The minutes of the meeting held on 12 February 2015 were taken as read, confirmed and signed. 253. Question Time. The Chief Executive reported that no questions had been received under Standing Order 35. 254. Questions asked by Members. The Chief Executive reported that no questions had been received under Standing Order 7(3) and 7(5). 255. Urgent items. There were no urgent items for consideration. 256. Declarations of interest. The Chairman invited members who wished to do so to declare any interest in respect of items on the agenda for the meeting. It was noted that all members who were also members of a Parish, Town, or District Council had personal interests in those applications which related to areas covered by those authorities. Mr Spence CC declared a personal interest in Item 10 (application no 2010/1031/07) as a member of the Whitwick Quarry Liaison Committee. With regards to Items 8 and 9 (application nos. 2014/0067/02 and 2015/0086/02 respectively) Mr Hunt CC said that he had omitted to follow the Council’s guidance on site visits and would therefore leave the meeting when those items were considered. 4 257. Presentation of petitions. The Chief Executive reported that no petitions had been received under Standing Order 36. 258. Leicestershire County Council Ashby de la Zouch (Highfields) Tree Preservation Order 1965 - Application to fell a Turkey Oak tree at 1 Hill Street Ashby de la Zouch. The Board considered a report of the Director of Environment and Transport, a copy of which, marked ‘Item 7’, is filed with these minutes. Mr Coxon CC, the local member, supported the recommendation in the report. RESOLVED: That consent is granted to fell the Turkey oak at 1 Hill Street, Ashby de la Zouch. REASON FOR DECISION: The Turkey oak T1 is causing structural damage to the Applicant’s outbuilding and it is potentially dangerous due to the leaning stem and loss of large diameter braches. The removal of the tree will have a minor detrimental impact on the amenity of the area that will be mitigated by the remaining protected broadleaved trees. 259. 2014/0067/02 (2014/CM/0011/LCC): Lafarge Tarmac Limited - Extension of the mineral extraction area, relocation of the primary crusher and surge pile, relocation of quarry office, workshops, lorry and car parks, construction of overburden landforms, and proposed restoration and aftercare - Mountsorrel Quarry, Loughborough Road, Mountsorrel. (Mr Hunt CC, having declared that he omitted to follow the Council’s guidance on site visits, left the meeting during consideration of the application.) The Board considered a report of the Chief Executive, a copy of which, marked ‘Item 8’ is filed with these minutes. The Board also considered a supplementary report regarding a Member Site visit. In accordance with the procedure for making representations to the Board Mrs J. Davies (local resident, Quorn) spoke against the proposals and Mr T. Deal (Lafarge Tarmac) spoke as the applicant. It was confirmed that the modifications to the application had been communicated to the Quarry Liaison Committee, and to local residents via public events in Mountsorrel and Quorn. Members received further advice from the Chief Executive, including - (i) That vibration levels from production blasting were monitored at 4 different locations around the quarry, with an additional monitor in place at the nearest residential property. There had been no recorded incidents where the blasting exceeded the maximum allowed levels. 5 (ii) Existing measures for ensuring dust arising from operations was kept to a minimum had been reviewed and it was proposed that new conditions would be put in place. (iii) A total of 119 representations had been submitted regarding the application (referred to at paragraph 132 of the report), all of which had been taken into account in the assessment of the proposals. The local member Mr A.M. Kershaw CC spoke regarding the application. He said that whilst the site was known as Mountsorrel Quarry, the residents of Quorn were most affected by the development. Mr Kershaw noted that under the proposed relocation scheme, all traffic leaving the site would be redirected via a one-way system to the quarry access off Granite Way, reducing traffic on Wood Lane in Quorn which would benefit residents. Mr Kershaw said he had been concerned regarding the expansion into Buddon Wood SSSI (Site of Specific Scientific Interest), and it was noted that this had been addressed in the report. RESOLVED: (a) That the application 2014/0067/02 be permitted subject to the conditions nos. 1-73 and the Notes to Applicant as set out in the appendix to the report, and the prior completion of a planning obligation covering: • Areas of ancient woodland not to be quarried; • Long-term management of the Ancient Woodland and native semi- natural woodland; • Public rights of way and access scheme covering proposed permissive paths/public access to restored areas and a dedicated public bridleway between the rail halt on Bond Lane and the rail bridge on Swithland Lane; • A schedule of planning permissions to be superseded • Rescinding of previous legal agreement and inclusion of matters previously covered, in particular Liaison Committee; maximise stone removed by rail; felling and retention of trees; routeing of HGVs; access to Broad Hill; • Employment and Skills Plan. (b) That the Board confirms (as required by the Town and Country Planning (Development Management Procedure) (England) Order 2010 (as amended) that in dealing with the application the County Council worked in a positive and proactive manner, taking account of paragraphs 186 and 187 of the National Planning Policy Framework. 260. 2015/0086/02 (2015/CM/009/LCC): Lafarge Tarmac Trading Limited - Installation of wash plant facility - Mountsorrel Quarry, Loughborough Road, Mountsorrel. (Mr Hunt CC, having declared that he omitted to follow the Council’s guidance on site visits, was absent from the meeting during consideration of the application.) The Board considered a report of the Chief Executive, a copy of which, marked ‘Item 9’, is filed with these minutes. The Board also considered a supplementary report regarding a Member site visit. RESOLVED: 6 (a) That the application 2015/0086/02 be permitted subject to the conditions nos. 1-7 as set out in the appendix to the report; (b) That the Board confirms (as required by the Town and Country Planning (Development Management Procedure) (England) Order 2010 (as amended) that in dealing with the application the County Council worked in a positive and proactive manner, taking account of paragraphs 186 and 187 of the National Planning Policy Framework.
