1 Scope The purpose of this Bylaw is to set standards of control that must be observed by dog owners. It covers matters such as dogs in public places, wandering dogs, ownership of more than one dog, and nuisances caused by dogs. This Bylaw is not the only or major control document for dog owners. The Dog Control Act 1996 also addresses various issues such as registration, barking dogs, dogs attacking people or stock and other matters. The Dog Control Bylaw is made pursuant to the provisions in the Dog Control Act 1996 and the Local Government Act 1974. Both the Bylaw and the Act allow for legal action with consequent fines. 2 Definitions and interpretation For the purpose of this Bylaw, the following definitions shall apply: The Act means the Dog Control Act 1996 Beach means that part of the District below the vegetation line adjoining the coast and being the part of the coastal environment usually comprised of sand, shingle, stones, rock, water, pebbles or shells and any combination of such materials and includes the foreshore The Bylaw means the Dog Management Bylaw 2012 Chief Executive Officer means the person appointed as chief executive officer of Council pursuant to section 42 of the Local Government Act 2002 Council and the Council means Whangarei District Council. Council’s contractor means such person who is appointed by Council as Council’s contractor for the purpose of this Bylaw. Disability Assist Dog means a dog certified by one of the following organisations as being a dog trained to assist (or as being a dog in training to assist) a person with a disability: a Hearing Dogs for Deaf People New Zealand; or b Mobility Assistance Dogs Trust; or c New Zealand Epilepsy Assist Dogs Trust; or d Royal New Zealand Foundation of the Blind; or e Top Dog Companion Trust; or f An organisation specified in an Order in Council made under section 78D of the Dog Control Act. District means the territorial district administered by Council. Foreshore means any land covered and uncovered by the flow and ebb of the tide at mean spring tides. Owner in relation to any dog, means every person who: a Owns a dog b Has the dog in his or her possession, whether the dog is at large or in confinement, otherwise than for a period not exceeding 72 hours for the purpose of preventing the dog causing injury, damage, or distress, or for the sole purpose of restoring a lost dog to its owner, or c The parent or guardian of a person under the age of 16 years who: i Is the owner of the dog pursuant to paragraph (a) or paragraph (b) of this definition; and ii Is a member of the parent or guardians household living with and dependent on the parent or guardian

d But does not include any person who has seized or taken custody of the dog under the Act or the Animal Welfare Act 1999 or the National Parks Act 1980; or e The Conservation Act 1987 or any order made under the Act. Public Place means a place that, at any material time, is open to or is being used by the public, whether free or on payment of a charge, and whether any owner or occupier of the place is lawfully entitled to exclude or eject any person from that place. Registered means registered with Council for the current registration year as required by the Act. Sports Playing Field means an area line marked or otherwise marked for the purposes of playing organised sports. Working dog means: a Any disability assist dog b Any dog: i Kept by the Police or any constable, the Customs Department, the Ministry of Agriculture, the Ministry of Fisheries or the Ministry of Defence, or any officer or employee of any such Department of State solely or principally for the purposes of carrying out the functions, powers, and duties of the Police or the Department of State or that constable, officer, or employee; or ii Kept solely or principally for the purposes of herding or driving stock; or iii Kept by the Department of Conservation or any officer or employee of that Department solely or principally for the purposes of carrying out the functions, duties, and powers of that Department; or iv Kept solely or principally for the purposes of destroying pests or pest agents under any pest management strategy under the Biosecurity Act 1993; or iv-a Kept by the Department of Corrections or any officer or employee of that Department solely or principally for the purposes of carrying out the functions, duties, and powers of that Department; or iv-b Kept by the Aviation Security Service established under section 72B(2)(ca) of the Civil Aviation Act 1990, or any officer or employee of that Service solely or principally for the purposes of carrying out the functions, duties, and powers of that Service; or iv-c Certified for use by the Director of Civil Defence Emergency Management for the purposes of carrying out the functions, duties, and powers conferred by the Civil Defence Emergency Management Act 2002; or v Owned by a security guard as defined in section 4 of the Private Investigators and Security Guards Act 1974 and kept solely or principally for the purposes of carrying on the business of a security guard; or vi Declared by resolution of Council to be a working dog for the purposes of this Act, or any dog of a class so declared by the authority, being a dog owned by any class of persons specified in the resolution and kept solely or principally for the purposes specified in the resolution. For the purposes of this standard, the word ‘shall’ refers to practices that are mandatory for compliance with this standard while the word ‘should’ refers to practices which are advised or recommended. 3 Dogs to be under control at all times The owner or any person in charge or having control of any dog, shall keep such dog securely tied up or otherwise effectively confined or under his/her direct control. 4 Shelter Every owner of a dog shall ensure that the dog is provided with adequate shelter and that no suffering is caused to the dog by the manner of the shelter.

5 Areas where dogs are prohibited, dog exercise areas and areas where dogs must be on a leash 5.1 Dog prohibition areas The owner of a dog shall not cause, permit or allow such dog to enter or remain in or on any part of any street or public place declared by resolution of Council to be subject to the provisions of this clause unless such dog is being carried in a vehicle. The streets and public areas as resolved from time to time shall be detailed in Schedule A of this part of the Bylaw. 5.2 Dog Exercise areas The owner of a dog may run their dog off a leash in or on any part of any public place declared by resolution of Council to be subject to the provisions of this clause as long as owner has in his/her possession a hand held leash and the dog is under continuous and effective control at all times. The public areas as resolved from time to time shall be detailed in Schedule B of this part of the Bylaw. 5.3 Leash control areas The owner of a dog shall not cause, permit or allow such dog to enter or remain in or on any part of any public place declared by resolution of Council to be subject to the provisions of this clause unless such dog is being carried in a vehicle or is at all times on a hand held leash. The streets and public areas as resolved from time to time shall be detailed in Schedule C of this part of the Bylaw. 5.4 Exemption The prohibitions provided for in subclause (1) (2) and (3) hereof shall not apply in respect of registered guide disability assist dogs or Police dogs or any registered dogs taking part in a dog obedience class or exercise or a competition organised by a club or association and conducted with the written consent of Council. 5.5 Dogs in vehicles An officer may require the owner of any dog that is being carried in a vehicle in a public place to remove the dog from the public place area if the officer considers the dog to be a nuisance due to reasons of noise or aggressive behaviour. 6 Control of dogs wandering including on private property Any person shall commit an offence against this Bylaw if they fail to keep any dog under continuous and effective control. Any dog found not under continuous and effective control in any public place may be seized and detained by any authorised officer, or by a person employed by Council in that public place. 7 Infected dogs The owner or person in charge of any dog shall not allow any dog which is: a infected with any infectious disease, or b a bitch on heat. To take the dog or permit or suffer the dog to enter or remain in any public place. 8 Dogs becoming a nuisance or injurious to health The owner of any dog or the owner or occupier of any premises whereon any dog or dogs are customarily kept shall take adequate precautions to prevent the dog or dogs, or the keeping thereof, from becoming a nuisance or injurious to health.

If, in the opinion of Council, the dog or dogs or the keeping thereof on such premises has become or is likely to become a nuisance or injurious to health, Council, or any other person duly authorised on that behalf by Council, may by notice in writing, require the owner or occupier of the premises within a time specified in such notice to do all or any of the following: a reduce the number of dogs kept on the premises b construct, alter, reconstruct or otherwise improve the kennels or other buildings used to house or contain such dog or dogs c require such dog or dogs to be tied up or otherwise confined during specified periods d to clean and keep clean the dog kennel and associated area e take such other action as Council deems necessary to minimise or remove the likelihood of nuisance or injury to health. Any person to whom notice is given under the preceding provisions of this clause who fails to comply with such notice within the time herein specified shall commit an offence against this part of this Bylaw. 9 Causing dogs to become unmanageable Any person shall commit an offence against this Bylaw who behaves so as to cause any dog in any street, private street, or public place to become restive or unmanageable. 10 Dogs fouling public areas Where any dog defecates in any public place or private way or land or premises other than that occupied by the owner of the dog, that owner must remove the faeces forthwith and dispose of it in a hygienic manner. 11 Conviction and fines Every person commits an offence under this part of the Bylaw who fails, refuses or neglects to do anything required to be done, or does anything prohibited by these Bylaws, and is liable to: a the penalty provisions of section 683 of the Local Government Act 1974 b any other penalty pursuant to the Dog Control Act 1996, or c be served with an infringement notice pursuant to section 66 of the Dog Control Act 1996.

Schedule A Dog prohibition areas The following areas are designated as dog prohibited areas: . All Council Buildings including Forum North and all public libraries . All marked sportsfields . All cemeteries (unless otherwise authorised by the Chief Executive Officer in writing) Central Business District as indicated in Appendix 1 (map A) attached hereto All wetlands including but not limited to: . Kioreroa Road wetlands situated on the western side of Kioreroa Road . Barge Park wetlands Matakohe/Limestone Island All bush reserves including but not limited to: . Pukenui Forest including Western Hills . Mt. Aubrey, high track only . Parihaka reserve between the Hatea walkway and the Parihaka memorial, . AH Reed Park and excluding bush reserves identified in Schedule B Kensington Park Children’s Play Areas Conservation Ban areas (see maps at Appendix 1) The foreshore at the following locations:

Bland Bay/Teparapara From the northern promontory of Teparapara Bay around North Head Scenic Reserve to the northern end of Bland Bay at intersection where the sand meets the rock outcrop. Around Motokauri Island. Bream Head/Ocean Beach From the Urquharts Bay car park around the Bream Head reserve coast to the southern end of Ocean Beach adjacent to the rocks opposite Bream Islands. From the northern promontory on main use beach to the northern extremities opposite Awaroa rock. All estuarine areas upstream of both Matapouri bridges (western side of the road). Mimiwhangata Coastal From Taiwawe Bay to Pareparea Bay. Around Rimiriki and Wide Berth Islands. Park /Horahora From the sign and post at the western edge of Ngunguru River Public Reserve on the south side of the Ngunguru river/estuary, around the peninsular to the southern side of the Horahora River mouth, including the Horahora River estuary One Tree Point From the edge of the Oil Refinery, along Marsden Bay, past the Marsden Cove Marina to the end of the beach. Ruakaka From the Ruakaka estuary mouth up to Biller Road and where the estuary intersects with State Highway 1. Includes shaded water areas. Waipu From the Tip Road beach entrance south to the northern end of Camp Waipu Cove, back around the western side of the Waipu Wildlife Refuge to the northern side of the Waipu River mouth. Includes the shaded water areas. Whananaki From the Whananaki pedestrian bridge on the southern side of the Whananaki estuary and on to the open coast to Pitokuku Point and along Otamure Bay.

Summer beach dog prohibition All beaches between the hours of 9am to 5pm on any day during the period from and including 20 December in any one year to 31 January in the following year excluding:  the beach at Ruakaka lying between the eastern end of Mair Street Ruakaka and finishing at a line drawn directly eastward across Ruakaka Beach from the eastern end of Taotahi Walk, Ruakaka such being shown generally in Appendix 2 attached hereto.

 The beach at Uretiti lying between Tip Road and finishing at a line drawn directly eastwards across Ruakaka beach from the southern point of the Uretiti Camp ground block. Note Dog owners are also advised that DOC has rules in respect to dog access on reserves. Appendix 4 details these rules.

This is a guide to where dogs are permitted on public conservation lands managed by the Department of Conservation in the Whangarei District. Conservation lands are places where New Zealand’s unique plants, animals and heritage are protected. Please help us look after our native wildlife by taking your dog only to approve d dog areas.
