BRIEF RESUME' OF THE BUSINESS TRANSACTED BY THE RAJYA SABHA DURING ITS TWO HUNDRED AND FORTY SEVENTH SESSION (11-12-2018 to 9-01-2019) SUMMONS Summons for the Two Hundred and Forty Seventh Session of the Rajya Sabha was issued to the Members on the 17th of November, 2018.

DURATION OF THE SESSION The Two Hundred and Forty Seventh Session of the Rajya Sabha commenced on the 11th of December, 2018 and adjourned sine-die on the 9th of January, 2019. The sittings of the House scheduled for the 24th and 26th of December, 2018, were cancelled on account of Christmas, as per the announcement made in the House on the 19th of December, 2018. The sitting of the House scheduled for the 1st of January, 2019 was also cancelled, on account of New Year, as per the announcement made in the House on the 31st of December, 2018. On a request received from the Government, the Hon'ble Chairman extended the sitting of the House by one day and accordingly a sitting of the House was scheduled on the 9th of January, 2019. The House sat for 18 days and the actual hours of sittings were 27 hours and 14 minutes (excluding recess intervals). The House was prorogued by the President on the 10th of January, 2019.

NATIONAL ANTHEM On the 11th of December, 2018, the Session commenced with the playing of the National Anthem. (Time taken: 01 Minute)

ANNOUNCEMENT BY THE CHAIR

On the 19th of December, 2018, the Chairman made an announcement that in response to the joint appeal made by him and the Hon'ble Speaker, Lok Sabha to all Members of Parliament to contribute generously from their MPLADS Funds and to donate their one month's salary for relief and rehabilitation works in various parts of , affected by floods and landslides in the month of August, 2018, 97 Members of Rajya Sabha have contributed Rupees Thirty six crore Sixty Five lakhs Fifty thousand from their MPLADS funds and 60 Members have donated their one month's salary amounting to Rupees Fifty eight lakhs Sixty nine thousand Nine hundred ninety nine.

He also expressed his appreciation to all those who had contributed for the noble cause and requested other Members also to contribute to the cause.

RULING BY THE CHAIR On the 9th of January, 2019, the Deputy Chairman gave the following ruling:— "Hon'ble Members, before the House adjourned for the lunch, Smt. Kanimozhi, Member Rajya Sabha who has moved a Motion for Reference of the Constitution (One Hundred Twenty Fourth Amendment) Bill, 2019 to a Select Committee of the Rajya Sabha demanded that her amendment be first put to the vote of the House before the discussion on the motion for consideration of the Bill and the amendment thereto takes place. I would like to inform that as per well established practice, after the Motion for consideration of a Bill is moved by the Minister-in-charge of the Bill, any Member with prior notice can move an amendment for reference of that Bill to a Select Committee/Joint Committee. Thereafter both the Motion for consideration of the Bill and amendment moved thereto for reference of the Bill to the Select Committee, are taken up for discussion together. After the discussion is over, first the amendment moved by the Member for Select Committee is put up to the vote of the House. If it is carried, Motion for consideration of the Bill is not taken up but in case the Motion for Reference to the Select Committee is negative, the Motion for consideration of the Bill is taken up. I would like to give a few example in this regard. On 21st December, 2011, the Motion for consideration of the Academy of Scientific and Innovative Research Bill, 2011 as passed by the Lok Sabha was moved by the Minister-in-charge of the Bill. Thereafter, an amendment for reference of the said Bill to the Select Committee of the Rajya Sabha was moved by some Members. This was followed by the discussion on the motion for consideration of the Bill and the amendment moved thereto which lasted for about two and half hours. After the discussion, the reference of the Bill to the Select Committee was put to the vote of the House. As this amendment was negatived, Motion for consideration of the Bill was put to the vote of the House. Similarly, the same procedure was followed in respect of number of Bills such as the Mines and Minerals (Development and Regulation) Amendment, 2015, the 17

Insurance Regulatory and Development Authority Bill 1999, the Prevention of Money Laundering Bill, 1999. Thus it is the well established practice that both the Motion for consideration of the Bill and the amendments moved thereto for reference of the Bill to the Select Committee are first taken up for discussion together before putting to the vote of the House. Accordingly, Smt. Kanimozhi's amendment for reference of the Bill to the Select Committee will be put to the vote of the House after the discussion is over." (Time taken: 03 Mts.)

OBSERVATIONS BY THE CHAIR

(1) On the 18th of December, 2018, the Chairman made an observation regarding the continuous disruption of the proceedings of the House and appealed to all Members of the House to allow peaceful conduct of the House so that important issues could be discussed. (2) On the 20th of December, 2018, The Chairman made the following observation:— "Hon'ble Members on 18th December, 2018, when the House reassembled after lunch, Shri Anand Sharma while raising a point of order under Rule 238 submitted that on checking the records, he found that, that morning while Leader of the Opposition was speaking about the privilege notices, the Minister of State for Parliamentary Affairs referred to Shri who is the Congress President but a Member of the Lok Sabha and asked him to apologise. Yesterday i.e., 19th December, 2018, when the House met, Shri Vijay Goel, Minister of State for Parliamentary Affairs while pointing out to allegation made by Shri Anand Sharma submitted that he had nowhere referred to Shri Rahul Gandhi in his submissions made in the House on 18th December, 2018 and Shri Anand Sharma had misled the House. He demanded that Shri Anand Sharma should withdraw his words and those words should be removed from the official records of the Rajya Sabha. I had then said that I will go through records.

I have carefully gone through the debates of the Rajya Sabha of 18th December, 2018 and found that nowhere Shri Vijay Goel, Minister of State for Parliamentary Affairs in his submission referred to Shri Rahul Gandhi. Therefore, the averments made by Shri Vijay Goel are correct." (3) On the 21st of December, 2018, the Chairman made an observation regarding the continuous disruption of the proceedings of the House and appealed to all Members and parties of the House to allow peaceful conduct of the House so that important issues could be discussed. (4) On the 2nd of January, 2019, the Chairman made observations regarding the continuous disruption of the proceedings of the House and appealed to all Members and parties of the House to allow peaceful conduct of the House so that important issues could be discussed and Government Legislative Business could be disposed of, during the remaining four days of the Session. (5) On the 3rd of January, 2019, the Chairman made observations regarding the continuous disruption of the proceedings of the House and appealed to all Members of the House to follow the rules and procedures and allow the House to function, so that important issues could be discussed and Government Legislative Business could be disposed of, during the remaining three days of the Session.

RECOMMENDATIONS OF THE BUSINESS ADVISORY COMMITTEE 3 Meetings of the Business Advisory Committee were held during the Session to allocate time for Government Legislative and other Business. Recommendations of the Committee in respect of the meetings were reported to the House on the dates mentioned below: —

On the 4th of January, 2019, Shri Vijay Goel, Minister of State in the Ministry of Parliamentary Affairs and the Ministry of Statistics and Programme Implementation, moved the following Motion:— “That this House concurs in the recommendation of the Lok Sabha to suspend the para 3 of the Motion adopted by Lok Sabha on 22.07.2014 and to extend the tenure of present members of Rajya Sabha on the Committee on Welfare of Other Backward Classes (2018-19) upto the last day of the tenure of the present Lok Sabha, as adopted by Lok Sabha at its sitting held on 20.12.2018.”

namely the "Weighted Indexing System", which will prioritise reservations by taking into account the relevant social and educational criteria to assess the backwardness of every individual and assign a score to every individual belonging to an SC, ST or OBC group without changing the existing percentage of reservation benefits or the list of castes in SC, ST or OBC;
