Sam Schwab (SS) welcomed everyone and introductions were made. Apologies noted from Jill Britton, Head of Commissioning & Contracts LBN.
2. / Minutes and matters arising from the last meeting / Sam Schwab
Minutes of meeting dated 29th October 2015 confirmed as an accurate record.
Matters arising from the previous minutes:
Revised Serious Incident Policy will be presented at the next meeting on the 28th April 2016.
A Medication Policy Workshop was held with providers on the 08th January 2016, the work is ongoing and will continue to provide update.
Update on the Force Marriage Conference will be discussed as an agenda item by Mandy Oliver.
Update on the Law Commission consultation will also be discussed as an agenda item by Cathy Newcombe.
3. / Future Provider Engagement/Market Position Statement / Lydia Drummond
Under the Care Act, the Local Authority has a duty to provide information, advice and guidance to our customers about health and social care services available to them. There is also a duty in relation to market shaping and working with providers. LBN Adult Social Care is in the process of developing an online resource for providers to access information and support.There are three reasons for providing the information:
1.  Enable local providers to understand the services that our customers need and want;
2.  Assist providers to be in a position to develop their services to meet these needs / wants; and improve existing provision;
3.  Support providers to be in a better position to apply for external funding.
The Information, Advice and Guidance (IAG) service will cover the following key areas:
·  Market Position Statement
·  Procurement - details regarding LBN Contract Standing Orders (provide a structure within which purchasing decisions are made and implemented); Contracts Finders (lets you search for information about contracts worth over £10,000 with the government and its agencies); and capitalEsourcing (secure and efficient means for managing tendering activities)
·  Provider Forums and Newsletters – this will contain information regarding the Provider Newsletter; Strategic Provider Forum, ILSS Provider Forum, Older People (Care Homes) Provider Forum, Mental Health Provider Forum etc.
·  Procedure Guidelines / Checklists – this will provide guidance on what procedures and processes providers should have in place and guidelines to assist providers when they are reviewing their documents. This area will also provide information regarding the Newham Micro-enterprise Project; which helps to develop support services within the health and social care market in Newham. Some of the key information that is likely to be available will include: Complaints and Compliments; Equality and Diversity; Financial Management and Reserves, Information Governance Health & Safety; Recruitment and Selection; Performance Management and Supervision; Safeguarding Adults, Medication Policy etc.
·  Useful Links – this area will have useful links such as LBN Adult Social Care (ASC) high-level structure chart, LBN ASC and Clinical Commissioning Group (CCG) contacts, Companies House, Charities Commission, CQC, DBS, health and Safety Executive, Information Commissioner, Social Care Institute for Excellence (SCIE), LBN Directory of Services (DoS), ELS (Partnership of six local authorities) etc.
·  Training Opportunities – the section will provide information on some of the useful training that are offered by Adult Social Care Services such as Good Practice in Safeguarding Adults including details of how to access national training that we think it is useful for providers
·  Funding Opportunities – LBN specific, upcoming ASC/CCG procurements, Regional/National etc.
Once the project is finalised, it will be brought back to providers for discussion. Lydia welcomed feedback and said any thoughts and ideas including name for the website to be e-mailed to her ().
4. / Mental Health Accommodation Commissioning Intentions / Carys Esseen
For the past year or so, LBN has been working with stakeholders to establish what is good about Newham’s mental health supported living services, and what needs to be improved. Commissioners have also undertaken analysis of new and emerging needs so that we can plan and design services for the future. CE went through a PowerPoint presentation which summarised some of the key findings. CE stated that Newham is now in a position to consult on the top 10 commissioning priorities that will shape Newham’s activities over the next few years. They are:
1.  To create a clear pathway with movement through, and out of, supported housing
2.  To encourage and support greater partnership working
3.  To include strategic partners in the process of commissioning i.e. Planning, Housing Needs, Health
4.  To align services to the Care Act 2014 in terms of tiers of prevention
5.  Future-focussed commissioning
6.  Fewer providers in the market with regular monitoring, and increased support from commissioners
7.  To share information about our commissioning intentions with providers
8.  “Nothing about me, without me” – making services personalised
9.  Increasing the use of assistive technologies
10.  Placements are made within the borough – ensuring the right provision at home
CE circulated a hand out to providers and asked them to work together or individually to provide feedback on these priorities. CE agreed to circulate the document with the minutes so that other providers have an opportunity to submit their feedback.
Action:
·  All providers: consultation documents to be returned directly to CE () by 04th March 2016.
5. / Update on Current/Upcoming Procurement / Sam Schwab
We have recently closed the tender process for the Independent Living Support Services (ILSS). If you have put in a bit you can expect to hear from us by end of March.
We have open tenders for the following services:
1.  Dementia
2.  Stroke
3.  Healthwatch (all now closed)
Providers who are interested in bidding for the above services were referred to capitalEsourcing.
The following services will be tendered within the next two-three months:

·  Home and settle.
6. / ·  Safeguarding update

Reduce the risk of radicalistaion for people with LD / Mandy Oliver
Safeguarding Update:
The Pan London Adult Safeguarding Policy and Procedures will be launched on the 9th February 2016 and agreed to provide a detailed update including how it would fit in with our pathways at the next meeting in April.
Conference Update:
We had two successful conferences:
Forced Marriage conference was well attended. A lot of learning came out of this conference and also established that we need to produce a proces map, engage better with our community to try and raise their awarness.
Reduce the risk of radicalistaion for people with Learning Disabilities and Mental Health – at this event, Kent AC demonstrated an interactive tool that providers can purchase to use with customers to reduce risks. Providers were asked if they would like a Prevent session at the next meeting which was favourablly recieved. This will be organised for the next meeting.

Moira said she is in the process of organising Prevent events for Learning Disability providers and to contact her if anyone interested.
There were 601 safeguarding concerns received within the six months, of which 300 went through to equiries. These referrals were received from Health Partners, Police and Residential Care Homes. Financial abuse were the highested followed by neglect.
Safeguarding Newletter will be issued twice yearly and copies will be circulated to providers and made available on the Safeguarding website.
Action:
·  Prevent session to be organised by Mandy Oliver at the next Forum on the 28th April 2016.
7. / Mental Capacity Act / Deprivation of Liberty Safeguarding (DoLS) / Cathy Newcombe
Since the Supreme Court DoLs judgement of 19 March 2014, the number of DoLs applications has increased. We have received 700 applications since April 2015 to date and expecting them to increase up to 1000 by the end of financial year, where we only had 400 applications in year 2014/15 and 100 in 2013/14. Extra resources has been brought into process the increased number of applications. We are aiming to complete all applications within four weeks and to contact CN () if you have not received any responses.
DoLs only applies to Care Homes and hospitals. If a person’s liberty needs to be limited in other settings, an authorisation must be obtained from the Court of Protection and these are dealt by our Assessment and Care Management Section by the Supporting Care Team. They have developed a form ( Deprivation of Liberty in Supported Living or Other Community Settings) in order to facilitate the processes.
Law Commission Consultation - The DoLS have been criticised since they were introduced for being overly complex and excessively bureaucratic.In March 2014, the House of Lords Select Committee published a detailed report concluding that the DoLS were “not fit for purpose” and recommended that they be replaced. The law Commission subsequently produced a consultation paper which proposes that they be replaced with a new system, ‘Protective Care and ‘Restrictive Care’.. This system is not focused on authorising deprivations of liberty, but instead providing appropriate care and better outcomes for people who lack mental capacity and helping their family and carers.
The proposed “protective care” scheme aiming to:
·  Deliver improved outcomes
·  An Mental Capacity Act (MCA) based scheme
·  A non elaborate scheme
·  European Convention on Human Rights compliant
·  Supportive of UN Convention on the Rights of Persons with Disabilities (CRPD).
The proposal is to have the Best Interests Assessor role revised to become an Approved Mental Capacity Professional (AMCP) with greater responsibility for managing the assessment process. If a person my be deprived of liberty for up to 28 days in a hospital, assessment is made by clinician and certified by a registered medical practitioner. A responsible clinician must be appointed and a care plan produced. Further authorisations for a deprivation of liberty would require the agreement of an AMCP. The Mental Health Act would be amended to include deprivations of liberty in psychiatric units.
Provisional of change in legislation will be in April and agreed to provide update at the next meeting.
Action:
·  CN to provide update on the Law Commission reports at the next Forum.
8. / Workforce Development Update / Moira Storrar
A Briefing Note distributed and said a copy will be circulated with the minutes.
Qualtiy Workforce Development team will be commissioning a British Sign Language Level 1 qualification course. The course consists of 60 hours of study, costs approximately £400 per person. This is a very useful qualification for those who are working with people with hearing impairment. If anyone interested, please contact Moira on .
Workforce Development Partnership – there will be a Skills for Care/Partnership event taking place on the 4th February at St John’s Church, Stratford. The aim of the event to establish your training priorities. We are also planning the training programme for next financial year and asked providers to contact MS if anyone have individual training needs.
9. / AOB / All
Supported Living Contracts - Sarbjit Rai (Contracts Officer) said that the Supported Living contracts were sent out yesterday 27th January and to return them by the deadline 15th Feburary 2016. If any of the Supported Living providers have not received the contracts to contact Reetha Senan, Risk Management Officer on 020 3373 1263 or via e-mail .
Provider Newsletter - Sam Schwab informed providers to e-mail Reetha Senan () or Shabana Mushtaq () if they are not receiving the Provider Newsletters.
Sam flagged LBN’s awareness of the proposed Government changes to supported accommodation and the available level of housing benefit. Further work being done internally once the proposal is final – discussion with affected providers will occur.
Action:
·  Supported Living providers to return the signed contracts to Reetha Senan before 15th February 2016.
·  Providers to e-mail Reetha Senan () or Shabana Mushtaq () if they are not receiving the Provider Newsletters.
