NARRATIVE:

OnMonday, 12/21/2020, Iwasondutyinuniform working myscheduled shiftof6am – 4pm attheOregon Capitol MallAreaCommand Office. Duetoaplanned Special Legislative Session andtheexpectation forprotests andgathering occurring outside ofthe Capitol building, JesseOrosco hadrequested additional resources. Troopers working weregivenspecific assignments fortheday. Myassignment wasprimary operator andmonitor oftheSecurity Cameras inandaround theCapitol Building aswellashandling radiocommunication andassistindocumenting information fortheCommand Post.

Normally withaSpecial Legislative Session theCapitol Building would beopen however due torestrictions caused byCovid-19, theCapitol building hasbeenclosedtothepublic andonly accessible bythosewithkeycardaccess. Aswithpast’sprotests andrallies, theOregon State Police would maintain apresence within theCapitol building aswellasafewTroopers on

Ibegan monitoring thesecurity cameras atornear7:15amandquickly acknowledged the number ofvehicles andprotesters, arriving intheareaoftheCapitol building wasincreasing rapidly. AsIcontinued tomonitor itwasevident, individuals from thegroup ofprotesters wereactively seeking waystoaccess theCapitol Building bygoing tovarious doorsand checking toseeiftheanydoors wereunlocked oraccessible.

Shortly after8:00am, theOregon StatePolice wereworking tostopafemale attempting to gainaccess intheCapitol Building onthewestside, shewasclimbing through awindow toa conference room. Although thecrowd ofprotesters outside ofthebuilding grew innumbers andwerebecoming morevocal, theinteraction withpolice appeared lowlevel asStateTroopers wereinside the conference roomtalking withthefemale protester whowashalfway inthewindow. Two Troopers onbicycles responded tothewestsideoftheCapitol building toassistfromthe outside. ThetwoTroopers walked upto, thewindow atwhichtimethecrowdturned their focusawayfromsupporting thefemale anddirected theirattention towards thetwoTroopers. Itbecame evident thecrowd wasbecoming moreaggressive andbegan moving towards the twoTroopers. Without hesitation, thetwoTroopers backed awayandleftthelocation without incident togoinside theCapitol building.

Ashorttimelater, Iwatched asithappened liveonsecurity camera, StateRepresentative Nearman carelessly openthenorthwest frontADAdoortotheCapitol building andproceeded outthedoor. Thisparticular doorrequires akeycardtogainaccess. Withthedoor nowopen StateRepresentative Nearman sidestepped andallowed protesters clearunobstructed access, notonlythrough thefirstdoorlocked doorbutallowed thefirstprotester enough timetograb aninterior doorbefore itclosed. Theinterior dooralsorequires akeycardtogainaccess.

Ibroadcasted overpolice radio theopen doorandthatprotesters were accessing theCapitol building. Ithenwatched asprotesters physically resisted asTroopers attempted togain compliance inhaving thecrowdexitthrough theopendoor. Thesizeofthecrowdgrewlarger andtheprotesters became morehostile andeventually physically engaged withOregon State Police trying toforceentryintotheCapitol building.

Minutes later, Irecognized StateRepresentative Nearman onsecurity camera walking easton StateStreet andapproach thewestStateStreet doorentrance. StateRepresentative Nearman nonchalantly usedakeycardonthelocked doorandgained access intotheCapitol Building, whileOregon StateTroopers werephysically engaging withahostile, aggressive crowdbythe northwest ADAdoor.

On12/28/2020, Detective Jennifer Johnson contacted measking ifIcouldassistwithmaking copies ofsecurity video footage involving theevents attheCapitol building on12/21/2020.

Atornear8:05am, group leaves traffic island onCourt Standbegins marching westaround Capitol building.

Atornear8:05am, boththeSenate andHouse areinsession.

Atornear8:06am, group onthewestsideinfullkitnowcarrying longguns andsidearms.

Atornear8:08am, 2212reports acracked window onthedooronthewestside.

Atornear8:09am, Iadvised patrols therewasacrowd ofpeople gathering atthewestdoors oftheCapitol building. Individuals inthecrowd seenvisibly grabbing doorhandles tothe Capitol building. Thisisthesamelocation theLegislative Administration setuptwocanopies andtelevisions outside thewestdoorsforthepublictoviewtheSpecial Legislative Session.

Atornear8:15am, Iadvise of50+ people staging atwestenddoors entrance appeared tobe yelling.

Oregon StatePoliceDispatch Center advised ofacallforservice attheArchives Building. (D streetandSummer Street) duetoactivities attheCapitol Building, twomembers ofthe Oregon StatePolice Mobile Response Team onBicycle patrol responded tohandle thecall.

Atornear8:19am, Iadvise ofasubject inaredjacket atthewestsidepushing onawindow.

Atornear8:20am, Iadvise ofagroup ofpeople breaking awayfromthewestsidedoors and proceeding tothefrontwestADAdoors.

Atornear8:22am, Iadvise ofatleasttwoindividuals whojumped thelocked fenceatthe front oftheCapitol Building.

Icontinued tomonitor security cameras andcalling foradditional Troopers torespond tothe Capitol building. Iobserved threeindividuals outside attheStateStreet middle doors entrance. Irequested aTrooper respond totheStateStreetsidemiddle doorstomakesureof nofurther protesters gained access.

Iobserved through thesecurity camera’sStateRepresentative Nearman walking eastonState Street. Eventhough Irecognized himandknewhisname, Ididnotbroadcast hisnameover theairandjustkeptreferencing himasaStateRepresentative. While StateRepresentative Nearman entered theCapitol building fromtheStateStreetside, Troopers continued their attempt togetthedoorclosed.

There werenootherlocations around theCapitol building, which protesters accessed. When StateRepresentative Nearman opened thefrontwestADA door, themajority ofthecrowd that hadgathered onthewestsideoftheCapitol building rantowards theopendoor. Troopers still attheconference roomonthewestendoftheCapitol building wereabletoprevent the unknown female from gaining access.

NARRATIVE:

OnDecember23,2020, at 9:26am, MajorAndyHeidercalledmeandrequestedIassistinanongoing investigationintoeventsattheOregonStateCapitolbuildingonDecember21,2020. Theincidentinvolved severalprotestorsattemptingtogainaccesstothebuildingdespiteitsclosureoverCOVIDconcerns. The protestorswereabletogainaccessthroughanADAaccessdoorafteritwasopenedfromwithin. Troopers convergedontheareaandconfrontationensuedresultinginexposuretochemicalagentsandsomeinjuryto policepersonnel.

MajorHeidertoldmeinvestigatorswhowerereviewingsurveillancefootagetoldhimOregonState RepresentativeMikeNearmanhadopenedthedooranddepartedthebuildingwhichallowedtheprotestorsto gainentry. MajorHeiderrequestedIinvestigatetodetermineifRepresentativeNearmanhadintentionally providedaccesstoprotestorswho,once inside, hadcommittedcriminaloffensesofdisorderlyconduct, criminal trespassandassaultonapublicsafetyofficer.

IspokewithDetectiveJenJohnsonandrequestedsheassistmewiththeinvestigation. IassignedDet. OnJanuary4,2021, atapproximately8:10am, Ireceivedanexternalthumbdrivewithacopyofsurveillance footagefromtheCapitolbuilding. TheoriginalvideowasplacedintoevidencebySeniorTrooperFrankHagen. OnJanuary4,2021, I askedOSPResearchAnalystJohnLawsontocheckopensourcesitesforcontact informationforRepresentativeNearman. Lawsonprovidedmewith3contactnumbers. Atapproximately10:48am,I spokewithafemalewhoidentifiedherselfasRepresentativeNearman’swifeand saidhewasinameetinguntilaroundnoon. IaskedhertoletRepresentativeNearmanknowIhopedtospeak withhimandprovidedacall-backnumber.

Ataround12:04pm, IreceivedareturntelephonecallfromRepresentativeNearmanthatwasrecorded. RepetitiveNearmantoldmehewaswillingtospeakwithmebutthathewouldfirstspeakwithanattorney. RepresentativeNearmansaidhewouldcallmebackinthenextdayortwoandletmeknowhisdecision.

Captain Brooks toldmeaboutavideothatwaslocated ononeoftheOSPshared drives. Hetoldmethevideoshowed Representative Nearman exiting thewestADA Capitol Malldoors, andprotestors accessing theCapitol through theopened door. Theincident tookplaceonMonday December 21, 2020during special session which wasaonedayevent. Thisspecial session tookplacewhentheCapitol wasclosed duetothepandemic andspecial session wasgoingtobeavailable bythepublic through livestream.

IknowthatduringtheDecember 21, 2020, protestors accessed theclosedCapitol fromanopened door. Salem Police Officers aswellasOSPCapitol MallTroopers got intoaltercations withprotestors asprotestors entered thebuilding, whichwasclosed tothepublic. Iassisted inthisprotest inaSWAT (Special Weapons andTactics) capacity. Ilaterlearned thatthedoortotheCapitol wasopened byRepresentative MikeNearman.

Iwatched thevideoandrecognized Representative MikeNearman walkoutofthe Capitol usingthewestADAdoors. Isawpeople waiting outside oftheCapitol west ADAdoorsandwerepeering intotheCapitol intheexterior doorwithwindows. I watched Representative Nearman walkoutofonedoorandintoafoyer andwalked towards theotherdoortooutside wherethepeople werestanding. Iwatched Representative Nearman movetotherightofaperson standing outside andmoved around theperson. Thevideodoesnothaveaudio.

OnthevideowhentheRepresentative moves totherightofthepeople standing outside, anunidentified mandartsinside andgrabstheinterior doorbefore itcloses. Theman “waves” inothers tofollow. Iknow thatthedoortheunidentified manis holding openisasecure doorthatwould allowanyone tomovefreelywithinthe Capitol. Employees oftheCapitol aregiven ‘keycards’ granting themaccess toareas insideoftheCapitol.

Next, Iwatched several people come inside oftheCapitol. Numerous OSPCapitol MallTroopers moved toward thepeople inside andpushed themoutoftheCapitol. Some ofthepeople thathadmadeitinside oftheCapitol resisted police and altercations ensued (refertoSenior Trooper Hagen’svideo forfurther details). Hesaid, “So,you know, it,it was, uh,yeah, Ijust, I justdidn'tunderstand, Imean, wah, thewah, theonethingwedidn'thaveis,we didn'thaveany, uh, instructionnottogooutparticulardoors. Imean, thefrontdoorwasobviouslyclosed, butalltheside doorsandthebackdoorandthegaragedoorwere, youknow, we, wecouldenterandexitby. Um, thatonewasclosertotheprotesters. Iwas, Iwasn'tquitesurewhat, whathismotivationwas.”

ItoldRepresentative ReschkephonerecordsindicatedheandRepresentative Nearmanspokefor about15minutesafterthosetextmessagesweresent. IaskediftheydiscussedRepresentative Nearman’smotivationsduringthatcallandhesaidhedidn’trecall, thathecouldn’tsayforsurewhat wasinthatconversation. IaskediftheyhadspokenaboutRepresentative Nearman’smotivations for openingthedoorsincethenandhesaid, “Nuh, I,I, I haven’thadthatwithhim.”He saidhebelieved Representative Nearmanwasremorsefulthathewentoutthatdoorandthatinlookingbackhewould havepickedadifferentdoor. Representative ReschkesaidRepresentative Nearmanhasreceivedlots ofthreatssincethattimeonhispersonalphone.

ItoldTerrie thatIwascalling herregarding aninvestigation thatIwasdoingregarding arallyattheCapitol onDecember 21, 2020. Iasked TerrieifshewasattheCapitol thatdayandshetoldmeshewasn’tsureontheexactday. ItoldherthatIhad information thatshewastexting withRepresentative MikeNearman. Shesaid, “Uh, uh, Idid, Ineverspoketotheperson thatday. Thatperson neverresponded toany messages oranything, didn’tevenknowwhere hewas, didn’tknowwhat, what happened onthatpart.”

Iasked herwhyshewastexting withhimandshetoldme, “Uh, boy, Iwould imagine youguysalready gottextmessages orhavecopies ofthemorsomething, soitwas justabout whatsideofthebuilding weweresupposed tobeon.”I asked herwhyshe wasneeding togetspecific instructions onwhere tobeandshesaid, “Because ofthe, the, thedoorwouldbeopened, sothatpeople mayentertoattendtheclosed, uh, closedmeeting.”

Iaskedherifsheremembered itbeingspecial session onthedaythatshewasatthe Capitol andshetoldmeshedidn’tremember anddidn’tthinkthatitwasspecial session. Shesaid, “Uh, Ithinkitwasoneofthose things where theyjust, Idon’tknow, oneofthethingswhere theyjustkindofbasically said, ohwe’regoingtodothisand we’renotgoingtoallowthegeneral publictobeheretobeawitness toortopartake, uh, because oneofthegentlemen thatwaspartoftheevent, ornotoftheevent, but ofthesession, whatever youcallthatthing, uh, leftandthenwhenheheardwhatwas goingonoutside theCapitol, heturnedaround andcameback. So, because thatwas alsoaperson thatwasvoicing thefactthatthepeople aren’theretobeheardandit’s forthepeople because ofthepeople, bythepeople andy’allarejustdoingyourthing regardless ofthepeople.”

Iasked Terrie ifshewasthereattheCapitol thatdayinsupport ofthebuilding being openandforthepublic tobeallowed inside tohearthelegislative process andshe toldmeyes. Terrietoldmeshethought thatpeople couldhavetakenCOVID precautions andstillbeinside ofthebuilding toparticipate inwhatshedescribed as normal lawmaking.” Iasked herifitwasherunderstanding thattheCapitol was closed thatdayandshetoldmeyes. Terriedescribed asseeing oneofthedoors beingclosed with “anorange extension cord.”

Iasked herifthefootage wasrecorded from thatdayandshetoldmeitwasandthatitwasposted ontheinternet. Iasked herif thelivestreamer wasQuincy andshetoldmeitwas. Iasked herifsheknewwho Representative Nearman andifshemethimpriortothatdayandshesaid, “Uh, once.” Iherwhenthatwasandshetoldmethatshedidn’tremember butknewthatit wasbefore therallyattheCapitol (onDecember 21, 2020).

IaskedTerrie ifshecoulddescribe theeventthatshemetRepresentative Nearman atandshedescribed itas “someoffice space overinSalem.” Shetoldmeshewas notfamiliar withSalem andshegotlosttryingtogettothemeeting. Shetoldmeshe wenttothemeeting andmetupwithQuincy “tokeephisstream onpoint.” Iconfirmed thatshedidn’tknowwhatthedatethemeeting wasandshetoldme, “Noandit’son hisfeed, soImeanI’msureaperson wanted togoback, youcouldfinditonthelive feed.” Iasked herifthere wasanametothelivefeedfromthatmeeting andshesaid, Hmm, TheBlackConservative.” Iasked herifTheBlack Conservative wasQuincy’s nameofhislivestream andshetoldmeyesthatQuincy wasTheBlack Conservative. IaskedTerrie ifthisvideowaslocated onYouTube andshetoldmeyes. Thisisthe similar nameofthechannel thatthevideoJJJE-6wasonwithavideo ofameeting on December 16, 2020. Theonlydifference isthechannel iscalled TheBlack Conservative Preacher. Terrie toldmethemeeting wasforpeople toshow upatthe Capitol insupport ofopening upOregon. Iasked herifatanypointinthemeeting she remembered Representative Nearman saying notthatthisismynumber butifyou weretotextanumber 971andgivesoutanumber, Terrie said, “Wellit’s,it’ sonhis video. It,it’ sonthestream so,I mean, uh, it’sthere, uh, that, thatphonenumber or hisphone number, they’reallapartofthestream.” Iasked herifshegotthatnumber fromthemeeting thattheywerestreaming andshesaid, “Mm, hmm.” Itoldherafter receiving thatnumber shekeptitandwhenshewasattheCapitol fortheprotest she texted thenumber something totheeffectofwearehereandwhere doyouwantto meetus.She said, “Correct.” Iconfirmed thatshenevergotaresponse backfromhim andshetoldmeno (Representative Nearman’sphone records doindicate thathe replied backtoher).

Iasked herifshewastexting Representative Nearman togivehimalocation towhere shewasatandshesaid, “Wellasthestreamer, uh, working, beingtheassistant, beingthestreamer, having that, doingthatnumber, itwasamatter likeokaysowhat doorarewesupposed tobeat,where arewesupposed togotovideothis, where, youknow, thatkindofthing, sofromajournalistic viewpoint, itwasgotta gettheinfo, soyouknowwhere yougottago.”

Terrie toldmeshewasn’tthere texting Representative Nearman herlocation for people todestroy things. ItoldherthatIunderstood thatandshesaid, “Yeah, it,was, itwasamatter ofgoingin,uh, youwalkinthebuilding. Itgivesyouanopportunity to takeaseat, likeyou’resupposed toheyIgotalearning lesson aboutallthesethings too. Ididn’t’know thesethings wereopentostartwiththepublic, Ididn’tknowweas thepeople untilthen, couldactually participate inthosethings. Soknowing thatwe could, andtheywerebeingblocked.”

Ifyousaythedoor’sgoingtobeopen, where arewesupposed to be, andwhere arewesupposed tomeetor,you know, atwhatpoint. Youcantellme thewestsideofthebuilding. Icouldn’ttellyouwhatsidethewestis.”

ItoldTerrie thevideofromthemeeting thatsheattended earlier, Representative Nearman toldtheaudience togivealocation andtextanumber thathegaveout. I toldhersheknewfromthemeeting thatRepresentative Nearman wasgoingtobe theretohelpfacilitate letting people come inside oftheCapitol. Terrie said, “Didnot knowwhoitwasgoingtobethatandIdobelieve inthestream itdoesn’tsay, even thenhedoesnotsaywho. It’sjustaperson would bethere.” Terrie toldmeshenever knew whotheperson wasthatopened uptheCapitol doors. Shetoldmeherand Quincy werenotintheareawhenithappened. IaskedherwheresheandQuincy wereandshetoldmetheywereneartheTVmonitors when theperson brokethe door.

IaskedherifsheevermadeitinsideoftheCapitol andshesaid, “Iwasn’tatthearea, yeah. Iwasn’tattheareawhere thedoorwasopenandpeople actually wentin.Uh, I know somepeople wentin,but Ionlyknow thatbecause ofvideosthatI’veseen.”

Terrie toldmeshewentinside oftheCapitol withQuincy through adoorshe described asadoorthatfacedtheparking lot. Shesaidtheywereinasmalllobby andshewaswatching Quincy’sback. Iasked herifshesawRepresentative Nearman thatdayoftherallyandshetoldmeno. Shetoldmesheknew whathelookedlike fromthemeeting priorbutsaid, “Iwouldn’tknow whathelooked likebutwiththeway thecrowd was, unless Isawhimwalking outabuilding orsomething, Iwouldn’thave known whohewas.”

Territoldmeshewentinside oftheCapitol afterthescuffle outside. Shedescribed thescuffle asofficers deploying pepper ballsandsomeone fromthecrowddeployed bearspray. Terrie toldmetheyleftfrominside oftheCapitol afterofficers hadmade announcements tothecrowdtoexitthebuilding ortheyweregoingtobesubject to arrest. Terrie toldmeshewouldnotparticipate inanything thatwasgoingto jeopardize herself, hercareer, herhusband’scareer andherfamily.

Ireiterated toTerriethatsheattended ameeting thatRepresentative Nearman was speaking at,he presented anumber during thatmeeting tocontact “somebody”. Itold her, Ithinkitisfairtosaythatsheprobably thought shewastexting Representative Nearman andTerriesaid, “Uh, that’sfairtosay.” Itoldherpeople weregoingtobelet inside anddisrupt session inwhatshewasdescribing asapeaceful manner andshe said, “Idon’t,uh, Idon’twanttocallit,I don’tevenwanttousetheworddisrupt. Because disrupt means thatwe’reouttheretocause something. Thatwasn’tit.It was likeifwesithereandifwecomeinandwelisten, likeyouwould anyothersession, whichIhavecometolearnthatyoucandothat, uh, butit’sbeen closedandwe’ve had, youknow, people havefeelings thatalotofthingshavebeendoneandwedon’t gettobeapartofit.”

ShetoldmeshewenttoWashington D.C.with Quincy and assisted himwhilehewasstreaming theM.A.G.A (MakeAmerica GreatAgain) March.

Itoldherthatinvestigation thatIwasdoingwasahighly publicized inthemedia. I asked herifshehadlearned afterthefactwhoopened thedoorthatdaywhichlet protestors intothebuilding andshesaid, “Personally Idonotknowwhoopened the door. There isavideothatwasleaked bywhomever thatshows aperson walking out thedoor, walking downthesidewalk, going wherever. I’mnotgoing toputmyfinger onanybody andsayohyeah, Iknow thatperson because Idon’tknowtheperson personally thatwalked out. Uh, soIcan’t,I don’tthinkitwouldbeappropriate forme tosaythat.”

Itoldherthatwasfairenough asIwasgoingtoaskherwhotheperson was. Terrie said, “Ithinkyoualready know.” Terrie toldmeshedidn’tthinkitwasfairofherto makecomments onsomething thatshesawinavideoandnotsomething thatshe wasawitness to.She toldmeshetexted thenumber thatshewasinstructed totext fromthemeeting andinthattextsheincluded herlocation butnooneopened the doorsthattheywereat.I asked Terrie howshefound outaboutthemeeting thatshe received thenumber fromandshetoldmeQuincy toldheraboutthemeeting and asked hertoattend itwithhim.

Iasked himifheremembered Representative Mike Nearman beingthespeaker atthismeeting. Hesaid, “Ibelieve that’swhoitwas. I believe soyeah.” Iasked himifhewasfamiliar withtheperson andhetoldmehe thought thattheperson wasaRepresentative oracongress person ofOregon.

Iasked himhowhefoundoutabout themeeting andhetoldmeJanira buthewasn’t sureonhowJanira knewofthemeeting. Hetoldmehewasgiventhedate, timeand location ofthemeeting byJanira. Hetoldmehedidn’trecallwhatthemeeting was aboutandthathewould havetorewatchthevideotoremember thedetails.

Iasked himifheremembered theRepresentative giving outaphonenumber during themeeting andhesaid, “Idon’trecallthat, Idon’trecallthat. Idon’trecallaphone number myself.” ItoldhimthatIwatched thevideoandtheRepresentative gaveouta phone number andtoldpeople totextthatnumber andinclude yourlocation forthe December 21, 2020, rally. ItoldhimtheRepresentative wasimplying thatsomeone wasgoingtoopen thedoorwhere theperson wastexting from. Iasked himifhe recalled hearing thatduring themeeting andhesaid, “Youmake mewanttogoback andwatchit.Now youaregoingtomakemegobackandwatchit.”

ItoldQuincy thereason whyIobtained hisinformation isthatIhadevidence thathe wastexting thatnumber thatwasgivenatthemeeting, belonging toRepresentative MikeNearman. Ireadthefirsttextmessage tothatQuincy senttoRepresentative Nearman as “HeyMikethisisQuincy, whatdoordowecome in?”Quincy asked me whatthenumber wasandItoldhimitstarted witha971. “I,I doremember ‘cause he wastalkin, a,I thinkhewastalking aboutthecap- likemeetings orsomethin’ bein’ openattheCapitol forthepublic andwe, likepeople cangoin,we cangoinorlisten tomeetings orbe, bepresent. It’sopentothepublicbasically. Ithinkhedidsaythat atthemeeting. IfIremember correctly ‘cause hewastalkin’ aboutlegislate, Ibelieve legislation andallthat, andhewassayin’ thatthelegislations orthewhatever wasgo, whatever happens attheCapitol wasopentothepublic.”

ItoldQuincy thatlegislation istypically opened tothepublic butduetothepandemic itwasclosed andhadbeenclosed sinceMarch of2020, when thepandemic started. Quincy toldmeheremembered getting thephone number possibly fromJanira and toldmehevaguely remembered himorTerrie texting “Mike” atthatnumber. He recalled saying something totheeffectofweareonourway. Hetoldmehedidnot hearanything backfromhim. Representative Nearman records indicate that Representative Nearman texted Quincy twoseparate responses of; West“ door,” and Justtothesideofthemainentrance.”

Hesaid, “Itlooked like people werestanding, likedoorsweren’topen, butpeople werelikewaiting forthe doorstoopen.” HetoldmewhenhegottotheCapitol nodoorswereopened and people werejustoutside, standing nearamonitor.

Iasked himwhathereason tobetherewasandhetoldmehisagenda was “toshow thenation andworld, orwhoever waswatching, what’staken place. Iheardthatthere wasalegislation meeting andthat’swhyIwent.” Hetoldmehestreams various rallies andhewasadvised thattherewasarallyattheCapitol andhewasthereto livestream it.

Quincy toldmeTerrie washisassistance andwashiseyesbecause whatever heis streaming hegetsfocused onthatanddoesn’tpayattention towhatisgoingon around him. ItoldhimtheCapitol wasclosed thatdayandIknew thatpeople were thererallying because theywanted Oregon toopenupandtheCapitol toopenup. He said, “Ididn’tknowasfaras, oh, openuptheCapitol typeofthingfrommy understanding itwassupposed tobeopenforthepublic.” Hesaid, “Forbecause what Miketalked aboutatthemeeting andfromtheunderstanding, uh, he, youknow, and thepeople wereoutside saying thesamething. It’ssupposed tobeopenforus.”

Iasked himwhathethought Representative MikeNearman’srolewasbecause he contacted himforareason andhesaid, “I,honestly, Ihadnocluewhathisrolewas except thatIthought thathewasalegislator orRepresentative orsomethin’, soI thought thatmaybe hehadsomesortof,um, Iguess weight orauthority to,to let people in cause‘ Iheardabunch of,I heardabunch ofthings, thattherewasagroup ofpeople getting’ togo, getting’ togoin,like media typeo’thing. ThenIheard that nobody cangoin,so Iwasjust, reallywhen Igotthere Iwaskindo’confused. Like what’sgoin’ on. Tobehonest withyou, Iwaskindo’confused.”

IaskedhimifhesawRepresentative attheCapitol duringtherallyandhetoldmeno. IreadhistexthesenttoRepresentative Nearman as, “MikethisisQuincy. Whatdoor wedocomein.”I readRepresentative Nearman’stextstohimasWestdoor,” and Justtothesideofthemainentrance.” ItoldhimthatIwanted toknowabouttheir conversation andhetoldme, “Ohyeah, andthat, that, sothewestdoorwas, iswhere everybody wasat.So, likeIsaid, that’swhyIwasconfused about ‘cause everybody wasat,I believe, atthewestdoorandI’mlikewellwhatwestdoor? Everybody’sout hereanditwasjustconfusing because I’m,you know, Ishowed uptothethingto livestream, anditmadeitsound, he, likewecouldgetin,at least, atleastasfaras livestream, andmeandmedia orlivestream, itwaskindo’like youcangetin.And so Iget, I’matthewestdoor. Iamtextin’ okayI’mheretogetin.Uh there’slikeagroup ofpeople outhere. Idon’tknowifeverybody elseisgoinbutIwanna getin.You know. IaskedJanira aboutameeting thatoccurred inSalem onDecember 16, 2020. Janira toldmeshecouldlookupthedateinhercalendar. Shetoldmethatsheattended a meeting onDecember 16, 2020, called “BillFest.” Iasked herabout “BillFest” and shedescribed itasatraining toresearch bills. ShetoldmeStateRepresentative Nearman walked themthrough theprocess. Shetoldmeshehelped organize the training tohelppeople understand theprocess andlearnhowtheycanbeapartof theprocess bythings liketestifying. Shetoldmethemeeting washeldatthe Freedom Foundation office inSalem, Oregon. Iasked herhowshemetQuincy and shetoldmethrough theOregon Chapter ofBlexey (unknown onspelling). Janira told mesheinvitedQuincy andTerrie because sheknew thathewasa live“ streamer” and duetothewinter andCOVID shewanted himtorecordthemeeting sopeople could learnabouttheprocess.

Iasked herwhatshethought Monday, December 21, 2020, wasgoing tobeabout andshetoldmeshethought itwasgoingtobelikemanyrallies thattheyheldinthe pastwhere people weregoingtotheCapitol andsupport theircause. Shetoldmeshe thought itwasgoingtobealotliketheRepublican Walkout fromacoupleofyears agowhentheRepublican walked outofthebuilding andprotestors aligned the walkway andwerecheering andgiving theRepublicans “high-fives.” Shetoldmeshe didnotexpectthatDecember 21, 2020, wasgoingtoturnoutthewaythatitdidand described itas “things getting outofhand.” Shetoldmeshewaswatching Quincy’s livestream atworkthatdayoftheeventasitunfolded.

Shetoldmewhenshelooked atitshethought thatpeople thatwereinside ofthe Capitol wereallowed tobeinside. ShetoldmesheheardfromFacebook thatthere wasaT.Vlocated outside. Shetoldmewhenshewaswatching Quincy’slivestream andsawthatthesameT.Vmoved inside thattheyweregivenpermission tobeinthe building. Shetoldmeitwasonlyafterwards thatshefoundoutpeople gotarrested fromrefusing toleavetheCapitol. Iasked herifsheknewiftheCapitol wasopened thatdayandshetoldmesheknewthattheCapitol wasclosed thatdayforspecial session andtherallywas “Re-OpenOregon.”

Iasked himifhehadaCapitol badge thatallowed himaccess tothebuilding andhesaidhedid. Hetoldmehethought he parked towards theWorld WarIIMemorial. Iasked himwhatdoorhenormally went through andhetoldmeheusually enters neartheHouse ofRepresentatives side. He toldmehethought thatheentered onthewestsideofthebuilding. Iasked himifhe sawpeople nearthedoorsandhetoldmethattherewasacouple people attheside. Bensaidmostofthepeople wereinthefrontoftheCapitol. Iasked himifhewas nearthe “Liberty Bell” andhetoldmehedidn’tknowwhatbellIwastalking about. I explained theareaasthedoorsthatlatergotdamaged byprotestors.
