The 244th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 08th – 09th October, 2017 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 244th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

ATTENTION!

1. The Committee unanimously decided that the institution may reply in response to the decision of the Committee uploaded on the ERC website without waiting for formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution needs to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier.

5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 6. The Committee suggested to prepare Data Bank for the teachers. 7. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier.

Matter relating to inspection conducted u/s 13 with the direction of Hon’ble High ER-244.17 Court of Jharkhand in W.P. (PIL) No. 327 of 2011. St. Xavier’s College, P.B. No.9, Purulia Road, Ranchi, Jharkhand-834001. (B.Ed.) 1. 244.17.1 (Private) (Ranchi University) (Code No. APE00244) The institution was granted recognition for conducting B.Ed. course vide order dated 29.10.2004 with 100 intake from the academic session 2005-2006.

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda - Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the Hon’ble High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the NCTE Act 1993 and Rule 8 of NCTE Rules.

The ERC in its 171st meeting held on 3rd -4th June, 2014 considered the matter and as decided, a Notice dated 18.06.2014 was issued to the institution on the following grounds:

(i) The institution is required to appoint one more lecturer and submit a fresh faculty list duly approved by the Registrar of the concerned University adding the name of newly appointed lecturer. (ii) Psychology Resource Center is not available in the institution. (iii) Original FDRs of Rs. 5.00 lakh and Rs. 3.00 lakh is to be submitted towards endowment fund and reserve fund respectively into joint account in the name of institution and RD, ERC, NCTE, Bhubaneswar

Reply in response to ERC’s Notice dated 18.06.2014 has not been received till date and the institution is still deficient on the above grounds.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. APE00244 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session.

Radha Govind Teachers Training College, Behind Ramgarh College, Ramgarh Cantt., 2. 244.17.2 Dist. Hazaribagh, Jharkhand-829122. (B.Ed.) (Private) (Code No. APE00722) The institution was granted recognition for conducting B.Ed. course vide order dated 15.12.2006 with 100 intake.

The ERC in its 191st meeting held on 14th -15th July, 2015 considered the matter and as decided, a Notice dated 30.07.2015 was issued to the institution on the following ground:

(i) As per the faculty list submitted lecturer in Physical Education, Music are shown part time which is not permissible as per new Regulation 2014. The institution is required to appoint them as regular basis.

Reply in response to ERC’s Notice dated 30.07.2015 has not been received till date and the institution is still deficient on the above ground.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. APE00722 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session.

Swami Ram Krishan Paramhansh Teacher Training College, Vill/PO-Karmatand, Dist- 3. 244.17.3 Bokaro, Jharkhand – 828307. (B.Ed.) (Private) (Vinoba Bhave University) (Code No. APE00819) The institution was granted recognition for conducting B.Ed. course vide order dated 28.02.2008 with 100 intake from the academic session 2008-2009.

(i) In view of the dispute between two groups of the Managing Committee, it needs to be decided whether Mr. R.N. Singh has the authority to submit application for shifting of premises on behalf of the institution and its Managing Committee. The matter is sub-judice. In any case, since the College has not been functioning since the session 2011-2012 and Shri R.N. Singh applied for shifting of premises only on 13.06.2012, the request need not be considered. (ii) The institution located at Karmatand, where recognition was granted, is neither entitled nor equipped to run the B.Ed. programme.

Reply dated 28.05.2014 received from the institution in response to Notice dated 01.05.2014 is not satisfactory and the institution is still deficient on the above grounds.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. APE00819 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session. Tathagat Teachers Training College, Plot No. 498, 500, Vill-Jorapipal, PO-Kalyanpur, 4. 244.17.4 Dhanbad, Jharkhand. (B.Ed.) (Private) (Vinoba Bhave University) (Code No. APE00508) The institution was granted recognition for conducting B.Ed. course vide order dated 08.09.2005 with 100 intake from the academic session 2005-2006.

The ERC in its 174th meeting held on 5th August, 2014 considered the matter and as decided, a Notice dated 13.08.2014 was issued to the institution on the following grounds:

(i) Faculty list in original signed by the Registrar of the concerned university is to be submitted. (ii) The institution has not submitted the renewed/converted FDRs of Rs. 5 lakh and Rs. 3 lakh in the joint name of institution and RD, ERC, NCTE, Bhubaneswar. (iii) As per NCTE norms, the academic staff of the institution( including part time staff) shall be paid such salary in such scale of pay as may be prescribed by the UGC/University from time to time, through account payee cheque or as per advice as per advice into the bank account of employee specifically opened for the purpose. The supporting staff shall be paid as per the UGC/State Government/Central Government pay scale structure. (iv) The institution is required to submit the 3 months Bank statement clearly stating that amount has been deposited in the bank account of the staff.

Reply in response to ERC’s Notice dated 13.08.2014 has not been received till date and the institution is still deficient on the above grounds.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. APE00508 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session.

Rajeev Gandhi Memorial Teacher’s Training College, 12-Digwadih, PO-Pathardih, 5. 244.17.5 Dist-Dhanbad, Jharkhand – 828119. (B.Ed.) (Private) (Vinoba Bhave University) (Code No. APE00858) The institution was granted recognition for conducting B.Ed. course vide order dated 29.10.2004 with 100 intake from the academic session 2005-2006.

The ERC in its 176th meeting held on 9th October, 2014 considered the matter and as decided, a Notice dated 11.11.2014 was issued to the institution on the following grounds:

(i) The institution does not have built up area of 1500 Sq. Mts. The psychology and science resource centers need improvement. (ii) A qualified and eligible Principal needs to be appointed. (iii) The institution has managed academic affairs efficiently but the number of working days needs to be increased. (iv) The institution is not maintaining the FDRs towards endowment fund and reserve fund in the manner prescribed by the NCTE.

In response, the institution submitted reply vide letter dated 27.11.2014 with some documents. However, the institution is still deficient on the following ground:

(i) As per special visiting team report, the total built up area of the institution was 13400 Sq. ft. i.e. 1244.89 Sq. Mts. only which is less than required built up area of 1500 Sq. Mts.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. APE00858 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session. ARS B.Ed. College, Plot No. 62, 63, 64, 65, Street No. 1, Vill- Lakrakhanda, PO- 6. 244.17.6 Bokaro, Town/City-Bokaro Steel City, Tehsil/Taluka- Chas, Dist-Bokaro, Jharkhand- 827010. (B.Ed.) (Private) (Vinoba Bhave University) (Code No. ERCAPP708) The institution was granted recognition for conducting B.Ed. course vide order dated 28.08.2012 with 100 intake from the academic session 2012-2013.

The ERC in its 176th meeting held on 9th October, 2014 considered the matter and as decided, a Notice dated 11.11.2014 was issued to the institution on the following grounds:

(i) Sh. Ram Chandra Roy appointed lecturer in English has submitted his resignation on 16.09.2014. (ii) The institution is required to appoint a Lecturer in English Method as per NCTE Norms and submit a fresh faculty list duly approved by Registrar of the concerned University adding the name of newly appointed Lecturer.

Reply in response to ERC’s Notice dated 11.11.2014 has not been received till date and the institution is still deficient on the above grounds.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. ERCAPP708 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session.

Matter relating to inspection conducted u/s 13 with the direction of Hon’ble High ER-244.17 Court of Patna in CWJC No. 13927 of 2009. Patna Training College, Dariapur, Bankipore, Patna, Bihar - 800004. (B.Ed.) 7. 244.17.7 (Constituent Unit) (Patna University) (File No. BR-S/E-6/96) The institution was granted recognition for conducting B.Ed. course vide order dated 12.02.1997, 24.11.1998, 22.02.1999 and 30.05.2015 with an intake of 60, 60, 90 & 100 respectively.

The Chairperson, NCTE, New Delhi had constituted a Committee for inspection of the B.Ed. institutions in Bihar as per direction of the Hon’ble High Court of Patna vide order dated 19.01.2010 in connection with CWJC No. 13927 of 2009. Accordingly, the Committee conducted the inspection of institutions including this institution during the period from February, 2010 to May, 2010.

The ERC in its 172nd meeting held on 17th June, 2017 considered the matter and as decided, a Notice dated 26.06.2014 was issued to the institution on the following ground:

(i) The institution is required to appoint a regular principal and submit the fresh faculty list duly approved by the Registrar of the concerned university alongwith his/her educational/professional certificates within 30 days from the issue of letter.

Reply in response to ERC’s Notice dated 26.06.2014 has not been received till date and the institution is still deficient on the above ground.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. BR-S/E-6/96 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session.

Women’s Training College, Patna University, Patna, North Gandhi Maidan, Patna - 8. 244.17.8 800001. (B.Ed. Course) (Government) (Patna University) (BR-S/E-5/96) The institution was granted recognition for conducting B.Ed. course vide order dated 22.02.1999 & 30.05.2015 with intake of 120 & 100 respectively.

The ERC in its 179th meeting held on 22nd -23rd January, 2015 considered the matter and as decided, a Notice dated 31.01.2015 was issued to the institution on the following ground:

(i) The institution has not appointed the teaching staff on regular basis as per NCTE norms.

Reply in response to ERC’s Notice dated 31.01.2015 has not been received till date and the institution is still deficient on the above ground.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. BR-S/E-5/96 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session.

Directorate of Distance Education, L.N. Mithila University, Darbhanga, Bihar - 9. 244.17.9 846008. (B.Ed. –ODL Mode) (University Deptt.) (Code No. APE00389) The institution was granted recognition for conducting B.Ed.(ODL Mode) course vide order dated 04.07.2007 with 500 intake.

The ERC in its 175th meeting held on 9th September, 2014 considered the matter and as decided, a Notice dated 19.09.2014 was issued to the institution on the following grounds:

(i) The institution has not appointed the lecturers in English, Mathematics and Foundation course. (ii) The institution has not submitted the fresh faculty list duly approved by the Registrar of the concerned university. (iii) The institution vide its representation dated 24.08.2014 has sought 03 months time for appointment of the above faculty members. (iv) The committee accepted the request of the institution.

Reply in response to ERC’s Notice dated 19.09.2014 has not been received till date and the institution is still deficient on the above grounds.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed.(ODL Mode) course of the application bearing Code No. APE00389 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session.

Kameshwar Singh Darbhanga Sanskrit University, PO./Dist.-Darbhanga, Bihar - 10. 244.17.10 846008. (Shiksha Shastri -B.Ed. Course) (University Deptt.) (Code No. APE00247) The institution was granted recognition for conducting Shiksha Shastri (B.Ed.) course vide order dated 21.06.2005 with 100 intake from the academic session 2005-2006.

The ERC in its 178th meeting held on 11th -12th December, 2014 considered the matter and as decided, a Notice dated 01.01.2015 was issued to the institution on the following grounds:

(i) The institution has not appointed the Part-time lecturer in Physical education. (ii) The institution has not submitted the educational/professional certificated of newly appointed English lecturer Dr. Dhaiya Nath Choudhary alongwith individual affidavit in the stamp paper. (iii) The institution is required to appoint a part-time lecturer in Physical education and submit a fresh faculty list duly approved by the Registrar of the concerned university adding the name of newly appointed part-time lecturer

Reply in response to ERC’s Notice dated 01.01.2015 has not been received till date and the institution is still deficient on the above grounds.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to Shiksha Shastri (B.Ed.) course of the application bearing Code No. APE00247 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session.

Magadh University, Department of Education, Bodh Gaya, Dist. - Gaya, Bihar - 11. 244.17.11 824234. (B.Ed. Course) (University Deptt.) (Magadh University) (Code No. APE00536) The institution was granted recognition for conducting B.Ed. course vide order dated 03.05.2007 with 100 intake.

The ERC in its 165th meeting held on 5th -6th December, 2013 considered the matter and as decided, a Notice dated 17.12.2013 was issued to the institution on the following grounds:

(i) Clarification u/c 17 was issued to the principal on 21.08.2013. (ii) In response to the said clarification, the institution vide representation dated 21.09.2013 requested one month time for appointment of the new principal. (iii) The Committee accepted the request of the university and allowed 30 days more time to compliance the clarification issued u/c 17. (iv) The institution is required to submit a fresh faculty list adding the name of the newly appointed principal duly approved by the Registrar of the university.

Reply in response to ERC’s Notice dated 17.12.2013 has not been received till date and the institution is still deficient on the above grounds.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. APE00536 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session. Al-Momin College of Education, Mohalla Aminabad, At/PO. - Bishunpur, Via - Chirki 12. 244.17.12 Bazar, Dist. - Gaya, Bihar - 824237. (B.Ed. Course) (Private) (Magadh University) (Code No. APE00395) The institution was granted recognition for conducting B.Ed. course vide order dated 03.10.2006 with 100 intake.

A complaint dated 28.05.2013 received against the institution making serious allegations that a CBSE school is also running in the same building of the institution. The matter was considered by ERC in its 159th meeting held on 6th August, 2013 and accordingly, letter dated 12.09.2013 was issued to the Secretary, Deptt. of Higher Education, Govt. of Bihar for conduct of inspection and initiating inquiry on the complaint, endorsing a copy to the institution for comments. Reply dated 01.10.2013 submitted by the institution in the matter of complaint is not satisfactory.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. APE00395 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session.

Veerayatan B.Ed. College, Pawapuri, Dist.- Nalanda, Bihar - 803116. (B.Ed. 13. 244.17.13 Course) (Private) (Aryabhatta Knowledge University) (Code No.APE00798) The institution was granted recognition for conducting B.Ed. course vide order dated 10.10.2007 with 100 intake.

The ERC in its 165th meeting held on 5th -6th December, 2013 considered the matter and as decided, a Notice dated 17.12.2013 was issued to the institution on the following grounds:

(i) The NCTE has no objection to allow the change of affiliating body subject to the condition that both the Universities i.e. Magadh University and Aryabhatta Knowledge University issue NOC/Acceptance. (ii) The institution has not submitted the faculty lit duly countersigned by the Registrar of the concerned university on each page.

Reply in response to ERC’s Notice dated 17.12.2013 has not been received till date and the institution is still deficient on the above ground.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. APE00798 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session.

Nalanda Open University, 3rd Floor, Biscomaun Bhawan, Gandhi Maidan, Patna, 14. 244.17.14 Bihar - 800001. (B.Ed.-ODL Mode) (University Deptt.) (BR-SO/N-8/2004) The institution was granted recognition for conducting B.Ed. (ODL Mode) course vide order dated 05.03.2007 with 500 intake.

The ERC in its 157th meeting held on 27th -29th June, 2013 considered the matter and as decided, a Notice dated 15.07.2013 was issued to the institution on the following grounds:

(i) Letter of inspection was issued to the institution as well as VT expert on 11.12.2012 & 04.04.2013. (ii) The institution vide letter dated 13.04.2013 has submitted that “at present the Vice-Chancellor, or Pro Vice-Chancellor in Nalanda Open University are not in position. Therefore the institution requested to postpone the visit of inspection team in Nalanda Open University for the time being, the inspection team may visit after the appointment of Vice-Chancellor in the University. (iii) The Committee accepted the request of the institution and allows two months more time for conducting the inspection.

Consent for inspection from the institution in response to ERC’s Notice dated 15.07.2013 has not been received till date and the institution is still deficient on the above ground.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed.(ODL Mode) course of the application bearing Code No. BR-SO/N-8/2004 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session.

Veer Kunwar Singh University, Department of Education, Dist. - Bhojpur, Ara, Bihar - 15. 244.17.15 802301. (B.Ed. Course) (University Deptt.) (Code No. APE00529) The institution was granted recognition for conducting B.Ed. course vide order dated 04.10.2006 with 100 intake from the academic session 2006-2007.

The ERC in its 159th meeting held on 6th August, 2013 considered the matter and as decided, a Notice dated 21.08.2013 was issued to the institution on the following grounds:

(i) The institution is recognized from 04.10.2006. The required number of faculty members have not been appointed by the university till date.

(ii) The minimum requirement of faculty to run B.Ed. course is – 01 Principal, 01 lecturer for Foundation course, 05 lecturers for Methodology course like English, Language, Science, Social Science, Mathematics and two part-time lecturers- one in Physical Education and another in Performing Arts/Music.

Reply in response to ERC’s Notice dated 21.08.2013 has not been received till date and the institution is still deficient on the above ground.

In view of the above, the Committee decided as under: The Committee is of the opinion that recognition granted to B.Ed. course of the application bearing Code No. APE00529 is withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session. The ERC re-viewed the matter in accordance with the appeal order and observed as under:-

The institution is required to submit the following documents as mentioned in the SCN dated 07.11.2016 and further as per direction of the Appellate Authority:

(i) Building plan is not in the name of the institution and not approved by any Govt. Engineer. The total demarcated land and built up area is not mentioned in the submitted building plan. (ii) Building completion certificate issued from any Govt. Engineer not submitted.

In view of the above, the Committee decided as under: Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused on the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision. Guru Nanak College, Dhanbad, Post Box No.93, Dist-Dhanbad, Jharkhand-826001 24. 244.4.2 (Course-B.Ed.) (Vinoba Bhave University)(Code No.APE00429) The institution was granted recognition for conducting B.Ed. course on 07.09.2005 with 100 intake from the academic session 2005-2006. The recognition of B.Ed. course was withdrawn vide Order dated 19.08.2014 from the academic session 2015-2016. The Appellate Authority vide order dated 10.12.2014 decided that another inspection under section 13 of the NCTE Act, 1993 be conducted. The institution requested not to conduct inspection and desired not to continue the B.Ed. course. Hence, the withdrawal order dated 19.08.2014 remained unchanged which was intimated to the institution vide letter dated 07.03.2017.

Again, the institution preferred an appeal to the Appellate Authority against the ERC’s order dated 19.08.2014. The Appellate Authority vide Order No. 89-350/2016 Appeal/10th Meeting-2017 dated 21.06.2017 decided that the appeal has become infructuous as the B.Ed. course is not running in their institution as it was withdrawn by the ERC on 19.08.2014.

In view of the above, the Committee decided as under: A letter be issued to the institution stating the above position as directed by the Appellate Authority. The ERC in its 242nd meeting held on 15th -16th July, 2017 considered the representation dated 23.05.2017 of the institution requesting for exclusion of land in plot No. 98 & 276 from the land schedule of Balurghat B.Ed. College and accordingly, letter dated 02.08.2017 was issued to the institution seeking clarification regarding submission of Resolution of Managing Committee for exclusion of land and NOC from Govt. of West Bengal for removal of remaining unused land of the leased land. In response, the institution vide its letter dated 24.07.2017 through e-mail submitted some documents.

The Committee considered the reply and observed as under: (i) Out of 9186.36 Sq. Mts. (2.27 Acre) land, the institution is required atleast 4500 Sq. Mts. land demarcated for the teacher education programme and the rest area of land is to be free to use as other educational purpose. (ii) The institution is required to submit a photograph/videograph as a proof for demarcation of recognised teacher education institution.

In view of the above, the Committee decided as under: A letter be issued to the institution to submit its reply within 21 days.
