TO PROVIDE CABLE SERVICE TO THE TOWN OF CORNWALL AND APPROVING A CABLE FRANCHISE AGREEMENT WITH CHARIER COMMUNICATIONS, INC. WHEREAS, the Town of Cornwall (the "Town") is a franchising authority in accordance with Title VI of the Communications Act of 1934 (the "Communications Act"), and is authorized to grant cable television franchises pursuant to Article 11 of the New York State Public Service Law, and Title 16, Chapter VIII, of the Official Compilation of Codes, Rules and Regulations of the State of New York (the "Cable Laws"); WHEREAS, CHARIER COMMUNICATIONS, INC, ("Charter") is upgrading its existing telecommunications and information services network pursuant to authority under Section 27 of the New York Transportation Corporations Law and Title II of the Communications Act, and Charter desires to use its network to provide cable service in the Town; WHEREAS, Charter submitted a written application for a cable television franchise to the Town (the "Charter Application"), which the Town has reviewed; WHEREAS, due negotiations between the Town and Charter have resulted in a proposed "Cable Franchise Agreement between the Town of Cornwall and Charter Communications, Inc.," which proposed agreement was filed with the Town on May 14, 2018 ("Charter Franchise Agreement"); and WHEREAS, the New York State Public Service Commission has sole jurisdiction over any SEQRA proceedings in this matter; and WHEREAS, on May 14, 2018 at a regularly scheduled Town Board meeting a public hearing was held on the proposed Charter Franchise Agreement at which members of the Town Board, Charter and the public were given notice and opportunity to comment; ' NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Cornwall finds that it approves the character of Charter; and be it FURTHER RESOLVED, that the Town Board fords that Charter is legally, technically, and financially and otherwise qualified to meet the cable-related needs and interests of the Town and will meet all statutory and regulatory non-discrimination requirements; and be it FURIHJLR RESOLVED, that the Town Board finds that although the terms of the proposed Charter Franchise Agreement are not identical to those of the franchise agreement with the incumbent operator, the terms of both agreements contain no economic or regulatory burdens which when taken as a whole are greater or lesser than those burdens placed upon one another; and be it DRAKE LOEB'"' 555 Hudson Valley Avenue, Suite 100, New Windsor, New York 12553 Phone: 845-561-0550 RTBM 5-14-18 FUR 111ER RESOLVED, that the Town Board authorizes the award of a non-exclusive franchise to Charter to own, construct, operate and maintain a cable system along the public rights-of-way within the unincorporated area of the Town, except for that area served by Frontier in the western part of the Town, in order to provide cable service, which authorization is made in accordance with the applicable provisions of Title VI of the Communications Act and the Cable Laws; and be it • FURTHER RESOLVED, that the Town Board authorizes the Supervisor of the Town to enter into a franchise agreement with CHARIER COMMUNICATIONS, INC., in a form approved by the Town Attorney, and to, execute any other documents necessary to effectuate the ranting of the franchise on behalf of the Town of Cornwall. Petitioner PMCM TV, LLC obtained a license from the Federal Communications Commission to operate television station WJLP in northern New Jersey on radio-frequency channel 3, the same radio-frequency channel used by PMCM’s predecessor station in Nevada. However, the FCC assigned WJLP virtual channel 33, the channel to which viewers tune their televisions in order to watch WJLP. The FCC did this to protect the “Channel 3” brand identity of intervenor broadcasters that already used virtual channel 3 in service areas that overlapped with that of WJLP. For similar reasons, the FCC refused to require cable operators to carry WJLP on cable television as “Channel 3.” PMCM seeks review of both decisions.

AND CABLEVISION SYSTEMS CORPORATION Pursuant to the Media Bureau's Public Notice, DA 14-1298 (rel. Sept 12, 2014), Time Warner Cable Inc. ("TWC") and Cablevision Systems Corporation ("CSC") hereby submit the following joint reply comments on the above-referenced Request for Declaratory Ruling of Meredith Corporation and "Alternative PSTP Proposal" of PMCM TV, LLC, licensee of Station WJLP(TV) (formerly known as KVNV(TV)). The issue at the heart of both Meredith's Declaratory Ruling request and PMCM's Alternative PSIP Proposal is whether WJLP should be assigned PSIP channel 33 (as proposed by Meredith) or the two-part PSTP channel starting with 3 .10 (as proposed by PMCM). The interest of TWC and CSC in this channel assignment dispute arises from the fact that it would be extremely disruptive· and confusing for cable subscribers if cable operators in the New York OMA were required to begin carrying WJLP on cable channel 3 (thereby necessitating the relocation of other services) only to have to move the station (necessitating further movement of other channels) if it ends up being assigned PSIP channel 33. Recognizing that the public interest would not be served by the disruption and confusion that would result if cable operators commenced carrying WJLP on one channel and then moved it to another cable channel, the Media Bureau issued a "Deferral Order" on July 25, 2014, excusing cable operators in the New York DMA from having to comply with PMCM's carriage and channel positioning elections until 90 days after the date of a "final decision" regarding WJLP's PSIP channel assignment.

The station announced this morning, during a special ceremony in Lower Manhattan, that its signal will be powered by the most powerful, solid-state broadcast transmitter ever constructed. “This is a significant achievement. Telemundo 47’s over-the-air broadcast signal has become the very first to resume transmission from One World Trade Center. We are particularly proud that Telemundo 47 - a Spanish language television station – was the first television station in the market to do so,” said Cristina Schwarz, Telemundo 47 President and General Manager. “This pioneering moment became possible through the leadership of the best engineering and technology team in television, as well as through a great partnership with The Durst Organization.” Only twelve linear feet in size, Telemundo 47’s over-the-air transmitter is powered by 66 kilowatts of cutting-edge technology. This power will provide Telemundo 47 with the largest coverage area of any television station in the New York market. Later this year, the transmitter will also power the over-the-air signal from sister station NBC 4 New York / WNBC, which is preparing to relocate its transmission facilities to One World Trade Center.
