Chairman CHAFFETZ. The Committee on Oversight and Govern- ment Reform will come to order. And, without objection, the chair is authorized to declare a recess at any time. I appreciate you all being here for our hearing, ‘‘Ensuring Trans- parency Through the Freedom of Information Act.’’ We have just completed votes on the floor, and I am sure we will have some members as they hustle back here to the hearing, but I wanted to get started. We have a very distinguished couple of panels. We appreciate those that are participating and sharing their perspectives with us. I would remind the committee that we are not only the Oversight Committee but we are also Oversight and Government Reform. The goal of these hearings is to come to a place where we can actually reform this process so that it works, no matter who is in the White House, no matter what administration is there, that we get this part of the equation right. My passion for this comes from the idea that government should be open and transparent. It is what separates the United States of America from everybody else. We are self-critical. We do take things and look back, and sometimes those things are a little bit embarrassing. But because it might be a little bit embarrassing is not enough to withhold information from the public and the public’s right to know. It is the heart of what we do as a com- mittee, it is what we are supposed to be doing as the United States Congress, and it is what we are supposed to be doing as a country. And nothing makes government more accountable than making its actions open and transparent to those that are paying the bills. And, clearly, in retrospect, look- ing back with 20/20 vision, you can go back with great clarity, but that is why it is important to do this and understand. A request for FOIA must simply be in writing and reasonably de- scribe the records being requested. That is it. That is the way, at least, it should be. But navigating the FOIA process is complicated and varies across government agencies. Something like 550,000 times in just the time since I have served in Congress, which is the same time that President Obama took office, 550,000 times FOIAs were rejected because there was some sort of exemption that took place. Some of the questions I sent went to the heart of her book-in-progress, so she declined to answer them. However, her answers to my other questions were revealing and explosive. I know you’ve had problems with your Wikipedia page. What happened there? Long story short: there is a concreted effort by special interests who exploit Wikipedia editing privileges to control my biographical page to disparage my reporting on certain topics and skew the information. Judging from the editing, the interest(s) involved relates to the pharmaceutical/vaccine industry. I am far from alone. There is an entire Wikipedia subculture that exists to control pages and topics, and another one that watchdogs all that’s gone wrong with Wikipedia (Wikipediocracy).

    TIMELINE: Congressional Oversight in the Face of Executive Branch and Media Suppression: The Case Study of Crossfire Hurricane 2009 FBI opens a counterintelligence investigation of the individual who would become Christopher Steele’s primary sub-source because of his ties to Russian intelligence officers.1 June 2009: FBI New York Field Office (NYFO) interviews Carter Page, who “immediately advised [them] that due to his work and overseas experiences, he has been questioned by and provides information to representatives of [another U.S. government agency] on an ongoing basis.”2 2011 February 2011: CBS News investigative journalist Sharyl Attkisson begins reporting on “Operation Fast and Furious.” Later in the year, Attkisson notices “anomalies” with several of her work and personal electronic devices that persist into 2012.3 2012 September 11, 2012: Attack on U.S. installations in Benghazi, Libya.4 2013 March 2013: The existence of former Secretary of State Hillary Clinton’s private email server becomes publicly known.5 May 2013: o News reports reveal Obama’s Justice Department investigating leaks of classified information and targeting reporters, including secretly seizing “two months of phone records for reporters and editors of The Associated Press,”6 labeling Fox News reporter James Rosen as a “co-conspirator,” and obtaining a search warrant for Rosen’s personal emails.7 May 10, 2013: Reports reveal that the Internal Revenue Service (IRS) targeted and unfairly scrutinized conservative organizations seeking tax-exempt status.8

    Testimony of Sharyl Attkisson, Sinclair’s Full Measure Nonpartisan Investigative Journalist December 3, 2020 I’ve been a nonpartisan journalist for nearly 40 years in local news, CNN, CBS, PBS and the national station group Sinclair. I’ve watched a dramatic devolution in our industry as we’ve allowed ourselves to be transformed itself into tools of political and cooperate interests pushing narratives, manipulating and shaping information on the news and online, and seeking to shape public opinion rather than report facts and various views. In this media landscape, we’ve allowed some of the biggest and most important stories of our time to be covered in a fantastical and one-sided, often inaccurate and incomplete way, while important violations of law and constitutional rights go unchallenged. Tools of intelligence-gathering and law-enforcing, which are meant to protect Americans, are routinely used to instead spy on them, to gather information that isn’t the government’s business, and, in some instances, it appears, to punish or silence those with whom they disagree — personal and political foes, in and out of government. And partly because the news media has dropped the ball, they are unaccountable, operating in an extra-constitutional structure that continues from administration to administration meaning this is not a partisan issue. We have to confront the fact that our intelligence structure and some inside our federal agencies have proven more powerful than Congress, the legislative or judicial branches… have become more influential with the media... and have proven largely immune from prosecution and oversight. Even the President of the United States— whoever it may be— who appoints the leaders in this structure, who directs the national priorities, who serves as commander in chief— plays second fiddle to this structure.

    Crushed by COVID-19 Medical Bills, Coronavirus Victims Need Debt Relief Under the Bankruptcy Code and Workers’ Compensation Laws Creola Johnson* ABSTRACT After the U.S. declared COVID-19 a pandemic, cracks in the U.S.’s fragile privatized healthcare system were exposed. At the start of the pandemic, 74 million U.S. residents were already uninsured or underinsured. To date, over 7.7 million recently terminated employees have lost their employer-provided health insurance, while over 24.6 million individuals have been infected with COVID-19 and 800,000 have been hospitalized. As a result, coronavirus survival often comes with astronomical medical bills like the $1.1 million hospital bill received by Michael Flor, a 70-year-old survivor who spent 62 days in the hospital for treatment. This Article examines how the U.S.’s flawed healthcare system and federal bankruptcy law may work together to unfairly penalize debtors burdened with medical debts arising from treatment for an infectious disease, like COVID-19. The financial fate of many burdened with infectious-disease medical bills will depend on whether a court characterizes such bills as “consumer” debts. Under the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, individuals with “primarily consumer debts” are subject to a complex calculation known as the “Means Test.” Debtors who have their massive medical bills characterized as non-consumer debts are allowed to wipe out those bills quickly in a Chapter 7 case. Debtors who have such bills characterized as consumer debts and who fail the Means Test are forced into a five-year repayment plan in a Chapter 13 case, where they pay down their unsecured debts, including medical bills.

    MEMO FOR THE MOVEMENT Conservatives Oppose H.R. 1, the Ultimate Fantasy of the Left January 28, 2019 Washington, DC Conservatives are united in opposing H.R. 1, the attempt by House Democrats to fundamentally undermine the American electoral system. While they cloak the bill in terms of “restoring democracy” and “preventing corruption,” the legislation has one goal: to protect incumbents, at the expense of the First Amendment, federalism, and individual voter integrity. H.R. 1 undermines the First Amendment. H.R. 1 undoes key Supreme Court cases that protect elections as fundamental to free speech. It would allow the Federal Election Commission to track and catalogue more of what Americans are saying, register even very small political donations, and make public those who donate to different charitable and nonprofit organizations. The legislation will subject private citizens to intimidation and harassment for their private and political beliefs, far broader than what was done in the IRS targeting scandal in 2013. H.R. 1 yanks election authority away from the states. H.R. 1 reasserts the ability of the federal government to micromanage state elections through a process known as “preclearance.” Preclearance, which was previously overturned by the Supreme Court, requires states to get permission from the federal government for changes as small as modifying the hours of an election office, or moving a voting location from a school gym to the library. Critically, none of these practices would undo any fraud or corruption. Rather, these same practices result in incorrect registrations and inaccurate voter data, while failing to address actual corrupt practices like ballot harvesting.

Suite 600 Washington, D.C. 20007 Dear Ms. Mitchell: It has come to our attention that you sent a memorandum dated September 21, 2011 to the Board of Directors of the American Conservative Union on which you serve.1 In it, you made certain representations concerning specific, serious charges by Frank J. Gaffney, Jr. concerning the conduct of Grover Norquist and Suhail Khan. These charges relate specifically to their ties to and activities in support of Islamists inside the United States, including the Muslim Brotherhood, its operatives, front groups and agendas. The following were among your representations: Because of the serious nature of Mr. Gaffney’s allegations against Suhail and in my role as a board member of and/or counsel to several leading conservative groups, I un- dertook to read all the materials that Mr. Gaffney furnished to me. I have also re- viewed the videos, DVDs and power point presentation that Mr. Gaffney provided as “evidence” of Suhail’s role(s) in these various Muslim extremist organizations refer- enced in Mr. Gaffney’s materials. While there was substantial material regarding the activities of the various organizations, there was absolutely nothing contained in any of the materials that in any way linked Suhail (or Grover) to such organizations or their activities. I repeatedly asked Mr. Gaffney ‘where is the evidence of any relationship between these organizations and Suhail Kahn?’ He never provided a single fact or any docu- mentation that would tie Suhail to any Muslim extremist organization.
