A RESOLUTION FOR A MISSION STATEMENT OF THE QUAPAW TRIBE OF OKLAHOMA

WHEREAS, the Quapaw Tribe of Oklahoma is a federally recognized Indian Tribe and is governed by a Governing Resolution adopted by the Quapaw Indian Council on August 19, 1956, and approved by the Commissioner ofIndian Affairs on September 20, 1957; and

WHEREAS, the Governing Resolution delegates authority to the Quapaw Business Committee to speak and act on the behalf ofthe Quapaw Tribe; and

WHEREAS, the Quapaw Tribal Business Committee is thus empowered and obligated to transact Tribal businesses, including business with the Department of the Interior, or the Generally; and • THEREFORE BE IT RESOLVED, The Mission Statement of the Quapaw Tribe of Oklahoma Business Committee shall be: Pursuant to the purpose and intent of the governing resolution of the O-Gah-Pah (Quapaw) Tribe of Oklahoma, as a sovereign nation, the tribal mission is to maintain and exercise self-governance that is continuously working toward economic self-sufficiency, to protect it's land and resources, to improve the health and welfare of it's members through quality programs while maintaining cultural heritage, and to develop economic opportunities for the tribe and it's members.

RESOLUTION SUPPORTING THE OKLAHOMA MUSEUM OF HISTORY

WHEREAS, the Quapaw Tribe of Oklahoma is a federally recognized Indian Tribe and is governed by a Governing Resolution that was duly adopted by the Quapaw Indian Council on August 19,1956, and approved by the Commissioner of Indian Affairs on September 20,1957; and

WHEREAS, the Governing Resolution delegates authority to the Quapaw Tribal Business Committee to speak and act on behalf of the Quapaw Tribe; and

WHEREAS, the Oklahoma Museum of History is an exciting project and will be of great benefit for tribal people in Oklahoma.

RESOLUTION REQUESTING A REVISION TO THE BIA TRIBAL RESERVATION ROAD INVENTORY

WHEREAS, the Quapaw Tribe of Oklahoma is a federally recognized Indian Tribe and is governed by a Governing Resolution that was duly adopted by the Quapaw Indian Council on August 19, 1956, and approved by the Commissioner of Indian Affairs on September 20, 1957; and

WHEREAS, the Governing Resolution delegates authority to the Quapaw Tribal Business Committee to speak and act on behalf of the Quapaw Tribe; and

WHEREAS, the QuapawTribe of Oklahoma is a federally recognized Indian Tribe eligible for program funds, by authority of P.L. 93-638; and

WHEREAS, the Quapaw Tribe of Oklahoma has identified a transportationlroad • project that has been a priority for implementation; and

NOW THEREFORE BE IT RESOLVED that the Quapaw Tribal Business Committee hereby requests that the following revisions be made to the Quapaw Tribe's BIA Indian Reservation Road Inventory: Route 104 from 7.4 miles to 6.5 miles; Route 105 from 4.6 miles to 3.2 miles; Route 123 from 3.1 miles to 3.0 miles; Route 156 from 4.1 miles to 4.4 miles; Route 157 from 3.5 miles to 3.8 miles.

A RESOLUTION FOR THE QUAPAW TRIBE TO FILE AND AMICUS BRIEF IN THE COBELL LITIGATION RELATED TO BIA REORGANIZATION

WHEREAS, the Quapaw Tribe of Oklahoma is a federally recognized Indian Tribe and is governed by a Governing Resolution adopted by the Quapaw Indian Council on August 19, 1956, and approved by the Commissioner ofIndian Affuirs on September 20, 1957; and

WHEREAS, the Governing Resolution delegates authority to the Quapaw Business Committee to speak and act on the behalfofthe Quapaw Tribe; and

WHEREAS, the Quapaw Tribal Business Committee is thus empowered and obligated to transact Tribal businesses, including business with the Department of the Interior, or the United States Generally; and

WHEREAS, the Quapaw Tribal Business Committee occupies a relatively unique position as a "direct service" tribe under the BIA's partial superintendence; and

WHEREAS, the Quapaw Tribal Business Committee plans in the near future to establish itself • under a model ofselfgovernance; and WHEREAS, the Quapaw Tribe has initiated a federal lawsuit that in part alleges that the federal government has mismanaged its assets and funds, and that some of this mismanagement is related to the poor organization ofthe Department ofthe Interior as it relates to Native American issues; and

WHEREAS, in the Cabell litigation, the federal government will file a plan for reorganization on January 6, 2002; and

WHEREAS, it is anticipated that this plan may in some respects be reasonable, but in others will continue to be lacking, especially with respect to the issues that are most important to the Quapaw Tribe as a direct service tribe, and as a tribe burdened with numerous issues relating to the management ofits assets.

WHEREAS, the Quapaw Tribe of Oklahoma is a federally recognized Indian Tribe and is governed by a Governing Resolution adopted by the Quapaw Indian Council on August 19,1956, and approved by the Commissioner ofIndian Affairs on September 20, 1957; and

WHEREAS, the Governing Resolution delegates authority to the Quapaw Tribal Business Committee to speak and act on the behalf of the Quapaw Tribe; and

WHEREAS, the Quapaw Tribal Business Committee is thus empowered and obligated to transact Tribal business including attorney contracts; and

WHEREAS, the Quapaw Tribal Business Committee desires to retain adequate legal counsel to assist with its representation in the litigation captioned and styled as Quapaw Tribe a/Oklahoma versus Department a/Interior et aI., No. 02-CV-129-B(M), • hereinafter the "Trust Case," which is pending in the United States District Court for the Northern District of Oklahoma; and

WHEREAS, the Quapaw Tribal Business Committee desires to retain attorney Stephen R. Ward as co-counsel to assist the Tribe's general counsel, Jason B. Aamodt, as counsel of record in the Trust Case; and

WHEREAS, the Quapaw Tribal Business Committee delegates to the Tribal Chairman the authority to enter into an attorney representation agreement and client engagement letter with Mr. Ward, such that ML Ward may represent the Quapaw Tribe as co-counsel in the Trust Case; and

WHEREAS, the Quapaw Tribal Business Committee acknowledges and agrees that the attorney representation agreement and client engagement letter between the Tribe and ML Ward and his law firm, Conner & Winters, P.C., shall contain a waiver of the Tribe's sovereign immunity for the limited purpose of providing for the arbitration of fee disputes between the Tribe and ML Ward, as well as for the enforcement of any arbitral award, which is a standard requirement in Mr. Ward's and his law firm's client • engagement letters. ,

NOW THEREFORE BE IT RESOLVED, by the Business Committee of the Quapaw Tribe of Oklahoma that the Tribal Chairman may enter into an attorney representation agreement and endorse a client engagement letter on behalf ofthe Tribe in accordance • with this resolution. CERTIFICATION

WHEREAS, the Northeastern Tribal Health System is a self-governance consortium of the Quapaw, Seneca-Cayuga, Peoria, Ottawa, Modoc, Miami, and Tribes and • Nations created to administer Indian health operations, and WHEREAS, the Northeastern Tribal Health System wishes to build a clinic facility on Trust land located at 21 South Eight Tribes Trail, and

WHEREAS, the Quapaw Tribal Business Committee supports the lease of Trust land to house a clinic for the Northeastern Tribal Health System, Said land is located at 21 Eight Tribes Trail, which shall consist of the following:

SURFACE ONLY in a parcel of land containing 8.3 acres, more or less, located in the SE' Y. of Section 29, Township 28 North, Range 23 East of the Indian Base and Meridian, Ottawa County, Oklahoma, described as follows: .. Beginning at an aluminum cap on the West of., the SE \4, 216.13 feet NOf031 'IO"W along the West line ofthe SE Y2 167.78 to an aluminum cap on the intersection of a curve, thence along a curve to the right having a chord bearing of N28°13'43"E, a radius of 4247,53 and a length of 1457.28 feet to the point of beginning, thence S18°40'16"W, 857.18 feet, thence S79°19'39"W, 112.93 feet, thence S82°05'45"W, 367,99 feet, thence S73°32'54"W, 223.44 feet, thence • S40020'04''W, 140.51 feel, to the point ofbeginning. . This tract contains 8.3 acres, less any existing utility leases that were already established. Tract description is subject to possible minor changes in response to a survey due to be completed in 2002. Changes arc to be • incorporated into the lease. NOW THEREFORE BE IT RESOLVED that John Berrey, Chairperson of the Quapaw Tribal Business Committee, or his authorized representative, is hereby authorized to negotiate and execute a lease with the Northeastern Tribal Health System for the maximum tenm of years allowable by federal law for the purpose of tribal administrative reserve and to promote tribal self-detenmination and such other uses as may be detenmined including commercial operation acceptable to the lessor.

Provided that, if, by July I, 2012, no clinic construction has begun, the lease shall tcnminate.

Fair annual rental is waived and the lease shall also contain a provision for a renewal for a like tenm of years with the same tenms and conditions, and

BE IT FURTHER RESOLVED that the Quapaw Tribe of Oklahoma requests that the Secretary of the Interior or hislher authorized representative approve the lease.

WHEREAS, the Governing Resolution delegates authority to the Quapaw Tribal Business Committee to speak and act On behalfofthe Quapaw Tribe, and

WHEREAS, the Quapaw Tribe ofOklahoma is a federally recognized Indian Tribc eligible under P.L. 98-638, Section 102, as amended, to apply for Fiscal Year 2002 Indian Health Service grant funds available under the Tribal Management Grant Program, and

WHEREAS, the Quapaw Tribe desires to apply for these funds to conduct management system • corrections and improvements to maintain and increase management capacity, and WHEREAS, the Quapaw Tribe ofOklahoma is qualified to administer the grant and asserts that it is in the best interests of the Tribal membership to apply for the grant, and

THE QUAPAW TRIBE OF OKLAHOMA RESOLVES TO GIVE OUR CONSENT TO THE OF OKLAHOMA TO USE THEIR GRANT FUNDS TO CLEAN UP OPEN DUMP AREAS ON THE UNDIVIDED SHARED PROPERTIES.

WHEREAS, the Quapaw Tribe of Oklahoma is a federally recognized Indian Tribe and is governed by a Governing Resolution adopted by the Quapaw Indian Council on August 19, 1956, and approved by the Commissioner ofIndian Affairs on September 20, 1957; and

WHEREAS, the Governing Resolution delegates authority to the Quapaw Business Committee to speak and act on the behalf ofthe Quapaw Tribe; and

WHEREAS, the Quapaw Tribe of Oklahoma is committed to the concept of Indian tribes functioning as a sovereign government; and

WHEREAS, the Quapaw Tribe of Oklahoma desires that the property located S Y:z NW V. and that part of N Y2 SW V. of section 21, Township 27 N, R 24E lying north of the Centerline • Highway numbered 60, Indian Base Meridian containing I 14 acres, more or less, Ottawa County, Oklahoma, have open dumpsites contained there in cleaned up; and

NOW THEREFORE BE IT RESOLVED, by the Business Committee of the Quapaw Tribe of Oklahoma request the grant monies obtained by the Wyandotte Nation of Oklahoma be used to clean up above mentioned properties.

WHEREAS, the Quapaw Tribe of Oklahoma is a Federally recognized Indian Tribe and is governed by a Governing Resolution that was duly adopted by the Quapaw Indian Council on August 19, 1956, and approved by the Commissioner ofIndian Affairs on September 20, 1957; and

WHEREAS, the Oklahoma Museum ofHistory is an exciting project and will be 0 f great benefit for tribal people in Oklahoma; and

A RESOLUTION TO ALLOW OKLAHOMA MANAGEMENT TO ENTER INTO AN AGREEMENT WITH CHOCTAW RACING TO PROVIDE PARIMUTUEL BETTING SERVICES TO THE QUAPAW CASINO AND RV RESORT

WHEREAS, the Quapaw Tribe of Oklahoma is a federally recognized Indian Tribe and is governed by a Governing Resolution adopted by the Quapaw Indian Council on August 19, 1956, and approved by the Commissioner ofIndian Affairs on September 20, 1957; and

WHEREAS, the Governing Resolution delegates authority to the Quapaw Business Committee to speak and act on the behalfofthe Quapaw Tribe; and

WHEREAS, the Quapaw Tribal Business Committee is thus empowered and obligated to transact Tribal businesses, including business with the private businesses; and

WHEREAS, the Quapaw Tribal Business Committee desires that Choctaw Racing will provide • pari-mutuel betting services to the Quapaw Casino and RV Resort. NOW THEREFORE BE IT RESOLVED, by the Business Committee of the Quapaw Tribe of Oklahoma that Oklahoma Management may enter into an agreement with Choctaw Racing whereby Choctaw Racing may provide pari-mutuel racing and betting services to Oklahoma Management and the Quapaw Casino and RV Resort.

Whereas, The Quapaw Tribe of Oklahoma is a Federally r~ognized Indian Tribe and is governed by a Governing Resolution that was duly adopted by the Quapaw Indian Council on August 19, 1956 and approved by the Commissioner of Indian Affilirs on September 20, 1957 with reservation boundaries located within the geographical boundaries ofthe State ofOklahoma; and

Whereas, The Governing Resolution delegates authority to the Quapaw Tribal Business Committee to speak and act on behalf of the Quapaw Tribe; and

Whereas, The Quapaw Tribe is a Federally-recognized Indian Tribe eligible for program funds by authority of PL 93-638; and

Whereas, The Quapaw Tribe recognizes the importance and the n~essity to repatriate its cultural items including our ancestral human remains that are currently in the possession of museums and Federal • agencies; and Whereas, The Quapaw NAGPRA office, in accordance with the laws and regulations set forth in the Native American Graves Prot~tion and Repatriation Act, is responsible for identifYing, documenting, and repatriating Native American human remains and cultural items, including funerary objects, sacred objects and obj~ts of cultural patrimony that are culturally affiliated with the Quapaw Tribe; and

WhereBll, The Quapaw Tribe finds it necessary to apply for grant funding in order to continue its obj~tives and repatriation efforts with regard to NAGPRA

NOW THEREFORE BE IT RESOLVED, the Business Committee of the Quapaw Tribe of Oklahoma does support and approve the National Park Service NAGPRA Grant Application 2002, entitled: Quapaw Tribal Repatriation: Can't Stop Now, as it is in the best interest of the Tribe to continue its repatriation endeavors which are vital to the cultural and spiritual well-being ofthis Tribe_
