Childers Date Approved: April 10, 2017 ii Abstract This dissertation project offers an historical perspective on news media response to mass violence. More specifically, my dissertation traces associations between mental illness and dangerousness as articulated in the aftermath of rampage shootings. Drawing from rhetorical and reception history methodologies, I investigate the discursive aftermath of four notable rampage shootings: the 1949 neighborhood shooting in Camden, New Jersey; the 1984 McDonald’s shooting in San Ysidro, California; the 1991 Luby’s shooting in Killeen, Texas; and finally the 2012 movie theater shooting in Aurora, Colorado. An analysis of news media reports in the aftermath of these shootings reveals the extent to which journalists used fear and stigma associated with the mentally ill as a justification or explanation for the violence. Over time, watching for signs of mental illness became the primary narrative in responses to mass shootings in contemporary American culture. As such, mental illness links the public’s desire to know, or understand, mass violence with the public’s desire to control, or prevent, mass violence. The case studies presented in this dissertation demonstrate that for the American news media and its audience, mental illness has become one of, if not the, primary warning signs of mass shootings. Ultimately, however, accusations of madness and stigmatization of the mentally ill often prevent effective policy change. I believe it is the job of rhetorical scholars to recognize, investigate, and expose the political and ideological commitments underpinning cultural understandings and policy decisions. Indeed, the pervasive use of mental illness in news media as the justification for violence suggests that any benefits of advocacy campaigns and other anti- stigma initiatives cannot be fully realized without substantive changes in news media production habits. iii Acknowledgements Contrary to what my advisor would say, a dissertation does not necessarily start with a question. Indeed, a good question does matter. But I believe a dissertation starts long before a question is formed. It starts in the classes we take, the colleagues we meet, and the events we attend. That being said, there are so many people who have contributed to the success of this dissertation project. Writing a dissertation is hard. It is a labor of love—a product of an unwavering desire to achieve a dream. In this section, I want to say thank you to the many individuals who gave up their time and offered their guidance in the completion of this project. First and foremost, I want to thank my advisor, Dr. Jay Childers. For those who know me, it would come as little surprise that I am a rather demanding pupil; I pride myself on my time management skills and far too often focus on research-product over research-process. Despite these faults, Jay found a way to help me grow as both a scholar and a person. Although his methods were, at times, frustrating and his feedback piercing, his dedication to my success was resolute. Jay was always available to think through a research question, talk through an argument, or, all too often, provide resources to improve my grammar skills. My parents fielded tearful calls about the impossibility of finishing this project, cheered on my successes, patched the wounds of rejection, and, from time to time, sent along a little money to buy some chocolate to make the writing process a little sweeter. It is not often I am unable to find the words to express adoration or appreciation, but when it comes to my mom and dad, there are no words, in any language, that can grasp the immense gratitude and love I have for their unwavering support. I owe them everything. My sisters, Amanda and Kristina have also been instrumental to finishing this project. Kristina read through countless chapter drafts, reigning in the grammatical errors and troubleshooting ideas or arguments I was failing to articulate clearly. Amanda supported and encouraged me as each deadline was met and goal was achieved. She also helped by letting me video chat with my adorable nephews, Westin and Caleb.     America’s Background Check System and Ways to Improve It The Brady Campaign to Prevent Gun Violence In the aftermath of the horrific shooting at Marjory Stoneman Douglas High School on February 14, 2018, and the massacres in Sutherland Springs and Las Vegas in late 2017, the background check system and how it works has once again become the subject of public attention. That system exists because of the tireless work of Jim and Sarah Brady. Congress enacted the Brady background check system despite fierce opposition from the National Rifle Association (NRA). This system is the best and greatest defense America has against access to guns by dangerous people. It seems that consensus can be reached on few things in Washington, but this is one where consensus is almost unanimous: 97 percent of Americans believe that the background check system should be fortified.1 The question before policy makers today is how to best strengthen this system, which has already blocked more than 3 million attempts to buy guns by people barred under law from having them.2 This report provides those answers, along with some key facts as to why the system needs improvements and the fixes that address those needs. Real change in the National Instant Criminal Background Check System (NICS) requires: (1) Closing the legal gaps that today result in at least one in five guns being sold without a background check; (2) providing greater funding to state, tribal, and federal agencies for inputting records into the system; and (3) ensuring state, tribal, and federal agencies take greater responsibility for inputting all relevant records into the system in a timely manner by becoming more directly involved in conducting background checks themselves.

Seung-Hui Cho murdered 32 people, wounded 17 others, and took his life at Virginia Polytechnic Institute that day. Although many critical details surrounding the event were unknown or unclear immediately after it took place, local and national media outlets published as much information as possible, even at the risk of inaccurate reporting. For example, one of the first reports published by the media after the rampage described “unimaginable horror as some students were lined up against a wall and shot” by the gunman, who was supposedly not a student and was looking for his girlfriend (Hauser & O’Connor). It was later confirmed that the shooter was 23-year-old Virginia Tech student Seung-Hui Cho, who was not only classified as mentally ill, but was also deemed “an imminent danger to self and others” by a district court in Montgomery County, Virginia, in December of 2005 (Effron).

BARRING IMMORAL SPEECH IN PATENT AND COPYRIGHT Ned Snow* ABSTRACT In the past three years, the Supreme Court has twice ruled that Con- gress’s moral bars to trademark protection violate the First Amendment. Those rulings raise a simple question in other areas of intellectual property. Does the First Amendment preclude Congress from denying patent or cop- yright protection based on a moral reason? Congress, for instance, might deny patent protection for inventions directed toward the consumption of marijuana. Inventors would accordingly choose not to disclose knowledge about those inventions to the public, and the denial would chill their speech. Similarly, Congress would chill speech if it denied copyright pro- tection for moral reasons. A copyright bar to statues of the Confederacy, for instance, would deter artists from speaking such content. Hence, through patent and copyright, Congress might seek to influence speech in accord with its moral viewpoint.

Their support has never waned and without them, none of my accomplishments are possible. iii Abstract Extremist Manifestos: Mass Shooters’ Understanding of Law, Politics, and Crime A subset of mass shooters writes manifestos which outline the rationale for their intended violence. Most scholarly assessments focused on the psychological perspective of the shooters (Hamlett 2017; Knoll 2012; Bondü & Schneithauer 2015). Instead, this thesis considers the shooters’ socio-legal imagination as offered in their manifestos, focusing on their understanding and construal of crime, law, and politics. Most of these shooters portray their violence as a form of justice in an unjust world.
