Limited (Casio UK) and to its ultimate parent company, Casio Computer Co., Limited (Casio Japan) (together, the Addressees). 1.2 By this Decision,1 the Competition and Markets Authority (the CMA) has concluded that: • Casio UK infringed the prohibition in section 2(1) of the Competition Act 1998 (the Act) (the Chapter I prohibition) and/or Article 101 of the Treaty on the Functioning of the European Union (the TFEU) by entering into an agreement and/or participating in a concerted practice with [Reseller 1], one of Casio UK’s UK resellers: o that [Reseller 1] would not advertise or sell online digital pianos or digital keyboards supplied to it by Casio UK (the Relevant Products) below a price specified by Casio UK from time to time (the Minimum Price); o which amounted to resale price maintenance (RPM) in respect of online sales of the Relevant Products by [Reseller 1]. • The agreement and/or concerted practice: o had as its object the prevention, restriction or distortion of competition within the UK and/or between EU Member States; o may have affected trade within the UK and/or between EU Member States; and o lasted from 4 February 2013 to 5 April 2018 (the Relevant Period) (referred to below as the Infringement). 1.3 The CMA has

    Powers of investigation Understanding competition law Competition law 2004 Since 1 May 2004 not only the European Commission, but also the Office of Fair Trading (OFT) has the power to apply and enforce Articles 81 and 82 of the EC Treaty in the United Kingdom. The OFT also has the power to apply and enforce the Competition Act 1998. In relation to the regulated sectors the same provisions are applied and enforced, concurrently with the OFT, by the regulators for communications matters, gas, electricity, water and sewerage, railway and air traffic services (under section 54 and schedule 10 of the Competition Act 1998) (the Regulators). Throughout the guidelines, references to the OFT should be taken to include the Regulators in relation to their respective industries, unless otherwise specified. The following are the Regulators: • the Office of Communications (OFCOM) • the Gas and Electricity Markets Authority (OFGEM) • the Northern Ireland Authority for Energy Regulation (OFREG NI) • the Director General of Water Services (OFWAT) • the Office of Rail Regulation (ORR), and • the Civil Aviation Authority (CAA). Section 52 of the Competition Act 1998 obliges the OFT to prepare and publish general advice and information about the application and enforcement by the OFT of Articles 81 and 82 of the EC Treaty and the Chapter I and Chapter II prohibitions contained in the Competition Act 1998. This guideline is intended to explain these provisions to those who are likely to be affected by them and to indicate how the OFT expects them to operate. Technical development of the piano and how its market grew The first acoustic piano was made in 1709 by Bartolomeo Cristofori, who was a harpsi- chord producer for the Medici family in Italy. The piano was originally built in the shape of a harpsichord. At the beginning pianos were played in relatively small rooms, such as in a salon of a noble residence. But pianos gradually came to be played at concert halls holding thousands of people. The sound of pianos needed to be more powerful and emo- tional. The only way was to increase the tension on the strings. New materials were need- ed since the existing wooden plates could not sustain such tension. Alpheus Babcock, who was a boiler shop owner in the U.S., invented the full iron frame piano in 1825. His pianos succeeded in obtaining more powerful tension than wooden frames and expanded the sound range by octaves. In 1837, Jonas Chickering, a piano engineer and a founder of Chickering & Sons in the U.S., improved Babcockʼs frames and a patent was granted to him in 1841. Steinway & Sons eventually played an even greater role in the evolution of the piano. Steinway & Sons was established in 1853 in New York by Heinrich Engelhart Steinway, who was a German piano producer. This company made important inventions and im- provements to the piano, for example the invention of the over-string scale(crossing the middle and bass strings) for grand pianos, quick response hammer action, and improve- ment of the full cast-iron plate.
