A number of water activities will be conducted including water skiing, dragon boat displays, paddling events and a navy rescue display. A fireworks display will be conducted between 9.00pm to 10.00pm on Saturday 28 October 2017. Primary Industries Notices FISHERIES MANAGEMENT ACT 1994 Section 76 Instrument of Determination of Management Charge for 1 July 2017 to 30 June 2018 I, GEOFF ALLAN, Deputy Director General, Department of Primary Industries, Fisheries, with the delegated authority of the Minister for Primary Industries and the Secretary of the Department of Industry, Skills and Regional Development pursuant to sections 227 and 228 of the Fisheries Management Act 1994 (“the Act”), do by this instrument of determination pursuant to sections 76(1) and (2) of the Act, determine the management charge for the period 1 July 2017 to 30 June 2018 payable by holders of shares in any of the relevant share management fisheries in respect of each fishing business the components of which include shares in one or more of the relevant share management fisheries as follows: 1. If the components of a fishing business include shares (of any class) in one or more of the relevant share management fisheries, the management charge in respect of that fishing business (the management charge) is the total of the following amounts: (a) for the first class of shares held by the fishing business –$1,147; (b) for the second class of shares held by the fishing business – $1,147; (c) for the third and each subsequent class of shares held by the fishing business – the discounted amount for that class of shares. 2. The discounted amount for a class of shares is calculated as follows: (a) for the third class of shares held by the fishing business – $688 (being 60% of $1,147, rounded to the nearest dollar); (b) for the fourth class of shares held by the fishing business – $413 (being 60% of the discounted amount for the third class of shares held by the fishing business, rounded to the nearest dollar); (c) for the fifth class of shares held by the fishing business – $248 (being 60% of the discounted amount for the fourth class of shares held by the fishing business, rounded to the nearest dollar); (d) for the sixth class of shares held by the fishing business – $149 (being 60% of the discounted amount for the fifth class of shares held by the fishing business, rounded to the nearest dollar); (e) and so on until all classes of shares held by the fishing business have been accounted for. 3. If the components of a fishing business for which a management charge is payable include a southern fish trawl endorsement, the calculation of the management charge is modified as follows: (a) the southern fish trawl endorsement is to be treated as if it were the first class of shares held by the fishing business; (b) in subclause 1(a) of this instrument of determination, the amount to be added for that first class of shares is nil. Note: No management charge is included for the southern fish trawl endorsement because an annual contribution of $1,147 is payable in respect of that endorsement under section 115A of the Act. 4. For the purposes of this instrument of determination, a class of shares is held by a fishing business if the shares are a component of that fishing business on 31 October 2017. In this instrument of determination: class of share means a class of share in a relevant share management fishery, as listed in: (a) clause 5 of the Appendix to the Fisheries Management (Estuary General Share Management Plan) Regulation 2006; (b) clause 5 of the Appendix to the Fisheries Management (Estuary Prawn Trawl Share Management Plan) Regulation 2006; (c) clause 5 of the Appendix to the Fisheries Management (Ocean Hauling Share Management Plan) Regulation 2006; (d) clause 4 of the Appendix to the Fisheries Management (Ocean Trap and Line Share Management Plan) Regulation 2006;

(e) clause 4 of the Appendix to the Fisheries Management (Ocean Trawl Share Management Plan) Regulation 2006. relevant share management fishery means any of the following share management fisheries, as described in Schedule 1 to the Act: (a) the estuary general fishery; (b) the estuary prawn trawl fishery; (c) the ocean hauling fishery; (d) the ocean trap and line fishery; (e) the ocean trawl fishery. southern fish trawl endorsement has the same meaning as it has in the Fisheries Management (General) Regulation 2010. The conduct of the shark management trial in accordance with the management plan for that trial adopted in clause 4 is approved.

4 Adoption of Management Plan

This Order adopts the management plan titled Management Plan for the Second NSW North Coast Shark Meshing Trial that commences on 1 November 2017 (Management Plan).

5 Termination of existing shark management trial

This Order terminates the trial approval in the Fisheries Management (Shark Management Trial Ballina Shire and Richmond Valley Councils) Order 2016.

6 Publication of this Order and Management Plan

A copy of this Order and the Management Plan is to be made available on the Department of Industry website.

CHARITABLE TRUSTS ACT 1993 ORDER UNDER SECTION 13 CY PRÈS SCHEME RELATING TO THE ESTATE OF EUPHEMIA POLYKARPOU Section 9(1) of the Charitable Trusts Act 1993 permits the application of property cy près where the spirit of the original trust can no longer be implemented. Section 13 (1)(c) of the Charitable Trusts Act 1993 allows the Attorney General to establish a scheme in accordance with a referral from the Court under subsection (2) of that Act. By clause 5a of her Will dated 22 March 2004, the testator Euphemia Polykarpou made a testamentary direction that her executors hold the rest and residue of her estate and divide it: “4.1 As to a 50% part or share thereof to be used for research into the causes of and cures for multiple sclerosis, the distribution and use of such funds, whether to any hospital, medical practitioner, scientist or research facility to be at the discretion of the Executor. 4.2 As to the remaining share thereof, to ‘OPRAH'S ANGEL NETWORK (OAN)’ 110N Carpenter Street, Chicago, Illinois, 60607 United States of America.” Ms Polykarpou died on 2 March 2015. Probate of her Will was granted on 20 October 2015, at which time the estate had a value of approximately $1,784,237.19. The gift to the OAN is worth 50% of that amount and the current value of that portion is $609,127.66.

OAN was incorporated in 1998 and dissolved in 2010. It was an entity associated with the American media personality Oprah Winfrey. As the entity had ceased to exist, the gift to OAN failed as a means of carrying out Ms Polykarpou's charitable intention. On 22 July 2016, in Estate Polykarpou: Re a charity [2016] NSWSC 209, Lindsay J declared that the gift constituted a valid charitable trust, and that a cy près scheme should be settled in respect of its application. His Honour referred the establishment of the cy près scheme to the Attorney General, identifying the primary charitable purpose of the gift as being for ‘the betterment, support and enrichment of women and children in need or for educational purposes…’ (at [108]). There are two applications to the Attorney General with proposals for the use of the trust funds of $609,127.66. These are: Oprah Winfrey Leadership Academy Foundation (OWLAF) scheme OWLAF is a not for profit organisation incorporated in Illinois United States. The Oprah Winfrey Leadership Academy was founded by Oprah Winfrey in South Africa to provide an independent residential boarding secondary school for disadvantaged girls. The proposed scheme would involve the Trustee, a NSW based solicitor, holding and administering, in perpetuity, the trust funds of the Polykarpou Trust for the Oprah Winfrey Leadership Academy (‘the Polykarpou Trust’). Income and capital of the trust would be applied at the discretion of the trustee solely in furtherance of the Polykarpou Trust's objects, whose core purposes are: a) to assist and support the charitable purposes and activities of the OWLAF solely in relation to women and children who are in need or disadvantaged; b) [Omitted] c) to assist disadvantaged female students graduating from the Oprah Winfrey Leadership Academy for Girls – South Africa or with scholarships for such disadvantaged female students to attend college in South Africa or the United States; and d) To do all such other things that are incidental or conducive to furthering the core purpose of the trust. The scheme proposed by OWLAF would primarily benefit girls and young women in need or disadvantage in South Africa, as opposed to women and children in need. Further to the extent that funds can be applied for the second limb of the primary charitable purpose – education purposes – this is limited to young females in South Africa. The Young Women's Christian Association of NSW (YWCA) The scheme proposed by the YWCA proposes to apply the trust funds to benefit women and children requiring post crisis domestic violence services in South Western Sydney. This includes education related services and assistance and measures to counteract disadvantage. The funds would be held in trust to: i. Provide wrap around support and care co-ordination in one location that ensure victims receive the physical and mental health services necessary to make a full recovery; ii. Support women to develop the necessary skills/ financial independence to achieve safety and stability and to parent independently; iii. Ensure women and children have the uniforms and equipment necessary to access education and employment; iv. Provide support to enable children to fully engage with education and develop their potential; v. Assist women to undertake training and skills development to enable them to gain/maintain employment, reduce poverty and disadvantage and develop to their full potential; vi. Provide case management and brokerage to address barriers to service and education access, such as childcare to enable study or transport to access health services; vii. Assist women and children to connect with their local community through participation in sport, creative and volunteering activities that enrich their lives and help them develop supportive relationships that increase future resilience and provide opportunities for personal development; viii. Collect feedback and undertake research to tailor the service and develop it through iterative change into a best-practice model. By virtue of the fact that the OWLAF scheme’s main focus is the provision of assistance and support to disadvantaged students attending the Academy and its graduates, the OWLAF scheme would primarily benefit young women in South Africa. It is therefore arguable that the purpose of the OWLAF scheme is narrower than the primary charitable purpose.

By comparison, the YWCA NSW scheme proposes to benefit women and children requiring services South Western Sydney. In this respect, the YWCA NSW scheme may be viewed as being closer to the primary charitable purpose of benefiting both women and children, than the OWLAF proposal. This is an appropriate matter in which the Attorney General should approve a cy près scheme under section 13(1)(a) of the Charitable Trusts Act 1993. I therefore hereby Order that the YWCA NSW is to hold the gift in clause 4.2 of the Will of the deceased on trust, to apply the capital and income for the purpose of establishing and funding a post-crisis domestic violence centre in Campbelltown which provides services to women and children as described in the YWCA’s application to the Crown Solicitor. Terms used in this Exemption have the same meaning as in the Work Health and Safety Act 2011 and the Regulation. 5. Nothing in this Exemption affects any other applicable requirement imposed by law in relation to matters relating to this exemption.
