1 Vérité ou droit - La défense Lincoln de Michael Connelly N’y a-t-il pas quelque chose de dérangeant, de pathétique même, chez les individus qui identifient, hâtivement et sans réflexion, « droit et vérité »; qui glorifient sans raison et sans discernement la notion de droit, ou encore l’idée et la « réalité » hypothétique d’un droit qu’ils ne connaissent aucunement (et qu’ils n’ont pas, fort heureusement pour eux, envie de connaître non plus), et ceci parce qu’ils croient, sans jugement et avec la foi du charbonnier, que ladite notion coïncide avec une vérité, métaphysique ou transcendante; ou qui, par un atavisme culturel si typiquement occidental, leur ayant si solidement lavé le cerveau, identifient, en se remémorant les récits du droit naturel classique ou du positivisme juridique, la notion de droit avec la notion de vérité pour, par ce biais, opportunément effectuer le couronnement d’une troisième notion, à savoir celle de justice. Comme si les deux notions avaient quelque chose de commun, quelque chose les ayant rapproché l’une de l’autre, là où ne s’agit que de deux notions antagonistes fonctionnant en principe ensemble mais jamais en concert, sinon en représentant, de façon plus réaliste, l’antithèse l’une de l’autre. Cela laisse songeur. Et il faut, par principe, réfléchir sur ce qui nous laisse songeur.
