The regular monthly meeting was held June 16, 2011 at the Lordstown Recreation Building at 4:00 PM. The meeting was called to order by Chairman, Kevin Campbell, followed by the Lord’s Prayer and Pledge of Allegiance to the Flag. Roll call was taken.

MINUTES: Campbell made a motion to approve the minutes of April 28, 2011. Dietz seconds the motion. Motion carries with all ayes.

PUBLIC COMMENTS: Campbell apologized for having to move the meeting to the Recreation building and thanked them for their cooperation. Requested their patience and explained there are only 173 customers connected to the sewer and many more to go. Arlow: 6050 Highland Avenue and also representing 6049 and 6071 Highland. On June 10, 2008 we contracted with a drain layer and on March 24, 2009 Trumbull County inspected our homes. On August 20, 2009 a variance was granted by Trumbull County Building Inspection to have the controller unit exceed the maximum feet from the grinder pump at 6049 Highland. We have tried to keep things going. On June 11, 2011 Platt and the Utility Committee came to our home and was to send email of how to get basement service. As of this date I have not received that email. At 6049 Highland ground water has been drained twice from the grinder pump well casing. According to the BPA rules ground water is not acceptable in the well casing. Last

1 Monday, we received our letters to connect by June 22, 2011 for these three properties and I want a letter sent, a legal notification in writing, not verbal. Campbell: Later in the meeting we plan on discussing these issues. We need to get people connected as fast as possible so we can balance our bills. I’ve considered extending the deadline but if I extend it once it would expected again. I will cover this later in the meeting. Arlow: Can we speak again? Discussion held between members Campbell made a motion to amend the agenda to allow for public comments after new business has been discussed. Dietz seconds the motion. Motion carries with all ayes.

Zoldan: 613 Brunstetter, I have two letters to read. First one is to Karen Jones, in response to your letter of October 11, 2010. “Dear Karen Jones, I am responding to your letter of October 11, 2010. Since you wrote this letter to me, I have found a couple of things out. I have told you but I never got a response from you. I was told by a resident home owner that he and a contractor went up to the Water Department to get a sewer permit straightened out. I was told they were talking and joking around. I was not there, but I got the blame. If you and Cindy want to file charges, go ahead!! I told you, Karen, in about November of 2010 what I found out and I never got an apology. I had nothing to do with the incident. In you October 22, 2010 letter you stated” I have instructed Cindy that if she is harasses by you again she is to call the police and have you removed from the office area” This letter is to advise you that if she does, since you gave her the authority, you are responsible for her actions. I don’t think a councilman or resident should have to worry about being harassed for wanting to improve the village. I do want this letter to be read at the next Public BPA Meeting on 6-16 2001 and put into the minutes.” Signed Councilman Stanley Zoldan Zoldan: Second letter: “BPA on or about the first week of June I was talking to Bill Blank, Debbie Bracken and Fred Isler. A call comes in and Debbie said the lady wants to talk to a councilman. Debbie gave me the phone and the lady proceeded to complain about the baseball team. I told her to call the school because council didn’t have anything to do with it. At about that time Cindy came up and I asked her about the call and she said Chris Lee is president and she is Treasurer. Cindy then proceeded to tell me how I cost her brother Dan some jobs on the sewer line. I said I don’t know what you are talking about. She then gave me the name of the homeowner and asked him why Dan didn’t get the sewer job. When I talked to the homeowner he said he didn’t use Danny because Danny never called him back about the sewer job. According to the newspaper which is public knowledge. There was talk about him and his company bankruptcy, his splitting up with his partner; the talk of hazardous waste was being thrown in the field who was to blame, and the talk of some stolen equipment. True we did talk about his problems about 7 or 8 months ago because he was the talk of the town. When I talked to the homeowner he said he didn’t use Danny because Danny never called him back about the sewer job. I’m tired of Cindy accusing me of things I didn’t say. Again I must say if she would stay in her office and focus on her Water Department duties she may not get herself into some many other situations that don’t pertain to the Water Department. I understand the office is closed from 3-4 on the afternoon so Cindy can get her work done. I also now understand she gets a lot of overtime. If she has so much work to do I think she should get a part time person to help her. This is something to think about. If Cindy dies or quits or gets sick for a long period of time, does that mean we shut down the Water Department? Don’t you think you should have somebody there to take her place in case she can’t perform her job? Maybe the pressure is too much on her! In closing I like the part when someone comes up between the hours of 3 & 4 to do business with the Water Dept. (pay bill, etc.) “Sorry Karen Jones says I’m not allowed to do business with you go upstairs and pay your bill.” I want this in the B.P.A. minutes of June 16th, 2011. Thank you” signed Stanley Zoldan Zoldan: This amazes me that it takes 3-4 days to get permits done. I come to the both

2 of you, if it is too much, you must put a part time person in.

CORRESPONDENCE: Slusarczyk: Today, I received results of the Ohio EPA inspection/survey dated June 15, 2011 from Charlotte E. Hammar. It states that we must respond, in writing within 30 days, indicating how and on what schedule the system will address the following requirements. 1. At the time of the survey we tried to locate the drainage pipe for the Brunstetter Road meter pit, but it was obscured by vegetation. Mr. Bruce Platt indicated that he would ensure that the drainage for the meter pit was located, and debris removed so proper drainage of the pit could occur. The drainage pit, along with the meter pit itself, should be periodically inspected to ensure that it remains clear. A screen should be placed on the discharge pipe to prohibit the entrance of vermin. 2. Lordstown maintains both master meter pits and master meters. According to Bruce Platt the master meters between Niles and Lordstown are calibrated about every three years. At the time of the survey only the Salt Springs road meter was active and the Brunstetter road meter was inactive. Please continue to ensure the accuracy of the meters and supply a copy of the meter calibration test results to the City of Niles. 3. In the past Lordstown has experienced water surge originating from MVSD pumping to the Route 45 tank (on the 24 inch transmission main). The water level in the storage tank is monitored by MVSD through telemetry at the valve pit. Water hammer was suspected as the cause of valve breakage which flooded the valve pit at the entrance to the tank. The flooded valve pit disrupted the telemetry and resulted in overflow of the storage tank. Lordstown installed a globe valve at the entrance to the storage tank which resolved the problem. It was noted that Lordstown had zero waterline breaks in the past twelve months by addressing surge protection. During the inspection of the tank it was noted that the previous overflow event of the storage tank disturbed the gravel at the base of the tank overflow valve. There was no undermining of the structure; however, the gravel needs to be redistributed. As a general rule, any time a tank overflow event occurs, the tank overflow pipe (and screen) should be examined, and look for any damage to the structure or surrounding area. Campbell: How do you feel it went? Platt: I am aware of 2 of the 3 items and the 3rd one she may be confused on. I will check with her.

NEW BUSINESS Campbell: I’m considering extending the June 22nd deadline for the frontage fees to August 31, 2011. Tom, what do you think? Dietz: King and his neighbor need additional work. Discussion held Campbell made a motion to have Mr. Dutton prepare legislation to extend the connection date deadline to August 31, 2011. Dietz seconds the motion. Motion carries with all ayes. Arlow: That is not even 90 days. I’m asking for 90 days. Campbell: We will work with the people. Arlow: Who does my legal counsel need to talk to? At Monday night’s council meeting… (public noise- inaudible) Campbell: As of right now we extended the people who are past their 90 days notice until August 31st… Arlow: My letter is dated… (public noise- inaudible) Jones: There is wording in there… Campbell: I make a motion to extend the June 22, 2011 deadline for residents notified in 2010 to August 31, 2011. Residents notified in 2011 will be granted 90 days from the date of notification. Dietz seconds the motion. Motion carries with all ayes. Campbell: I will call Mr. Dutton.

Animal Welfare League – Sewer connections for 2 parcels Dietz: Bruce can you give us an update on that?

3 Platt: Kennel has city water from the home. Water is metered in the house. One water tap goes into the home but two grinder pumps stations were installed and they are scheduled to connect tomorrow. Campbell: Sewer is alright to connect, it is proper. Did you find a water tap for the kennel? Platt: No, the kennel needs a tap. Slusarczyk: Jan Solomon was in the Zoning office after our last meeting and I discussed it with her to let her know that we are researching the two parcels and what needs to be done. Campbell: They need to separate waterline for the kennel… (public noise- inaudible) Holton: If done today? Campbell: We would charge.

947 Hallock Young – Sewer connections Platt: This is the dental clinic. Campbell: Basement offices and two upstairs apartments. Platt: 2 sewer laterals, don’t know why two. Two septic systems and one water service line that supplies the entire building that we verified a few days ago (527*1). The garage has four outside spigots and a sink. Campbell: Service and meter going to the building? Platt: The pool shed does and water is off there. There is a leak in the building so they fill the pool from the storage garage. Campbell: Is there a line to the shed from the barn? Platt: I don’t know, it is not leaking underground…(public noise – inaudible) Campbell: How far away from the apartment to clinic is the tap? Platt: Several hundred feet Dietz: What do we need? Campbell: One to the clinic and one to the apartments. Biddle, Andy: It was two houses with two septic tanks. Discussion held with members and Biddle’s explaining structures and connection for apartment and businesses. Maps reviewed Campbell: Bruce to work with Lesley to see if lines can be connected by gravity due to the two up flush commodes. Campbell: I believe the sink in the building poses a problem. Biddle, Andy: Sink will be gone. Campbell: Issue with one meter in building for residential and commercial use. Platt: We are only obligated to 1st floor service not basement, right Lesley. Gordon: Yes. Campbell: can you see where we are at, Bruce and Tom will go out and check out the water issues.

Sewer billing onset Campbell: On June 6th, 2011 we had a work session to clarify that billing begins as of the date you connect at the road. Campbell made a motion to clarify that sewer billing begins when the sewer connection is made at the road. Dietz seconds the motion. Motion carries with all ayes.

Additional Public Comments: Arlow: I am good with what you said of 90 days to connect. Baer: I just want you to know that Stanley version is not accurate. I’ve already spoken with you so if you don’t need me any more I am going to leave. Campbell: We do not need you any more, thank you for coming.

ENGINEERS REPORT: Gordon: I have no report. They did schedule a Utility Committee meeting for next Wednesday @ 8:30AM and they are to invite Mahoning County.

UTILITY REPORT: Platt: Lift station #4 was not hit by lightning, the motor was trying to run out of phase on one or two phase. They are trying to work on the connection problems.

CLERKS REPORT: Slusarczyk: I submitted my report in writing for your reference. With the Sewer status as of 6- 15-2011 we have billed 173 accounts for sewer. a. 52 accounts have not attempt to install/permit (8 notifications were just mailed on 6-10-2011 b. 7 have not been notified to connect c. 27 permits granted & waiting to connect d. 4 need BPA consideration on allowable connection i. Total of 90 left to process ii. Status is 2/3’s complete 2. 655 Ravine Court (broken lateral) repaired and completed lateral connection on 6-15-2011 3. Consumer Confidence Report 1. Due in homes July 1, 2011 2. Requested quotes on June 6-15-2011 3. Will need to be printed, folded, sealed and taken to the post office. 4. Kevin to sign certification for EPA 4. Printer purchase and bills forms – not able to review information yet 5. New Permits – are needed &we are just about out. Need updated before having more made. 6. Vacation reminder for July 5th thru 8th. Sign posted on door since 6-3-2011. Slusarczyk: In addition to my written report I wanted to notify you that when we changed the water rates and then prepared “final” bills there were a few that had to be reduced to the amount that was charged when they finaled. During the monthly billing process they were recalculated at the higher rate.

Slusarczyk: regarding our trash contract I was able to help the Zoning office have the trash cleaned up at an abandoned home on Tait Rd at no cost to the Village. It was something that

5 they were unaware our contract covers that.

Slusarczyk: I would like to clarify how the office is being closed and whose idea it was came up with Dan Cuckovich. He came into the Zoning office at 3:42PM to see Ron and when he was done he said he needed more permits. I gave him the permit applications and he wanted me to grant them. I was in the middle of preparing the bank deposit and had to leave work at 4:00PM, my door was shut before he entered the building. He got mad because I would not. He had previously done the same thing and I stopped what I was doing that day to help him because he was not aware of the time change then. I told him weeks previously that that time was for me to close out the day. So he asked for an appointment and I said sure, when? He said now. I told him no, I was leaving. So he threw the permits on my desk. I told him that he could put the permits in the drop box with the payment and I would get them first thing in the morning. That is when he asked who came up with the idea to close the office at 3:00PM anyway and I responded Karen Jones. Campbell: I would like to add that we did speak to Mr. Baer and he did tell us that what Stanley said was inaccurate.

SUPERINTENDENTS REPORT: Platt: I confirmed Hoffman does have city water in his barn.

Platt: We have two options to repair the controller. Thoma can wire in a digital device that will cost $565 for the parts and $549.00 for labor or we can use our contract to work against that. Or we can replace the cam and it will be $1,700.00 Campbell made a motion to purchase parts for the controller at MVSD with the valve price not to exceed $600 in parts. Dietz seconds the motion. Platt: I need to purchase more water meters. I have two prices. Neptune’s meters are $90.50 each and Sensus’s meters are$97.45. Sensus can read down to the 1/10th gallon. I recommend we purchase the Sensus meter. One hundred of them will be $9,745.00. Dietz made a motion to purchase 100 Sensus meters at $97.45 each. Campbell seconds the motion. Motion carries with all ayes.

Platt: I need to purchase 25 safety cones; they are about $13.75 apiece.

Platt: My meeting I had scheduled with LBG on Monday at 10AM was a no show and they have not contacted me either, so there is nothing to report.

Dietz: I have a question – Is there any safety items that can be put on the pump stations? Platt: Yes, there is a device. Buy one for each pump station the quote I got from McLaughlin is $6,000 for repair…(public noise - inaudible) Dietz: If lightning hits it what does it cost to replace the pump? Platt: $3,000
