REPORT BY THE DIRECTOR OF INFRASTRUCTURE SERVICES

Abstract: This report recommends that the Committee notes the applications detailed in Appendix 1 of the report determined by the Head of Planning and Transport in accordance with the Scheme of Delegation detailed in Standing Orders.

1.0 RECOMMENDATION

1.1 The Committee is asked to note the applications, detailed in the Appendix, determined under delegated powers.

2.0 INTRODUCTION

2.1 In terms of the Scheme of Delegation to officers, the Head of Planning and Transport is authorised to approve planning applications in accordance with the Development Plan, the Local Plans or established policies and where there are no objections, except those which raise a general issue affecting a large area, or are of major land or economic development significance. The Head of Planning and Transport is further authorised to refuse minor planning applications that are clearly contrary to planning policies (e.g. illuminated signs, satellite antennae, certain householder applications, etc).

3.0 DELEGATED DECISIONS

3.1 Attached as an Appendix is a list of 57 applications determined under delegated authority during the period 31 March 2008 to 22 April 2008.

4.0 FINANCIAL IMPLICATIONS

4.1 There are no financial implications.

5.0 HUMAN RIGHTS IMPLICATIONS

5.1 There are no Human Rights issues arising directly as a result of this report.

The scheme shall thereafter be implemented in accordance with the approved scheme prior to the occupation of the development hereby permitted.

7 That prior to the commencement of the development, details of the means of site enclosure and boundaries to each of the residential units proposed to be used, shall be submitted for the written approval of the planning authority and be erected on or before completion of the development. The approved scheme shall be implemented.

8 That prior to commencement of the development hereby approved, samples of the roof and external wall finishes be submitted to and approved in writing with the Planning Authority. The approved scheme shall thereafter be implemented prior to occupation of the any part of the development hereby approved.

Conditions

1 That this grant of express consent shall operate for a period of 5 years from the date of the granting of consent.

2 That all advertisements displayed and any land used for the display of advertisements shall be maintained in a clean and tidy condition to the reasonable satisfaction of the Planning Authority.

3 That any hoarding or similar structure or any sign, placard, board, or device erected or used principally for the purpose of displaying advertisements shall be maintained in a safe condition to the reasonable satisfaction of the Planning Authority.

4 That where any advertisement is required under these regulations to be removed the removal thereof shall be carried out to the reasonable satisfaction of the Planning Authority.

Conditions

3 The access to the site shall be located at the existing breach in the road side hedge.

4 The verge crossing at the proposed access shall be formed and constructed in accordance with the standards of Angus Council.

5 A minimum of two car parking spaces shall be provided within the site curtilage.

6 Turning space shall be provided with the site curtilage to allow vehicles to enter and leave in a forward gear.

7 That the proposed foul drainage system for the proposed development shall be undertaken to the satisfaction of the Building Control Authority and SEPA.

4 No demolition or development shall take place prior to a photographic survey being undertaken by the developer and approved by the planning authority. All elevations, both internal and external, together with the setting of the building, and any unusual feature/s, shall be photographed and clearly annotated on a plan. Photographs, which should be digital on CD, shall be clearly marked with place name for identification, national grid reference and planning reference and deposited in the local Sites and Monuments Record.

5 That the proposed protective barriers and hinged protective barriers are not approved as part of this permission unless otherwise agreed in writing with the planning authority.

07/01346/FUL West Residential Ltd Erection of Four Dwellinghouses Within Walled Garden at:- House Walled Garden Tealing Angus

Conditions

1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission.

2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the Planning Authority.

3 That the proposed foul drainage system for the proposed development shall be undertaken to the satisfaction of the Building Control Authority and SEPA and implemented in accordance with those approved prior to occupation of the dwellinghouse hereby approved.

4 That details be submitted for the written approval of the planning authority of a scheme for the management and future maintenance of rainwater runoff within the site (SUDS). The agreed scheme shall thereafter be implemented prior to the occupation of any dwellinghouse. If the scheme falls outwith the site an application shall be made for planning permission for the same. The SUDS scheme shall be fully implemented in accordance with the technical standards of SEPA.

5 That prior to the commencement of development a detailed specification of proposed landscaping and boundary treatments shall be submitted to and approved in writing by the planning authority. The approved scheme shall thereafter be implemented.

6 That all planting comprised in the approved details of landscaping be carried out in the first planting season following the completion of the development or at earlier stages and any plants or trees which within a period of 5 years from the commencement of the use die; are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species.

7 That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 as amended, the permitted development rights provided by Classes 1,3 and 7 are hereby removed unless otherwise agreed in writing with the planning authority.

8 That the roof and external wall finishes shall be agreed in writing the Planning Authority prior to development commencing. The agreed scheme shall thereafter be implemented prior to occupation of the approved dwellinghouses.

9 That prior to the commencement of development, a methods statement shall be submitted to the Planning Authority for written approval detailing the materials to be used (including type of mortar) in creating the returns in the listed wall. The approved scheme shall be implemented prior to occupation of the dwellinghouse.

10 Prior to any works commencing, the developer shall secure the implementation of an archaeological standing building survey Level 1 of the extant structures, to be carried out by an archaeological organisation acceptable to the planning authority. The scope of the archaeological standing building survey will be set by the Aberdeenshire Council Archaeology Service on behalf of the planning authority. The name of the archaeological organisation retained by the developer shall be given to the planning authority and to the Aberdeenshire Archaeology Service in writing not less than 14 days before the survey commences. Copies of the resulting survey shall be deposited in the National Monuments Record for Scotland and in the local Sites and Monuments Record upon completion.

11 Prior to the commencement of development, visibility sightlines of 3.0 x 70 metres shall be provided on each side of the proposed access at its junction with the public road.

12 Within the above splays nothing shall be erected or planting permitted to grow to a height in excess of 1050mm above the adjacent road channel.

13 The verge crossing at the proposed access shall be improved to form a new bellmouth junction with kerbed radii of 6 metres and a minimum throat width of 5.5 metres. The access shall be constructed in accordance with the standards of Angus Council.

14 That no works in connection with the development hereby approved shall take place unless a detailed levels survey of the site has been submitted to and approved in writing by the planning authority. The detailed drawings shall show finished ground and floor levels of the proposed development relative to existing ground levels and a fixed ordnance datum point.

3 That details of the roof and wall colour shall be submitted for the prior written approval of the Planning Authority and thereafter implemented in full accordance with the approved details prior to completion of the development.

Conditions

1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission.

2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the Planning Authority.

3 That prior to the development hereby approved being brought into use, the footway crossing at the access shall be altered to meet with the current standards of Angus Council.

4 That the development hereby approved shall not be brought into use unless a turning space has been formed within the site curtilage which will allow service vehicles to enter and leave in forward gear. Once formed the turning space shall be permanently retained as such unless otherwise indicated in writing by the Planning Authority.

5 That the development hereby approved shall not be brought into use unless one Sheffield type cycle stand has been provided within the site curtilage.

6 That no development in connection with the planning permission hereby approved shall take place unless full details of the proposed means of disposal of surface water from the development have been submitted to and approved in writing by the Planning Authority. Unless otherwise agreed in writing by the Planning Authority, surface water shall be disposed of via the use of Sustainable Urban Drainage Systems and the development shall not be occupied unless the agreed drainage system has been provided in its entirety.

7 That no works in relation to the development hereby approved shall take place unless a scheme of hard and soft landscaping works has been submitted to and approved by the Planning Authority. Details of the scheme shall include:

(i) Existing and proposed ground levels and finished floor levels relative to a fixed datum point; (ii) Existing landscape features and vegetation to be retained; (iii) The location of new trees, shrubs, hedges and grassed areas; (iv) A schedule of plants to comprise species, plant sizes and proposed numbers and density; (v) The location, design and materials of all hard landscaping works including walls, fences and gates

All soft landscaping proposals shall be carried out in accordance with the approved scheme and shall be completed during the planting season immediately following the commencement of development or such other date as may be agreed in writing with the Planning Authority. Any planting which, in the opinion of the Planning Authority within a period of five years from the completion of development, is dying, being severely damaged or becoming seriously diseased, shall be replaced by plants of similar size and species to those originally required to be planted.

Conditions

Conditions

1 That no development in connection with the planning permission hereby approved shall take place unless full details of the siting, design, external appearance and landscaping of the development and the means of access serving the development (hereinafter referred to as the “Reserved Matters”) have been submitted to and approved by the Planning Authority.

2 That application for approval of reserved matters shall be made to the Planning Authority within 3 years beginning with the date of this outline planning permission

3 That the development hereby granted shall be begun on or before whichever is the latest of the following dates:

(a) The expiration of five years beginning with the date of the outline planning permission; or (b) The expiration of two years from the final approval of the reserved matters or in the case of approval of different dates, the final approval of the last such matters to be approved.

6 That development in the site be limited to single storey development only.

7 That the number of dwelling units within the site be limited to one only.

8 That development in the site shall fully comply with the parameters contained within Angus Council Advice Note 14: Small Housing Sites.

9 That no works in connection with the development hereby approved shall take place unless a detailed levels survey of the site has been submitted to and approved in writing by the planning authority. Conditions

1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission.

2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the Planning Authority.

3 That the rainwater run-off from roofs and hard surfaces be directed to a soakaway system to the satisfaction of the Building Standards Authority.

4 That the disposal of sewage effluent be in accordance with the standards required by both the Building Control Authority and the Scottish Environment Protection Agency.

5 Prior to any works commencing, the developer shall secure the implementation of an archaeological building survey Level 1 of the extant structures, to be carried out by an archaeological organisation acceptable to the planning authority. The scope of the archaeological standing building survey will be set by the Aberdeenshire Council Archaeological Service on behalf of the planning authority. 11 That prior to the commencement of development the colour of the timber cladding be agreed in consultation with the Planning Authority.

12 That precise details of the style of window to be utilised be submitted to and approved by the Planning Authority prior to installation.

13 That no development takes place until there has been submitted to and approved by the Planning Authority, a scheme of landscaping.
