Beginning in 1976, with the adoption of the Constitution of 1974, the Senate elects one of its own members as president in accordance with Article III, Section 7 of that constitution. Page 2 of 120 Revised: September 24, 2021 THE SECRETARY OF THE SENATE Beginning with the first Louisiana Constitution in 1812, the members of the Senate have been able to choose their own clerical officers. Article 9 of the 1812 constitution states: " The members of the Senate shall be chosen for the term of four years, and when assembled shall have the power to choose its officers annually". Act No. 4 of 1812 also provided a stipend of three and a half dollars per day for the secretary. The next constitution, adopted in 1845, has similar language with regard to the officers of the Senate (Article 14), and in particular, Article 104 specifically requires that the "secretary of the senate and clerk of the house of representatives shall be conversant with the French and English languages, and members may address either house in the French or English language". The constitutions of 1852, 1864 and 1868 continue the provision that the members of the senate shall have the power to choose their officers. Act No. 52 of the 1870 Extraordinary Session specifically provides that "for the purpose of facilitating the organization of their respective bodies, the Secretary of the Senate and the Chief Clerk of the House of Representatives, shall hold over and continue in office from one term of the General Assembly to another, and until their successors are duly elected and qualified". The provisions of this Act were incorporated into the Louisiana Revised Statutes of 1952, Title 24, Section 33. It is not until the constitution of 1879 that language is adopted as being specific to legislative officers. Article 41 of that constitution states: "The clerical officers of the two Houses of Representatives shall be a Secretary of the Senate and Clerk of the House of Representatives,...". Similar language follows in the constitutions of 1898, 1913, and 1921 in articles 43, 43 and 28 respectively. With the adoption of Louisiana's newest constitution in 1974, the tradition continues in Article III, § 7(C), which provides that the "clerical officers shall be the clerk of the House of Representatives and the secretary of the Senate...
