Conservation Commission Minutes Plymouth Conservation Commission Minutes of the Meeting May 8, 2018 Page 1 of 3 TOWN OF PLYMOUTH CONSERVATION COMMISION 508-747-1620 x 10139 MINUTES OF THE MEETING May 8, 2018 The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, May 8, 2018 at the Plymouth Town Hall, 26 Court Street, Ropewalk Meeting Room, Plymouth, MA 02360. Present: Gerre Hooker; Chair, and Commissioners, Robert Cunha, Brendan Murphy and Frank Drollett Absent: Sarah Trainor; Vice-chair, Karen Edwards and Bruce Howard The Conservation Planner, Richard Vacca and the Administrator, Krista Lewis, were also present. Disclosure: These minutes are not verbatim – they are the Secretary’s interpretation of what took place at the meeting. – Open Meeting Law, G.L. c. 30A § 22. All materials presented during this meeting are available in the Conservation Office. Administrative Business – May include topics not reasonably anticipated by the Chair 48 hours in advance of the meeting ADMINISTATIVE ITEMS: 6:54 PM MINUTES: May 1, 2018 Robert motioned to approve May 1, 2018 minutes Unanimously approved ACTION ITEMS: MISCELLANEOUS: PLYMOUTH BEACHES RESEARCH/ACTIVITY PERMIT APPLICATIONS: Bonobo Communications, on behalf of AZMAX, Japan - Filming piping plover from courtship, scraping, nesting to breeding baby, and monitoring and banding activities by researcher/scientist, fencing by volunteers on the beach. Television Nature documentary program on piping plover to be aired on NHK, national public broadcasting organization in Japan. Southeastern Massachusetts Pine Barrens Alliance - Volunteers will walk various Plymouth beaches to look for and document presence of horseshoe crabs. Our findings from this project will be used to determine if future monitoring of horseshoe crabs is needed. Rich briefed the Commission and the Public on the two-beach research/activity permit applications. Ted Bubbins, Parks and Forestry Superintendent inquired about the Horseshoe Crabs. Chair, Gerre Hooker, signed off on both permits. ORDER OF CONDITIONS: Neil J. Boyle, 50 Nameloc Road, Parcel ID 054-000-006B-000 Brendan motioned to approve Orders of Conditions Unanimously approved Stephen and Jennifer Herchen, 21 Ellisville Road, Parcel ID 053-000-031-008. Brendan motioned to approve Orders of Conditions Unanimously approved DETERMINATION OF APPLICABILITY: Franklin Triffletti, 11 Baker Road, Parcel ID 098-000-016A-000. Brendan motioned to approve a Negative Determination of Applicability Unanimously approved CERTIFICATE OF COMPLIANCE: Sarah Bodamer (f/k/a Sarah Lynch) and Shannon Bodamer: 120 Long Duck Pond Road, Parcel ID 122- 010P-1333-000. Frank motioned to issue the Certificate of Compliance Unanimously approved OPEN HEARING BEGINS: 7:03 PM 7:04 PM Ted Bubbins, Parks and Forestry Superintendent, 255 Water Street (Nelson Park) Parcel ID 010-000-031-000 & 012-000-057-000. A Request for Determination of Applicability to repave rubber surface with concrete pavement, fill and cap catch basin, redirect drainage from splash pad, and place straw wattles for erosion control between the project and the Buffer Zone, Plymouth Harbor. Ted Bubbins was present and presented his plan to the Commission. Frank inquired about the original rain garden. Ted Bubbins explained the rain garden was created to collect the water however, due to elevation it hadn’t worked correctly. Everett Malaguti from South Cherry Street, Chair of Natural resources Committee, spoke to the Commission with concerns of the un-utilized rain garden and its current unkept status. Ted Bubbins explained that the rain garden had never been maintained. However, it will be maintained now on a regular basis. Frank asked how old the splashpad is. Ted explained it was built around 2009. Frank made a comment that dogs should be banned from the Nelson Park. Brendan motioned to approve a Negative Determination of Applicability Unanimously approved 7: 17 PM Lighthouse Point LLC, Brian McLaughlin, 61 Hedge Road, Parcel ID 006-000-062J- 000. A Request for an Amended Order of Conditions for DEP File #SE57-2841, in order to raise the retaining wall 4 feet in the Buffer Zone of Coastal Bank, Coastal Beach, and Land Subject to Coastal Storm Flowage. Engineer, Zac Basinski, was present and presented his plan to the Commission and explained he encouraged his client to raise the retaining wall. Robert asked if this would impact the neighbors from the South and if this would cause additional erosion. Zac explained the way the storms have been hitting the retaining wall would not negatively impact neighbors. Ed Pesce of 451 Raymond Road, asked if Mr. McLaughlin would be able to have a permit that allows repairs indefinitely without having to go before the Commission every time Rich responded that there is a Repair Permit available which allows for repair work to be completed and brought back to its previous state without going before the Commission. Brendan motioned to approve Amended Orders of Conditions. Unanimously Approved 7:32 PM John Crane and Michele Morris, 120R Drew Road, Parcel ID 088-000-015A-000. A Notice of Intent to lift a single-family dwelling, expand with an addition, upgrade a septic system, remove a revetment, add material to and replace a lawn area suitable for nesting Northern Redbellied Cooters, construct a wildlife management pond/shelter, and construct a raised dike/driveway, in the Buffer Zone of Great South Pond. Frank motioned to continue this hearing for May 22nd at 7:15 PM Unanimously approved 7:33 PM Paul Weismann, 71 Knotty Pines Road, Parcel ID 086-000-006-000 A Notice of Intent to construct a 1-story addition on the street side of the property; and add an extension to the existing porch within the 100-feet Buffer Zone of Bordering Vegetated Wetland to Boot Pond. This project is subject to review by Natural Heritage and Endangered Species Program and MESA. Engineer, Mark Flaherty, was present and presented to the Commission. Mark informed the Commission that he does not have a decision back yet from that Natural Heritage and Endangered Species Program and MESA. Rich asked about the tree being cut. Mark informed everyone that 8-inch (8”) maple tree will be taken down and a two (2) 3-inch (3”) diameter October Red Maples will be planted. Frank motioned to continue this hearing until June 5th at 7:25 PM due to lack of Natural Heritage and Endangered Species Program. -Unanimous 7:44 PM Plymouth Rod & Gun Club, Inc., Walter Fray, President, 225 South Meadow Road, Parcel ID 108-000-023-000. A Notice of Intent to reconstruct the clubhouse building serviced by a new water supply well and upgraded septic system, in the Buffer Zone of Bordering Vegetated Wetlands of Fresh Meadow Pond. Engineer, Ed Pesce, was present and presented to the Commission Robert asked how long the Club has been there. President, Walter Fray, answered it started around 1939. Frank asked if there has ever been test done on the soil for high lead count. Ed Pesce and Walter Fray do not know if it has, but added the well is not near the shooting area and the well water will be tested. Rich had no comments and recommended issuance. Brendan motioned to approve the Notice of Intent. Unanimously approved Randy Parker was present and asked the Commission to revisit allowing heavy machinery on coastal beaches beyond the Memorial Day deadline. The Commission discussed this issue further. Bob motioned to extend allowing heavy machinery on coastal beaches until June 21st.   • Massdot Is Committed to Improving the Quality of Stormwater Runoff from Its Highways
    MassDOT is committed to improving the quality of stormwater runoff from its highways. Through the “Impaired Waters Program,” MassDOT addresses stormwater runoff from its roadways draining to impaired water bodies as part of compliance with the NPDES Phase II Small MS4 General Permit. Stormwater best management practices (BMPs) are implemented to the maximum extent practicable through two methods: retrofit projects and programmed projects. Retrofit projects are tracked within the MassDOT Impaired Waters Program Database, while programmed projects are tracked through this Water Quality Data Form (WQDF). The goal of the WQDF is to raise awareness of the necessity to implement stormwater BMPs during programmed projects and to capture information about stormwater BMPs that are implemented. There are two WQDFs required as part of each programmed project. One is specific to the 25% design stage, and the other is specific to the 75% design stage. Please download the latest version of the WQDF from the MassDOT website. Please fill out the tab titled “75% Design Form,” and check the box at the bottom of the form to ensure that all questions have been answered adequately. Please submit this form in Excel format only and name your file with the convention WQDF25_projectnumber.xlsm. Submit the form to your MassDOT project manager as part of the project's electronic submittal. An interactive web map is available to aid in filling out the WQDF. It is available at http://mass.gov/massdot/map/wqdf. If MassDOT has requested that the form be revised and resubmitted, resubmit the form using the naming convention WQDF75_projectnumber_rev.xlsm.
