Pursuant to Section 22 of the Municipal Government Act, Chapter M26-1, and Bylaw No. 1469 the Town of lnnisfail intends to close to public travel and dispose of a portion of a public highway as follows:

1. Plan 6093HW All that portion of 53rd Street and corner cut-off adjoining the west boundary of Lot 4, Block 45 of said plan which lies south west of the production north westerly of the north east limit of the lane in said block and wh ich and which lies north of said Block 45. 2. WHEREAS, the Council of the Town of lnnisfail deems it expedient to provide for a bylaw for the purpose of closing to public travel certain roads or portions thereof situated In the said municipality, thereafter disposing of same, and

WHEREAS, notice of intention to pass the bylaw has been published in a local newspaper on two consecutive weeks in accordance with section 606 of the Municipal Government Act, and

WHEREAS, Council was not petitioned for an opportunity to be heard by any person claiming to be prejudicially affected by the bylaw.

LEGISLATIVE REQUIREMENT I AUTHORITY: Municipal Government Act Chapter M-26 Section 6 states a municipality has natural person powers, except to the extent that they are limited by this or any other enactment.

BACKGROUND/PROPOSAL: At the July 14, 2008 meeting Council reviewed a request to implement a toilet replacement rebate program similar to the one implemented in Red Deer. Before Council made a decision, on this request, Administration recommended a utility rates and water conservation comparison be done and be brought back at a future meeting. A regional comparison was done which included communities on a regional water line and communities that ran their own utility system. The following information was obtained on conservation programs and utility rates:

City of Red Deer Operates their own utility system Has a toilet rebate program ($50 for a 6L toilet & $100 for a 3L/6L dual flush toilet). Limit of 2 rebates per household. Water rate: $13.84 + $.5245/m3 Wastewater rate: $27.39 per month flat fee

Town of Blackfalds Part of regional water system. Operate their own sanitary sewer No rebate program Water rate: $14.40 + $1 .60/m3 Wastewater rate: $12.10 + $10 surcharge+ 40% of water charge.

Town of Lacombe Part of regional water system. Operate their own sanitary sewer. No rebate program Water rate: $17.42 + $1.50/m3 Wastewater rate: $6.97 +$.601m3 of water

City of Airdrie Part of regional water system. Operate their own sanitary sewer. Has a toilet rebate program ($50 for a 6L toilet & $100 for a 3L/6L dual flush toilet). Water rate: $27.55 +$.?171m3 Wastewater rate: $24.53 + $1 .14741m3

Town of Cochrane Operate their own water system. Pipe sanitary sewer to . Has a toilet rebate program ($100 for a 6L toilet & $250 for a 3L/6L dual flush toilet). Water rate: $4.59 +$.951m3 (first 25m3), $1.271m3 (26- 60), $1.89/m3 (over 60). Wastewater rate: 80% of water consumption@ $1 .631m3

Compared to the municipalities on a regional system the Town of lnnisfail remains quite competitive with a water rate of $1 .251m3 and a wastewater rate of 80% of the water charge. Even with the lower rates, historically Town residents do exhibit good conservation practices.

1 As part of the July 14 h discussion it was requested the investigation include a rebate program involving the replacement of furnaces. Administration determined none of the comparison municipalities offered such a program, however, the Federal Government continues to offer a furnace rebates through its ecoENERGY Retrofit program. ALTERNATIVES I BENEFITS I DISADVANTAGES: 1) Council can direct administration to budget for a toilet rebate program for the 2009 budget.

Barbara, It has not been a good year for me. I had to burry my wife as well as my mother-in-law within the past 10 months. I would however like to see the tax item with the Town cleaned up as it is a real headache for me as well I'm sure to the town office. Is there any way the Town will help us out by reducing the interest charges made to the account over the past few years. These are the killers. I wouldn't expect the late charges to be omitted, but some relief in the interest may help us clean it up. Please let me know what it will take to clear the account. Thanks Ray

Barb, this bit of info may be of some help to council.

My Parents Bob Marcil and Grace were well known by most of the older gereration of lnnisfail.

Mother Grace was born Grace Wood at Dickson Alberta and grew up on her parents farm 12 miles west of the Bowden Institute. Bob was born in Quebec and on a tour of Ca nada ended up working for Wilf Edgar just west of town in the Little Red Dear Distri ct. When they married they bought a piece of farm land just across the road from the Grandma Wood's property. George Wood still owns the homestead where Mother grew up.

In the early 50s my father Bob took a job as a painter and decorator with a commercial company out of Ca lgary. Grace worked for Percy and then a restaurant as a short order cook, then on to the County road crew and eventually the Hospital kitchen. All the time both working hard and they managed to purchase a home on railway street only 2 doors from the current City Office. Later on in the late 50s or early 60s they bought the house at 4704 50th Ave using money from sale of the family farm to Chet Sisson. They paid taxes without fail always on time until they both passed on. Bob was well known as a hard worker for the Seniors Autum Glenn Lodge from his age 60 to 75. He worked many unpaid hours looking after all the maintenance, painting and gardening all on his own. While he was employed there he grew all the vegetables for the entire residences consumption, storing it in a root cellar for use all winter long.

When My parents both passed on is when the tax problem started to develop. Brother Joe and wife Julie living in the home were to look after the taxes and maintain the property, but this has slipped under their occupancy. Joe is now 75 and Julie in her late 60s. They are both on minimum assisted income. Joe suffered a stroke some years ago and is an acute diabetic. Julies heath is good too my knowledge. Their son Robert and his wife as well as their 2 small children also live at the property. Robert has periodic jobs but until 2 years ago was a professional student still taking classes at nearly 40 years of age. I was the executor of my Moms estate which involved only 1/2 of the title. Myself and Gerald a brother living in Ontario were the recipients of the other 1/2 of the title. I live in Calgary and have done so my entire life after leaving lnnisfail at age 21.

After my Mother passed away 6 years ago, I ag reed that Joe and Julie could remain living in the property so long as they paid the taxes, and utilities and looked after maintenance. A couple years later when Robert became a permanent fixture I asked for a small user fee of $400.00 per month. This has been a real problem as they have not lived up to this agreement. The last bit of users fees I have received on behalf of myself and my Brother Gerald (also named in the estate) was 18 months ago. I have had to buy out Gerald's share of the estate recently to settle with him and it looks as though I may also have to purchase Joe's portion due to the tax situation. I am hoping the Town Council will agree to a reduction in the Interest charges so It may leave a bit of money for Joe and family after all their outstanding bills are paid. They are also indebt of a credit card and Robert to Student loans.

As Minister of Municipal Affairs, I am committed to my mandate to support the development and long-term sustainability of municipalities.

I very much appreciated the open and frank conversations I had with you in 2007 on the topic of municipal sustainability. Your input was critical·to the formation of the Municipal Sustainability Initiative.

However, we must continue to discuss the challenges we face today, anticipate the challenges we will face tomorrow, and ensure that we have a long-term vision and plan for municipalities.

As the chairman of the lnnisfail Rotary 2008 Golf Classic, I want to thank you and the Town for your sponsorship at our fund raising golf tournament this year.

Your support has helped us towards our goal in providing seventy-five percent of the funds raised towards the purchase of a new Innisfail Community Bus that is so badly needed. It has been driven many miles to deliver our seniors on tours and events, sports teams to play in other communities ~md other or·ganiz~•tions to various functions. The other twenty-five percent will go towards our· International Project in Uganda. In this endeavor, we will install a water purification system to provide clean drinking water, supply mosquito nets to prevent malal'ia, provide solar lighting for their medical clinic, school supplies for the children plus goats and chickens to provide milk and eggs.

So, as you can sec, you arc helping to make lnnisfail and another village in Uganda a better place to live.

To : Innisfail Town Council

I am writing to request that the building the town bus is stored in should be REMOVED from this residential area. It is an eyesore to the town of Innisfail and especially to this street. The town has a beautiful little lake on this street and the makings of a very nice green space which is very often used by residents and visitors to take wedding pictures, graduation pictures and for family gatherings, but they have to look at this ugly building which comes into your line of vision. I think the town should seriously consider tearing down t his unsightly building. They could store the bus in the town compound. Does t he town not choose "the most beautiful street11 each year and put a sign up on that street indicating that the people that live on that street are concerned about how their street looks and also the rest of the town? It tells me that t he town IS co ncerned about the beautification of our streets. So can we not do SOMETHING about this terrible looking building ? Once it would be removed, the town could then enlarge the green space and even more of the lake would be visible to the public. When the town planned to build a new su b division in this area, I think they should have gone a step further and enhanced the area by removing that hideous old bus garage and showing off pretty little Dodd's Lake.

Also I want to add that quite often there is a gentleman that comes to the bus garage and backs out the bus and lets it run while he drives in his new little truck and washes it. Can this person not wash his truck at home or even consider taking it to one of the car washes in this town ? Meanwhile t he whole area fills up with toxic diesel fumes which smell awful, not to mention t hat it is very wasteful and now becoming very costly t o buy diesel fuel. I wonder too about the FULL gas can that he hoists out of the bus after the bus has been on a trip, and places it in his truck. What is THAT all about ???

Another issue is the removal of snow from t he driveway of the bus garage in t he winter time. It doesn't matter how much it has snowed - whether it is a little or a lot, the next morning a HUGE front end loader comes like clockwork at eight o'clock in the morning and removes that" dusting " of snow from the driveway. One would think that this might be important if there was an ambulance or any emergency vehicle parked in this garage, but a bus . . . . that is used to transport people for recreational purposes ??? I don't think that it should be a high priority, and I wonder how many other people in Innisfaii would, shou ld they know this. Don't we have more important issues to spend tax dollars on ? I also want to add that the town of Innisfail should make RECYCLING for the people a lot more accessible. It is important to make it very easy for people to RECYCLE . The garbage pick-up crew should NOT be picking up EVERYTHING from the streets on garbage day but believe me -- they do I There are still a lot of people that have to be TAUGHT to recycle and if it were made easy it would become a habit much quicker. The recycle bins should be put back into a place where everyone has access to them 24 hours a day, 7 days a week. Another idea might be for the Town of Iinnisfail to make a blue box pickup available to EVERY residence in Innisfail. The cost could be picked up on our utility bill. How much more could that possibly cost and is it not worth the effort to save our planet. WHATEVER has to be done to make this happen, should be done ASAP. We are growing in leaps and bounds, and Innisfail should be keeping up and doing everything possible to keep our town clean, beautiful and healthy.

There is one more issue I would like answered. It is in regards to parking recreational vehicles on your own yard. I understand that the new sub­ division of Aspen Heights has a bylaw that does not allow an owner to park an R.V. past the garage on their own yard, even though, anywhere else in Innisfail, owners CAN park any recreational vehicle right up to the sidewalk on their own yard if they so desire. Is the subdivision that was planned by the town across from Dodd's Lake also not considered a new subdivision? Why then would this bylaw not be used in this development ? At the very least is there not a bylaw that states that you cannot block your neighbours view with recreational vehicles, etc. I would like to be enlightened on this issue.

Please consider these recommendations and bring them up at your next meeting.

Re: Spay/Neuter Program To: Dale Mather The purpose of this letter is to inform you of a successful Spay/Neuter progt·am for dogs within the City of Red Deer. For the last three years, the City of Red Deer has enjoyed success with a program allowing its citizens to have their dog spayed or neutered at no charge to the citizen. The funds for this have come from a slight increase of$2.00 for each dog license purchased. The extra $2.00 per license is put into a fund for the purpose of the program. Citizens are then encouraged to apply for the program when they license their unaltered dog. They are given a deadline to remit the application to the City of Red Deer. All applications are then collected and approved by the City of Red Deer Licensing Department. Upon approval, the citizen is sent an official approval letter and can make the appointment for their dog to receive the surgery at any participating veterinarian clinic. The program is accessible to any citizen regardless of their income or circumstances. The citizens who utilize the program also contribute to the program by licensing their pet first. We at Alberta Animal Services feel that with the success of this program, this could also be well received by the citi zens of your Town. As well as promoting responsible pet ownership, this program helps to reduce the number of unwanted animals. The benefit to the Town is increased license sales, as more citizens will want access to this program. The program will also show its citizens that the Town is committed to responsible pet ownership as well as hdping to get the unwanted pet population under control. Please note that the City only does this for dogs, as citizens are not required to license cats in Red Deer.
