Abstract The constitutional placement of the vice president as the president of the Senate is a unique feature of the chamber. It places control over the Senate's rules and precedents under an individual who is not elected by the chamber and receives no direct benefits from the maintenance of its institutions. We argue that this feature has played an important role in the Senate's development. The vice president has frequently acted in a manner that conflicted with the wishes of chamber majorities. Consequently, senators have been reluctant to allow cham- ber power to be centralized under their largely unaccountable presiding officer. This fear has prevented the Senate from allowing its chair to reduce dilatory action, as the House has done. Accordingly, delay via the filibuster, has become commonplace in the Senate. Such delay has reduced the Senate's efficiency, but has largely freed it from the potential influence of the executive branch. -

The first will be a great and total eclipse, on Friday March 15th, at 9h. 28m. morning, but by reason of the moon's south latitude, her shadow will not touch any part of North America. The course of the general eclipse will be from southwest to north- east, from the Pacific Ocean a little west of Chili to the Arabian Gulf and southeastern part of the Mediterranean Sea. The termination of this grand and sublime phenomenon will probably be witnessed from the summit of some of those stupendous monuments of ancient industry and folly, the vast and lofty pyramids on the banks of the Nile in lower Egypt. The principal cities and places that will be to- tally shadowed in this eclipse, are Valparaiso, Mendoza, Cordova, Assumption, St. Salvador and Pernambuco, in South America, and Sierra Leone, Teemboo, Tombucto and Fezzan, in Africa. At each of these places the duration of total darkness will be from one to six minutes, and several of the planets and fixed stars will probably be visible. 2. The other will also be a grand and beautiful eclipse, on Satur- day, September 7th, at 5h. 35m. evening, but on account of the Mnon's low latitude, and happening so late in the afternoon, no part of it will be visible in North America. -

Upon learning of the soldiers’ absences the British military took local physician, Dr. William Beanes, and two other residents into custody and threatened to burn Upper Marlboro if the British soldiers were not returned. John Hodges, a local attorney, arranged the soldiers’ return to the British military. For this, Hodges was charged with high treason for “adhering to [the] enemies, giving them aid and comfort.” The resulting jury trial was presided over by Justice Gabriel Duvall, a Supreme Court Justice and Prince Georges County native, and highlights how the crime of treason was viewed in early American culture and the role of the jury as deciders of the facts and the law in early American jurisprudence. Contextually, Hodges’ trial took place against the backdrop of the War of 1812 and was informed by the 1807 treason trial of Aaron Burr. Introduction to the Ratification of the Constitution in Maryland Founding the Proprietary Colony The founding and establishment of the propriety government of Maryland was the product of competing factors—political, commercial, social, and religious. It was intertwined with the history of one family, the Calverts, who were well established among the Yorkshire gentry and whose Catholic sympathies were widely known. George Calvert had been a favorite of the Stuart king, James I. In 1625, following a noteworthy career in politics, including periods as clerk of the Privy Council, member of Parliament, special emissary abroad of the king, and a principal secretary of state, Calvert openly declared his Catholicism. This declaration closed any future possibility of public office for him. Shortly thereafter, James elevated Calvert to the Irish peerage as the baron of Baltimore. Calvert’s absence from public office afforded him an opportunity to pursue his interests in overseas colonization. Calvert appealed to Charles I, son of James, for a land grant.1 Calvert’s appeal was honored, but he did not live to see a charter issued. In 1632, Charles granted a proprietary charter to Cecil Calvert, George’s son and the second baron of Baltimore, making him Maryland’s first proprietor. Maryland’s charter was the first long-lasting one of its kind to be issued among the thirteen mainland British American colonies. Proprietorships represented a real share in the king’s authority. They extended unusual power. Maryland’s charter, which constituted Calvert and his heirs as “the true and absolute Lords and Proprietaries of the Region,” might have been “the best example of a sweeping grant of power to a proprietor.” Proprietors could award land grants, confer titles, and establish courts, which included the prerogative of hearing appeals. -

From incorporation in 1796 the municipal government's evolution has been indicative of this process. From its inception the city government has been dominated by the mayor and city council. The records of these chief administrative units, spanning nearly the entire history of Baltimore, are among the most significant sources for this city's history. This guide is the product of a two year effort in arranging and describing the mayor and city council records funded by the National Historical Publications and Records Commission. These records are the backbone of the historical records of the municipal government which now total over three thousand cubic feet and are available for researchers. The publication of this guide, and three others available on other records, is preliminary to a guide to the complete holdings of the Baltimore City Archives scheduled for publication in 1983. During the last two years many debts to individuals were accumulated. First and foremost is my gratitude to the staff of the NHPRC, most especially William Fraley and Larry Hackman, who made numerous suggestions regarding the original proposal and assisted with problems that appeared during the project. -

These actions have made the Senate a less efficient chamber, but have largely freed it from the potential influence of the executive branch. We examine these arguments using a mix of historical and contemporary case studies, as well as empirical data on contentious rulings on questions of order. -
