Autorka artykułu wśród najważniejszych uwarunkowań wymienia: regulacje prawne harmonizujące prawo polskie i unijne, społeczny postulat równości w dostępie do dystrybuowanych dóbr i świadczeń społecznych, oczekiwania par starających się o dziecko i cierpiących z powodu niepłodności. W wyniku analizy tych trzech fundamentalnych uwarunko- wań autorka stwierdza, że największy i najbardziej znaczący wpływ spośród anali- zowanych uwarunkowań ma kwestia równości dostępu do świadczeń, a właściwie jej braku. Stawia ponadto tezę, że powszechny dostęp obywateli do pomocy państwa w korzystaniu z medycznie wspomaganej prokreacji niesie korzystne skutki zarów- no dla państwa, jak i dla jego obywateli (w wymiarze demograficznym, gospodarczym, emerytalnym i społecznym). Zapewnianie i promowanie równości w dostępie oby- wateli do medycznie wspomaganej prokreacji jest wyzwaniem dla rozwoju społe- czeństwa demokratycznego państwa prawa. SŁOWA KLUCZOWE niepłodność, medycznie wspomagana prokreacja, dostęp do medycznie wspomaga- nej prokreacji, równość w dostępie do świadczeń społecznych 10 MAGDALENA DEBITA __________________________________________________________________________________________________________________________________________________________________________________________________________________________________ Wstęp W artykule podjęto problematykę psychospołecznych uwarunkowań i skut- ków dostępu obywateli do medycznie wspomaganej prokreacji w Polsce. Psychospołeczne uwarunkowania wiążą się w pierwszej kolejności z har- monizującymi prawo polskie i prawo unijne regulacjami prawnymi w dzie- dzinie medycznie wspomaganej prokreacji, jako że prawo to ważny element porządkowania stosunków społecznych1. Wśród przywołanych uwarunko- wań znajduje się także społeczny postulat gwarantowania przez państwo równości w dostępie do dystrybuowanych dóbr i świadczeń społecznych – tu świadczeń polityki prorodzinnej. Wspomniane uwarunkowania dotyczą też oczekiwań oraz potrzeb samych par dążących do posiadania dziecka, a potrzebujących pomocy w tej dziedzinie za pośrednictwem medycznie wspomaganej prokreacji. Celem artykułu jest przedstawienie najważniejszych zjawisk, które mogą być konsekwencją ograniczenia obywatelom prawa do równości w dostępie do medycznie wspomaganej prokreacji w Polsce w połowie drugiej dekady XXI wieku. Istotne staje się też zaprezentowanie, w jaki sposób można rozumieć, a także przyporządkować zasadę równości do sfery uprawnień obywateli w kwestii korzystania z usług przypisanych do medycznie wspomaganej prokreacji. Za podobnie ważną uznano potrzebę przedstawienia zarówno głównych niekorzystnych skutków dyskryminacji par, jak również efektów postawienia obywateli przed problemem nierówności w dostępie do me- dycznie wspomaganej prokreacji. W artykule przyjęto ponadto tezę, że skutki powszechnego dostępu obywateli do pomocy państwa w obszarze medycznie wspomaganej pro- kreacji mogą być pozytywne, prowadząc do poprawy dzietności w państwie i zabezpieczenia przyszłych potrzeb społecznych (na przykład emerytal- nych), podczas gdy ograniczenie dostępu i równości obywateli rodzi szereg niekorzystnych skutków, zarówno indywidualnych (dla osób i par), jak i sys- temowych (dla państwa). Uściślić należy, że ze względu na fakt, iż prawo krajowe w zakresie do- stępu do in vitro zostało już przez autorkę omówione w innym artykule, poniższe rozważania skupione będą wokół prawa unijnego. 1 W artykule pominięto dokładną analizę krajowych regulacji prawnych w przed- miocie medycznie wspomaganej

    “Carry on, but don’t get caught”- Margaret Thatcher, British State collusion and the murder of Pat Finucane By Dr Stephen Kelly The decision on behalf of the Council of Europe to re-open a case concerning the murder of prominent Belfast solicitor Pat Finucane in 1989 has resurrected a fiercely contested debate surrounding the extent of collusion between the British state and Loyalist paramilitaries during Margaret Thatcher’s premiership, writes Stephen Kelly. On 12 March 2021, at a meeting of the Council of Europe, attended by government officials of its 47 member states, Europe’s leading human rights body announced its decision to re- open Finuance’s case. This move ensures that the body will monitor how the United Kingdom addresses ‘the fact there has never been an adequate investigation into the 1989 shooting’.1 This decision on behalf of the Council of Europe comes less than four months after the British government’s announcement, on 30 November 2020, not to order a public enquiry into Finucane’s murder at the hands of the Ulster Defence Association (UDA)/Ulster Freedom Fighters (UFF) in February 1989. Although Brandon Lewis, secretary of state for Northern Ireland, has previously acknowledged state collusion and apologised to the Finucane family, speaking in the House of Commons in November of last year, he stipulated that there would be no inquiry into Finucane’s murder pending a new review conducted by the Police Service of Northern Ireland (PSNI).     British Politics and Policy at LSE: Margaret Thatcher, state collusion, and the murder of Pat Finucane Page 1 of 2 Margaret Thatcher, state collusion, and the murder of Pat Finucane The UK government’s recent decision not to establish a public enquiry into the 1989 murder of Belfast solicitor Pat Finucane has resurrected a contested debate surrounding the extent of collusion between the British state and Loyalist paramilitaries during Margaret Thatcher’s premiership. Stephen Kelly discusses some of the evidence surrounding this case. On 30 November 2020, Brandon Lewis, secretary of state for Northern Ireland announced that the British government had decided not to order a public enquiry into the 1989 murder of Belfast solicitor Pat Finucane at the hands of Ulster Freedom Fighters (UFF). Accusations of alleged collusion existed long before Thatcher’s arrival at No. 10 Downing Street. During the mid-1970s, for example, the British security forces and Loyalist paramilitaries were allegedly involved in a series of horrendous acts of violence, including murder. These included the Dublin-Monaghan bombings in 1974 and the Miami Showband killings in 1975.

After importing a British Army colonel last week, Assistant U.S. Attorney Richard Stearns called on a Special Branch Inspector from Dublin and an RUC constable as prosecution witnesses. Gardai Inspector Dermot Jennings testified on Wednesday that he had not yet been promoted from detective sergeant when he found the Clondalkin letters in Peter Maguire's garage during Operation Mallard in October 1987. The operation was a nationwide search of 50,000 homes throughout the 26 counties. The inquiry must comply with national and international standards including those set out in the UN Manual on the Effective – 2 – Prevention and Investigation of Extra-legal and Summary Executions . These standards require that such an inquiry be: a) independent of all government agencies accused or alleged to be culpable by omission or commission; b) empowered to compel testimony and the production of documents; c) transparent; d) empowered to exhaustively investigate all of the unresolved allegations of collusion by government agents; and e) empowered to recommend appropriate prosecutions.
