    Southwest Florida District 9 DRAFT Comprehensive Emergency Management Plan for Hazardous Materials 2020 RESOLUTION: 2020-01 RESOLUTION OF THE SOUTHWEST FLORIDA LOCAL EMERGENCY PLANNING COMMITTEE, APPROVING THE REGIONAL HAZARDOUS MATERIALS EMERGENCY PLAN WHEREAS, with the enactment of the Emergency Planning and Community Right-To Know Act of 1986, Congress imposed upon Local Emergency Planning Committees and local governments additional planning and preparedness requirements for response to emergencies involving the release of hazardous materials; and WHEREAS, a Local Emergency Planning District is required to develop an Emergency Response Plan for Hazardous Materials to become a component part of the State Emergency Planning District Plan; and WHEREAS, The Southwest Florida Local Emergency Planning Committee's Hazardous Materials Emergency Plan will be reviewed by the Florida State Emergency Response Commission for Hazardous Materials as meeting the criteria for such plans established by the Administrator, United States Environmental Protection Agency and the National Response Team; and WHEREAS, this plan is intended to provide the framework for the development of detailed operating procedures by first response public safety agencies charged with the responsibility of protecting the public's health and safety from the discharge or release of extremely toxic chemicals. By Report and Order, FCC 58-573, Power Limitations of Class IV Stations, 17 RR 1541 (1958), released June 2, 1958, the Commission increased the maximum permissible daytime power for Class IV AM broadcast stations from 250 watts to 1 kilowatt. This action was taken in response to a petition for rule making filed April 3, 1956 by Community Broadcasters Association, Inc. ("CBA"), an organization representing Class IV AN stations. The across-the-board approach to the power increase was chosen to improve reception of these stations while maintaining their existing coverage areas. CBA also had petitioned for a power increase at night as well, but this could not then be pursued because of international treaty constraints. Recent international developments have suggested that these international restrictions against increasing nighttime power will likely be removed at an early date.

The best expression of this condition is found in the story behind the development and proliferation of digital audio broadcasting (DAB). Radio is the last of the traditional mass media to navigate the convergence phenomenon; convergence itself has an inherently disruptive effect on traditional media forms. However, in the case of radio, this disruption is mostly self-induced through the cultivation of communications policies which thwart innovation. A dramaturgical analysis of digital radio’s technological and policy development reveals that the industry’s preferred mode of navigating the convergence phenomenon is not designed to provide the medium with a realistically useful path into a 21st century convergent media environment. Instead, the diffusion of “HD Radio” is a blocking mechanism proffered to impede new competition in the terrestrial radio space. HD Radio has several critical shortfalls: it causes interference and degradation to existing analog radio signals; does not have the capability to actually advance the utility of radio beyond extant quality/performance metrics; and is a wholly proprietary technology from transmission to reception.

    STATE OF MINNESOTA CAMPAIGN FINANCE AND PUBLIC DISCLOSURE BOARD Findings and Order in the Matter of the Complaint of Steven Timmer Regarding the King Banaian and KYCR Radio Summary of the Complaint and Response On August 5, 2010, the Campaign Finance and Public Disclosure Board (the Board) received a complaint from Steven Timmer regarding King Banaian (“Respondent”), a candidate for the House of Representatives in District 15B. Mr. Banaian’s principal campaign committee registered with the Board as the “King Banaian for House” committee (“the Committee”). The Complaint The allegations of the complaint may be summarized as follows: An organization named Salem Communications owns two radio stations in Minnesota. One broadcasts on AM 1280 and goes by the call letters WWTC, and carries the trade name “The Patriot”. The other broadcasts on AM 1570 and goes by the call letters KYCR. King Banaian had a weekly radio program on WWTC named The King Banaian show. At some point the program moved to KYCR where it continues to be produced and aired. The King Banaian Show is broadcast live on Saturday mornings and is repeated on Sundays in a recorded version. It is also available online in a version that may be played on demand. After he became a candidate for the House of Representatives, Mr. Banaian continued to host his radio program. KYCR includes on its website this statement regarding The King Banaian Show: King Banaian is an economist and a professor who forecasts the central Minnesota economy and has consulted governments in several foreign countries. The show looks at economic and financial news and business trends, explaining economics and political economy for the investor, the entrepreneur, and those just interested in economics with a bit of political insight.
