ART. 2° - A arrematação far-se-á pelo maior lance. ART. 3° - Os produtos a serem licitados estarão à disposição dos interessados, nos locais de alojamento, mencionado no catálogo. ART. 4° - É facultado aos interessados fazer examinar por técnicos de sua confiança os produ- tos a serem licitados, antes do Leilão. Portanto, serão inaceitáveis quaisquer reclama- ções posteriores. ART. 5° - Os vendedores e a APPS não se responsabilizam por quaisquer alteração ocorridas no estado dos animais após a arrematação, tampouco acidente de transporte. Parágrafo único - Lembramos aos interessados que procedam com antecedência a devida revisão dos animais. ART. 6° - Após o Leilão os animais retornarão aos locais de origem e, deverão ser retirados no prazo de 4 (quatro) dias úteis a contar da data da arrematação. ART. 7° - Os lances corresponderão ao valor da parcela mensal e seu valor será determinado pelo leiloeiro. ART. 8° - Foram dispensados os necessários cuidados para que o catálogo esteja correto, mas a APPS, os vendedores e o leiloeiro não respondem por erros ou omissões do mesmo. Eventuais correções feitas durante o leilão prevalecerão sobre o catálogo. II - DOS COMPRADORES ART. 9° - Os compradores poderão optar pelas seguintes condições de pagamento: - 15 parcelas iguais, sem juros e sem correção. - à vista com desconto a ser anunciado pelo leiloeiro. - Os animais arrematados por valor de parcela inferior ou igual a R$ 300,00 (trezentos reais), deverão ser pagos à vista. ART 10° - Os interessados em obter financiamento deverão apresentar, à APPS, cadastro para apreciação, até 10 dias antes do leilão. Parágrafo único - Os compradores que não estiverem cadastrados ou aqueles cujos cadastros não forem aprovados terão que efetuar o pagamento à vista, gozando do desconto anunciado pelo leiloeiro. ART. 11° - Os compradores deverão pagar as seguintes taxas: a. 8,0% (oito por cento) sobre o valor do arremate, para qualquer opção de pagamento. b. Transferência de propriedade, de acordo com a tabela de emolumentos do Stud Book Brasileiro. ART. 12° - Aos compradores compete ainda: a. assinar no ato da compra, nota promissoria no valor correspondente ao preço da aquisição. mais as taxas devidas, com vencimento contra apresentação e que deverá ser paga ou substituida quando da regularização da compra. b. Assinar a transferência de propriedade; c. Assinar o contrato de financiamento; d. Os acertos das compras deverão ser efetuados junto à APPS, no local do leilão e nos escritórios de São Paulo (Av. Ibiapinópolis, 61 - Jd. Paulista) e Rio de Janeiro (Hipódromo da Gávea, Vila Hípica 4). ART. 13°- Caso ocorra atraso de 30 dias de pagamento de alguma parcela referente à compra efetuada neste leilão, a transferência do animal adquirido será bloqueada. Comprovado o atraso de 60 (sessenta dias), a APPS poderá solicitar ao Stud Book Brasileiro o cancelamento da transferência, retornando o animal em questão, para a propriedade do vendedor. III - DOS VENDEDORES ART. 14°- Pagar as despesas do leilão que serão rateadas por animal. ART. 15°- No caso da não apresentação do animal inscrito,seu responsável também deverá pagar a importância mencionada acima. ART. 16°- No caso de defesa ou forfait, o vendedor terá 5 (cinco) dias úteis para efetuar o pagamento. Após este prazo,incidirão juros sobre o débito. a. na defesa, o vendedor ficará responsável pelo pagamento das taxas de comprador, além das despesas previstas no art. 14°. NORMAS ESPECÍFICAS IV - CONDIÇÕES FINAIS ART. 17° - O animal arrematado será entregue pelo vendedor mediante autorização, por escrito, da APPS, a qual será dada imediatamente após a regularização da compra, correspondendo ao vendedor a responsabilidade de manutenção do animal até, no máximo 4 (quatro) dias úteis subsequentes à arrematação, exceto para os casos mencionados no artigo 6°. A partir do 5° (quinto) dia útil, as despesas de manutenção ficarão por conta do com- prador, pagas diretamente ao vendedor no dia da retirada do animal no valor de R$ 40,00 (quarenta reais) a diária. Parágrafo único - Eventuais problemas decorrentes da não retirada do animal são de exclusiva responsabilidade do comprador. ART. 18° - A palavra do leiloeiro, no decorrer do Leilão, está credenciada a alterar ou complemen- tar estas normas, bem como as demais informações do catálogo. O leiloeiro reserva-se o direito de não aceitar lances de pessoas que, a seu exclusivo critério, julgar não responsáveis, sendo seu julgamento soberano. ART. 19° - Fica estabelecido o fôro da cidade do Vendedor, para a eventualidade de qualquer pendência judicial. ART. 20° - Após o prazo de 4 (quatro) dias úteis, caso não tenha ocorrido o acerto, por parte do comprador, o vendedor poderá aceitar, ou não, com anuência da APPS, a substituição do comprador. ART. 21° - No caso de acerto direto entre as partes, as taxas deverão ser pagas à Agência. Após o prazo de 5 (cinco) dias, se o comprador não tiver efetuado o pagamento, o débito será efetuado contra o vendedor. ART. 22° - As taxas do leilão são irrestituíveis, mesmo para os casos de anulação. ART. 23° - Os casos omissos serão julgados pelos vendedores e pela APPS, a seu exclusivo critério, sendo finais e definitivas as suas decisões, não podendo ser encaminha- do nenhum tipo de reclamação, sem primeiro ocorrer o acerto inicial. ART. 24° - É facultado ao vendedor a exigência de avalista. No caso da não aprovação do avalista indicado, o comprador ficará sujeito ao pagamento à vista. ART. 25° - O não pagamento de uma das notas promissórias implica no vencimento automático de todas as demais, ainda por vencer. ART. 26° - As vendas realizadas são irrevogáveis e irretratáveis, não podendo o comprador recusar o animal ou solicitar redução de preço (art. 1106 do Código Civil). Todos os participantes obrigam-se a acatar as disposições do regulamento, não po- dendo se excusarem de aceitá-las, alegando que não as conheciam (art. 3° da Lei de introdução Civil). ART. 27º - As éguas dadas como cheias far-se-ão acompanhar de atestado veterinário, entretan- to os compradores terão 48 (quarenta e oito) horas para confirma-la, por veterinário de sua confiança. Após esse prazo não mais serão aceitas reclamações. ART. 28° - Os compradores terão o direito de fazer examinar os animais, por veterinários de sua confiança não sendo aceitas devoluções posteriores à arrematação, conforme regula- mento dos leilões. ART. 29° - A APPS não é responsável por eventuais problemas nas aquisições feitas através do sistema telefônico implantado no leilão. ART. 30° - Os participantes deste leilão, especialmente inscritores e arrematadores, obrigam-se a acatarem as disposições destas normas Específicas, instituídas pelos Jockey Club de São Paulo, Jockey Club Brasileiro, Jockey Club do Rio Grande do Sul e Jockey Club do Paraná. ART. 31° - O Compromissário Comprador, depois de notificado por via postal, com prazo de cinco dias, outorga desde já poderes especiais e irrevogáveis aos Jockeys Clubes Brasilei- ro, de São Paulo, do Paraná e do Rio Grande do Sul, a critério do vendedor, para debitar em conta corrente do proprietário e/ou criador, todas as parcelas devidas e referentes ao presente compromisso de compra vencidas e não pagas nas épocas convencionadas, inclusive juros de mora e/ou multa contratual, dando como bons e corretos os débitos eventualmente feitos, sem direito a qualquer reclamação ou con- testação. Os valores debitados em conta corrente do Compromissário Comprador serão levados a crédito em conta corrente do Promitente Vendedor, caso não haja contranotificação fundamentada. Brenton Avdulla was a leading apprentice in Melbourne before a ‘chance’ phone call from Gai Waterhouse saw him relocate to Sydney to be indentured to her.
