COVID-19 PREVENTION AND SELF-ISOLATION ORDER

TO: All persons residing in or present in Prince Edward Island; and

All businesses, services and organizations operating or carrying on business in Prince Edward Island

WHEREAS a state of public health emergency was declared in Prince Edward Island on March 16, 2020 as a result of the COVID-19 pandemic pursuant to Order in Council EC2020-174, and continued on April 15, 2020 by Order in Council EC2020-254, on May 15, 2020 by Order in Council EC2020-305, on June 15, 2020 by Order in Council EC2020-350, on July 14, 2020 by Order in Council EC2020-435, on August 14, 2020 by Order in Council EC2020-488, on September 13, 2020 by Order in Council EC2020- 542, on October 13, 2020 by Order in Council EC2020-603, on November 12, 2020 by Order in Council EC2020-649, on December 12, 2020 by Order in Council EC2020-724, on January 11, 2021 by Order in Council EC2021-1, on February 10, 2021 by EC2021-71, on March 12, 2021 by Order in Council EC2021-138, on April 11, 2021 by Order-in-Council EC2021-271, on May 11, 2021 by Order-in-Council EC2021-407 and on June 10, 2021 by Order-in-Council EC2021-494;

AND WHEREAS in consultation with the Lieutenant Governor in Council, I believe it is reasonably nec- essary to impose special measures in the Province in order to protect the health of the population;

AND WHEREAS I, as the Chief Public Health Officer, pursuant to subsection 39(2) of the Act, believe on reasonable and probable grounds that:

(a) a communicable disease, COVID-19, including any new variants of the virus causing COVID-19, exists or may exist in the Province;

(b) the communicable disease presents a risk to the health of persons in the Province; and

(c) the requirements specified in this Order are necessary to prevent, decrease or eliminate the risk to health presented by the communicable disease;

AND WHEREAS pursuant to subsection 39(1) of the Act, I, as the Chief Public Health Officer, may require a person to take or refrain from taking any action that is specified in this Order in respect of a com- municable disease;

AND WHEREAS pursuant to clauses 49(2)(c.1) and (d) of the Act, I, as the Chief Public Health Officer, may order persons to refrain from entering or attending a public place or premises; to refrain from assem- bling in a public gathering in a specified area; limit the number of persons who will be permitted to attend a public gathering; or limit the purpose for a public gathering;

AND WHEREAS pursuant to clause 49(2)(g) of the Act, I, as the Chief Public Health Officer, may order any other measure that is reasonably believed to be necessary for the protection of the health of the popula- tion during the public health emergency;

AND WHEREAS the reasons for this Order are the global COVID-19 pandemic, the health risks posed by the pandemic, including health risks posed by new variants of the virus causing COVID-19, and the necessity to prevent, decrease or eliminate those health risks;

AND WHEREAS testing and isolating individuals who test positive for COVID-19, and any variants of concern, will prevent transmission of the virus and the associated illness and death and protect Prince Edward Island’s health care system; princeedwardisland.ca/royalgazette July 3, 2021 ROYAL GAZETTE 1081

AND WHEREAS, at the time of making this Order, recommendations from the National Advisory Com- mittee on Immunization inform that first doses of currently authorized COVID-19 vaccines in Canada have been shown to offer at least short-term protection against COVID-19 disease and that approximately two weeks after receiving a completed series, authorized vaccines have been shown to be highly efficacious in the short term against confirmed symptomatic COVID-19 disease, appear to be efficacious against severe COVID-19 outcomes such as hospitalization or death and may reduce asymptomatic infection and trans- mission of the COVID-19 virus;

AND WHEREAS pursuant to subsection 56(1) of the Act, I, as the Chief Public Health Officer, may require any person to provide information that the Chief Public Health Officer reasonably considers necessary to:

(a) assess the threat that a disease presents to public health and plan for and address the threat; or

(b) evaluate and monitor the health and safety of the general public.

NOW THEREFORE, pursuant to my authority under subsections 39(1), 49(2), 49(3), and 56(1) of the Act, I hereby order as follows:

Definitions

1. In this Order:

(a) “close contact” means:

(i) A person who provides care for or has close (within two metres) physical contact with a person who is confirmed or suspected to be infected with COVID-19;

(ii) A person who has close, prolonged, physical contact with a person who is a probable or confirmed case of COVID-19 during the person’s illness with COVID-19 or within 48 hours of the onset of the probable or confirmed case’s COVID-19 symptoms;

(iii) A person who comes into direct contact with the infectious body fluids (for example: a cough or a sneeze) of a person who is confirmed or suspected to be infected with COVID-19; or

(iv) A person who is exposed to COVID-19 in such other conditions as determined by the Chief Public Health Officer

but does not include a person who consistently and appropriately uses personal protective equip- ment while caring for a person who is confirmed or suspected to be infected with COVID-19.

(b) “COVID-19 molecular test” means a COVID-19 screening or diagnostic test carried out by an accredited laboratory, including a test performed using the method of polymerase chain reaction (PCR) or reverse transcription loop-mediated isothermal amplification (RT-LAMP).

(c) “COVID-19 vaccination record” means a record of information provided by a person to a public health official to indicate that the person has been vaccinated for COVID-19 on a certain date(s) with one dose or two doses of a vaccine authorized by Health Canada for use in relation to the COVID-19 pandemic, and which record may include a record of vaccination from a province or territory in Canada which details:

(i) the person’s name, address, provincial health number and date of birth;

(ii) the name of the vaccine and the dose administered; princeedwardisland.ca/royalgazette 1082 ROYAL GAZETTE July 3, 2021

(iii) identification of the manufacturer and lot number of the vaccine;

(iv) the date on which the vaccine was administered.

(d) “essential services” means services that, if interrupted, would endanger the life, health, or per- sonal safety of whole or part of the population, including essential services listed at https://www. publicsafety.gc.ca/cnt/ntnl-scrt/crtcl-nfrstrctr/esf-sfe-en.aspx.

(e) “fully vaccinated” means, in relation to an individual, that the individual has received a com- pleted series of a vaccine authorized by Health Canada for use in relation to the COVID-19 pandemic.

(f) “household” means persons who normally reside together at a residence.

(g) “letter of approval issued by a public health official” means a letter of approval issued to a person pursuant to the Chief Public Health Officer’s Travel Restrictions Order effective June 27, 2021, as may be amended or replaced from time to time.

(h) “mask” means a commercial medical or non-medical mask or home-made mask made in accor- dance with the Public Health Agency of Canada instructions located at: https://www.canada.ca/ en/public-health/services/diseases/2019-novel-coronavirus-infection/prevention-risks/sew-no- sew-instructions-non-medical-masks-face-coverings.html, that covers the nose and mouth.

(i) “negative test result for COVID-19” means, in relation to an individual, a negative result for a COVID-19 molecular test that was performed on a specimen collected from the individual no more than 72 hours prior to the date of the individual entering the Province, which test result must contain:

(i) the individual’s name and date of birth;

(ii) the name and civic address of the facility that administered the test;

(iii) the date the test was performed;

(iv) the type of test that was performed; and

(v) the test result.

(j) “organizer” means the person who submits, to the Chief Public Health Officer, the operational plan for an organized gathering under the Organized Gatherings sections of this Order.

(k) “partially vaccinated” means:

(i) in relation to an individual 18 years of age or older, 21 days after the individual has received one dose of a two-dose series of a vaccine authorized by Health Canada for use in relation to the COVID-19 pandemic; and

(ii) in relation to an individual 12 to 17 years of age, that the individual has received one dose of a two-dose series of a vaccine authorized by Health Canada for use in relation to the COVID-19 pandemic.

(l) “PEI pass” means a document issued to a person, 12 years of age or older, by a public health of- ficial which indicates that: princeedwardisland.ca/royalgazette July 3, 2021 ROYAL GAZETTE 1083

(i) a resident of Prince Edward Island, who has not been outside Atlantic Canada or the Magdalen Islands in the 14 days prior to entering the Province and who is fully vac- cinated or partially vaccinated does not need to self-isolate after entering the Province, subject to any requirements as may be determined by the Chief Public Health Officer;

(ii) a resident of the Magdalen Islands, New Brunswick, Newfoundland and Labrador or Nova Scotia who has not been outside Atlantic Canada or the Magdalen Islands in the 14 days prior to entering the Province and who is fully vaccinated or partially vaccinated may enter the Province and does not need to self-isolate after entering the Province, subject to any requirements as may be determined by the Chief Public Health Officer;

(iii) a person who is not a resident of Atlantic Canada or the Magdalen Islands who has not been outside Atlantic Canada in the 14 days prior to entering the Province and who is fully vaccinated or partially vaccinated may enter the Province and does not need to self- isolate after entering the Province, subject to any requirements as may be determined by the Chief Public Health Officer;

(m) “PEI Self-isolation Declaration for Atlantic Travel” means a document issued by a public health official to a person pursuant to the Chief Public Health Officer’s Travel Restrictions Order -effec tive June 27, 2021, as may be amended or replaced from time to time

(n) “public place” means any part of the following places accessible to the public, insofar as it is enclosed:

(i) a retail business, a shopping centre, or a building or room of a business where services are provided;

(ii) a restaurant or a liquor licensed establishment;

(iii) a place of worship or faith gathering;

(iv) a place where activities or services of a cultural or entertainment nature are offered;

(v) a place where sports are played or recreational activities are carried on;

(vi) a rental hall or other place used to hold events, including conventions and conferences, or to hold receptions;

(vii) a place where Government services are available to the public;

(viii) a common area, including an elevator, in a tourism establishment, as defined under the Tourism Industry Act R.S.P.E.I. 1988, Cap. T-3.3;

(ix) a lobby, reception area, stairwell or elevator in an office building other than an apartment building;

(x) a common area or public space on a university or college campus; and

(xi) a train or bus station, a ferry terminal, or an airport.

(o) “self-isolate” means compliance with the following measures:

(i) A person must remain in their residence or residence grounds, except to seek medi- cal care or due to extraordinary circumstances including reasons of personal safety. A person who resides in an apartment building, condominium, rental accommodation, rooming house, or other attached housing must remain on the residence’s property and maintain a two-metre distance from other persons at all times while in common areas, corridors, stairwells, elevators, other shared spaces, and outdoors;

(ii) If a person must leave their residence or the residence’s property for a reason outlined in sub-clause (i), the person must maintain a two-metre distance from other persons at all times, other than during treatment by a health care worker; and

(iii) all additional self-isolation requirements published at: https://www.princeedwardisland. ca/en/information/health-and-wellness/covid-19-self-isolation.

Points of Entry

2. Every person arriving on Prince Edward Island at any and all points of entry shall:

(a) stop when instructed to do so by a peace officer or public health official;

(b) answer any questions posed and provide all information requested by a peace officer, public health official, or health practitioner, including but not limited to: name, proof of identification, place of ordinary residence, license plate number, contact information, travel details, reason for travelling into the Province, occupation, employer, employer contact, work location and symp- tom information;

(c) if requested by a public health official or health practitioner, submit to such tests, including a COVID-19 molecular test, and examinations as may be required by the Chief Public Health Officer;

(d) if requested by a public health official or a peace officer, provide a person’s negative test result for COVID-19;

(e) if requested by a public health official or a peace officer, provide a person’s COVID-19 vaccina- tion record where necessary;

(f) declare if they are experiencing symptoms of COVID-19 including coughing, difficulty breath- ing, or fever; and

(g) if requested by a public health official or a peace officer, provide complete details of their self- isolation plan, any applicable letter of approval from a public health official, their Self-isolation Declaration for Atlantic Travel or their PEI Pass.

Mandatory Self-Isolation

3. Unless exempted by the Self-Isolation Exemption Order or as directed by a public health official, persons travelling into, residing in or present in Prince Edward Island who fall under any of the cat- egories below shall self-isolate for the period of time specified here. For greater certainty, mandatory self-isolation for an individual under this Order is based on that individual’s circumstances, and self- isolation requirements for an individual may change and be affected, for example, by travel, testing for COVID-19, failing to submit to a required test, symptoms of COVID-19 or contact with others affected by COVID-19: princeedwardisland.ca/royalgazette July 3, 2021 ROYAL GAZETTE 1085

(a) Persons diagnosed with COVID-19 shall self-isolate for a period of at least 10 days, including 10 days after the onset of symptoms, and such additional time until the person is cleared by a public health official.

(b) Persons who are symptomatic and awaiting the results of a test for COVID-19 shall self-isolate as follows:

(i) A person with a history of travel shall self-isolate for 14 days if the person’s history of travel was international and for 8 days if the person’s history of travel was domestic, regardless of whether a negative test result is received during that period;

(ii) A person who is symptomatic without a history of travel is not required to self-isolate after receipt of a negative COVID-19 test result.

(c) Persons who are not fully vaccinated and are identified as a close contact of

(i) a confirmed case of COVID-19, or

(ii) a suspected case of COVID-19

shall self-isolate for a period of 14 days from the last day of being a close contact, regardless of whether a negative test result for COVID-19 is received during that period. For greater certainty, a person is no longer considered a suspected case if they fall under sub-clause 3(b)(ii) and have received a negative COVID-19 test result.

(d) Persons who are household members of a person who is self-isolating as a result of potential exposure to COVID-19 (such as history of travel or a close contact with a positive case) shall self-isolate for a period of 14 days or for a period of 8 days if history of travel was domestic from the last day of contact with the person who is self-isolating unless the person who is self isolating, while staying in the same residence:

(i) has their own separate room in the residence;

(ii) sanitizes their hands before leaving the separate room;

(iii) wears a non-medical mask when outside the separate room;

(iv) avoids being in the same space as other household members;

(v) has their own bathroom, or if sharing a bathroom in the residence, cleans high-touch surfaces (e.g. doorknob, tap, toilet handle, sink, tub) after each use;

(vi) has food and beverages prepared by others and accesses them in a non-contact manner;

(vii) does not share dishes, drinking glasses, cups, eating utensils, towels, bedding or other household items with others in the residence;

(viii) keeps their personal items (e.g. toothbrush, cups, cell phones, tablets, laptops) separate from those belonging to other household members; and

(ix) does not share food, drinks, cigarettes or any other orally-consumed items with house- hold members. princeedwardisland.ca/royalgazette 1086 ROYAL GAZETTE July 3, 2021

(e) Persons travelling into the Province from outside Canada on and after June 17, 2021 shall self- isolate for 14 days from their date of entry to the Province or for the duration of their stay in the Province (if shorter than 14 days), regardless of whether a negative test result for COVID-19 is received during that period.

(f) Notwithstanding clause (e), persons travelling into the Province from outside Canada on and after June 17, 2021 who are not required to quarantine or self-isolate after entering Canada pursuant to any Order of the Government of Canada under section 58 of the Quarantine Act (Canada) shall self-isolate for 8 days from their date of entry to the Province or for the duration of their stay in the Province (if shorter than 8 days), regardless of whether a negative test result for COVID-19 is received during that period.

(g) Persons travelling into the Province from within Canada on and after June 27, 2021 shall self- isolate for 8 days from their date of entry to the Province (including, subject to the federal requirements, if the person is travelling into the Province after having completed part of the quarantine or self-isolation required pursuant to any Order of the Government of Canada under section 58 of the Quarantine Act (Canada) in another province or territory) or for the duration of their stay in the Province (if shorter than 8 days), regardless of whether a negative test result for COVID-19 is received during that period.

Mandatory Self-Isolation – Temporary Foreign Workers

4. Subject to clause 3(f) and section 5, effective June 17, 2021, all temporary foreign workers travelling into the Province shall self-isolate for 14 days at a quarantine facility designated by the Minister of Health and Wellness, regardless of whether a negative test result for COVID-19 is received during that period.

5. The following temporary foreign workers are exempt from the requirements in section 4:

(a) temporary foreign workers employed by an employer that has submitted a transition plan which addresses self-isolation requirements, and which plan has been approved by the Chief Public Health Officer; and

(b) such other temporary foreign workers as may be otherwise exempted by the Chief Public Health Officer under exceptional circumstances, provided satisfactory arrangements have been made for the temporary foreign worker to comply with self-isolation requirements.

6. Temporary foreign workers exempted from the requirements of section 4 who travel into the Province shall remain subject to the requirement to self-isolate in accordance with this Order, an applicable transition plan, and applicable directions of the Chief Public Health Officer.

Testing Requirements

7. Every person present in Prince Edward Island shall submit to such tests, including a COVID-19 molecular test, and examinations as may be required for a public health purpose by the Chief Public Health Officer.

Masking Requirements

8. Effective 12:01 a.m. November 20, 2020, all persons must wear a mask while present in a public place.

9. Notwithstanding section 8, a person is exempt from the requirement to wear a mask while present in a public place if the person:

(a) is less than 2 years of age:

(b) is age 2 to 5 years and will not wear a mask;

(c) is a person for whom the wearing of the mask is not possible because of the person’s medical condition;

(d) cannot remove their mask without assistance;

(e) is reasonably accommodated by not wearing a mask in accordance with the Human Rights Act, R.S.P.E.I 1988, Cap. H-12;

(f) is in the public place receiving care or being provided a service or while participating in a physi- cal or other activity requiring the mask be removed, in which case the person may remove the mask for the duration of the care, service or activity;

(g) removes the mask momentarily for identification or ceremonial purposes;

(h) is in a courtroom, jury room or secured area in a courthouse, or room where a proceeding or meeting of an administrative tribunal established by legislation is being held;

(i) is consuming food or a beverage in a public place;

(j) is a performer, performers in a small group or an officiant in the course of performing activities requiring the playing of a wind instrument, or vocalization such as talking or singing at the fol- lowing events or activities:

(i) conventions, conferences or speaking engagements;

(ii) social events;

(iii) arts and culture events;

(iv) sports and physical activity; or

(v) weddings, funerals and other faith gatherings.

10. Effective 12:01 a.m. November 20, 2020, all persons must wear a mask while travelling on vehicles providing transportation to the public, including:

(a) any public transit, including municipally-operated buses;

(b) any public passenger vehicle, including community transit vehicles, commercial vehicles (shut- tle vans), and vehicles providing charters or tours or both;

(c) any school buses operated by an education authority under the Education Act, R.S.P.E.I. 1988, Cap. E-.02, and any vehicles of any capacity operated by private schools registered under the Private Schools Act, R.S.P.E.I. 1988, Cap. P-20.01;

(d) commuter vehicles, courtesy vehicles, vans, mini-buses, or buses of any passenger capacity providing services to the public;

(e) taxicabs, as defined in the Highway Traffic Act, R.S.P.E.I. 1988, Cap. H-5, operating in Prince Edward Island.

11. Notwithstanding section 10, the following persons are exempt from the requirement to wear a mask while travelling on vehicles providing transportation to the public:

(a) a person who is less than 2 years of age;

(b) a person who is age 2 to 5 years and will not wear a mask;

(c) a person for whom the wearing of a mask is not possible because of the person’s medical condition;

(d) a person who cannot remove their mask without assistance; and

(e) a person who is reasonably accommodated by not wearing a mask in accordance with the Human Rights Act, supra.

12. A person may remove the mask momentarily for identification purposes when boarding any public transit set out in section 10.

13. The requirements to wear a mask as set out in this Order do not apply to persons in public places that are in compliance with the following, as applicable:

(a) Directive on Visitation to Long-Term Care Facilities and Nursing Homes;

(b) Directive on Schools;

(c) Directive on Licensed Child Care Centres;

(d) Guidance for Unlicensed Child Care Centres; and

(e) Private Community Care Facilities Visitation Guidance.

14. For greater certainty, the requirements to wear a mask as set out in this Order are the minimum stan- dards that persons, businesses, services and organizations must adhere to, and where the business, service or organization’s operational plan required in accordance with this Order imposes a greater standard, then that standard applies.

15. For greater certainty, the requirements to wear a mask as set out in this Order do not replace the im- portance of compliance with all other public health preventative measures required such as physical distancing and hand hygiene.

16. For greater certainty, nothing in this Order affects in any way the masking requirements set out in the Self-Isolation Exemption Order.

Businesses, Services and Organizations

17. Businesses, services and organizations may provide services to the public at a location that is acces- sible to the public in accordance with this Order. princeedwardisland.ca/royalgazette July 3, 2021 ROYAL GAZETTE 1089

18. Effective June 6, 2021, businesses, services and organizations outlined here must comply at all times with the preventative measures described in this section, in addition to following all applicable public health measures:

(a) Operators of businesses, services and organizations that offer food and beverage services, in- cluding all Liquor Control Act, R.S.P.E.I. 1988, Cap. L-14-licensed facilities, may open the business, service or organization to the public, but must:

(i) limit the number of persons on the premises in accordance with the Organized Gather- ings sections of this Order;

(ii) limit table capacity to a maximum of 20 persons at a table and ensure there is a distance of two metres or more between tables; and

(iii) ensure patrons remain seated at all times, except for when entering, exiting, using the washroom or picking up take-out; for greater certainty, the requirement for patrons to remain seated means that food and beverage should be served to or consumed by patrons while the patrons are seated except where an operational plan provides for patron self- serve options;

(b) Operators of businesses, services and organizations that operate recreation facilities, including museums, libraries and casinos, may open the business, service or organization to the public, but must ensure that any group activities operated by the business, service or organization are organized in accordance with the Organized Gatherings sections of this Order;

(c) Operators of businesses, services and organizations that operate fitness facilities and gyms may open the fitness facility or gym to the public, but must ensure, that physical distancing of two metres is maintained between patrons and that any group activities operated by the business, service or organization are organized in accordance with the Organized Gatherings sections of this Order;

(d) Operators of businesses, services or organizations that offer organized recreation or team sports may continue those activities, in accordance with the Organized Gatherings sections of this Order;

(e) Operators of businesses, services and organizations that offer personal services, such as hair and nail services, massage services, tattoo services and acupuncture services, must ensure that a non-medical mask is worn at all times by employees and patrons;

(f) Operators of businesses, services or organizations that offer worship services or that operate movie theatres, concert halls and bingo halls may remain open to the public, in accordance with the Organized Gatherings sections of this Order.

19. Businesses, services and organizations that are closed to the public under this Order may continue to operate serving the public by means of telephone, virtual services, delivery, and pick-up, provided that owners and operators of those services comply at all times with the preventative measures de- scribed under this Order.

20. Owners and operators of businesses, services and organizations that are permitted to operate under this Order shall take the following preventative measures:

(a) take every reasonable step to ensure minimal interaction of people (including employees and patrons) within two metres of each other; princeedwardisland.ca/royalgazette 1090 ROYAL GAZETTE July 3, 2021

(b) take every reasonable step necessary to prevent employees who are required to self-isolate, as provided above, from entering workplaces;

(c) develop and follow an exclusion policy that ensures symptomatic employees are immediately excluded from work activities;

(d) develop and follow an operational plan detailing how risk of transmission of COVID-19 will be mitigated;

(e) ensure enhanced cleaning and disinfection of shared areas and surfaces;

(f) ensure hand washing stations are available;

(g) ensure compliance with masking requirements set out in this Order;

(h) follow any direction issued to a specific class of businesses, services or organizations, as refer- enced in Appendix A, as may be amended from time to time; and

(i) follow any other direction issued to the business, service or organization by the Chief Public Health Officer.

21. All child care facilities, including licensed and unlicensed centres, are permitted to be open to the public. Licensed centres must comply with the Chief Public Health Officer’s Directive on Licensed Child Care Centres, as may be amended from time to time. Unlicensed centres must comply with the Chief Public Health Officer’s Guidance for Unlicensed Child Care Centres, as may be amended from time to time.

22. All Kindergarten – grade 12 public and private schools in the Province may offer in-person learning, may have a contingency plan for remote learning and must comply with the Chief Public Health Of- ficer’s Directive on Schools, as may be amended from time to time.

23. All post-secondary education and training institutions in the Province may offer in-person learning with the public health measures as outlined in section 20 in place, or may operate by remote learning.

Personal Gatherings

24. Except as outlined in section 25, all persons are prohibited from attending a personal gathering with persons outside their household at an indoor location or at an outdoor location. A personal gathering includes a gathering at a private residence, public space or public place and which includes persons from different households.

25. Section 24 does not apply to:

(a) organized gatherings which are conducted in accordance with the Organized Gatherings sections of this Order;

(b) businesses, services or organizations (including child care facilities) which are permitted to operate under the Businesses, Services and Organizations sections of this Order or any specific direction of the Chief Public Health Officer;

(c) facilities where health care or social services are provided;

(d) a service provider who enters a residence to perform work at the residence; princeedwardisland.ca/royalgazette July 3, 2021 ROYAL GAZETTE 1091

(e) persons from different households who carpool or share drives in an automobile where all per- sons wear a non-medical mask and take every reasonable step to ensure as much distance as possible between themselves and persons from other households; and

(f) an individual who gathers at an indoor location or at an outdoor location where:

(i) there are no more than 20 persons present at the indoor location or at the outdoor location;

(ii) all persons attending the personal gathering are asymptomatic of COVID-19; and

(iii) the personal gathering is not held at the residence of a person who is self-isolating.

Organized Gatherings

26. Effective June 27, 2021, except as permitted under sections 27, 28, 29 and 30, no person shall hold an organized gathering at an indoor location or at an outdoor location.

27. Organized gatherings, including worship services, of up to 50 persons, in addition to staff and offici- ants necessary for the gathering, are permitted to be held at an indoor location or at an outdoor loca- tion provided the organizer:

(a) develops, follows and makes available for inspection, to the persons at the gathering and to the Chief Public Health Officer, an operational plan detailing how risk of transmission of COVID-19 will be mitigated at the gathering;

(b) communicates details of the operational plan outlined in (a) to persons present at the organized gathering, including staff, participants and volunteers, before and at the time of the organized gathering;

(c) maintains oversight of the organized gathering to ensure all persons in attendance comply with the requirements of the operational plan outlined in clause (a), including to ensure that the num- ber of persons present does not exceed the number of persons documented in the operational plan; and

(d) maintains, in written or electronic format, an accurate and legible contact-tracing record of all people, including their contact information, present at the gathering for the purpose of providing the record to the Chief Public Health Officer to facilitate contact tracing, if necessary, which contact-tracing record:

(i) must be available to the Chief Public Health Officer promptly after a request to the orga- nizer from the Chief Public Health Officer for the record;

(ii) must be stored in a safe, secure location for one month after creation of the contact- tracing record and then disposed of using a secure destruction method, to maintain the confidentiality of personal information collected under this section; and

(iii) must be made in accordance with any business sector-specific guidance issued by the Chief Public Health Officer.

28. Organized gatherings for weddings and funerals, including worship services and receptions, of more than 50 persons to a maximum of 150 persons, are permitted to be held at an indoor location or at an outdoor location provided: princeedwardisland.ca/royalgazette 1092 ROYAL GAZETTE July 3, 2021

(a) the organizer of the gathering ensures the premises or place where the gathering is held is physi- cally divided into separate areas which contain no more than 50 persons each;

(b) the organizer of the gathering:

(i) obtains prior approval from the Chief Public Health Officer;

(ii) develops, follows and makes available for inspection, to the persons at the gathering and to the Chief Public Health Officer, an operational plan detailing how risk of transmission of COVID-19 will be mitigated at the gathering;

(iii) communicates details of the operational plan outlined in (ii) to persons present at the organized gathering, including staff, participants and volunteers, before and at the time of the organized gathering;

(iv) maintains oversight of the organized gathering to ensure all persons in attendance com- ply with the requirements of the operational plan outlined in sub-clause (ii), including to ensure that the number of persons present does not exceed the number of persons documented in the operational plan;

(v) maintains a contact-tracing record in accordance with clause 27(e);

(vi) does not hold the gathering unless the organizer is a business, service or organization permitted to operate under the Businesses, Services and Organizations sections of this Order;

(vii) complies, to the extent possible, with the Multiple Gatherings Guidance; and

(viii) complies with any other direction issued by the Chief Public Health Officer.

29. Organized gatherings, including worship services, of more than 50 persons to a maximum of 200 persons, are permitted to be held at an indoor location or at an outdoor location provided:

(a) the organizer of the gathering is not organizing a wedding (including a wedding reception) or a funeral (including a funeral reception);

(b) the organizer of the gathering ensures the premises or place where the gathering is held is physi- cally divided into separate areas which contain no more than 50 persons each;

(c) the organizer of the gathering:

(i) obtains prior approval from the Chief Public Health Officer;

(ii) develops, follows and makes available for inspection, to the persons at the gathering and to the Chief Public Health Officer, an operational plan detailing how risk of transmission of COVID-19 will be mitigated at the gathering;

(iii) communicates details of the operational plan outlined in (ii) to persons present at the organized gathering, including staff, participants and volunteers, before and at the time of the organized gathering;

(iv) maintains oversight of the organized gathering to ensure all persons in attendance com- ply with the requirements of the operational plan outlined in sub-clause (ii), including princeedwardisland.ca/royalgazette July 3, 2021 ROYAL GAZETTE 1093

to ensure the number of persons present does not exceed the number of persons docu- mented in the operational plan;

(v) maintains a contact-tracing record in accordance with clause 27(e);

(vi) does not hold the gathering unless the organizer is a business, service or organization per- mitted to operate under the Businesses, Services and Organizations sections of this Order;

(vii) complies, to the extent possible, with the Multiple Gatherings Guidance; and

(viii) complies with any other directions issued by the Chief Public Health Officer.

30. Organized gatherings, including worship services, of more than 200 persons, are permitted to be held at an indoor location or at an outdoor location provided:

(a) the organizer of the gathering is not organizing a wedding (including a wedding reception) or a funeral (including a funeral reception);

(b) the organizer of the gathering ensures the premises or place where the gathering is held is physi- cally divided into separate areas which contain no more than 50 persons each; and

(c) the organizer of the gathering:

(i) obtains prior approval from the Chief Public Health Officer after meeting any require- ments specified by the Chief Public Health Officer;

(ii) develops, follows and makes available for inspection, to the persons at the gathering and to the Chief Public Health Officer, an operational plan detailing how risk of transmission of COVID-19 will be mitigated at the gathering;

(iii) communicates details of the operational plan outlined in (ii) to persons present at the organized gathering, including staff, participants and volunteers, before and at the time of the organized gathering;

(iv) maintains oversight of the organized gathering to ensure all persons in attendance com- ply with the requirements of the operational plan outlined in sub-clause (ii), including to ensure the number of persons present does not exceed the number of persons docu- mented in the operational plan;

(v) maintains a contact-tracing record in accordance with clause 27(e);

(vi) does not hold the gathering unless the organizer is a business, service or organization permitted to operate under the Businesses, Services and Organizations sections of this Order;

(vii) complies, to the extent possible, with the Multiple Gatherings Guidance; and

(viii) complies with any other directions issued by the Chief Public Health Officer.

31. In addition to the requirements above, a business, service or organization holding an organized gath- ering must comply with the Businesses, Services and Organizations sections of this Order.

32. The operator of a business or facility must not rent, reserve or allow the business or facility to be used for an organized gathering, including when a business is used for an organized gathering at a private residence, that would contravene the Organized Gatherings sections of this Order.

33. The owner of a private residence must not allow the private residence to be used for an organized gathering that would contravene the Organized Gatherings sections of this Order.

34. Any person attending an organized gathering shall take every reasonable step to maintain a distance of two metres or more from persons who do not reside in their household.

Long-Term Care Facilities and Nursing Homes Visitation

35. Visitation to long-term care facilities and nursing homes is permitted provided the facility complies with the Chief Public Health Officer’s Directive on Visitation to Long-Term Care Facilities and Nurs- ing Homes, as may be amended from time to time.

General

36. Notwithstanding anything in this Order, the Chief Public Health Officer may:

(a) exempt a person or class of persons from the application of any section of this Order under ex- ceptional circumstances or on reasonable grounds; and

(b) impose, on any person or class of persons exempt from the application of any section of this Order under clause (a), public health measures consistent with this Order to minimize the risk of introduction or spread of COVID-19.

37. For greater certainty, nothing in this Order limits the operation of the Act or its regulations or restricts the ability of the Chief Public Health Officer to issue public health orders or other orders or directives, as necessary.

38. This Order:

(a) revokes and replaces my order of June 17, 2021;

(b) is effective on June 27, 2021 at 8 a.m., except where stated in this Order to have retroactive effect; and

(c) shall remain in effect for the duration of the public health emergency in the Province, unless earlier amended or revoked.

TAKE NOTICE that failure to comply with this Order is an offence for which you may be liable on sum- mary conviction in accordance with section 66 of the Act.

1. In addition to the requirements in clauses 20(a) to (i) of this Order, limitations are imposed on certain businesses, services and organizations as may be indicated in the following documents:

(a) Restaurants and bars in accordance with the Chief Public Health Officer’s “Food Premises Guidance”.

(b) Personal services in accordance with the Chief Public Health Officer’s “Personal Services Guidance”.

(c) Funeral homes in accordance with the Chief Public Health Officer’s “Funeral Homes Guidance”.

(d) Golf Courses, private and public, in accordance with the Chief Public Health Officer’s “Golf Course Guidance”.

(e) Employers of Temporary Foreign Workers in accordance with the Chief Public Health Officer’s “A Guidance Document for Seafood Processors Employing Temporary Foreign Workers” and “A Guidance Document for Farms Employing Temporary Foreign Workers”, as applicable.

(f) Accommodations in accordance with the Chief Public Health Officer’s “Fixed Roof Tourism Establishment Accommodation Guidelines”.

(g) Gyms, fitness studios, yoga studios, climbing walls, swimming pools, spas and similar indoor recreational facilities in accordance with the Chief Public Health Officer’s “Fitness Facilities Guidance”.

(h) Campgrounds and RV parks in accordance with the Chief Public Health Officer’s “Campground Guidance”.

(i) Camps and day programs in accordance with the Chief Public Health Officer’s “Camps and Day Programs Guidance”. 27

SELF-ISOLATION EXEMPTION ORDER

TO: All persons residing in or present in Prince Edward Island

WHEREAS a state of public health emergency was declared in Prince Edward Island as a result of the global COVID-19 pandemic on March 16, 2020 pursuant to Order in Council EC2020-174, and continued on April 15, 2020 by Order in Council EC2020-254, on May 15, 2020 by Order in Council EC2020-305, on June 15, 2020 by Order in Council EC2020-350, on July 14, 2020 by Order in Council EC2020-435, on August 14, 2020 by Order in Council EC2020-488, on September 13, 2020 by Order in Council EC2020- 542, on October 13, 2020 by Order in Council EC2020-603, on November 12, 2020 by Order in Council EC2020-649, on December 12, 2020 by Order in Council EC2020-724, on January 11, 2021 by Order in Council EC2021-1, on February 10, 2021 by EC2021-71, on March 12, 2021 by Order in Council EC2021-138, on April 11, 2021 by Order in Council EC2021-271, on May 11, 2021 by Order-in-Council EC2021-407 and on June 10, 2021 by Order-in-Council EC2021-494;

AND WHEREAS pursuant to the Act, I, as the Chief Public Health Officer issued an order effective March 22, 2020, which was later amended to be effective on March 31, April 17, May 1, May 8, May 15, May 22, June 1, June 12, June 26, August 19, October 2, November 20, December 4, December 7, De- cember 8, December 18, 2020, January 6, 2021, January 23, 2021, February 16, 2021, February 28, 2021, March 1, 2021, March 4, 2021, March 13, 2021, April 1, 2021, April 15, 2021, April 19, 2021, June 6, 2021, June 17, 2021 and June 27, 2021 (“COVID-19 Prevention and Self-Isolation Order”) with respect to self-isolation requirements;

AND WHEREAS the COVID-19 Prevention and Self-Isolation Order provides that I may exempt a person or classes of persons from the application of any section of the COVID-19 Prevention and Self- Isolation Order;

AND WHEREAS work and schooling are known to be social determinants of health in Prince Edward Island and considering the mental health of certain workers and individuals facilitating custody and access with children, I have determined there are certain asymptomatic individuals who must work or attend school and who may be exempted from the requirement to self-isolate for 14 days when arriving in the Province during the public health emergency while still maintaining measures to protect the health of the population;

AND WHEREAS testing and isolating individuals who test positive for COVID-19, and any variants of concern, will prevent transmission of the virus and the associated illness and death and protect Prince Edward Island’s health care system;

NOW THEREFORE, pursuant to my authority under subsections 39(1), 49(2), 49(3) and 56(1) of the Act, I hereby make the following Order and exemptions from the requirements in the COVID-19 Prevention and Self-Isolation Order to self-isolate:

Definitions

1. In this Order, the definitions in the COVID-19 Prevention and Self-Isolation Order, as may be amend- ed from time to time, apply and have the same meaning in this Order except as otherwise defined in this Order, and:

(a) “Atlantic Canada” means the provinces of New Brunswick, Newfoundland and Labrador, Nova Scotia and Prince Edward Island. princeedwardisland.ca/royalgazette July 3, 2021 ROYAL GAZETTE 1097

(b) “dependent” means, in relation to an individual, a person claimed or to be claimed as a dependent of the individual for income tax purposes for the applicable taxation year.

(c) “domestic rotational worker” means a person who is a resident of Prince Edward Island, has completed a PEI Resident Worker Travel Form and who

(i) Travels frequently for same day work travel outside the Province within Canada (1 or more times per week or 4 times or more per month) with the risk of being in contact within two metres of other persons during their work travel; or

(ii) Travels routinely and frequently for work outside of the Province within Canada on a set schedule, spends 50% or more of their time outside the Province for work and are per- sons who spend 21 days or less in the Province at one time before leaving the Province again for work within Canada.

(d) “domestic travel” means travel within Canada.

(e) “end of life situation” means a situation in which an individual is being actively treated for a life threatening illness which may end their life, which treatment can include palliative care.

(f) “extended family” means, in relation to an individual, a foster parent, or any other person stand- ing in loco parentis, a child or stepchild that is not a dependent, a grandchild or ward of the indi- vidual, a brother, sister, grandparent, great grandparent, mother-in-law, father-in-law, daughter- in-law, son-in-law, sister-in-law, brother-in-law, aunt, uncle, niece or nephew.

(g) “federally-exempt international travel” means international travel after which an individual is not required to quarantine or self-isolate after entering Canada pursuant to any Order of the Govern- ment of Canada under section 58 of the Quarantine Act (Canada);

(h) “health care facility” includes a long-term care facility, nursing home or community care facility.

(i) “high risk facility” means a health care facility, meat packing plant, seafood processing plant, correctional facility, child care facility or kindergarten – grade 12 school.

(j) “household” means, for the purposes of this Order, the persons who normally reside with an individual.

(k) “international rotational worker” means a person who

(i) is a resident of Prince Edward Island;

(ii) has completed a PEI Resident Worker Travel Form;

(iii) is not required to quarantine or self-isolate after entering Canada pursuant to any Order of the Government of Canada under section 58 of the Quarantine Act (Canada); and

(iv) travels routinely and frequently for work outside of Canada on a set schedule, spends 50% or more of their time outside the Province for work and are persons who spend 21 days or less in the Province at one time before leaving the Province again for work within Canada.

(m) “letter of approval issued by a public health official” means

(i) a letter of approval issued to a person pursuant to the Chief Public Health Officer’s Travel Restrictions Order effective June 27, 2021, as may be amended or replaced from time to time;

(ii) a letter of approval issued to a person by a public health official in response to a PEI Resident Worker Travel Form; or

(iii) for the purposes of section 16 includes an Authorized Designated Visitor form com- pleted and approved by a long term care facility administrator or attending physician.

(n) “outside Atlantic Canada”, in relation to an individual, means being outside Atlantic Canada in the 14 days or less prior to travelling into the Province.

(o) “PEI Pass” means a document issued to a person, 12 years of age or older, by a public health of- ficial which indicates that:

(i) a resident of Prince Edward Island who has not been outside Atlantic Canada or the Magdalen Islands in the 14 days prior to entering the Province and who is fully vac- cinated or partially vaccinated does not need to self-isolate after entering the Province, subject to any requirements as may be determined by the Chief Public Health Officer;

(ii) a resident of the Magdalen Islands, New Brunswick, Newfoundland and Labrador or Nova Scotia who has not been outside Atlantic Canada or the Magdalen Islands in the 14 days prior to entering the Province and who is fully vaccinated or partially vaccinated may enter the Province and does not need to self-isolate after entering the Province, subject to any requirements as may be determined by the Chief Public Health Officer;

(iii) a person who is not a resident of Atlantic Canada or the Magdalen Islands who has not been outside Atlantic Canada and who is fully vaccinated or partially vaccinated may enter the Province and does not need to self-isolate after entering the Province, subject to any requirements as may be determined by the Chief Public Health Officer.

(p) “PEI Resident Worker Travel Form” means an application form relating to this Order including information as may be required under the COVID-19 Prevention and Self-Isolation Order and such additional requirements as indicated by the Chief Public Health Officer, including:

(i) frequency of work travel;

(ii) a person’s need to leave the person’s residence to perform work duties in the Province;

(iii) employer support of a person’s return to work after travelling outside of the Province; and

(iv) COVID-19 vaccination record.

(q) “resident”, for the purposes of this Order, has the same meaning as in theChief Public Health Of- ficer’s Travel Restrictions Order effective June 27, 2021, as may be amended or replaced from time to time.

(r) “resident short-term travel isolation measures” means compliance with the following measures:

(i) maintaining a physical distance of two metres from other persons in public spaces, whether indoors or outdoors;

(ii) wearing a non-medical mask indoors or outdoors when within two metres of individuals outside your household; and

(iii) following all public health measures.

(s) “rotational travel isolation measures” means compliance with the following measures:

(i) not attending public places including schools, grocery stores, banks, places of worship, restaurants, gyms or community centres, such as arenas;

(ii) not visiting with or hosting persons outside your household;

(iii) not volunteering in the community in situations which may involve contact with persons from outside your household (i.e. fire departments);

(iv) wearing a non-medical mask indoors or outdoors when within two metres of individuals outside your household, including at school or daycare, if able, for children;

(v) having limited contact, where possible, with members of your household;

(vi) attending only essential medical, dental and health care appointments;

(vii) attending outdoor public spaces for exercise and recreation, as necessary, but avoiding crowded spaces;

(viii) going for drives outside your property, as necessary, to transport household members to activities such as work, school or recreational activities; and

(ix) arranging to pick up groceries or other essentials by delivery or by using a drive-thru service (for example, at restaurants or banks).

(t) “self-isolate except when at work” means compliance with the following measures:

(i) A person must self-isolate for 14 days after international travel, 8 days after federally- exempt international travel, 8 days after domestic travel or for the duration of their stay in the Province (if less than the days indicated here) except when travelling from home to work, when performing work or when travelling home from work;

(ii) A person must wear a non-medical mask when performing work, if the person’s work involves interaction with any other persons, including with the public;

(iii) A person must regularly practice hand hygiene and avoid contact within two metres of other persons, where possible, when at work; and

(iv) A person must follow all public health measures applicable to their workplace.

(u) “truck driver” means a person who drives a commercial truck (vehicle with a gross weight of over 4,500 kilograms) and who:

(ii) who travels for work outside Canada and who is not required to quarantine or to self- isolate after entering Canada pursuant to any Order of the Government of Canada under section 58 of the Quarantine Act (Canada).

(v) “work” means, for the purposes of this Order, the paid employment performed by a person at the work location provided to a public health official.

(w) “work isolation workplace measures” means the measures as outlined at subclauses 1(t)(ii), 1(t)(iii) and 1(t)(iv).

General Application

2. For greater certainty,

(a) The exemptions in this Order are in relation to the COVID-19 Prevention and Self-Isolation Or- der and do not affect the operation of a federal, provincial or local public health order requiring individuals to remain in isolation except to the extent indicated in those orders.

(b) Where there is no exemption listed in this Order for a person, the COVID-19 Prevention and Self-Isolation Order applies to the person.

3. All persons subject to this Order shall monitor for symptoms of COVID-19, and if experiencing symptoms of COVID-19, shall immediately self-isolate until cleared by a public health official.

4. For greater certainty, nothing in this Order limits the operation of the Act or its regulations or restricts the ability of the Chief Public Health Officer to issue public health orders or other orders or directives, as necessary.

Atlantic Canada and Magdalen Islands – Fully vaccinated or Partially vaccinated

5. (1) Effective June 27, 2021, and notwithstanding sections 6 to 22, persons travelling into the Prov- ince who:

(a) are:

(i) residents of Atlantic Canada who were present in Atlantic Canada or the Magdalen Is- lands for at least 14 consecutive days prior to travelling into the Province;

(ii) residents of the Magdalen Islands who were present in Atlantic Canada or the Magdalen Islands for at least 14 consecutive days prior to travelling into the Province; or

(iii) persons who were present in Atlantic Canada for at least 14 consecutive days prior to travelling into the Province;

(b) are fully vaccinated or partially vaccinated who have a PEI Pass and such persons less than 12 years of age travelling with them;

(c) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(d) do not have a diagnosis of COVID-19 or symptoms of COVID-19 without a negative test result for COVID-19;

(e) are not a close contact of someone with symptoms of COVID-19 or in isolation; and princeedwardisland.ca/royalgazette July 3, 2021 ROYAL GAZETTE 1101

(f) are not the subject of a federal, provincial or local public health order requiring them to remain in isolation in another jurisdiction,

are exempt from the requirement to self-isolate.

(2) Effective June 27, 2021, persons, who

(a) meet the requirements of clauses 5(1)(a), (c), (d), (e) and (f);

(b) are not fully vaccinated or partially vaccinated;

(c) are 12 years of age or older;

(d) are a member of the household of a person described in subsection (1); and

(e) are travelling into the Province with the person described in subsection (1);

are exempt, when staying at the same property as the person described in subsection (1) and re- maining on that property, from the self-isolation requirement outlined at sub-clause 3(d)(iv) of the COVID-19 Prevention and Self-isolation Order only, and must meet all other self-isolation require- ments of that Order.

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

Rotational Workers

6. Asymptomatic persons who are international rotational workers are exempt from the requirement to self-isolate after international travel, provided they comply with the following conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) follow any direction provided to them by a public health official;

(c) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(d) self-isolate until they receive an initial negative test result for COVID-19;

(e) after receiving an initial negative test result, if not vaccinated, follow the rotational travel isola- tion measures, for 8 days or for the duration of their stay in the Province (if 8 days or less);

(f) after receiving an initial negative test result, if fully vaccinated or partially vaccinated, follow the resident short-term travel isolation measures for 8 days or for the duration of their stay in the Province (if 8 days or less); and

(g) with employer support and after receiving an initial negative test result, attend work in the Prov- ince while following the work isolation workplace measures, except cannot attend work if the work is in a high risk facility.

7. Asymptomatic persons who are domestic rotational workers are exempt from the requirement to self- isolate after domestic travel, provided they comply with the following conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) follow any direction provided to them by a public health official;

(c) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(d) self-isolate until they receive an initial negative test result for COVID-19 in the Province;

(e) after receiving an initial negative test result, if not fully vaccinated or partially vaccinated, fol- low the rotational travel isolation measures, for 8 days or for the duration of their stay in the Province (if 8 days or less);

(f) after receiving an initial negative test result, if fully vaccinated or partially vaccinated, follow the resident short-term travel isolation measures for 8 days or for the duration of their stay in the Province (if 8 days or less); and

(g) with employer support, and after receiving an initial negative test result, attend work in the Province while following the work isolation workplace measures.

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

Resident Truck Drivers

8. Asymptomatic truck drivers who reside in the Province are exempt from the requirement to self- isolate after international or domestic travel, provided they comply with the following conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(c) self-isolate until they receive an initial negative test result for COVID-19 in the Province, except on travelling into the Province, they may deliver their truck load in a contactless manner before self-isolating; and

(d) after receiving an initial negative test result after international travel, follow the resident short- term travel isolation measures for 14 days or for the duration of their stay in the Province (if 14 days or less); or princeedwardisland.ca/royalgazette July 3, 2021 ROYAL GAZETTE 1103

(e) after receiving an initial negative test result after federally-exempt international travel or domes- tic travel, follow the resident short-term travel isolation measures for 8 days or for the duration of their stay in the Province (if 8 days or less).

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

Government of Canada Exceptions – Other Workers

9. Asymptomatic members of the Canadian Armed Forces and asymptomatic transportation crews on planes, helicopters, buses or marine vessels, including members of the Canadian Coast Guard, who reside in the Province and who travel for work within Canada or who travel for work outside Canada and who are not required to quarantine or self-isolate after entering Canada pursuant to any Order of the Government of Canada under section 58 of the Quarantine Act (Canada) are exempt from the requirement to self-isolate after international or domestic travel, provided they comply with the fol- lowing conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) follow any direction provided to them by a public health official;

(c) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(d) self-isolate until they receive an initial negative test result for COVID-19 in the Province; and

(e) after receiving an initial negative test result after international or domestic travel, follow the resident short-term travel isolation measures for 8 days or for the duration of their stay in the Province (if 8 days or less).

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

10. Asymptomatic persons who are not required to self-isolate after entering Canada pursuant to any Order of the Government of Canada under section 58 of the Quarantine Act (Canada), and who are not rotational workers, truck drivers, persons described in section 9 or persons who work in a high risk facility in the Province, are exempt from the requirement to self-isolate after international travel provided they comply with the following conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) follow any direction provided to them by a public health official;

(c) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(e) after receiving an initial negative test result, self-isolate except when at work for 8 days or for the duration of their stay in the Province (if 8 days or less); and

(f) undergo follow-up testing for COVID-19 as directed by a public health official at the designated testing location.

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

Non-resident Truck Drivers, Transportation Crews and Military

11. Asymptomatic truck drivers, members of the Canadian Armed Forces and transportation crews on planes, helicopters, buses or marine vessels, including members of the Canadian Coast Guard who do not reside in the Province are exempt from the requirement to self-isolate after international or domestic travel provided they comply with the following conditions:

(a) follow any direction provided to them by a public health official;

(b) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(c) self-isolate until they receive an initial negative test result for COVID-19 in the Province, except on travelling into the Province, truck drivers may deliver their truck load in a contactless manner before self-isolating; and

(d) after receiving an initial negative test result, self-isolate except when at work for 14 days after international travel, 8 days after federally-exempt international travel, 8 days after domestic travel or for the duration of their stay in the Province (if less than the days indicated here).

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

Domestic Travel Outside of the Province

12. Asymptomatic persons, except those persons described in section 13, are exempt from the require- ment to self-isolate after domestic travel outside of the Province when they are at work, provided they comply with the following conditions:

(i) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(ii) follow any direction provided to them by a public health official;

(iii) undergo testing for COVID-19 required by the Chief Public Health Officer at a location designated by the Chief Public Health Officer as directed by a public health official;

(v) after receiving an initial negative test result, self-isolate except when at work for 8 days or for the duration of their stay in the Province (if 8 days or less).

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

13. Asymptomatic persons who do not reside in the Province and are travelling into the Province for work and exiting the Province the same day are exempt from the requirement to self-isolate after domestic travel provided they comply with the following conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) follow any direction provided to them by a public health official;

(c) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official; and

(d) self-isolate except when at work for the duration of their stay in the Province.

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

Attendance at Court

14. Asymptomatic persons travelling into the Province after international travel or domestic travel from outside of the Province for the purpose of participating in an in-person court proceeding in the Prov- ince, whether the accused, victim, witness or party in such proceeding, are exempt from the require- ment to self-isolate after such international travel or domestic travel, provided they comply with the following conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) follow any direction provided to them by a public health official;

(c) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(d) after travelling into the Province, self-isolate for 14 days after international travel, 8 days after federally-exempt international travel, 8 days after domestic travel or for the duration of their stay in the Province (if less than the days indicated here) other than when they are in court;

(e) wear a non-medical mask when interacting with other persons; and

(f) practise hand hygiene and follow all public health measures.

symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

Attendance at Birth of a Child

15. Asymptomatic persons travelling into the Province after international travel or domestic travel from outside of the Province, for the purpose of compassionate visitation at the Prince County or the Queen Elizabeth Hospital for the birth of a child, are exempt from the requirement to self-isolate after international travel or domestic travel provided they comply with the following conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) follow any direction provided to them by a public health official;

(c) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(d) self-isolate until they receive an initial negative test result for COVID-19 in the Province;

(e) after receiving a negative test, self-isolate except when they are attending at the Prince County Hospital or the Queen Elizabeth Hospital for compassionate visits for the birth of the child, for 14 days after international travel, 8 days after federally-exempt international travel, 8 days after do- mestic travel or for the duration of their stay in the Province (if less than the days indicated here);

(f) undergo follow-up testing for COVID-19 as directed by a public health official at the designated testing location;

(g) wear a non-medical mask when interacting with other persons; and

(h) practise hand hygiene and follow all public health measures, including wearing personal protec- tive equipment (PPE), during the compassionate visitation.

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

Visiting an Individual During End of Life Situation

16. Asymptomatic persons travelling into the Province after international travel or domestic travel from outside of the Province for the purpose of visiting an individual in an end of life situation are exempt from the requirement to self-isolate after international travel or domestic travel provided they comply with the following conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) follow any direction provided to them by a public health official;

(c) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(d) self-isolate until they receive an initial negative test result for COVID-19 required under clause (c), unless otherwise directed by the Chief Public Health Officer that an initial negative test is not required;

(e) after receiving a negative test or written confirmation from a public health official that a test for COVID-19 is not required, self-isolate except when they are visiting the individual in an end of life situation, for 14 days after international travel, 8 days after federally-exempt international travel, 8 days after domestic travel or for the duration of their stay in the Province (if less than the days indicated here);

(f) undergo follow-up testing for COVID-19 as directed by a public health official at the designated testing location;

(g) wear a non-medical mask when interacting with other persons; and

(h) practise hand hygiene and follow all public health measures and restrictions imposed by the facility housing the individual in the end of life situation, including wearing personal protective equipment (PPE), during the visitation with the individual in the end of life situation.

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

Attending a Wake, Funeral or Burial

17. Asymptomatic persons travelling into the Province after domestic travel from outside of the Province for the purpose of attending a wake, funeral or burial of an extended family member are exempt from the requirement to self-isolate after domestic travel provided they comply with the following conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) follow any direction provided to them by a public health official;

(c) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(d) self-isolate until they receive an initial negative test result for COVID-19 in the Province;

(e) after receiving a negative test, self-isolate, except when they are attending the wake, funeral or burial, for 8 days or for the duration of their stay in the Province (if 8 days or less);

(f) undergo follow-up testing for COVID-19 as directed by a public health official at the designated testing location;

(g) wear a non-medical mask when interacting with other persons; and

(h) practise hand hygiene and follow all public health measures.

Child Custody and Access

18. Asymptomatic persons who are not residents of the Province travelling into the Province after domes- tic travel from outside of the Province for the purpose of facilitating custody or access with children are exempt from the requirement to self-isolate after domestic travel provided they comply with the following conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) follow any direction provided to them by a public health official;

(c) after entering the Province, self-isolate for the duration of their stay in the Province other than when they are facilitating the custody or access exchange with the child or children;

(d) facilitate the custody or access exchange of the child or children within 24 hours after entering the Province;

(e) while in the Province, only attend at the designated location where the custody or access ex- change of the child or children will occur;

(f) other than the designated location prescribed in clause (e), avoid all public places;

(g) leave the Province immediately upon completing the custody or access exchange;

(h) wear a non-medical mask when interacting with other persons; and

(i) practise hand hygiene and follow all public health measures.

19. Asymptomatic persons who are residents of the Province and are travelling into the Province after domestic travel for the purposes of facilitating a custody or access exchange outside the Province are exempt from the requirement to self-isolate provided they comply with the following conditions:

(a) while outside the Province, stopped only for essential purposes (for example: fuel, take away food, washroom) and only attended at the designated location where the custody or access ex- change of the child or children occurred; and

(b) practised hand hygiene and followed all public health measures during travel outside the Province.

20. Except as outlined in section 19, asymptomatic persons who are residents of the Province and are travelling into the Province after domestic travel for the purposes of facilitating custody or access for children outside the Province are exempt from the requirement to self-isolate provided they comply with the following conditions:

(a) on or before travelling into the Province, receive a letter of approval issued by a public health official;

(b) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(c) self-isolate until they receive an initial negative test result for COVID-19 in the Province;

(d) after receiving a negative test result, follow the rotational travel isolation measures for 8 days or for the duration of their stay in the Province (if 8 days or less);

(e) undergo follow-up testing for COVID-19 as directed by a public health official at the designated testing location; and

(f) practise hand hygiene and follows all public health measures.

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

21. Asymptomatic children under the age of 18 years travelling into the Province after domestic travel from outside of the Province for the purpose of exercising or facilitating custody or access with their parent or legal guardian, on their return to the Province, are exempt from the requirement to self- isolate after domestic travel provided that, for the period of 8 days after travelling into the Province, they comply with the following conditions:

(a) undergo testing for COVID-19 required by the Chief Public Health Officer at a location desig- nated by the Chief Public Health Officer as directed by a public health official;

(b) self-isolate until they receive an initial negative test result for COVID-19 in the Province;

(c) undergo follow-up testing for COVID-19 as directed by a public health official at the designated testing location; and

(d) practise hand hygiene and follow all public health measures.

Except as directed by a public health official, if a person under this section receives a positive test result for COVID-19, they must self-isolate for at least 10 days, including 10 days after the onset of symptoms, or if a person under this section fails to submit to the required tests, they must self-isolate for 14 days.

PEI Resident Essential Travel

22. Effective June 17, 2021 at 8 a.m., persons who are residents of the Province who:

(a) have not been outside of the Province for a period greater than 24 hours immediately prior to travelling into the Province;

(b) do not have symptoms of COVID-19 or have a current diagnosis of COVID-19;

(c) are not a close contact of someone with symptoms of COVID-19 or a current diagnosis of COVID-19;

(d) are not the subject of a federal, provincial or local public health order requiring them to remain in isolation

(e) follow any direction provided to them by a public health official; and

(f) meet the requirements and comply with all mandatory direction provided at: www.princeed- wardisland.ca/en/information/self-isolation-exemptions-pei-resident-same-day-travel, princeedwardisland.ca/royalgazette 1110 ROYAL GAZETTE July 3, 2021

are exempt from the requirement to self-isolate.

Effective Date

23. This Order:

(a) revokes and replaces my order of June 17, 2021;

(b) is effective on June 27, 2021 at 8:01 a.m., except where stated in this Order to have retroactive effect; and

(c) shall remain in effect for the duration of the public health emergency in the Province, unless earlier amended or revoked.

TAKE NOTICE that failure to comply with this Order is an offence for which you may be liable on sum- mary conviction in accordance with section 66 of the Act.

TRAVEL RESTRICTIONS ORDER

WHEREAS a state of public health emergency was declared in Prince Edward Island on March 16, 2020 as a result of the COVID-19 pandemic pursuant to Order in Council EC2020-174, and continued on April 15, 2020 by Order in Council EC2020-254, on May 15, 2020 by Order in Council EC2020-305, on June 15, 2020 by Order in Council EC2020-350, on July 14, 2020 by Order in Council EC2020-435, on August 14, 2020 by Order in Council EC2020-488, on September 13, 2020 by Order in Council EC2020- 542, on October 13, 2020 by Order in Council EC2020-603, and on November 12, 2020 by Order in Council EC2020-649, on December 12, 2020 by Order in Council EC2020-724, on January 11, 2021 by Order in Council EC2021-1, on February 10, 2021 by EC2021-71, on March 12, 2021 by Order in Council EC2021-138, on April 11, 2021 by Order in Council EC2021-271, on May 11, 2021 by Order- in-Council EC2021-407 and on June 10, 2021 by Order-in-Council EC2021-494;

AND WHEREAS in consultation with the Lieutenant Governor in Council, I believe it is reasonably necessary to impose restrictions on travel into the Province in order to protect the health of the population;

AND WHEREAS pursuant to subsection 49(2) of the Act, I, as the Chief Public Health Officer, may take special measures to protect the public health of the population of Prince Edward Island;

AND WHEREAS pursuant to clause 49(2)(e) of the Act, I, as the Chief Public Health Officer, may order persons to refrain from travelling to or from any area of the province or on any road, street or highway;

AND WHEREAS pursuant to clause 49(2)(g) of the Act, I, as the Chief Public Health Officer, may order any measure the Chief Public Health Officer reasonably believes is necessary for the protection of the health of the population during the public health emergency;

AND WHEREAS the Government of Canada has imposed restrictions on travel into Canada pursuant to section 58 of the Quarantine Act (Canada) with limited exemptions;

AND WHEREAS the reasons for the order are the global COVID-19 pandemic and the health risks posed by the pandemic, including the health risks posed by any new variants of the virus causing COVID-19;

AND WHEREAS the necessity to prevent, decrease or eliminate those health risks, including through the use of isolation and testing for COVID-19 and any variants of concern, will assist to prevent transmission of the virus and the associated illness and death and to protect Prince Edward Island’s public health and health care system;

AND WHEREAS, at the time of making this Order, recommendations from the National Advisory Com- mittee on Immunization inform that first doses of currently authorized COVID-19 vaccines in Canada have been shown to offer at least short-term protection against COVID-19 disease and that approximately two weeks after receiving a completed series, authorized vaccines have been shown to be highly efficacious in the short term against confirmed symptomatic COVID-19 disease, appear to be efficacious against severe COVID-19 outcomes such as hospitalization or death and may reduce asymptomatic infection and trans- mission of the COVID-19 virus;

AND WHEREAS pursuant to subsection 56(1) of the Act, I, as the Chief Public Health Officer, may require any person to provide information that the Chief Public Health Officer reasonably considers necessary to:

(b) evaluate and monitor the health and safety of the general public;

AND WHEREAS pursuant to section 60 of the Act, a public health official may request assistance from a peace officer in conducting an inspection, investigation, inquiry, search or in enforcing an order made under the Act;

AND WHEREAS pursuant to subsection 61(4) of the Act, no person shall knowingly provide false or misleading information, either orally or in writing, to a public health official;

NOW THEREFORE, pursuant to my authority under subsections 49(2) and 56(1) of the Act, I hereby order as follows.

Definitions

1. In this Order:

(a) “Atlantic Canada” means the provinces of New Brunswick, Newfoundland and Labrador, Nova Scotia and Prince Edward Island.

(b) “family” means, in relation to an individual, a person who is a spouse, common-law partner, child, stepchild, ward, parent, step-parent, guardian, foster parent, person standing in loco parentis, grandchild, brother, sister, grandparent, great grandparent, mother-in-law, father-in-law, daughter- in-law, son-in-law, sister-in-law, brother-in-law, aunt, uncle, niece or nephew to the individual;

(c) “fully vaccinated” means, in relation to an individual, that the individual has received a com- pleted series of a vaccine authorized by Health Canada for use in relation to the COVID-19 pandemic;

(d) “household” means the persons who normally reside with an individual;

(e) “negative test result for COVID-19” means, in relation to an individual, a negative result for a COVID-19 molecular test that was performed on a specimen collected from the individual no more than 72 hours prior to the date of the individual entering the Province, which test result must contain

(i) the individual’s name and date of birth;

(ii) the name and civic address of the facility that administered the test;

(iii) the date the test was performed;

(iv) the type of test that was performed; and

(v) the test result;

(f) “ordinarily present” means present in the referenced Province or geographical area for six months or more, and includes transient persons who have not been resident in another province or coun- try for six months or more if they have been resident in the Province or geographical area con- tinuously for three months or more;

(g) “outside Atlantic Canada”, in relation to an individual, means being outside Atlantic Canada in the 14 days or less prior to travelling into the Province;

(h) “partially vaccinated” means:

(i) in relation to an individual 18 years of age or older, 21 days after the individual has received one dose of a two-dose series of a vaccine authorized by Health Canada for use in relation to the COVID-19 pandemic; and

(ii) in relation to an individual 12 to 17 years of age, that the individual has received one dose of a two-dose series of a vaccine authorized by Health Canada for use in relation to the COVID-19 pandemic;

(i) “peace officer” includes a police officer or any other person designated or appointed as a peace officer under any law of Prince Edward Island;

(j) “PEI pass” means a document issued to a person, 12 years of age or older, by a public health of- ficial which indicates that

(i) a resident of Prince Edward Island who has not been outside Atlantic Canada or the Magdalen Islands in the 14 days prior to entering the Province and who is fully vac- cinated or partially vaccinated does not need to self-isolate after entering the Province, subject to any requirements as may be determined by the Chief Public Health Officer;

(k) “PEI Self-isolation Declaration for Atlantic Travel” means a document issued by a public health official to a person who is not fully vaccinated or partially vaccinated which indicates that

(i) a resident of Prince Edward Island who has not been outside Atlantic Canada or the Magdalen Islands in the 14 days prior to entering the Province does need to self-isolate after entering the Province, subject to any requirements as may be determined by the Chief Public Health Officer;

(ii) a resident of the Magdalen Islands, New Brunswick, Newfoundland and Labrador or Nova Scotia who has not been outside Atlantic Canada or the Magdalen Islands in the 14 days prior to entering the Province may enter the Province and does need to self-isolate after entering the Province, subject to any requirements as may be determined by the Chief Public Health Officer;

(iii) a person who is not a resident of Atlantic Canada or the Magdalen Islands who has not been outside Atlantic Canada may enter the Province and does need to self-isolate after entering the Province, subject to any requirements as may be determined by the Chief Public Health Officer;

(m) “seasonal resident” means a person who is a resident of a Canadian province or territory other than Prince Edward Island or a Canadian citizen, and who owns, for seasonal use, residential property or a mobile home as defined in subsections 1(o) and 1(h)(i) the Real Property Assess- ment Act, R.S.P.E.I. 1988, Cap. R-4;

(n) “work” means, for the purposes of this Order, the paid employment performed by a person at the work location provided to a public health official.

Arriving on and travelling into Prince Edward Island

2. Every person arriving on Prince Edward Island at any and all points of entry, including by motor vehicle, airplane, helicopter, marine vessel, or otherwise, shall, for the purposes of this Order:

(i) stop when instructed to do so by a peace officer or public health official;

(ii) answer any such questions and provide such information (including a negative test result for COVID-19 or any document required under this Order such as a PEI Pass or a letter of approval issued by a public health official) as required by a peace officer, a public health official or the Chief Public Health Officer; and

(iii) undergo such examinations as required by a peace officer, a public health official or the Chief Public Health Officer.

3. For greater certainty, every person who travels into the Province must provide such information, undergo such examinations (including testing for COVID-19) and comply with all applicable orders and directions issued by the Chief Public Health Officer, including the COVID-19 Prevention and Self-Isolation Order, as may be amended from time to time. These orders can be found at:

4. Except as permitted under sections 7, 8, 9, and 10 of this Order, all persons arriving at the Province are prohibited from traveling into the Province from any of the following areas:

(a) the highway at the entrance to the Confederation Bridge;

(b) the highway at the entrance to the Wood Islands ferry terminal;

(c) the highway at the entrance to the Souris ferry terminal;

(d) the highway or street at the entrance to the Charlottetown airport;

(e) any port, harbour, wharf, launching, beach, and any part of the shoreline of the Province; and

(f) any and all other points of entry to the Province.

5. For greater certainty, no person shall transport a person into the Province except as permitted under sections 7, 8, 9, and 10.

6. Where any person travels into the Province in contravention of this Order, a peace officer is hereby authorized and directed to return that person to an interprovincial border and require the person to leave the Province immediately or at such a time as may be directed to the person by a peace officer.

7. The following persons may travel into the Province:

(a) residents of Prince Edward Island (“PEI resident”) with proof of identification;

(b) commercial vehicle drivers delivering goods (driving a commercial vehicle with a gross weight of over 4,500 kilograms);

(c) persons travelling for the sole purpose of travelling to or from the Magdalen Islands, Quebec who have a Province of Quebec self-declaration form and, if travelling to the Magdalen Islands, a reservation for the CMTA ferry to the Magdalen Islands for within 24 hours of the person’s entry to the Province.

PEI Pass or Self-isolation Declaration required (negative test for Magdalen Island residents)

8. The following persons may travel into the Province effective June 27, 2021 with a PEI Pass or a PEI Self-isolation Declaration for Atlantic Travel:

(a) residents of New Brunswick, Newfoundland and Labrador or Nova Scotia who have not been outside Atlantic Canada or the Magdalen Islands in the 14 days prior to entering the Province;

(b) residents of the Magdalen Islands who have not been outside Atlantic Canada or the Magdalen Islands for at least 14 consecutive days prior to travelling into Prince Edward Island and who provide a negative test result for COVID-19 as required by the Chief Public Health Officer on initial entry to the Province from the Magdalen Islands.

PEI Pass or Self-isolation Declaration, with extra documentation as may be required

9. The following persons may travel into the Province effective June 27, 2021 with a PEI Pass or a PEI Self-isolation Declaration for Atlantic Travel and such other evidence of presence in Atlantic Canada as may be required by the Chief Public Health Officer or a public health official:

(a) persons present in the provinces of New Brunswick, Newfoundland and Labrador, Nova Scotia or Prince Edward Island (other than PEI residents) for at least 14 consecutive days prior to travelling into Prince Edward Island.

Letter of approval

10. Subject to section 11, the following persons may travel into the Province from outside Atlantic Cana- da with a letter of approval issued by a public health official:

(a) persons travelling into the Province for emergency medical purposes, including patients and persons necessary to travel with patients, and persons accompanying animals for emergency services at the Atlantic Veterinary College;

(b) persons exercising or facilitating custody or access with children under the terms of a written agreement or court order regarding custody, access or parenting;

(c) persons travelling to participate in an in-person court proceeding in the Province whether the accused, victim, witness or party in such proceeding;

(d) persons travelling to attend a school in Prince Edward Island that is an Education Act, R.S.P.E.I. 1988 Cap. E-.02 public school, a Private Schools Act, R.S.P.E.I. 1988 Cap. P-20.01 private school or a post-secondary education and training institution that is listed as a Designated Learn- ing Institution for Prince Edward Island by the Government of Canada for the purposes of any order issued under section 58 of the Quarantine Act (Canada);

(e) persons travelling into the Province to drop off a student enrolled in a school or institution re- ferred to in clause (d) or to pick up the student from that school or institution, if the person leaves the Province immediately after the drop-off or pick-up;

(f) persons travelling into the Province from outside Atlantic Canada to perform work in the Province;

(g) Canadian citizens or permanent residents of Canada travelling into the Province to permanently relocate to reside in the Province;

(h) seasonal residents and members of their household;

(i) Canadian citizens or permanent residents of Canada from outside Atlantic Canada who are fam- ily of a PEI resident, and members of that family’s household, who are travelling into the Prov- ince to connect with the PEI resident or to stay at an unoccupied residence of the PEI resident;

(j) Canadian citizens or permanent residents of Canada from outside Atlantic Canada who are fam- ily of a seasonal resident, and members of that family’s household, who are travelling into the Province to stay at the residence, as described in 1(m), of the seasonal resident

(k) persons, under the age of 12 years, who are not travelling into the Province with a parent or guardian over the age of 18 years who has approval to travel into the Province in accordance with sections 8 to 10 of this Order. For greater certainty, persons under the age of 12 years may travel with into the Province with their parent or guardian over the age of 18 years using the same approval document issued to their parent or guardian entering the province in accordance with sections 8 to 10; or

(l) persons travelling in exceptional circumstances or on compassionate grounds, as determined by the Chief Public Health Officer or her designate, subject to conditions that may be imposed by the Chief Public Health Officer or her designate.

11. Persons travelling under sections 8 to 10 of this Order are prohibited from travelling into the Province without the applicable document for entry. A PEI Pass, Self-isolation Declaration for Atlantic Travel or letter of approval under this Order will not be issued by a public health official to a person who:

(i) is unable to demonstrate, to a public health official, that the person qualifies (including whether the person is fully vaccinated or partially vaccinated) for the applicable docu- ment on requirements determined by the Chief Public Health Officer; or

(ii) is a person subject to a federal, provincial or local public health order requiring them to remain in isolation in another jurisdiction.

12. This Order:

(a) revokes and replaces my order of May 19, 2021;

(b) is effective on June 27, 2021 at 8:01 a.m, except where stated in this Order to have retroactive effect; and

(c) shall remain in effect for the duration of the public health emergency in the Province, unless earlier amended or revoked.

13. For greater certainty, nothing in this Order limits the operation of the Act or its regulations or restricts the ability of the Chief Public Health Officer to issue public health orders or other orders or directives, as necessary.

REAL PROPERTY TAX ACT REGULATIONS AMENDMENT

(Approved by Her Honour the Lieutenant Governor in Council dated June 22, 2021.) Pursuant to subsection 43(1) of the Real Property Tax Act R.S.P.E.I. 1988, Cap. R-5, Council made the following regulations:

1. Subsection 9(1) of the Real Property Tax Act Regulations (EC512/72) is revoked and the following substituted:

The interest rate in the new subsection (1.1) has not been changed but it has been set out in a separate subsection for clarity and in conformity with proper drafting rules.

(Approved by Her Honour the Lieutenant Governor in Council dated June 22, 2021.) Pursuant to subsection 29(1) of the Roads Act R.S.P.E.I. 1988, Cap. R- 15, Council made the following regulations:

1. Schedule C-3, LOCAL (CLASS 3) HIGHWAYS, to the Roads Act Highway Access Regulations (EC580/95) is amended by the addition of the following after subsection 1(77):

(77.1) Route 260 Frenchfort Road: The unpaved portion of Route 260 commencing at the intersection of Route 2 in the settlement of Dunstaffnage to the intersection of Route 2 in the settlement of Ten Mile House. 2. These regulations come into force on July 3, 2021.

EXPLANATORY NOTES

SECTION 1 amends Schedule C-3 to the Roads Act Highway Access Regulations (EC580/95) by adding the unpaved portion of Route 260 commencing at the intersection of Route 2 in the settlement of Dunstaffnage to the intersection of Route 2 in the settlement of Ten Mile House.
