LAND TENURE SYSTEMS IN ESWATINI • Swazi Nation Land (SNL) - Accounts for 75% of the land which is used for grazing, cropland and homesteads.

• SNL is held in trust for the Swazi Nation by His Majesty the King, entrusts about 350 Princes, Chiefs and their inner councils with day-to-day administration and management of the land • Title Deed Land (TDL).

• Since the majority of Eswatini Citizens do not own land, but have only user rights, security of tenure is low.

• Agricultural Commercialization is therefore compromised (the land cannot be used as collateral).

• Livelihood improvement and food and nutrition security is also compromised .

• Land resources are under increasing pressure which is driven by • a growing population • the rising demand for inter alia irrigated agriculture, industrial forestry, livestock grazing, biodiversity conservation, • uncontrolled rural settlement

• The main technical issue is the absence of an effective land administration and management system (cadastre) that can be used by all land-related organizations.

• Under traditional management and administration the record of land assignment rests with the memory of the Chief and his council members. • .

• • When land is allocated, the chief or his representative walks the boundary and lays markers that delineate the area. • These are normally respected by all members of the community. • Chiefdom and homestead boundaries are not cadastralised. • Herein lies the core of the challenge of land administration and management in the Kingdom of Eswatini. • This Project seeks to support the Kingdom in addressing this challenge through strengthening the analytical tools and capacity necessary for sustainable land administration and management thus bringing together traditional and modern systems

Overall objective of the project is to improve food security and land access for the rural poor.

Purpose is to provide tools and capacity for sustainable land administration at Chiefdom level but also at constituency, regional and national levels.

› Result 1: Tools are developed and used for more efficient Land Administration of Swazi Nation Land at National and level.

› Result 2: Relevant stakeholders capacitated to use the cadastre and manage Swazi Nation Land more efficiently and sustainably.

Expected results (1) Tools are developed and used for more efficient land administration at chiefdom and Constituency level.

Activities (in 4 pilot areas): Tenure responsive land use mapping Data collection (homestead allocations, households, etc.) Land records validated by and kept in the chiefdom Outcomes: Identify and record homestead areas Raise awareness of benefits and use of land information Increase accessibility of land information

Expected results (2) Educating, training and building capacity of users of land and cadastral information to manage Swazi Nation Land more efficiently and sustainably

Activities: Process mapping and streamlining Preparation of guidelines and manuals Training (mainly training of data collectors to use the data collection tools)

Outcome: System of records of land allocation and land use that increases transparency and security, particularly for women and the poor.

Expected results (3) Proposed institutional arrangements for administration of land presented to and endorsed by key stakeholders.

Activities: Consultation and consensus-building Discussion papers Proposed amendment to or new legislation

Outcome: Rationalised and streamlined land administration arrangements that are recognised and used by stakeholders.

Aerial survey and equipment procured. All pilot area Tinkhundla selected in the four regions of the country as follows Hhohho – Lubombo – Manzini – Mkhiweni Shiselweni – Meetings with Chiefs from all 4 regions

• Slow implementation progress.

• MOA staff for data collection have yet to be appointed.

• insufficient vehicles and funds for fuel and fieldwork allowances.

7th Capitalization Meeting EU Land Governance Programme Lessons Learned

• Project Buy-in has to be acquired before the signature of grant agreement

• Participating institutions to have clear and agreed on deliverables.

• Land Management Board to be consulted at the conceptualisation of the project.

• Optimal budgeting is key in the timely achievement of project objectives

Completing the data collection, quality assurance, and delivery of results in the form of maps and records to the first pilot area chiefdom.

› Commencement of fieldwork data collection in the remaining chiefdoms of the first pilot area, and chiefdoms of the second pilot area. If resources permit, commence fieldwork in the third and fourth pilot areas.

› Prepare drafts of procedural guidelines, manuals and training materials.

› Complete and distribute institutional arrangements stocktake report and discussion paper and hold workshop.

› Hold preliminary discussion on follow on project.
