Subject: IEEE P802.15.1 Patent Request Letter

Dear Francis,

Based on the signed Bluetooth-IEEE License to Publish derivative work, the IEEE 802.15 is in the process of developing a standard, titled "Part 15.1: Wireless Personal Area Network Medium Access Control (MAC) and Physical Layer (PHY) Specifications", that may utilize Bluetooth wireless technology using patented material. As such, there is the possibility that this standard may be covered by patents that Bluetooth Special Interest Group Promoters, Associates, and Adopters hold or patent applications they have made. A copy of the draft standard is included. Please have the Bluetooth SIG Legal Committee review and advise as to whether or not they are aware of any patents that apply to information in the document.

The IEEE patent policy [1,2] requires a release letter such as the one attached if any part of the Bluetooth wireless technology applies to the attached draft standard. I would appreciate it very much if you would make this letter and draft standard available to the Bluetooth SIG Membership and their respective patent departments – I anticipate they would provide such a letter, if appropriate. I hope to hear from you by November 3, 2000. If I receive no response by that date, I will have to presume that the Bluetooth SIG member companies have no patent issues with regard to this draft standard.

This letter is written in response to your letter of ( date ), which requested that ( company ) confirm to the IEEE that we will provide licenses under our ( country ) Patent # with respect to the proposed IEEE P802.15.1 draft 0.7.2 standard. In that regard:

In the event the proposed standard is adopted and the standard cannot be practiced without the use of the cited patent, ( company ) agrees upon written request to grant a nonexclusive license under such patent on a nondiscriminatory basis and on reasonable terms and conditions.

This letter does not grant any right to the IEEE with respect to ( company ) copyrights or other intellectual property rights that relate to the proposed standard. Any party interested in the license described above may write to ( name of contact person ) at the address on the letterhead.
