1. SCOPE OF EMPLOYMENT The employee is appointed as ______. You will report

4.2 That such termination shall not be construed as being retrenchment, but shall be the expiry of this Employment Contract. The employee will therefore not be eligible for any severance pay as a result of the expiry of this contract. 4.3 The period of employment stipulated in this employment contract does not constitute guaranteed employment. The employee accepts this employment condition and also that his service may be terminated at an earlier stage for any good cause shown by either party.

6. REMUNERATION Your monthly salary will be R ______. Please note that we do not offer a guaranteed 13th cheque or bonus. 7. OVERTIME Any overtime performed by the employee shall be done in terms of an agreement. Payment of overtime shall be at the rate of one and a half the normal hourly tariff multiplied by the hours worked overtime. Any employee appointed in the capacity of maintenance staff accepts overtime work to be a condition of service.

8. DEDUCTIONS The employer will deduct any money from the employee in compliance to legislation. It is specifically agreed that, should any party terminate this contract, the employer will be entitled to subtract any money owed by the employee from the final payment.

9. ANNUAL LEAVE The employee is entitled to one day leave for every 17 shifts worked. Application for leave must be done in writing and the employer retains the right to decide whether leave should be granted for the applied period depending on circumstances.

The company closes down over the Christmas period and employees should ensure that they have leave to their credit to cover this period. If the employee does not have enough leave credits, the outstanding number of days will be taken as unpaid leave.

10.SICK LEAVE Sick leave is based on cycled of thirty six (36) months in which the employee shall be entitled to: 10.1. During the first six (6) months of employment sick leave will be accumulated at rate of one (1) day for every completed 26 days of employment. Thereafter the employee will be entitled to the same number of day’s sick leave, which he/she normally works during a 6 weeks period, in a three-year cycle. 10.2. Payment of sick leave will be made in respect of a maximum of two (2) consecutive days sick leave unless a certificate issued by a medical practitioner, is submitted. Payment is respect of sick leave where no medical certificate is presented will only be made twice in a period of eight (8)weeks.

11.LUNCH BREAKS Since lunch breaks are compulsory, the employee shall take one-hour lunch break per day. Lunch breaks do not form part of normal hours of work.

12.DISCIPLINE AND GRIEVANCES The company’s disciplinary and grievances procedure will apply at all times. These procedures are available from Mr.\ Ms. ______.

13. T ERMINATION OF CONTRACT Two weeks notice of termination of service must be given. Notice of termination of services shall be given on or before the first or fifteenth day of the month. In all instances notice of termination of services shall be done in writing.

14.CONFIDENTIALITY UNDERTAKING No other forms of employment may be undertaken without the written consent of the company. Unless you are obliged by law to do so, the disclosure of the following information will constitute a material breach of this contract: -

14.1. Information concerning company results, methods or procedures; 14.2. The names of the Company’s suppliers or customers or the contractual arrangements being made with them; 14.3. Without being limited by the afore going any relevant data which is being used or which will be used by the Company and any other matter of information which is known by an employees or employees, suppliers and customers of the Company. 14.4. Also note that your salary and benefits is terms of this agreement are of a confidential nature, and should not be disclosed to any other employee or outside party.

15.ALTERATIONS OF CONDITION OF SERVICE The Company has the right to alter conditions of service from to time after proper consultations, in which case adequate notice will be given.

16.REFERENCES The Company reserves the right to do detailed reference checking on all employees. This may often only be a possibility once a staff member has joined the Company. Details of previous work history, detailed character reference, credit transfers end criminal records may be carried out. Should any information in this way indicate that any material facts or circumstance exists that would have effected the decision of employ a particular person; the Company may summarily terminate this contract of employment.

17.GENERAL

17.2 It is agreed that nothing in this Employment Contract shall affect the right of the employer to terminate this Employment Contract, with or without notice, to any good cause recognized by law as sufficient. 17.3 The employee acknowledges having received a copy of this employment contract and that the contents thereof are understood.
