NOTIFICATION No.4225-BCW/7P-41/18 – dated the 7 th September, 2018: In exercise of the power conferred by Section 13 of the West Bengal Scheduled Castes and Scheduled Tribes (Reservation of Vacancies in Services and Posts) Act, 1976 (West Ben. Act XXVII of 1976), the Governor is pleased hereby to make, with immediate effect, the following amendments in the West Bengal Scheduled Castes and Scheduled Tribes (Reservation of Vacancies in Services and Posts) Rules, 1976, published under this Department notification No. 374-TW/EC, dated the 16th August, 1976 (hereinafter referred to as the said rules ):-

Amendments In the said rules, -

(1) for rule 3, substitute the following rule :-

“3. Maintenance of register of appointments . – Every appointing authority shall maintain the register under clause (ii) of Schedule I of the Act and the Appendix I of these rules for Register of Appointments in respect of the direct recruitment or promotion.”; (2) after rule 3, insert the following rule :-

“3A. Maintenance of register of appointments, (ROA) by electronic means . – Every appointing authority shall maintain the Register of Appointments (ROA) on online basis as provided in the website www.wbreservation.gov.in as per modified Appendix I, may register and furnish the details for actions taken or to be taken under sections 4 and 6.”;

Filling of annual report of appointments of Scheduled Castes, Scheduled Tribes by electronic means . – Every appointing authority shall furnish annual report on an online basis provided in the website, www.wbreservation.gov.in in the modified format in Appendix II, Appendix IIIA and Appendix IIIB, and may register and furnish details as required under section 12(1).”;

(4) for rule 5, substitute the following rule :-

“5. Categorisation of services . – For the purposes of submission of reports referred to in rule – 4, or rule 4A, as the case may be, categorisation of services in different establishments shall be as laid down in the relevant Revision of Pay and Allowances Rules, applicable from time to time.”;

(5) for sub-rule (b) of rule 10, substitute the following sub-rule :- “(b) If a candidate from the Scheduled Castes or the Scheduled Tribes obtains promotion on the basis of merit with due regard to seniority, his promotion shall be made against unreserved vacancy and reserved vacancies shall be filled up by selecting candidates from the remaining Scheduled Castes or Scheduled Tribes candidates irrespective of merit but who are within the normal zome of consideration and are considered fit for promotion :

Provided that for the purpose of fitness, all Scheduled Caste and Scheduled Tribe employees who are within the normal zone of consideration for promotion to higher posts shall be given one grading higher than the grading assigned to them on the basis of their record of service excepting in those cases where it has already been accorded:

Provided further that the number of Scheduled Caste or Scheduled Tribe employees appointed on promotion to any unreserved vacancy in a service or post in any establishment to be filled up by promotion shall not be deducted from the quota reserved in such service or post for promotion for the members of the Scheduled Castes or Scheduled Tribes”;

(6) for Appendix I, substitute the following Appendix :-

NOTIFICATION No.3531-PL/PI/8C-15/07 Dated.04.12.2018: In exercise of the power conferred by Sec 2A of the Police Act, 1861(V of 1861), the Governor, in supersession of the earlier rules on the subject, if any is hereby pleased to make the following rules regulating Recruitment to the posts of Wireless Operator, Wireless Supervisor [Technical] Grade-II and Wireless Supervisor(Operational) Grade-II in West Bengal Police under Home(Police) Department, Government of West Bengal:-

Rules 1. Short Title and Commencement: (i) These rules may be called the Wireless Operator , Wireless Supervisor(Technical) Grade-II, Wireless Supervisor(Operational)Grade-II (Recruitment) Rules 2018. (ii) These rules shall come into force on and from the date of their publication in official Gazette.

2. Recruiting Agency : 1. Direct Recruitment to the posts of Wireless Operator, Wireless Supervisor(Technical ) Grade-II and Wireless Supervisor (Operational) Grade-II in West Bengal Police shall be made through the West Bengal Police Recruitment Board. 2. The West Bengal Police Recruitment Board shall invite applications from eligible candidates through advertisement.

3. The Method of Recruitment The posts of wireless Operator , Wireless Supervisor(Technical) Grade-II, Wireless Supervisor(Operational) Grade II in West Bengal Police shall be filled up from amongst the eligible candidates in the following manner:- (a) Name of the Post : Wireless Operator 100% of the posts of Wireless Operators in West Bengal shall be filled up by direct recruitment(selection) on the basis of the candidate’s qualifying in the Preliminary Examination(screening test) followed by the Physical Measurement test, Physical Efficiency Test, Final Competitive Examination and personality test. West Bengal Police Gezette 12 th April, 2019 10 (b) Name of the post: Wireless Supervisor [Technical]Grade-II, Wireless Supervisor(Operational) Grade-II (i) 50% of the posts of Wireless Supervisor(Technical) Grade-II and Wireless Supervisor(Operational) Grade-II in West Bengal Police shall be filled up by selection (direct recruitment ) on the basis of the candidate’s qualifying the preliminary Examination(screening test) followed by the Preliminary Measurement Test, Physical Efficiency test, Final Combined Competitive Examination and personality test. The plan of examination as stated under rule 5(b) of these rules; and (ii) 50% of the combined sanctioned strength of Wireless Supervisor(Technical) Grade-II and Wireless Supervisor(Operational) Grade-II in West Bengal Police shall be filled up by promotion from the post of Wireless Operator on the basis of Seniority.

4. Name of the Post: Wireless Operator (a) Eligibility Criteria: (i) The Candidate must be a citizen of . (ii) The candidate must have passed the Higher Secondary Examination(10+2) conducted by WBCHSE or equivalent Examination from any of the recognized Boards in Science with Physics and Mathematics. (iii) Language: (a) The candidate must be able to read , write and speak in .

However, the provision will not be applicable to the persons who are permanent residents of hill sub-divisions of and Districts. (b) For the applicant of hill sub-divisions of Darjeeling and , the provisions laid down in the West Bengal official language Act, 1961 will be applicable. (iv) Candidates should be in good mental and physical health. They should be free from any deformity likely to interfere with efficient performance of their work. (v) The age of the candidate must not be less than 18(eighteen) years and must not be more than 27 (twenty seven) years as on the 1 st January of the year of advertisement. The upper age limit shall be relaxable by 5(five) years in case of Scheduled Caste and Scheduled tribe candidates, by 3(three) years in the case of other Backward Class candidates and by 5(five) years in the case of Ex-serviceman candidates. Note : The personnel of West Bengal Police and having requisite qualifications and age are eligible to apply for the post provided that no departmental candidates shall be allowed to appear in the Competitive Examination more than three times. (b) Plan of Examination and Test (i) Preliminary Examination:

The Candidates will have to qualify this test. Total marks, syllabus and the minimum qualifying marks will be decided by the West Bengal Police Recruitment Board. Marks obtained in the Preliminary Examination will not be considered while preparing the final merit list of selection.

(ii) Final Competitive Examination: Candidates qualified in PMT and PET will have to appear in Final Competitive Examination. Police Recruitment Board may, from time to time prepare syllabus, fix total and qualifying marks for the written examination with the approval of the State Government

(iii) Personality Test: A limited number of the candidates fulfilling all the eligibility criteria for the post will be selected for a personality test on the basis of merit wise, based on the result of the Final Competitive Examination. Full Marks and pass marks for the personality test will be decided by the West Bengal Police Recruitment Board from time to time with the approval of the State Government. The final merit list of the provisionally selected candidates shall be prepared on the basis of the total marks obtained in the final Competitive Examination and the marks obtained in the Personality Test.

5. Name of the Post: Wireless Supervisor(Technical) Grade-II and Wireless Supervisor (Operational) Grade-II (a) Eligibility Criteria : (i) The candidate must be a citizen in India. (ii) The candidate must be a holder of a Bachelor’s degree with any of the following subjects:- Physics or Radio Physics or Electronics and Telecommunications or Electrical Engineering or Computer Science or Information Technology from any recognized University. (iii) Language -(a) The candidate must be able to read, write and speak In Bangali language. However, this provision will not be applicable to the persons who are permanent residents of hill sub-divisions of Darjeeling and Kalimpong Districts. (b) For the applicant of hill sub-divisions of Darjeeling and Kalimpong district, the provisions laid down in the West Bengal official language Act, 1961 will be applicable. (iv) Candidates should be in good mental and physical health. They should be free from any deformity likely to interfere with efficient performance of their work. (v) The age of the candidate must not be less than 21(twenty one) years and must not be more than 30(thirty) years sa on the 1 st January of the year of advertisement. (b) Plan of Examination and Test

(iii) Personality Test: A limited number of the candidates fulfilling all the eligibility criteria for the post will be selected for a personality test on the basis of merit, based on the result of the Final Competitive Examination. Full marks and pass marks for the personality test will be decided by the West Bengal Police Recruitment Board from time to time with the approval of the State Government. The candidates who fail to secure the pass mark in the personality test shall stand disqualified for the post, and as such shall not be in the zone of consideration for final selection. The final merit list of the provisionally selected candidates shall be prepared on the basis of the total marks obtained in the Final Competitive Examination and the marks obtained in the Personality Test.

6. Choice of posts in order of preference: The candidate applying for the posts of Wireless Supervisor shall be required to indicate his/her choice of posts on offer, in order of preference, such as Wireless Supervisor (Technical) Grade-II, WBP/Wireless Supervisor (Operational) Grade- II, WBP at the time of submission of the application. Such choice of posts shall be deemed final and shall be taken into consideration wh ile making recommendation for appointment after selection by direct recruitment.

7. Reservation of Posts: The reservation of posts for Scheduled Castes, Scheduled Tribes and OBC categories shall be as per orders issued by the State Government from time to time.

8. Verification of Character Antecedents: The character and antecedents of all the provisionally selected candidates shall be verified meticulously by the competent authority. For the purpose the provisionally selected candidates shall be required toi fill up a Verification Roll. 9. Medical Examination:

a) All Provisionally selected candidates will be sent for Medical Examination at the State Government designated hospitals. b) The selected candidates should be in good mental and physical health. They should be free from any deformity likely to interfere with efficient performance of their work. c) The candidates will undergo all necessary medical tests as prescribed by the Department of Health and Family Welfare, Government of West Bengal from time to time. d) The certificate of medical fitness will be issued by an authorized medical officer. 10. Appointing Authority: Assistant Inspector General of Police or Superintendent of Police, Telecommunication, West Bengal.

11. Discharge: (1) The Wireless Operator or Wireless Supervisor (Technical) Grade-II or Wireless Supervisor (Operational) Grade-II in West Bengal Police, while undergoing Basic Training as State Police Academy or at any Subsidiary Training Centre under West Bengal Police or undergoing the Training in telecommunication at the Training Centre at the HQ of West Bengal Police Telecommunication or undergoing probation is liable to be discharged by the appointing authority if he or she is considered by the said authority to be unsuitable for the post, the order of discharge shall be given effect to after its confirmation by the immediate higher authority.

(2) No appeal shall lie against the order of discharge during training/probation.

12. Savings:

Notwithstanding anything contained in these rules, the persons appointed on regular basis or substantively to the posts covered under these rules prior to the rules coming into force shall be deemed to have been appointed under these rules.
