Main results of the Council

The Council discussed the proposal for a regulation amending directive 2001/18/EC, as regards the possibility for the member states to restrict or prohibit the cultivation of GMOs in their territory.

The Council held an orientation debate concerning the proposal for a regulation on the establishment of a Programme for the Environment and Climate Action (LIFE).

The Council also adopted conclusions on:

– the follow-up to the Durban Climate Change Conference;

– Rio + 20: pathways to a sustainable future.

A Roadmap to a low-carbon economy in 2050

TheCouncilexamineddraftconclusionsonaroadmapformovingtoacompetitivelowcarbon economyin2050,whichaimedtoestablishasustainableandcosteffectivetrajectoryto2050,on thebasisofmilestonesfordomesticgreenhousegasemissionsreductionsof40%by2030,60%by 2040and80%by2050comparedto1990,asproposedintheCommission’scommunication"A roadmapformovingtoacompetitivelowcarboneconomyin2050"( 7505/1 1).

ThePresidencyandCommissionerHedegaardpointedoutthattheEuropeanCouncilhadinthelast yearrepeatedlycalledforprogressontheroadmap,andstressedthatthemilestoneswerenot bindingtargetsbutthattheEUshouldgiveapoliticalsignthatitwaswillingtomoveforwardon climateissues.

Although26memberstatescouldagreeonthePresidency'sfinalcompromiseproposal,one memberstatecouldnotaccepttheprovisionsregardinginparticularthemilestonesforEUdomestic emissionreductionsandfurtherworkonthe2030milestone.

ThePresidencyconcludedthatwhileitwasnotpossibletoadoptCouncilconclusionsonthe roadmap 1,26memberstatessupportedcontinuingwork,andthatitwouldhavetoconsiderthe situationandreportonittotheEuropeanCouncil.

Durban follow-up

TheCounciladoptedconclusionsonthefollowuptothe17thConferenceofthePartiestotheUN FrameworkConventiononClimateChange(UNFCCC),whichtookplacefrom28Novemberto 9December2011inDurban,SouthAfrica( 7517/12 ).

Theconclusionsgiveanassessmentoftheoutcomeoftheconference,andthediscussionfocused onthefollowingconcreteissuesrelatingtothesecondcommitmentperiodoftheKyotoProtocol:

– theenddateofthisperiod :thesecondcommitmentperiodshouldendin2020andthe conclusionsalsocallforareviewofthelevelofambitionundertheKyotoProtocol coincidingwiththe20132015reviewundertheConvention.

– QuantifiedEmissionLimitationorReductionObjective(QELRO) 1:theCouncilconfirmed thatby1May2012theEUanditsmemberstateswouldjointlysendinformationtothe UNFCCCSecretariatontheconversionoftheir2020emissionreductiontargetsinto QELROs.Thesewouldbeprovisionalandwithoutprejudicetosubsequentnotificationof theburdensharingandsubjecttothewrittenconsentofParties.

Itwasrecalledthatthissubmissionwouldbebasedonthe20%emissionreductiontargetenshrined intheclimateandenergylegislativepackage,entailingnochangesinmemberstates'existing emissionreductionobligations,andalsoreflectingtheEU'sconditionaloffertotakeona30% commitment.

– CarryoverofsurplusAssignedAmountUnits (AAUs) 1fromthefirsttothesecond commitmentperiod:severaldevelopedcountrieshavegreenhousegasemissionlevelswell belowtheirKyotoProtocoltargetsandarethereforeexpectedtohavesignificantamounts ofsurplusemissionallowancesoverthe20082012period.

ItwasgenerallyagreedthatanunlimitedcarryoverofsurplusAAUsafter2012(ascurrently foreseenintheKyotoProtocol)couldjeopardisetheenvironmentalintegrityoftheProtocoland thatthisissuemustbesolvedinanondiscriminatorymanner,treatingequallyEUandnonEU countrieswhichtakeonaQELROunderthesecondcommitmentperiod.

ManymemberstatesandtheCommissionstressedthattheEUhadtoliveuptoitsinternational engagementsandstayintheforefrontofthefightagainstclimatechange.

Rio + 20: Pathways to a sustainable future

TheCounciladoptedconclusionswithaviewtotheUNConferenceonSustainableDevelopment (Rio+20), tobeheldfrom20to22June2012inRiodeJaneiro(7514/12 ).

TheConferencewillfocusontwothemes:

– agreeneconomyinthecontextofsustainabledevelopmentandpovertyeradication;

– theinstitutionalframeworkforsustainabledevelopment.

TheconclusionsaimatcomplementingthegeneralguidelinesoftheEUpositionattheConference totakeintoaccountdevelopmentsthathavetakenplacesincethelastCouncilconclusionsonthis subject (15388/11 ),adoptedinOctober2011,andtheEUcontributiontotheUNDESA(United NationsDepartmentofEconomicandSocialAffairs)of28October2011 (15841/11 ) inparticular :

• adraftoutcomedocumentforRio+20,alsoknownasthe"zerodraft",wasissuedbyUNDESA inJanuary2012(negotiationsonthisdraftwillcontinuethroughthefirsthalfof2012inaseries ofmeetingstobeheldmainlyinNewYork);

• newissueswhichhavebeenbroughttothenegotiatingtablebyothercountries,suchas sustainabledevelopmentgoals(SDGs).

ItwasthereforenecessaryfortheCounciltogivenewguidancetothenegotiations,sendinga strongpoliticalmessagethatreiteratesthecommitmentoftheEUanditsmemberstatestothe Rio+20Conferenceanditspreparatoryprocess.TheEUanditsmemberstatesexpectthe Conferencetoproduceafocused,ambitiousandactionorienteddocument,includingconcreteand timelyfollowupactions,thatwillalsoshowarenewedpoliticalcommitmenttosustainable development.

TheEUhasalsocalledforactioninpriorityareasthatwillfacilitatethetransitiontowardsagreen economyandforastrengthenedinternationalenvironmentalgovernance,i.e.theupgradingof UNEPintoaspecializedUNagencyfortheenvironment,inordertostreamlineUNoperationsin thisfieldandtocontributetoareformedinstitutionalframeworkforsustainabledevelopment.

GMOs cultivation

TheCouncildiscussed,onthebasisofacompromisetextfromthePresidency,theproposalfora regulationamendingDirective2001/18/ECasregardsthepossibilityformemberstatestorestrictor prohibitthecultivation,inallorpartoftheirterritory,ofgeneticallymodifiedorganisms(GMOs) thathavebeenauthorisedatEUlevel.

TheaimoftheCommissionproposal( 12371/10 + ADD1 )wastoprovidealegalbasisintherelated EUlegalframeworktoallowmemberstatestorestrictorprohibitthecultivationofGMOsintheir territoryongroundsotherthanhealthandenvironmentconsiderations,whichhadalreadybeen addressedduringtheEUauthorisationprocessforGMOs.

Thecompromiseproposal,inspiredbytheapproachinthenewlyadoptedbiocideregulation 1, allowedfortwooptions:

– during the GMO authorisation procedure :uponrequestofamemberstate,the notifier/applicanthasthepossibilitytoadjustthegeographicalscopeoftheauthorisation, thusexcludingpartoralloftheterritoryofthatmemberstatefromcultivation;

– after the authorisation procedure :thememberstatehasthepossibilitytorestrictor prohibitthecultivationofanauthorisedGMO,providedthatthenationalmeasuredoesnot conflictwiththeenvironmentalriskassessmentcarriedoutatEUlevel.

AlthoughalargenumberofmemberstatescouldacceptthePresidencyproposal,itwasnotyet possibletoreachagreementintheCouncil.Somememberstatesstillhadconcernsregarding:

– thelegalcompatibilityofsomeprovisionsintheproposalwithWTOandEUinternal marketrules;

– howtoavoidpossibleoverlapsand/orinconsistenciesbetweenthemandatoryrisk assessmentatEUlevelandnationalenvironmentalmeasures;

– theimplementationoftheEnvironmentCouncilconclusionsadoptedon4December2008 (16882/08 ).

Programme for the Environment and Climate Action (LIFE)

TheCouncilhadanorientationdebateontheproposalforaregulationontheestablishmentofa ProgrammefortheEnvironmentandClimateAction(LIFE)fortheperiod20142020 (18627/1 1), onthebasisoftwoquestionspreparedbythePresidency (6820/12 ).Theaimoftheproposalisto increasetheefficiencyofthecurrentLIFE+Programme 1inordertoadaptit inter alia tothenew challengesaheadandtotheachievementofEurope2020objectivesandtargets.

Theindicationsresultingfromthedebatewillbetakenintoaccountinthefurtherworkonthenew regulation.TheEuropeanParliamentwillvoteitsreportbytheendof2012.

ThemainelementsofthenewLIFERegulationinclude:

• thecreationoftwosubprogrammesunderLIFE:onefortheenvironment(withabudgetofEUR 2.4billion)andoneforclimateaction(allocatedEUR800million);

• aspecialemphasisonbettergovernance;

• thecreationof"integratedprojects",whichwilloperateonalargescaleandwillaimtoimprove theimplementationofenvironmentalandclimatepolicyandtheirintegrationintootherpolicies;

• abetterdefinitionoftheactivitiesfundedforeachpriorityarea;

Ministersdiscussedtwokeyissues:geographicalbalancei.e.thecriteriaforthedistributionof LIFEfundsamongmemberstatesandcofinancingrates,includingsimplificationofprocedures..

Mostmemberstatesbelievedthattheconceptof"geographicalbalance"wasrelevantforthe distributionofIntegratedProjects,althoughmanymemberstateswouldprefertheconcepttobe clarifiedfurtherandspecificcriteriafortheimplementationof"geographicalbalance"tobe includedintheregulation.Severalmemberstatesconsideredthatthemeritandqualityshould remainthefirstcriteriafordistributionofprojects,inparticular"traditionalprojects".

Somememberstatesconsideredthatthegeographicalbalanceshouldapplytoalltypesofprojects, whileotherspreferredtokeepnationalallocations,asintheexistingLIFE+Regulation.

ManymemberstateswouldliketomaintainVATandpermanentstaffcostaseligiblecosts,evenif thatwouldentailadecreaseincofinancingrates,althoughsomeministersexpressedconcernthat thiswouldleadtoadecreaseinproposalsforprojects.Mostmemberstateswereinfavourofa simplificationofprocedures.

TheproposalwaspresentedbytheCommissionatthelastEnvironmentCouncilmeetingin December , inthecontextofitsMultiannualFinancialFramework(MFF)for20142020 1.

• Emissions Trading Scheme (ETS) for aviation

TheCommissionbriefedministersonthestateofplayregardingthecontactswiththirdcountries opposedtotheinclusionofinternationalaviationintheEU'sETS 1,whichstartedin1January2012.

TheCommissioncontinuesitsbilateraldiscussionswiththosecountries,whilealsopressingfor progresswithintheInternationalCivilAviationOrganisation(ICAO)foraglobalsolutiononthis issue.TheCommissionerpointedoutthattheEuropeanCourtofJustice,initsjudgmentof21 December2011regardingthevalidityoftheETSDirective,hadfoundtheEUschemetobefully compatiblewithinternationallaw.

TheEUETSscheme 2createsthelegalframeworkfortheEU'sindependentcommitment(thatis, independentofeventsininternationalclimatenegotiations)toreducingitsemissionsby20%by 2020comparedwith1990levels.

• Board of the Green Climate Fund

ThePresidencyinformedtheCouncilonthestateofplayregardingtheEUnominationsforthe BoardoftheGreenClimateFund,whichwasestablishedinDurban (6835/12 ).Theagreed compositionoftheBoardis12membersfromdevelopingcountriesPartiesand12membersfrom developedcountriesPartiesforatermofthreeyears.Nominationsshouldbesenttotheinterim secretariatoftheGreenClimateFundnolaterthan31March2012.

• European Semester/Annual Growth Survey

TheCounciltooknoteoforalinformationfromtheCommissionandthePresidencyconcerningthe wayforwardaftertheMarchEuropeanCouncil( 7348/12 ),inthecontextoftheAnnualGrowth Surveyfor2012( 17229/11 + ADD 1 + ADD 2 + ADD 3 + ADD 4 ),whichlaunchedthe2012 Europeansemesterofeconomicgovernance.Thesurveyisthebasisforbuildingthenecessary commonunderstandingontheprioritiesforactionatnationalandEUlevelforthenexttwelve months.

TheCommissionwillpresenttotheJuneEuropeanCounciladetailedassessmentofthe implementationbymemberstatesofthecountryspecificrecommendationsandthePlusPact commitmentsinthecountrybycountryanalysis.

• Global Ministerial Environment Forum

ThePresidencyandtheCommissionbriefedtheCouncilontheoutcomeofthe12thspecialsession oftheGoverningCouncil/GlobalMinisterialEnvironmentForum(GC/GMEF),whichtookplace inNairobifrom20to22February2012( 7306/12 ).Theaimofthemeetingwastopreparethe GC/GMEF’sinputtotheforthcoming'Rio+20summit',concerninginparticulartheenvironmental dimensionofsustainabledevelopment,thestatusofUNEPandtheconceptofgreeneconomy.

• Revision of the Gothenburg Protocol

TheCounciltooknoteofinformationfromthePresidencyandtheCommission(7303/12 ) onthe stateofplayconcerningtherevisionoftheGothenburgProtocol,whichwasadoptedin1999.To date,andfollowingEUenlargements,themajorityofthePartiestotheProtocolareEUMember States(21outof26)andtheEUwouldlikemorethirdcountriestobecomeparties.

NegotiationstoamendtheGothenburgProtocolhavebeenongoingsince2009andarenowdueto befinalisedattheupcoming30thsessionoftheCLRTAPExecutiveBodyinearlyMay2012.The CommissionandthePresidencyinvitedthememberstatestolendtheirpoliticalsupportfor ensuringasuccessfulconclusionofthiswork.

TheGothenburgProtocolisoneofseveralprotocolsconcludedundertheConventiononLong RangeTransboundaryAirPollution(CLRTAP).Itaimsatcontrollingtransboundaryairpollution andassociatedhealthandenvironmentimpacts,notablyacidification,eutrophicationandozone pollution.

• Sound level of motor vehicles

TheCounciltooknoteofinformationprovidedbytheNetherlandsdelegation (6840/12 )onthe proposalforaregulationonthesoundlevelofmotorvehicles(18633/11 ), whichaimstoreduce noiselevelsfrommotorisedvehicleswithinashorttimeframeandalsointroduceanewmethodof measurement.Noiselevelslimitshavenotbeenchangedsince1996andtheproposalstressesthat noisefrommotorvehiclesseriouslyaffectshumanhealth.

• Drought in Portugal

TheCounciltooknoteofinformationprovidedbythePortuguesedelegationontheconsequences oftheseveredroughtthataffects70%ofPortugal'scontinentalterritory.Thedelegationcalledfor EUassistanceinpossiblemitigationmeasures(7232/12 ).

• Status of the wolf population in Spain

TheCounciltooknoteofinformationfromtheSpanishdelegationrequestingmodificationofthe statusofthewolfforthepopulationofCastillayLeón,inDirective92/43/EEC("theHabitats Directive")(7369/12 ).

Recycling of batteries

TheCouncildecidednottoopposetheadoptionbytheCommissionofaregulationlayingdown rulesregardingthecalculationofrecyclingefficienciesoftherecyclingprocessesofwastebatteries andaccumulators,pursuanttoDirective2006/66/EC ( 5198/12 ).Thenewruleswouldapplyasfrom 1January2014.

Thedraftregulationissubjecttotheregulatoryprocedurewithscrutiny.Thismeansthatnowthat theCouncilhasgivenitsconsent,theCommissionmayadoptitunlesstheEuropeanParliament objects.

ENERGY

Energy performance of buildings - Delegated act*

TheCouncildecidednottoobjecttotheentryintoforceofaCommissionregulationestablishinga comparativemethodologyframeworkforcalculatingcostoptimumlevelsofminimumenergy performanceforbuildingsandbuildingelements( 5441/12 + 7091/12 )1.Theregulationsupplements directive2010/31/EUontheenergyperformanceofbuildings.

TheregulationisadelegatedactpursuanttoArticle290oftheTreatyontheFunctioningoftheEU. ThismeansthatnowthattheCouncilhasgivenitsconsent,theactcanenterintoforce,unlessthe EuropeanParliamentobjectstoit.

TRADE POLICY

EU-US customs cooperation - Trade partnership programmes

TheCounciladoptedtheEUpositiononadraftdecision,tobetakenwithintheEUUSjoint customscooperationcommittee,aimedatestablishingmutualrecognitionbetweentheAuthorised EconomicOperatorProgrammeoftheEUandtheCustomsTradePartnershipAgainstTerrorism ProgramoftheUS ( 6759/12 and 6759/12 ADD1 ).

Themutualrecognitionoftheseprogrammesisintendedtosecuretheinternationalsupplychain andfacilitatetradebetweentheEUandtheUS.Italsoconsolidatestheapproachagreedat internationallevelintheWorldCustomsOrganizationFrameworkofStandardstoSecureand FacilitateTrade(the"SAFEFramework").Italsoaddressestheconcernsofthebusinesscommunity tosimplifyrequirementsandtostandardisecustomssecurityprocedures.

EUUSrelationsintheareaofcustomsarebasedontheCustomsCooperationandMutual Assistanceagreementsignedin1997.
