ONSISTORIAL PROCESSES AND DECREETS, 1658-1800. EDITED BY FRANCIS J. GRANT, W.S., ROTHESAY HERALD AND LYON CLEKK. c-oW-^^ EDINBURGH : PRINTED FOR THE SOCIETY BY JAMES SKINNER & COMPANY. 1909. EDIJJBURGH : PRINTED BY JAMES SKINNKR AND COMPANY. PREFACE. Among the various civil jurisdictions exercised by the Ecclesiastical Courts prior to the Reformation was that of adjudicating in Con- sistorial causes or actions relating to marriage, legitimacy and divorce. The only records of that period now preserved in the General Register House are the Registers of two Officialates of St. Andrews for the years 1512-1552 and 1541-1554, excerpts from which were printed by the Abbotsford Club in 1845. In -1560 the jurisdiction of these Courts was abolished and on the institution of the Commissary Court in 1563-4 these cases were made over to the Commissaries of Edinburgh, who continued judges therein until 1830, when these matters were transferred to the Court of Session. The Record of these proceedings before 1658 will be found mixed up with those of the ordinary Court, but after that date the processes have been kept in separate bundles, and from 1684 the Extracted Decreets are contained in a different Register. These Processes and Decreets form the subject of this Index. The Processes include Actions for Divorce, both on the ground of desertion or adultery, Separation and Aliment, Declarator of Marriage or Legitimacy, Declarator of Freedom or Putting to Silence, Adherence, Reduction of Edicts of Executry, Nullity of Marriage, Reduction and Improbation and Scandal or Damages for Slander. When the decree has been extracted a reference is given to the volume and page where the same will be found. When there " is only a decreet and no process there is stated to be No warrants." ®fe Ornntmissannl cf OSitnburglj. CONSISTORIAL PROCESSES AND DECREETS, 1 658- 1 800. 1. THE CARLYLE SOCIETY SESSION 2011-2012 OCCASIONAL PAPERS 24 • Edinburgh 2011 1 2 President’s Letter With another year’s papers we approach an important landmark in Carlyle studies. A full programme for the Society covers the usual wide range (including our mandated occasional paper on Burns), and we will also make room for one of the most important of Thomas’s texts, the Bible. 2012 sees a milestone in the publication of volume 40 of the Carlyle Letters, whose first volumes appeared in 1970 (though the project was a whole decade older in the making). There will be a conference (10-12 July) of academic Carlyle specialists in Edinburgh to mark the occasion – part of the wider celebrations that the English Literature department will be holding to celebrate its own 250th anniversary of Hugh Blair’s appointment to the chair of Rhetoric, making Edinburgh the first recognisable English department ever. The Carlyle Letters have been an important part of the research activity of the department for nearly half a century, and there will also be a public lecture later in November (when volume 40 itself should have arrived in the country from the publishers in the USA). As part of the conference there will be a Thomas Green lecture, and members of the Society will be warmly invited to attend this and the reception which follows. Details are in active preparation, and the Society will be kept informed as the date draws closer. Meantime work on the Letters is only part of the ongoing activity, on both sides of the Atlantic, to make the works of both Carlyles available, and to maintain the recent burst of criticism which is helping make their importance in the Victorian period more and more obvious.

THE "SETON-GORDONS " Of the cadet branches of the family of Seton by- far the most Important, and the largest, is that which, only two generations after its emergence from the parent stem, dropped the patronymic and. assumed the surname of the heiress of Gordon. In so far as the history of Scotland is concerned, this family of "Seton-Gordons", i.e. the Gordons who originated from the Setons, was a more consistently im- portant factor in the affairs of State than the main line, from the early 15th Century onwards. To their undoubted success many factors contribu- ted. When Alexander de Seton, second son of Sir William de Seton, married in 1408 Elizabeth de Gordon he became through her, and her maternal relations, the .possessor of large properties. He found himself at once in the position of one of the great land owners in the North; and he and his successors were particularly skilful in "birsing yorifj;" their boundaries.

It lists former Fellows from the foundation of the Society in 1783 to October 2002. Most are deceased Fellows up to and including the list given in the RSE Directory 2003 (Session 2002-3) but some former Fellows who left the Society by resignation or were removed from the roll are still living. HISTORY OF THE PROJECT Information on the Fellowship has been kept by the Society in many ways – unpublished sources include Council and Committee Minutes, Card Indices, and correspondence; published sources such as Transactions, Proceedings, Year Books, Billets, Candidates Lists, etc. All have been examined by the compilers, who have found the Minutes, particularly Committee Minutes, to be of variable quality, and it is to be regretted that the Society’s holdings of published billets and candidates lists are incomplete. The late Professor Neil Campbell prepared from these sources a loose-leaf list of some 1500 Ordinary Fellows elected during the Society’s first hundred years. He listed name and forenames, title where applicable and national honours, profession or discipline, position held, some information on membership of the other societies, dates of birth, election to the Society and death or resignation from the Society and reference to a printed biography.

The aim of the report was to locate and compile all known information on the church and graveyard. The collated information will to be used as a basis for the survey and recording of the gravestones within the graveyard. The project was undertaken in partnership with the Dunadd Historic Graveyard Group, Historic Scotland, the Church of Scotland and Argyll and Bute District Council. The project is part of the Dalraida Project which is the major funder. 2. Desk Based Survey Methodology 2.1 Previous Work The historic graveyard of Kilmichael has aroused the interest of some of the earliest Scottish antiquarians, some of whom made descriptions and drawings following their observations (White 1875 and Drummond 1879).

PREFATORY NOTE. This volume completes the Index to this Commissariot, so far as it is proposed by the Society to print the same. It includes all Testaments recorded before 31st December 1800. The remainder of the Record down to 31st December 1829 is in the General Register House, but from that date to the present day it will be found at the Commissary Office. The Register for the Eighteenth Century shows a considerable falling away in the number of Testaments recorded, due to some extent to the Local Registers being more taken advantage of On the other hand, a number of Testaments of Scotsmen dying in England, the Colonies, and abroad are to be found. The Register for the years following on the Union of the Parliaments is one of melancholy interest, containing as it does, to a certain extent, the death-roll of the ill-fated Darien Expedition.
