legal sector, as well as benefitting the more experienced practitioners.

We are very grateful to the excellent line-up of presenters for giving up their time to share their knowledge and experience; we hope you will make the most of the opportunity to interact with these sector experts.

We are also very grateful to for kindly hosting the Conference at their Manchester offices.

The Conference is for one day and in the evening of the Conference there is a networking Reception and Dinner at Manchester Hall. This is included within the price of the Conference so we hope you will attend. Details of the venue, menu and dress code are set out in this pack. Presenters’ CVs Ian Salter, Chair UK INLA, Ian has worked at Burges Salmon for over 25 years and became a partner in Burges Salmon 1999. He is an expert in the field of nuclear regulation and international nuclear law and has advised extensively on commercial arrangements in the nuclear sector around the world. Ian chairs the Nuclear Industry Association's Legal and Financial Affairs Working Group, and also acts as the UK representative on the board of the International Nuclear Law Association with whom he has been actively involved since 1999. He is editor of 'The Burges Salmon Guide to Nuclear Law' (Second edition 2015). Dr Tim Stone CBE Tim is the Chairman of Nuclear Risk Insurers and is also the longest serving member of the Board of the European Investment Bank. He is a non-executive member of the Arup Group Board and a non-executive director of both Horizon Nuclear Power board and of the Site Licence Company. From 2011 –2015 he was a non-executive director of the Anglian Water Group. He is, or has been, a member of a number of advisory boards for infrastructure investors, funds and advisory firms. He was the one foreign member of the Expert Advisory Committee of the Royal Commission on the Nuclear Fuel Cycle established in 2015 by the government of South Australia. Until 2013, Tim was the Expert Chair of the Office for Nuclear Development in DECC and the Senior Advisor to successive Secretaries of State responsible for energy. He served five different Secretaries of State in two different governments over nearly 7 years. He holds a Visiting Professorship at University College London. Chair Andrew Carr, Andrew has been a with the company since 1999 when he joined BNFL Sellafield Ltd Group Legal at Risley. He took up the executive role of General Counsel for Sellafield Ltd in 2007 and was appointed to the Board as Company Secretary in April 2016. Andrew is a specialist nuclear regulatory lawyer with significant experience of managing legal issues at a national and international level throughout the nuclear fuel cycle. Andrew’s responsibilities include leading the provision of specialist legal advice and insurance support to the business, supporting the Board with corporate governance and compliance and being the executive lead for Hinton House in Warrington. Nick Atherton, Sellafield Nick is a Technical Manager for Sellafield Ltd leading the development of the Ltd Sellafield Site End States programme. Nick started his career in the brownfield redevelopment industry, where he led the remediation of a number of

industrial and military sites. He has worked in the Nuclear Industry for 15 years, across a variety of sites. Nick is an Environmental Scientist, and a Chartered Environmentalist. Part of his current role is to lead the Environmental Science research programme to support decommissioning, waste management and site remediation at Sellafield. Nick also chairs an inter- industry group that supports the NDA research programme for site remediation and reports into the Nuclear Waste and Decommissioning Research Forum. Helen Peters, Pinsent Helen is an environmental and nuclear law specialist. She has over 20 years’ Masons experience having retrained as a lawyer after a degree incorporating environmental science and working as an advisor to the National Farmers Union. She is recognised as a leading UK Environmental Lawyer by Chambers Legal Directory and Legal 500 and was a member of the Committee of Radioactive Waste Management (CoRWM) between 2012 and 2016, a group of independent experts appointed by the UK Government providing scrutiny and advice on higher activity radioactive waste. Helen is currently a member of the BEIS Working Group advising on modernising legislative controls for nuclear sites in the final stages of decommissioning. Chair Mark Richards, Mark is an experienced international lawyer working both in private practice Director UK INLA and industry. For 10 years, Mark was the Chief Counsel for International Operations for CH2M HILL. For 20 years prior to that Mark was a partner in Pinsent Masons where he headed the global nuclear and major projects practices. Highlights include: • Seconded as VP Legal to Canadian Nuclear Laboratories responsible for transforming the company into a commercial nuclear enterprise as part of the senior executive team. • ENEC Prime Contract Selection Lead he designed and managed the market engagement strategy, the EOI and PQQ processes for ENEC reactor technology procurement. • Lead external legal adviser to Chernobyl NPP and EBRD on the Chernobyl Shelter Implementation Plan including negotiating contracts for the Shelter Stabilisation, Integrated Monitoring and the New Safe Confinement. Mark is recognised by Legal 500 as a ‘leading individual’ for his work in the field of energy and natural resources. Kate Ward, BEIS Kate Ward is a career civil servant with over thirty years policy experience. She has extensive experience of the development of nuclear policy within Government and now leads the team responsible for nuclear third-party liability policy. In particular, she has developed the UK policy for the ratification

International Nuclear Law Association

of the 2004 Protocols to the Paris and Brussels Supplementary Conventions on nuclear third-party liability. Kate is also the current Head of the UK Delegation to the OSPAR Convention Radioactive Substances Committee. Kate’s previous posts in the civil service have been in Defra and DECC, covering areas including rural development, animal health emergencies, better regulation policy, climate change adaptation and a term in a Ministerial Private Office. Anthony Wetherall, Centre Anthony has sixteen years of nuclear law experience, with twelve acquired in for International Law, the Nuclear and Treaty Law Section of the IAEA Office of Legal Affairs (2002- National University of 2008 and 2010-2016). Since July 2016, he is a Senior Research Fellow at the Singapore Centre for International Law, National University of Singapore where he leads the research on the Government of Singapore’s project on nuclear law and

policy. He holds a Masters of Laws (LLM) with Distinction in Energy Law - specialism in nuclear law. Chair Claire Gooding, EDF Claire is Legal Affairs Director, Generation and Corporate, with responsibility for Energy all legal matters across the EDF Energy Generation and Corporate business; from operational to strategic matters and management of the Boards of Directors. Claire joined British Energy in 2007 as legal advisor to the British Energy trading and sales business. Following the EDF Energy acquisition, Claire took over responsibility for the Energy Sourcing and Customer Supply business before taking up the position of Head of Legal with responsibility for the generating fleet of EDF Energy in 2013. Claire will shortly be moving to a new role as General Counsel, HPC and Nuclear Development. Prior to joining British Energy Claire worked for a private practice law firm in London, specialising in project finance for international energy projects. She spent much of her early career working for clients on projects across Asia and the Middle East. Stephen Tromans QC, 39 Stephen is a specialist in energy and environmental law, and nuclear law in Essex Chambers particular. He has worked in the field since 1995 and published the first edition of his book on Nuclear Law in 1997. He is currently working on the third edition. His clients past and present have included: Ministry of Defence, NIREX, British Energy, Nuclear Risk Insurers, the Environment Agency, Nuclear Industries Association, the NDA, EDF, Horizon, and BEIS. He was appointed a member of the Committee on Radioactive Waste Management in 2016. He is a member of the UKELA Brexit task force and has written extensively on the implications of Brexit and Brexatom.

Ian Truman, Burges Ian is an expert in the field of nuclear regulation and international nuclear law Salmon and has invaluable experience in nuclear new build projects in the UK from his time as Deputy General Counsel of the Hinkley Point C Project. Since re-joining the firm Ian has used his industry experience of new nuclear projects in the UK to lead development of the firm's expertise in small modular reactors. Ian is a member of the Nuclear Industry Association, the Nuclear Institute, the International Nuclear Law Association and the World Nuclear Association. He regularly publishes articles on small modular reactors as well as speaking at high profile industry events. In June 2016 he was asked to be part of the Nuclear Institute's special working party on small modular reactors. Outside of the UK Ian has advised Governments, NEPIOs and contractors on issues relating to new nuclear development in Europe, the Middle East and South America. Kate Smith, Sellafield Ltd Kate heads up the Sellafield Ltd team of regulatory planning and property specialists who provide integrated tactical and strategic support to the business. After 10 years in private practice having participated in the Bloody Sunday Inquiry and spending 5 years based on the Sellafield site as part of a large and long-running piece of litigation, Kate joined the British Nuclear Group Ltd legal team before transferring to Sellafield Ltd. In 2005/06 Kate was engaged in the development of and subsequently lecturing in the nuclear policy, regulation and licensing module with Manchester University for the Nuclear Technology and Education Consortium’s MSc in nuclear engineering. In the last 12 years with Sellafield Ltd Kate has worked closely with, among other business areas, Sellafield’s Euratom article 37 and safeguards teams, the security and resilience department as well as the more mainstream such as planning, health & safety, permitting and licensing and investigatory matters that arise on a nuclear licensed site. Kate is also a member of Sellafield Ltd’s Brexit Working Group, which deals with Brexit related business impacts. Steve Ardern, EDF Energy Steve, Nuclear Policy Lead at EDF Energy, works on nuclear policy within the UK arm of EDF Group. EDF Energy operates eight nuclear power stations in the UK and is leading the UK’s programme to build the next generation of new nuclear reactors. Steve’s key areas of interest at the moment include Brexit, UK Industrial Strategy, and the geological disposal of radioactive waste. Steve trained as a chemist at the University of York and has an MBA from the University of Bath. He has 25 years’ experience in the nuclear industry in a wide range of roles. Steve has significant experience in civil nuclear emergency planning. During his career Steve spent 10 years in a consultancy role and

provided decision support to a number of radioactive waste and decommissioning projects. He has also worked on nuclear projects in several countries including Sweden and the Ukraine. Chair Graham Alty, Pinsent Graham specialises in the nuclear, power and infrastructure sectors and has Masons several years of in-depth experience with new build and decommissioning projects. He works with government bodies, site licence companies, utilities, power generators, commercial developers and contractors. Graham advises on procurement strategies, incentive mechanisms, PPP, commercial agreements, alliancing/frameworks, management contracting/construction management and design, build and operate models, for both owner/sponsor funded and project financed projects, including landmark infrastructure, power plants, nuclear waste management, roads, sports stadia/facilities and major real estate developments. Graham heads the firm’s nuclear practice and is a regular speaker/contributor at the World Nuclear Association, International Nuclear Lawyers Association, Law Review of the Year and the firms Nuclear Acquaint Course. Jillian Chung, EDF Energy Jill, head of legal HPC and nuclear development joined EDF in January 2018 after 16 years with Freehills. She is an experienced construction and engineering lawyer having worked on projects in the international and domestic markets, most recently HS2 and Thames Tideway. Her involvement with HPC stretches back to 2011. Paul Cowan, 4 New Square Paul Cowan is a barrister and arbitrator at 4 New Square chambers, with two decades of experience advising on high profile international and national construction disputes. Paul has uniquely detailed experience of new build nuclear projects having acted for many years as project and disputes counsel on the Olkiluoto 3 project in Finland, as well as extensive experience in the wider power and oil & gas sectors, including in numerous civil law jurisdictions. Paul is a particular specialist in presenting and defending delay and disruption claims. This includes successfully defending against a € multi- billion disruption claim brought by a contractor on a nuclear power project, as well as in establishing new case law relating to construction delay both in the High Court and in the Court of Appeal (Carillion v Woods Bagot & Others [2017]). Doug McIntyre, Vice Douglas is Vice-President Legal & Insurance and Corporate Secretary for President Legal, CNL Canadian Nuclear Laboratories. He has been working for and with Canada’s national nuclear laboratory for the past decade.

Prior to his nuclear exposure, Doug spent 16 years focused on intellectual property, both in-house at QNX Software Systems and in private practice with Gowlings. He has years of experience providing strategic counsel to a variety of

companies in the areas of technology, software, water purification, medical and nuclear. Doug obtained a Bachelor of Commerce from Queen’s University in 1986, his LLB from the University of Toronto in 1990 and was subsequently called to the Ontario Bar in 1992.
