Proposed Waiting Restrictions, Chiltern Drive & Pennine Way Subject of Report Verwood

Executive Summary Following the advertising of proposed changes to parking restrictions in various roads in Verwood, objections have been received to the proposals for Chiltern Drive. This report considers those objections, and whether the proposals in Chiltern Drive should be implemented as advertised.

Impact Assessment: Equalities Impact Assessment: The proposed waiting restrictions will have the usual exemption for disabled badge holders.

Budget:

The cost of making the Order is estimated at £2500 inclusive of advertising charges.

Recommendation That having considered the objections received, Cabinet be recommended to approve the proposed waiting restrictions on Chiltern Drive with a minor amendment.

1 Background

1.1 Proposals were advertised for public consultation on 17 July 2015 for a change to waiting restrictions in Verwood. The only objections received were to the proposed No Waiting restrictions in Chiltern Drive Verwood. This report considers those objections.

1.2 Chiltern Drive is part of a large cul-de-sac of three roads servicing approximately 150 houses and Morrisons Superstore located on the south-eastern side of Verwood town centre. The Superstore was re-developed in 2014 which resulted in changes to the layout of access from the road.

1.3 Before the re build of the Superstore some restrictions already existed along Chiltern Drive. Appendix 1, shows the existing restrictions on a base map showing the site before it was redeveloped.

2 Information

2.1 The existing restrictions allow those residents in Cotswold Close who do not have off street parking to park in Chiltern Drive.

2.2 The advertised proposals included a “No Waiting at Any Time” restriction, also shown in Appendix 1. This proposed restriction would remove all parking in and around the new entrance to the Superstore and allow for the safe movement of all traffic to the Superstore and the new petrol station including the petrol tankers making deliveries to the petrol station. It would also keep the lower part of Chiltern Drive free for general deliveries to the Superstore which is further north along Chiltern Drive.

3 Law

3.1 Sections 1 and 2 of the Road Traffic Regulation Act 1984 allow the County Council to make an Order prohibiting or restricting the waiting of vehicles or the unloading of vehicles. The circumstances where an Order may be made include:

For avoiding danger to persons or other traffic using the road;

For facilitating the passage on the road of any class of traffic.

3.2 The Local Authorities’ Traffic Orders (Procedure) ( and Wales) Regulations 1996 provides that an order making authority may modify an advertised order, whether in consequence of any objections or otherwise, before it is made. Where the modifications appear to make a substantial change to the proposals, further notification is required.

4 Consultation

4.1 Under Dorset County Council’s procedure, primary consultation was carried out on the proposed scheme and is supported by the Local Members for Verwood & Three Legged Cross, East Dorset District Council, Verwood Town Council and the Police.

4.2 There have been two responses to the public consultation process, which are summarised below. One objection to the proposals is from a resident of Cotswold Close who regularly parks in Chiltern Drive and one objection is for other reasons.

Resident of Cotswold Close, Objects to the proposed yellow lines. He has no off-street parking so parks in Chiltern Drive which is a short walk from Verwood his property where he has lived since 1982.

Resident of Cartref Close, Objects to the proposed yellow lines in as much that they do not go far enough along Chiltern Drive and the surrounding Verwood roads. Traffic has increased since he moved to Cartref Close 28 years ago.

4.3 The resident from Cotswold Close who objected to the proposed restrictions has no off street parking and so parks in Chiltern Drive which is a short walk from his property where he has lived since 1982. He has requested that we remove a section of the proposed “No Waiting at Any Time” on the western side of Chiltern Drive and replace it with limited waiting of 1 hour between 8.30am and 5.00pm This would at least allow him to still park near his house in the evenings as shown in appendix two.

4.4 The resident from Cartref Close who objected to the proposed restrictions believes that the restrictions should also be applied further along Chiltern Drive and the surrounding roads as traffic has increased since he moved to his property 28 years ago.

4.5 Of the two responses received, it is considered that the proposal put forward by the resident of Cotswold Close is a reasonable compromise to the original proposal. This proposal will still prevent parking around the new entrance to the Superstore, which in turn should allow traffic to flow in and out of the Superstore entrance. The proposal put forward by the resident of Cartref Close for more restrictions along Chiltern Drive and the surrounding roads is not considered appropriate. These are not through roads so all the traffic relates to the homes in the area.

4.6 It is proposed that the advertised proposals are modified to change a short length of no waiting at any time becomes waiting limited to one hour between 8.30am to 5.00pm. This modification is not considered to be a substantial change and further notifications not considered necessary.
