Texas1 declared that morality, absent third-party harm, is an insufficient basis for criminal legis- lation that restricts private, consensual sexual conduct.2 In a strongly worded dissent, Justice Scalia declared that this “called into question” state laws against obscenity (among others), as such laws are “based on moral choices.”3 Justice Scalia does not specifically reference Miller v. Califor- nia,4 the last case in which the Supreme Court directly addressed the issue of whether the government may suppress obscenity. However, if, as Justice Scalia suggests, obscenity laws have their primary basis in private morality, the governing case that permits such laws must countenance such a moral basis. The logical conclusion is that Lawrence calls Miller, which provides the legal test for determining obscenity, into question.5 ∗ John M. Olin Fellow in Law, Harvard Law School. What is patriarchy? What and who is a woman? How does gender relate to sexuality, and to class and race? Should housework be waged, should sex be for sale, and should feminists trust the state? This course is an introduction to feminist political thought since the mid-twentieth century. It introduces students to classic texts of late twentieth-century feminism, explores the key arguments that have preoccupied radical, socialist, liberal, Black, postcolonial and queer feminists, examines how these arguments have changed over time, and asks how debates about equality, work, and identity matter today. We will proceed chronologically, reading texts mostly written during feminism’s so-called ‘second wave’, by a range of influential thinkers including Simone de Beauvoir, Shulamith Firestone, bell hooks and Catharine MacKinnon. We will examine how feminists theorized patriarchy, capitalism, labor, property and the state; the relationship of claims of sex, gender, race, and class; the development of contemporary ideas about sexuality, identity, and gender; and how and whether these ideas change how fundamental problems in political theory are understood. 1 Course Requirements: Undergraduate students: 1. Participation (25%): a. Class Participation (15%) Class Participation is an essential part of making a section work. Participation means more than just attendance. Remarks by Redstockings speaker Marisa Figueiredo Shulamith Firestone Memorial September 23, 2012 In 1978, at the age of 16, while In high school, I lived in Akron, Ohio. I went to to the public library on weekends and on one shelf were three books in a row that changed my life forever and are the reason I am here today: Simone de Beauvoir's The Second Sex, Shulamith Firestone's The Dialectic of Sex The Case for Feminist Revolution, and Redstockings' Feminist Revolution. With my consciousness raised to the point of passionately identifying myself as a radical feminist in the tradition each book represented, I ardently wanted to connect with Shulamith Firestone and Redstockings , so I wrote to both. I heard back from Redstockings, not Shulamith, and since 1984, I have been active in Redstockings. On May Day in 1986, Redstockings organized a Memorial for Simone de Beauvoir and I felt deeply honored when asked by Kathie Sarachild to read Shulamith's Firestone's tribute she had sent to the Memorial. It was several sentences in Shulamith's beautiful handwriting saying that Simone de Beauvoir had fired her youthful ambitions at age 16 and my heart was pounding as I read it, because Shulamith had fired my youthful ambitions at age 16, too! In the early 1990s, Kathie Sarachild introduced me to Shulamith Firestone, and I remember immediately feeling Shulamith's intensity of observation and perception of details unnoticed by others. All this despite her physical vulnerability that overwhelmed me, which I soon learned from her, resulted from side effects of her medication and a recent hospitalization. -

MacKinnon on sex and sexuality has often been posed as adversary to the development of queer theory. Leo Bersani, in particular, is critical of the normative ambitions of their work, which he sees firstly as trying to ‘redeem’ sex acts themselves, and secondly as advocating for sexuality as a site of potential for social transformation. In this article, I argue that this is a misreading of their work. Drawing on Dworkin’s wide body of writing, and the early Signs essays of MacKinnon, I suggest that their work makes no such case for sex or sexuality. Rather, by bringing their analysis into conversation with Halberstam’s recent work on ‘shadow feminism’, I contend that Dworkin and MacKinnon’s anti- social, anti-pastoral and distinctly anti-normative vision of sex and sexuality shares many of the same features of queer theory, ultimately advocating for sex as ‘irredeemable’. -

Sie hatte schon vorher Freude an kreativen Praktiken gehabt (wie Weben und Stricken). In ihrer neuen Aktivität fand sie etwas befriedigendes, was sie sehr er- füllt. Ihre ersten Stickereien waren Buchstaben, vor allem aus dem Sajou-Alphabet. Als ich die sah, kam mir eine Idee. Gemeinsam dachten wir über eine fruchtbare Zusammen- arbeit nach, die unsere beiden jeweiligen Hobbys vereinen könnte. Was wäre, wenn sie meine eigenen Schriften stickte? Um diese Idee umzusetzen, entwickelte ich für meine Schrift Arthemys Display Light eine neue Version, die es meiner Mutter ermöglichte, die Formen auf ein spezielles Gewebe (namens Aïda) zu übertragen. Dieser Prozess erfordert eine binäre Sprache, genau wie Pixel auf einem Computer. Die Buchstaben werden also Punkt für Punkt gedacht und akribisch zusammengesetzt. Das geht weg von dem Ge- danken einer vektorisierten Form, die nur durch ihre Umrisse definiert wird. Vielmehr muss die Form in ihrer gesamten Fläche aufgebaut werden, wie mit Legosteinen! Auf dieser Grundlage konnte meine Mutter die verschiedenen Buch- staben bauen, indem sie einfach dem Raster des Gewebes folgte. Sicherlich war dieser Prozess ziemlich aufwendig und verlangte eine Menge Geduld ab, aber meine Mutter -

Big Hollywood names like James Franco and Rashida Jones are jumping on the bandwagon, using their influence and resources to invest in a type of audiovisual knowledge production far less mainstream than that in which they usually participate. The films that have resulted from this new movement are undoubtedly persuasive, no matter which side of the debate over pornography these directors have respectively chosen to represent. Moreover, regardless of the side(s) that audience members may have taken in the so-called “feminist porn debates,” one cannot ignore the rhetorical strength of the arguments presented in a wide variety of documentaries about pornography. -

Thats 25% of all daily searches (IFR, 2006). The sex industry is largest and most profitable industry in the world. “It includes street prostitution, brothels, ‘massage parlors’, strip clubs, human trafficking for sexual purposes, phone sex, child and adult pornography, mail order brides and sex tourism – just to mention a few of the most common examples.” (Andersson et al, 2013) In 2010, 13% of global web searches were for sexual content. This does not include P2P downloads and torrents. (Ogas & Gaddam) Pornhub receives over 1.68 million visits per hour. (Pornhub, 2013) Globally, teen is the most searched term. A Google Trends analysis indicates that searches for “Teen Porn” have more than tripled between 2005-2013, and teen porn was the fastest-growing genre over this period. Total searches for teen-related porn reached an estimated 500,000 daily in March 2013, far larger than other genres, representing approximately one-third of total daily searches for pornographic web sites. (Dines, 2013) The United States is the top producer of pornographic dvds and web material; the second largest is Germany: they each produce in excess of 400 porn films for dvd every week. Internet porn in the UK receives more traffic than social networks, shopping, news and media, email, finance, gaming and travel. -

Book Review: Ratna Kapur's Erotic Justice: Law and the New Politics of Postcolonialism London: GlassHouse, 2005. Pp. vi, 219. Ryan Charles Gagliot Nietzsche observed that the commonest stupidity consists of forgetting what one is trying to do.' As Ratna Kapur argues in Erotic Justice: Law and the New Politics of Postcolonialism, political activism's continued reliance on liberal and Western feminist agendas evinces an absence of deep thinking, in turn unwittingly reinforcing the hegemony and subordination it means to challenge. In this collection of essays, Kapur draws from postcolonial feminist legal theory to critique the misguided causal logic of liberalism, which mistakenly assumes that "more rights lead to more freedom and greater equality." 2 Examining law and political activism, Kapur concludes that, unless modem postcolonial society is understood as the site of an historical, discursive struggle informed by the colonial past, steadfast allegiance to the rights project of liberalism risks perpetuating the subordination of oppressed subaltern groups under the illusive panacea of universal rights.3 Kapur uses her analysis of the condition of Indian women, transnational migrants, and sexual subalterns- groups marginally situated in and subordinate to hegemonic Indian culture-to interrogate the broader agenda of liberalism and Western feminism. This agenda ostensibly endeavors to protect third-world "victims," but, instead, Kapur argues, it tends to offer legal protection on terms that paradoxically reinforce normative and essentialist assumptions of gender, culture, and agency-thus perpetuating the very subordination and victimization it seeks to remedy. But Erotic Justice not only challenges the politics of liberalism and Western feminism by exposing the limitations of the rights project; Kapur's collection of essays goes a step further and asks what the basis of political activism should be without the comfort of liberalism's clear yet misguided Yale Law School, J.D. -

She was sixtyseven, and she had battled schizophrenia for decades, surviving on public assistance. There was no food in the apartment, and one theory is that Firestone starved, though no autopsy was conducted, by preference of her Orthodox Jewish family. Such a solitary demise would have been unimaginable to anyone who knew Firestone in the late nineteensixties, when she was at the epicenter of the radicalfeminist movement, Firestone, top left, in 1970, at the beach, surrounded by some of the same women who, a reading “The Second Sex”; center left, with month after her death, gathered in St. Mark’s Gloria Steinem, in 2000; and bottom right, Church IntheBowery, to pay their respects. in 1997. Devlin FRSC Follow this and additional works at: https://digitalcommons.schulichlaw.dal.ca/scholarly_works Part of the Law and Gender Commons, and the Law and Philosophy Commons Devlin: Transformation or Resistance 167 Feminism may pose the opportunity to conceptualize and nourish another, emancipatory side of power, a side that expands our horizons rather than curtails them, a side that nurtures our personhood rather than stultifies it, a side that fosters care for our inherent human dignity rather than inflaming· the festering sores of "anxious privitism"216 and possessive individualism. 217 Feminism, rather than working within and thereby reproducing the androcentric interpretation/imposition of power, may be able to challenge the very meaning of power itself. Difference,with its substantive emphasis on the ethic of care, may fit with this alternative conception of power. However, because of her unidimensional conception of power, MacKinnon understands "difference" as "powerlessness" rather than "power to".218 Although MacKinnon is correct to point out that, historically, the awareness of difference has operated to women's disadvantage, and that women's caring role has been part of their strategy forsurvival, we must be careful not to make this into an essentialist thesis that difference = domination/subordination. Such an approach ignores the factor of human - particularly male - agency in making this correlation. But, again, what has been socially constructed by males is capable of being ( de)reconstructed by females and profeminist males.
