RESOLUTION NO. 2354

A RESOLUTION ESTABLISHING GUIDELINES FOR PRIVATE PROPERTY OWNERS TO LANDSCAPE PUBLIC PARK AREAS, GREENWAYS, AND NATURAL PRESERVATION AREA.

WHEREAS, the City of Overland Park, Kansas, owns and maintains park areas, greenway linkages, and natural preservation areas; and,

WHEREAS, the City of Overland Park recognizes the importance of planting trees, preserving natural areas, and preserving the natural environment; and,

WHEREAS, the City and citizens alike can benefit from the planting of trees, grasses, flowers, etc., in public park areas, greenways, and natural areas.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS:

1. That private property owners may request in writing to the Director of Parks and Recreation permission to plant trees, grasses, flowers, etc., in public park areas, greenways, and natural preservation areas. Permission to perform such plantings will be granted if in the judgment of the Director of Parks and Recreation, the plantings do not interfere with other citizens having access or use of an area, do not create any drainage or erosion problems, and it is understood that the City is not responsible for such plantings in any way. Any approved plantings become the property of the City and may not be removed without the express permission of the Director.

2. That private property owners will not be allowed to construct, build, or assemble any type of structure on City property, greenways, or natural preservation areas. This would include but not be limited to fences, playgrounds, bridges, basketball courts, tree houses, dams, retaining walls, dog houses, vegetable gardens, flagpoles, etc.

3. That private property owners will not be allowed to remove trees, topsoil, subsoil, rocks, etc., from park areas, greenways, and natural preservation areas.

ADOPTED by the City Council of the City of Overland Park, Kansas, this 16th day of July, 1990.
