1. Purpose of Report

To seek Committee approval to take up the option available in the existing Waste Disposal Contract with Shanks Waste Services Limited of Coatbridge, to extend the contract period for the initial period of three years from 1"ApriI 2002 for a further two years.

2. Backqround

An existing contract for the provision of a waste disposal service (QANVD19911) with Shanks Waste Services Limited of Coatbridge, commenced on 1'' April 2000 for the disposal of waste at Riggend and Greengairs Sites, with an option available to the Council to extend the contract for a further two years.

Since the original contract was signed, there have been a number of legislative and policy changes made which influence waste disposal arrangements. The Local Government in Scotland Act 2003 requires the Council to produce an integrated plan for approval by the Minister. Work is underway in connection with the plan and this will be reported to Committee in due course.

On 24'h February 2003, the Scottish Executive and SEPA published the National Waste Plan 2003. This strategy sets landfill reduction targets to be met by 2010, 2013 and 2020. Over the longer term, it is intended to reduce landfilling of municipal waste from around 90% to 30%. Two interim targets were set to reflect the short term need to focus on municipal waste, these are to increase the amount of waste collected by local authorities which is recycled or composted to 25% by 2006 and to reduce landfilling of collected by local authorities to 1.5 million tonnes per year by 2006.

The legislative environment concerning landfill has also changed significantly. The Landfill (Scotland) Regulations 2003, currently in draft, are expected to be finalised soon. These regulations will implement the EU requirements which will require Landfill Site Operators to ensure that their charges for waste disposal cover a number of areas, including the costs of setting up and operating and costs for closure and aftercare of landfill sites, for a period of at least 30 years from their closure.

In order to increase the quantity of waste recycled, North Lanarkshire Council has been diverting a proportion of the waste which was originally landfilled in terms of this contract to the Shanks Waste Services Limited materials re-processing facility at Blochairn in Glasgow, since January 2002. Shanks Waste Services Limited have indicated that they would wish to negotiate the contract terms as a consequence of the new landfill legislation and the arrangements in place to increase of a proportion of the municipal waste.

It is proposed that North Lanarkshire Council should negotiate the terms of the extension of the existing contract with Shanks Waste Services Limited for provision of waste disposal services. The negotiation would recognise the implications of new landfill legislation and the National Waste Plan 2003.

4. Sustainabilitv Considerations

The intention in the revised arrangements would be to move to a more sustainable option with a larger proportion of the waste recycled.

5. Corporate Considerations

The financial and legal implications of the revised Waste Management Contract arrangements will be discussed with the Director of Finance and the Director of Administration.

6. Recommendations

It is recommended that:-

(a) That approval is given to take up the option to extend the existing contract for disposal of waste at Riggend and Greengairs Landfill Sites for a period of two years from 1"ApriI 2003. (b) That approval is given to negotiate the terms of the contract with the existing Contractor. (c) That approval is given to advertise for expressions of interest in the provision of longer term waste management options, in conjunction with other local authority partners where appropriate. (d) That the outcome of the contract negotiations for the provision of these short term arrangements and the proposed arrangements for the provision of an integrated waste management strategy be the subject of further reports to the Council in due course.
