*5390 WATER PIPE LEAKS—SUTHERLAND SHIRE—Mr Malcolm Kerr asked the Minister for Water Utilities, Minister for Small Business, Minister for Regional Development, and Minister for the Illawarra— (1) How many leaks have Sydney Water investigated in the Sutherland Shire since July 2000? (2) How many of these leaks were from pipes owned by Sydney Water? Answer— (1) and (2) Sydney Water has advised: Sydney Water's water supply system is a complex network of 21,000 kilometres of mains and approximately 5 million joints. The system is the largest and first to be established water network in . Water loss from water supply systems is a world-wide problem and is complex and expensive to fix. Most of the water loss is not due to visual main breaks and leaks, but is a result of underground seepage from some of the 5 million joints in Sydney Water's system. Of the total water loss, less than 3 per cent is from visual leaks and breaks. Factors such as climate, soil conditions and age of the infrastructure can affect leakage rates dramatically. Sydney Water has already reduced its level of leakage by nearly 25 per cent in the last couple of years which is currently saving around 48 million litres of water every day. Sydney Water's total investment in leak detection and water main repairs and replacement is $92 million this financial year made up of: • $59.5 million on water main renewals; • $5.5 million on underground leak detection; • $27.25 million on fixing main breaks and leaks and repairs to aboveground pipelines. The $59.5 million investment on water main renewals will fund the replacement of 95 kilometres of water mains right across Sydney, the Blue Mountains and the Illawarra. Sydney Water has also further expanded its water main inspection program. As part of this, they will scour 18,000 kilometres of our water mains for hidden leaks each year and replace 300 kilometres of water mains over the next four years. In relation to the Sutherland Shire, the majority of leaks investigated by Sydney Water were from non- Sydney Water pipes. The information provided is based on those leaks reported to Sydney Water from 1 January 2001 to 2 March 2006. Prior to that time information was captured in a different system and the collection and integration of these records is considered to be an unreasonable diversion of resources. Of the 7,639 leaks investigated over this 5 year two month period, only 2,866 were from pipes owned by Sydney Water. Sydney Water's new Operating Licence contains mandatory requirements to respond quickly to and stop the loss of water from visible leaks. priority. Sydney Water has a 24-hour response capability to attend to and repair leakage from its supply system with up to 70 work crews available to fix leaks on a given day. *5392 PARKING INFRINGEMENT REVENUE—HUNTERS HILL, LANE COVE AND RYDE—Mr Anthony Roberts asked the Deputy Premier, and Minister for Transport representing the Treasurer, Minister for Infrastructure, and Minister for the Hunter— How much revenue has been raised from traffic infringement fines issued in the following Local Government Areas: (a) Lane Cove (b) Hunters Hill and (c) Ryde for the period by year 1 July 2000 to the present date? Of the 1,562, 612 and 4,926 leaks investigated in the Lane Cove, Hunters Hill and Ryde local government areas respectively over this five year two month period, only 507, 176 and 2,085 were from pipes owned by Sydney Water. Sydney Water's new Operating Licence contains mandatory requirements to respond quickly to and stop the loss of water from visible leaks. Sydney Water will continue to treat leak reduction and renewals as a priority. Data prior to September 2002 is managed by NSW Police. *5395 KNIFE CARRYING CHARGE—RELIGIOUS BELIEF—Mr Richard Amery asked the Attorney General, Minister for the Environment, and Minister for the Arts— (1) Under the Summary Offences Act, is there a defence against a charge of carrying a knife, by claiming that the carrying of the knife is part of a religious belief? (2) Have there been any court cases where a person charged has used this defence? (3) If so, what was the result of these court cases? Answer— Section 11C (2) (a) (vii) of the Summary Offences Act 1988 provides for a defence of being in custody of a knife in a public place or school if the knife is carried for "genuine religious purposes". The Director of Public Prosecutions has advised that he is not aware of any court cases in which this defence has been raised. However, police prosecutors conduct the vast majority of summary prosecutions in the local court. As with other legal defences the onus of proof lies on the accused person to satisfy the court that they had a reasonable excuse for carrying a knife. Anyone who raises this matter would be required to prove that they are a member of a specified religious group, and prove that there is an established custom or practice of carrying a knife connected to the particular religion. *5397 WYONG HOSPITAL—Mr Chris Hartcher asked the Minister for Education and Training representing the Minister for Health— (1) How many wards at Wyong Hospital have been wholly or partially closed since 1 January 2005? (2) How many nurses registered and enrolled are actually employed at Wyong Hospital? (3) What is the required number of nurses to ensure all wards are fully operational? Answer— The Minister for Health advises me: (1) One for approximately two weeks. (2) and (3) Wyong Hospital's current approved nursing staff profile is 319.3 FTE. As at 28 February 2006, Wyong Hospital was staffed by 317 FTE. Where vacancies exist qualified staff are employed on a temporary basis pending permanent recruitment to such positions. *5398 SUTHERLAND HOSPITAL SECURITY—Mr Malcolm Kerr asked the Minister for Education and Training representing the Minister for Health— (1) What steps have been taken to improve security at Sutherland Hospital since October 2004? (2) How many extra security personnel have been employed? (3) Are all positions for security officers filled? Answer— The Minister for Health advises me: (1) to (3) Since 2002 the NSW Health has provided more than $9 million in capital funding to improve security for patients and staff, and support the NSW Government's zero tolerance response to violence in our hospitals. This is in addition to the $5 million per annum that is being provided to increase our numbers of security staff. In March 2005 NSW Health also released a security improvement tool, which helps hospitals measure their security programs and identify areas that may require improvement. Hospitals can then take the necessary action to ensure that their programs continue to be effective. The South Eastern Sydney & Illawarra Area Health Service has advised that since the Sutherland Hospital moved to its new premises in 2003, a range of security improvements have been implemented. They include: • Replacement of CCTV cameras from black⁄white to Envirodome colour cameras. • Additional cameras installed at the Kingsway entrance to the Hospital. • Upgraded the recording system from video to computer allowing incidents to be burnt onto CDs for police investigations etc. 6579 LEGISLATIVE ASSEMBLY QUESTIONS AND ANSWERS THURSDAY 6 APRIL 2006

• Increased security staffing on Friday and Saturday nights. • Increased duress alarms from 30 to 140. • Improved outdoor lighting across the Hospital Campus. • Implemented a policy for the scanning of difficult patients and visitors to the Hospital utilising metal detectors. The Area Health Service has further advised that there are currently no vacant security officer positions at Sutherland Hospital. *5399 MANLY HOSPITAL—MATERNITY SERVICES—Mrs Jillian Skinner asked the Minister for Education and Training representing the Minister for Health— (1) Is he proposing to cut maternity services at Manly Hospital? (2) If so, why? (3) What is your longer-term plan for Manly Hospital maternity wing? (4) What is the projected birth-rate for the Manly area? Answer— (1) to (3) The Northern Sydney and Central Coast Health Maternity Services Review was conducted to ensure safe and sustainable maternity services across the Area. Manly and Mona Vale Hospitals will operate as a single Maternity Service for the community of the Northern Beaches, with units remaining at both hospitals. The final service model will be developed through an implementation group composed of local management, clinicians and consumers. (4) NSW Health does not project birth rate data. *5405 FIBRE OPTIC CABLE INSTALLATION—YASS—Ms Katrina Hodgkinson asked the Minister for Water Utilities, Minister for Small Business, Minister for Regional Development, and Minister for the Illawarra representing the Minister for Natural Resources, Minister for Primary Industries, and Minister for Mineral Resources— (1) What was the cost to the NSW taxpayer for the installation of fibre optic cabling into the Department of Primary Industries Office (former Department of Agriculture offices) in Yass? (2) When was the decision to install this cabling made? (3) When was the decision to vacate this office made? Answer— I have been advised by the Minister for Natural Resources, Minister for Primary Industries and Minister for Mineral Resources of the following: (1) Optical fibre was not installed to Yass Office. (2) N⁄A. (3) 30 July 2004. *5408 PUBLIC BUSES—CASTLE COVE—Ms Gladys Berejiklian asked the Deputy Premier, and Minister for Transport— (1) Given the findings of the Unsworth Review into public transport, will he be providing greater access to public buses by Castle Cove residents? (2) If not, why not? Answer— I am advised: (1) and (2) The new Sydney metropolitan bus contracts include Service Planning Guidelines which introduce annual bus service reviews and outline community consultation processes. The consultation process requires the establishment of bus planning forums in each of the 15 contract regions in Sydney. The forums provide the opportunity for key stakeholders and transport groups to have input into the bus planning process in their region. *5409 LANE COVE TUNNEL FILTRATION TRIALS—Ms Gladys Berejiklian asked the Minister for Water Utilities, Minister for Regional Development, Minister for the Illawarra, and Minister for Small Business representing the Minister for Roads— In relation to the Lane Cove Tunnel project, when will the Government be commencing filtration trials? 6580 LEGISLATIVE ASSEMBLY QUESTIONS AND ANSWERS THURSDAY 6 APRIL 2006

Answer— I am advised: The ventilation system in the Lane Cove Tunnel will meet strict world air quality standards. Last year the then Roads Minister indicated that if the Federal Government increased its offer of $10 million for filtration - to fund half the cost of filtration via a special purpose grant - the RTA will hold discussions with Lane Cove Tunnel Company aimed at raising the other half. The Federal Government has not increased the offer. *5417 ROAD PROJECT EVALUATION—ALSTONVILLE BYPASS—Mr Donald Page asked the Minister for Water Utilities, Minister for Small Business, Minister for Regional Development, and Minister for the Illawarra representing the Minister for Roads— (1) When assessing the benefits⁄cost for a road project, what factors are included in: (a) Benefits; and (b) Costs? (2) What weighting are these various factors? (3) (a) In relation to the Alstonville Bypass, how much Federal money has been expended on the project in2003-04 and 2004-05? (b) How much of the Federal Government's money is still to be expended? Answer— I am advised: The costs and benefits of road projects are calculated in accordance with the RTA's Economic Analysis Manual. This Government recognises that development of east west routes in the North Coast region is a priority and we support the construction of the Alstonville Bypass. The Federal Government's Auslink agreement means NSW has to pay an extra $298 million over four years for maintenance, safety and minor works on former National Highways, previously fully funded by the Federal Government. Consequently, even though the design work, property acquisition and other pre-construction activities have been completed, the reduction in funding brought about by the Auslink agreement means that the Alstonville Bypass has been delayed for at least four years. I am advised that the Federal Government's commitment to the project is $12 million. The Federal expenditure on the project for 03⁄04 and 04⁄05 was approximately $6 million. *5418 ALSTONVILLE BYPASS PROJECT—Mr Donald Page asked the Minister for Water Utilities, Minister for Small Business, Minister for Regional Development, and Minister for the Illawarra representing the Minister for Roads— (1) What is the latest cost estimated for the Alstonville Bypass, identifying the break-up between land and property acquisition costs, planning costs, service relocations and construction costs? (2) In regard to land and property acquisition costs: (a) How many land acquisitions have been completed and how many are still to be completed? (b) How many land acquisitions are still under dispute? (c) If there are any, when do you expect the dispute to be resolved? (3) In regard to service relocations, what is the status of the service relocations for: (a) Country Energy? (b) Telstra? (c) Rouse Water or Ballina Shire water relocations? (d) Sewerage relocations? (4) In regard to design documentations for the Alstonville Bypass: (a) Is the design completed to the point to allow tenders to be called? (b) Have the contract documents been prepared to allow tenders to be called? (c) Has the contractor tender list been finalised? environmental issues? (e) If so, will this cause any changes to existing documents? (f) Are there any other reasons why design documentation needs to be changed? (5) (a) How long does the existing Ministerial approval for the Alstonville Bypass remain current? (b) What conditions need to be met to keep the Ministerial approval current and under what circumstances would it be necessary to do a new EIS because of delays in construction? Answer— The State Government recognises that development of east west routes in the North Coast region is a priority and we support the construction of the Alstonville Bypass. I am advised: The project is expected to cost in excess $60 million in 2005 dollars. The Federal Government's commitment is only $12 million. All thirty property acquisitions have been completed. Three acquisition valuations are in dispute and are expected to be resolved within the next twelve months. The Federal Government's Auslink agreement means NSW has to pay an extra $298 million over four years for maintenance, safety and minor works on former National Highways, previously fully funded by the Federal Government. Consequently, even though the design work, property acquisition and other pre-construction activities have been completed, the reduction in funding brought about by the Auslink agreement means that the Alstonville Bypass has been delayed for at least four years. *5420 CHILD PORNOGRAPHY OFFENCES—KEMPSEY HOSPITAL—Mr Andrew Stoner asked the Minister for Education and Training representing the Minister for Health— In relation to the charging and subsequent conviction of the then Children's Ward supervisor at Kempsey District Hospital, Bruce Mackay, in relation to child pornography offences: (1) How long did Mr Mackay remain on duty at the hospital after he had been charged by police? (2) How long did he remain on pay after being charged? (3) Why was he allowed to remain in charge of children after being charged with the offences? Answer— The Minister for Health advises me: (1) to (3) The former Minister for Health initiated an independent investigation, to be undertaken by Ms Chris Ronalds, SC, into the management of this staff member at Kempsey District Hospital. The former Minister tabled the report of this investigation in the House on 24th May 2005 and I refer the Honourable Member to that report and the former Minister's comments in the Hansard made on that date.

Answer— The Minster for Health advises me: The Health Services Union has lodged a claim on behalf of ambulance officers seeking enhanced death and disability benefits similar to that afforded to police officers and fire fighters. The matter is presently under consideration. 5442 HAWKESBURY RIVER WEED HARVESTER—Mr Steven Pringle to ask the Minister for Water Utilities, Minister for Small Business, Minister for Regional Development, and Minister for the Illawarra representing the Minister for Natural Resources, Minister for Primary Industries, and Minister for Mineral Resources— *5447 INEBRIATES ACT REVIEW—Ms Clover Moore asked the Minister for Education and Training representing the Minister for Health— When will the Government respond to the Report of the Legislative Council Social Issues Committee's Inquiry into the Inebriates Act 1912, given that the response was due in February 2005 and the Government tabled letters in March, April and June, stating that the response will be provided as soon as practicable? Answer— The Minister for Health advises me: Finalisation of a Government response to the Legislative Council Standing Committee on Social Issues Report on the Inebriates Act 1912 remains a high priority. The response is now being co-ordinated within the Health portfolio and it is expected to be tabled in Parliament as soon as practicable. It is important to note that the Committee's report raises complex ethical, legal and social issues concerning involuntary care for certain people with severe alcohol and⁄or drug dependence who are non- 6583 LEGISLATIVE ASSEMBLY QUESTIONS AND ANSWERS THURSDAY 6 APRIL 2006

offenders. The report has required extensive analysis and consultation with a wide range of Government agencies. *5448 BIRD FLU PANDEMIC—Ms Clover Moore asked the Minister for Education and Training representing the Minister for Health— Noting the increasing spread of bird flu across the world, and increasing warnings of the risk of a pandemic, and noting the development of a NSW Influenza Pandemic Action Plan: (1) What are current expert recommendations for preventative action, following the recent international conference on this matter? (2) What information and educational material has been developed for citizens to explain the disease and how they can reduce their risks? (3) What masks or other protective clothing might be useful for residents in the case of a bird flu epidemic? (4) (a) How will the Government ensure water and food supply, and electricity supply if there is an epidemic? (b) What action does the Government recommend for householders? (5) How will the Government ensure police, fire and other emergency services are able to operate if there is a bird flu epidemic? (6) What isolation and quarantine measures does the Government expect to be required to prevent a bird flu epidemic? Answer— The Minister for Health advises me: (1) Avian influenza ("bird flu") and pandemic influenza are different diseases. Avian influenza is a disease of birds that is occasionally transmitted to humans, but rarely, if ever, between humans. Pandemic influenza arises when a novel strain of influenza enters the community to which there is little or no immunity and which is easily transmitted from person to person. Pandemic influenza strains usually arise from avian influenza strains. Current expert recommendations for preventative action are incorporated in the Australian Management Plan for Pandemic Influenza and the NSW Health Interim Pandemic Influenza Action Plan. (2) Avian influenza fact sheets in a number of languages are available through the NSW Health website. A number of resources relating to pandemic influenza are available on NSW Health's Pandemic Influenza Preparedness website. (3) If avian influenza outbreaks in birds occurred in Australia, residents who have no contact with diseased birds are at little risk of contracting avian influenza and no special precautions are necessary. With respect to pandemic influenza, NSW will be guided by Australian Government policy regarding advice for masks and protective clothing and will be dependent on the actual nature of any epidemic. (4) (a) and (b) The NSW Interdepartmental Pandemic Taskforce is currently considering these issues. (5) The NSW Interdepartmental Pandemic Taskforce, which has representatives from police, fire and other emergency services, is considering these issues.
